Section (vi) Feed-in-tariff Scheme Arrangement Submission of this information means that the Feed in tariff application form does not need to be submitted. Please tick the relevant box to choose the FIT scheme arrangement for photovoltaic installation you want to opt for. For PVs generating more that 16Amps per phase, an authorisation form must be presented. A notification form is not required for systems less than 16Amps per phase. Sell all the electricity generated by my solar photovoltaic installation to Enemalta in accordance with rates and conditions established by the Feed-in Tariffs (Electricity Generated from Solar Photovoltaic Installations) Regulations. Generate electricity primarily for my own consumption and be paid the electricity not consumed at the time of generation and exported to the distribution system at the rates and conditions established by the Feed-in Tariffs (Electricity Generated from Solar Photovoltaic Installations) Regulations. Section (vii) Applicant s Declaration (a) I confirm that I will comply with planning permission requirements (b) I confirm that I am the owner of the property or an emphyteuta or a tenant with all the necessary authority to apply for this grant (tenants must attach a copy of contract for leasing). I also confirm that there is no legal impediment which precludes me from validly and, or successfully submitting this application. (c) I confirm that the building where the equipment is to be installed is covered by the relevant planning permits (d) I confirm that I (or any member of the household) have not obtained and will not obtain any other grants or subsidies for this system either from public or national funds or EU funds (e) I further confirm that I (or any member of the household) are not in receipt of any donations (financial or in kind) including discounts, offers or gifts which have not been deducted in the quotation attached to this application (f) I confirm that the property where the system is installed is residential and is used by myself principally for residential purposes (g) I confirm that I am not applying on behalf of an undertaking (carrying out an economic activity) and am not a landlord of the property where the system is installed (h) I am aware that the PV system to be installed shall remain in operation for the durability period stipulated in the guidelines 4 and I am aware of Article 71 (Durability of operations) of the Council Regulation EC/1303/2013 and shall abide by it (i) I confirm that my photovoltaic installation will be grid connected according to DSO requirements (j) I am aware that all the information submitted in this application may be cross checked with other government entities and authorise the REWS to ask any other government entity to provide the required information. 4 Should I decide to sell or rent the residence or change its use during this period, I shall inform REWS accordingly. (k) I will give access to all relevant organisations involved in the implementation and control of this scheme (including REWS, representatives from the Managing Authority and (local and EU) auditors amongst others) to inspect the photovoltaic installation at my residence after due notice given by the REWS (l) I am aware that personal information provided in this application is protected and used in accordance with the Data Protection Act. The information shown in this application form will be used and shared by/with the Regulator for Energy and Water Services and its agents, Planning Authority, and relevant organisations involved in the administration, supervision and auditing the scheme public funds in particular. The REWS may also use this information to demonstrate market transformation trends. (m) I am aware that the scheme is co-financed by the European Regional Development Fund I, the undersigned, certify that I have read, understood and agree to the requirements and conditions set out in the Guidelines to the scheme as published on the REWS website www.rews.org.mt 5. The information provided is accurate and true to the best of my knowledge. I understand that any attempt to misrepresent information in this application will invalidate this application and disqualify me from all claims to future grants. Applicant Signature Date Notes In cases where the Applicant does not conform to any provisions set out in the scheme, the Applicant shall be obliged to either change the equipment to bring the installations within the provisions of the scheme or refund the grant. Applicants are advised to submit the Application by hand or by mail to the REWS. No applications from retailers on behalf of their clients will be accepted. Prospective Applicants who intend to import systems directly are urged to pre-register their systems themselves PRIOR to making any commitments. STATE AID DECLARATION (DE MINIMIS) ------ REWS/2016/PV ------ If the submitted application is approved, the project will benefit from de minimis State aid in line with Commission Regulation (EU) No. 1407/2013 of 18 December 2013 on the application of Articles 107 and 108 of the Treaty on the Functioning of the European Union to de minimis aid. Commission Regulation (EU) No. 1407/2013 allows a single undertaking to receive an aggregate maximum amount of de minimis aid of 200,000 under all de minimis aid measures, over a period of three fiscal years. This aggregate maximum threshold applies in principle to all economic sectors with the exception of a single undertaking performing road freight transport for hire or reward for which a lower de minimis threshold of EUR 100 000 over any period of three fiscal years applies. The agriculture and fisheries sectors are subject to different thresholds and criteria. For the purpose of this declaration the term single undertaking shall have the meaning as established in Commission Regulation (EU) No. 1407/2013. Moreover fiscal year means the fiscal year as used for tax purposes by the undertaking concerned. This maximum threshold would include all State aid granted under this scheme and any other State aid measure granted under the de minimis rule. Any de minimis aid received in excess of the established threshold will have to be recovered, with interest, from the undertaking receiving the aid. The following is an indicative list of the possible forms of State aid: Grants from public bodies Loans or loan guarantees at favourable rates Tax benefits Waiving or deferral of fees or interest normally due Marketing and advertising assistance Consultancy, training and other support provided either free or at a reduced rate Aid for investment in environmental projects or research and development assistance Purchase, rent or lease of immovable property at less than market rate. Potentially any assistance from a public body may constitute State aid. Should you have any doubts whether any public assistance received is de minimis aid, you should contact the agency or department from which the assistance was received in order to ascertain this.
