CITY OF WARRENVILLE DU PAGE COUNTY, ILLINOIS ORDINANCE NO. 2966 ORDINANCE APPROVING TEMPORARY USE PERMIT FOR COMMITMENT DAY 5K AT LIFETIME FITNESS (28141 DIEHL ROAD) WHEREAS, Ryan Moran on behalf of Lifetime Fitness (the "Applicant") has requested approval of a Temporary Use Permit that would allow the Applicant to conduct a one-day Commitment Day 5K event on January 1, 2016, between the hours of 9:00 a.m. and 11:00 a.m. at the Lifetime Fitness center and adjacent local streets; and WHEREAS, Lifetime Fitness is located on the south side of Diehl Road, directly south of the termination of Winfield Road into Diehl Road and commonly known as 28141 Diehl Road; and WHEREAS, the Warrenville Plan Commission considered said application for temporary use permit at its November 19, 2015 meeting and subsequently unanimously recommended the City Council approval of said temporary use permit; and WHEREAS, the Mayor and City Council find and hereby declare that it is in the best interests of the City and its residents to accept the unanimous recommendation of the Plan Commission and approve the temporary use permit as set forth hereinbelow; NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF WARRENVILLE, DU PAGE COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The foregoing recitals shall be, and they are hereby, incorporated as findings of fact as if said recitals were fully set forth herein. SECTION TWO: A temporary use permit for a one-day Commitment Day 5K event on January 1, 2016 at Lifetime Fitness is hereby approved pursuant to Section 1.D.4 of the Zoning Ordinance of the City, subject to the following conditions: 1. The event shall be conducted in accordance with the Route Map, prepared by the City of Warrenville Community Development Department, dated November 13, 2015, which is attached hereto as Exhibit A and made a part, and the information provided with the Application materials. 2. Life Time Fitness shall provide written notifications to businesses located along the event route at least two weeks in advance of the event. Life Time Fitness shall provide clear operational instructions to all businesses identifying the need for access to their site during the event.
3. In case of heavy snowfall, the event may need to be canceled or re-scheduled. Snow plowing will be performed on a regular schedule by the City (Weaver Parkway) and DuPage County (Winfield, Mill and Diehl Roads), and will take priority over the road closures associated with the event. While an effort will be made to ensure these roads are cleared prior to the start of the event, the run may need to be delayed and/or interrupted in order to allow snow plows to clear the roads. 4. Life Time Fitness shall provide an executed Hold Harmless Agreement (in a form acceptable to the City) no later than one week prior to the event. 5. Life Time Fitness shall provide a Certificate of Liability Insurance, naming the City of Warrenville as additional insured no later than one week prior to the event. 6. Life Time Fitness shall ensure event staff is knowledgeable about the course configuration and is able to accurately report an emergency situation, including an accurate address, location and extent of injury or emergency situation, in order for the Fire Department to respond. 7. An operational plan for the event shall be submitted by Life Time Fitness to the City of Warrenville and approved by City staff at least two weeks prior to the event. 8. Life Time Fitness shall ensure event staff utilizes common radio frequency band two way radios in order to communicate with other event staff and police. 9. Life Time Fitness shall coordinate with the Warrenville Police Department on the event details, including the level of safety assistance provided and associated costs and fees. Closures at road intersections shall be controlled by the Warrenville Police Department and/or Emergency Management Agency. Additional traffic safety assistance may be provided by independent contractors. 10. Parking lot drive aisles, fire access, pedestrian walkways and handicapped spaces shall not be obstructed. 11. All signage associated with the event shall meet the requirements of the Warrenville Sign Ordinance/Cantera Development Control Regulations Sign Regulations. 12. Life Time Fitness shall police and promptly remove all trash from the event area. - 2 -
SECTION THREE: Any policy, resolution or ordinance of the City which conflicts with the provisions of this ordinance shall be and is hereby repealed to the extent of such conflict. Project No. 2015-0679 COMMUNITY DEVELOPMENT DEPARTMENT STAFF REVIEW PLAN COMMISSION / ZONING BOARD OF APPEALS November 19, 2015 TEMPORARY USE PERMIT FOR 2016 COMMITMENT DAY 5K AT LIFE TIME FITNESS 28141 DIEHL ROAD INTRODUCTION: In this case, Ryan Moran on behalf of Life Time Fitness (the "Applicant") is requesting approval of a Temporary Use Permit to conduct a one-day Commitment Day 5K event at the Life Time Fitness center and on adjacent local streets. The event would be held on Friday, January 1, 2016, from 9:00 a.m. until 11 a.m. Life Time Fitness center is located on the south side of Diehl Road, directly south of the termination of Winfield Road into Diehl Road and commonly known as 28141 Diehl Road (the "Subject Property"). Due to the requested full and/or partial street closures, a formal Temporary Use Permit approval by City Council is required in accordance with Section 1.D.4 Temporary Events of the Warrenville Zoning Ordinance. ANALYSIS: The following documents have been submitted to the Community Development Department, distributed to the Plan Commission/Zoning Board of Appeals, and are the basis for the review comments included in this report. Additional copies of any or all of these documents are available upon request and can be reviewed at the Community Development Department office. 1. Application for Temporary Use Permit signed by Ryan Moran, dated November 12, 2015. 2. Route Map, prepared by the City of Warrenville Community Development Department, dated November 13, 2015. Life Time Fitness in Warrenville is one of the 60 locations nationwide that were chosen by the corporate office to participate in and host the Commitment Day event. According to Life Time, approximately 250 people are expected to participate. As proposed and illustrated on the attached Exhibit A, the start and finish area would be staged in the parking lot of Life Time Fitness. The course would head east on Diehl Road before making a u-turn at West Street and head west on Diehl Road. The course would continue north onto Weaver Parkway and follow it back to Diehl Road. Participants would complete this course twice before reaching the finish line at the Life Time Fitness parking lot. The Applicant is also requesting partial and/or full closure of local streets, and assistance with directing traffic from the Warrenville Police Department during the event hours. According to the Applicant, all food and beverages would be provided inside the fitness center at their café. Upon consultation with various City departments and the Warrenville Fire Protection District, staff

The Warrenville Fire Protection District does not hold any objection to the event subject to Life Time Fitness following the conditions outlined in this report. Based on the above-noted findings, staff recommends approval of the requested Temporary Use Permit subject to the conditions outlined in the Conclusion section of this report. According to the Warrenville Zoning Ordinance, the Plan Commission makes recommendations to the City Council on all temporary use permit requests. CONCLUSION: Based on the above-noted findings, staff recommends the Plan Commission recommends City Council grant conditional approval of the requested Temporary Use Permit, which would allow Life Time Fitness to conduct a one-day Commitment Day 5K event on Friday, January 1, 2016, between 9:00 a.m. and 11 a.m. at the Life Time Fitness center and on adjacent local streets as described in the submitted Application, subject to the following conditions: 1.
