The Committee observed that the items are of 2004-2005 onwards make and there is no CEC submitted and Certificate from exporting company for accepting the re-export of defective or second hand EEEs, and the spares/part/component/consumables after their use or once such items achieve end of life is also awaited. Accordingly, the applicant was asked to submit the aforesaid documents for the consideration of the case in the next meeting of Expert Committee. 24/06/2016 Now the applicant has submitted the aforesaid documents. 2.1.12. M/s Oracle India Import of 9928 nos. of The matter was discussed in the 68 th meeting of Expert 5

Delhi Ltd., New 27/2013-HSMD) refurbished spare parts from Singapore for provide AMC/Warranty services Committee held on 26 th and 27 th April, 2016. The Committee noted that the CEC pertaining to functionality was merely a sample and that too from Chennai, whereas the refurbished spare parts are proposed to be imported from Singapore. In the absence of a documentary evidence of the functionality of theses spare parts, the Committee deferred the matter. The Committee also noted that the applicant hasn t yet even identified the refurbished spare parts physically which will be imported. The Committee advised the applicant to reapply based on the nos. of spare parts identified and evidence of their functionality if is available from the exporting country. Now the applicant confirmed for presentation. 2.1.13 M/s Schneider Electric IT business India Ltd., Bangalore 196/2014-HSMD) Two : (i) Import of 1 no. of defective electronic good for upgradation, testing and validation purpose and thereafter will be returned to the customer The matter was discussed in the 69 th meeting of Expert Committee held on 24 th and 25 th May, 2016. Since the details of the items proposed to be imported are not clear, the Committee suggested that the applicant may be called for presentation and technical discussion in the next meeting. Now the applicant has confirmed for presentation. (ii) Import of 1 no. of testing equipment for reuse in research and development purpose 2.1.14 M/s Shell India Import of 1 no.(114 kg) of The matter was discussed in the 69 th meeting of Expert 6

Ltd.(F.No. 23-86/2011- HSMD) Import of 391 no. of second hand equipment from China for the production of mobile phones; Now the applicant has confirmed for presentation in the meeting. Based on the discussion with the applicant and on the documents submitted by the applicant, the Committee noted that the application for 391 no. of items from China doesn t have a CEC and the second application is deferred for want of CEC. The applicant needs to submit the document with regard to employment generation. The applicant has submitted the relevant document. AGENDA 2.2: IMPORT OF LEAD SCRAP: Sl. Ltd., Patna 168/2015-HSMD) Import of 4320 MT of lead scrap (ISRI Code : Radio, Racks, Rails, Ropes, Relay, Rakes, Rents etc.). The matter was last discussed in the 67 th meeting of Expert Committee held on 29 th and 30 th March, 2016. The decision is mentioned below: Subsequent to the submission of site visit report by CPCB it is seen that the unit is not using alkali in the scrubber and also does not have membership of TSDF for disposal of slag and other membership of TSDF for disposal of slag and other hazardous waste. The Committee suggested that a confirmation should be received from the applicant that they will meet the above two requirement before the case is reconsidered for import. Now the applicant has informed that they installed Alkali scrubber and attached some photograph of the same. In respect of membership of TSDF for disposal of slag and other hazardous waste, they have already deposited the fee for lifetime membership and signed the agreement with M/s Bharat Oil Wastage Management Ltd., Kanpur and also attached the documents for ready reference. 8

M/s S&J Granulate Solutions(P) Ltd., Mumbai (F. M/s Vellis Rubber Industries, A.P. 82/2016-HSMD) Import of 11500 MT of used tyres and tubes scrap with multiple cuts for manufacturing of crumb rubbers CTO and Authorization from the concerned SPCB(valid upto 30/04/2021) Document depicting the status of employment generation indicating the no. of people benefitted. M/s Shree Ganesh Rubber Products, Navi Mumbai 230/2014-HSMD) Import of used rubber tyres scrap The matter was last discussed in the 68 th meeting of Expert Committee held on 26 th and 27 th April, 2016. The Committee noted that the improvements as suggested by CPCB during the site visit as well as conveyed vide Ministry s letter dated 2 nd March, 2016 have not been implemented by the applicant. The matter is therefore was deferred and accordingly requested the applicant for submission of the evidence of the implemented recommendations for consideration of the case in the next meeting of the Expert Committee. Now the applicant has informed that as per suggestions of CPCB and recommendation of the Expert Committee 10

of meeting, they implemented the suggestions and has submitted a video CD as a proof of the reference. 2.3.5. M/s Mounika Industry, Telangana 273/2014-HSMD) Import of used rubber tyres scrap. The matter was last discussed in the 66 th meeting of Expert Committee held on 25 th and 26 th February, 2016 and the recommendations of the Committee is mentioned below : Since the permission was granted to the applicant in November, 2015, the case can only be considered in the next financial year i.e. 2016-17. As per new Hazardous and other Wastes(Management, Handling and Trans boundary Movement) Rules, 2016, for the import of used rubber tyres scrap, Authorization under the aforesaid Rules has to be sought from the applicant alongwith the document depicting the status of employment generation indicating the no. of people benefitted. Now the applicant has submitted the aforesaid documents. 11

of 2.3.6. M/s Vinora Industries, Chennai 36/2014- HSMD) Import of used rubber tyres scrap. The matter was last discussed in the 63 rd meeting of Expert Committee held on 3 rd and 4 th November, 2015 subsequent to the submission of inspection report by CPCB. From the inspection report by CPCB, the Committee noted that a number of suggestions have been made for improvement which should be conveyed to the applicant for implementation. Now the applicant submitted some photographs as a proof of implementations suggested by CPCB and the Expert Committee and requested to consider their case in the forthcoming EC meeting to be held on 4 th and 5 th July, 2016. 2.3.7 M/s Astra Corporation, Mohali 102/2015-HSMD) Import of used butyl rubber tubes scrap Ministry had already granted permission for import of 1700 MT of used butyl rubber tubes scrap(pressed/baled/shredded/multiple cuts) from Pakistan, Hongkong, Saudi Arabia, Philippines and UK for recycling purpose vide O.M. dated 31/7/2015. Now, the applicant has requested this Ministry for addition of GCA Countries in their existing permission letter dated 31/07/2015. 2.3.8 M/s Radial Rubber Industries, Kolkata 7/2008- HSMD) Import of green tyres, tyres code(friction), Rubber Component, Steel Code Conveyer belt and industrial Ministry has granted permission for import of 1500 MT of green tyres, tyres code(friction), Rubber Component, Steel Code Conveyer belt and industrial fabric from various countries for manufacturing of rubber tyre flaps through ICD Tuglakabad vide O.M. dated 02/22/2012. 12

Now the applicant has requested to add Kolkata Port/Haldia Port and also ICD Jaipur Port in the existing permission letter for import of balance quantity. AGENDA 2.4 : IMPORT OF FERRO MANANESE SLAG Sl. of application 2..4.1 M/s Anjaney Alloys Ltd., Visakhapatnam, A.P. (F.No.23-75/2016- HSMD) Import of 60,000 MT of Ferro Mananese Slag. The matter was considered in the 69 th Meeting of the Expert committee. In order to elicit the information such as the manganese content in the slag, the recovery in the applicant s plant, disposal of residual slag etc. The Committee recommended that the technical representative of the company may be called for technical discussion and presentation. The applicant has now confirmed for technical discussion and presentation. 11/5/2016 13
