2. 0 REGISTRATION CATEGORY Currently open for individual 3 categories EIA Consultant, Assistant Consultant & Subject Consultant 6

2.1 EIA Consultant Min 7 years in general environmental management Min 5 years in EIA Actively involved in EIA studies Good understanding in EIA processes and regulations Basic environmental management knowledge and skills Familiar with environmental assessment techniques and mitigating measures May choose up to four areas of specialization 7

2.2 Subject Consultant In depth knowledge in any field related to EIA (e.g: list in Section 4) Applicant may specify further in form 8

2.3 Assistant Consultant trainee level and work under supervision of EIA Consultant May upgrade to EIA Consultant 9

3.0 ROLES & RESPONSIBILITIES 3.1 EIA Consultants:- Conduct the study based on scope of study or approved TOR Guide EIA Assistants Report writing for related sections. Draft may be done by EIA Assistants, however final write-up must be examined and approved by EIA Consultant 10

Applicants with other non-technical or science degrees may only work within their specialization Minimum 7 years Minimum 5 years 5 reports i. Attendance of formal EIA Training ii. Sufficient understanding of EIA process, environmental planning, law and regulations in Malaysia iii. For specialized area or expertise- specific training/ academic qualification is required. Evidence - certificates or examination results 15

6.0 OTHER REQUIREMENTS 6.1 Portfolio of Work For EIA Consultant Covering five (5) of most relevant EIA reports (Format in Appendix 2) For Subject Consultant Samples of work/ related sections/ summary. Must highlight areas chosen 18

6.2 References Applicants must name two (2) referees to verify their capabilities, skills, knowledge and experiences (Form B : Referee Assessment) 19

6.3 Interview Special interview session may be conducted if needed 20

6.4 Personal Attributes Competent Good interpersonal skills Independent Skills of personal organization Able to make professional judgment Able to react with sensitivity to the conventions and culture of the organization, site or region in which EIA study is performed 21

7.0 CODE OF CONDUCT All applicants must sign and agree to abide by the Code of Conduct 22

8.0 PROFESSIONAL INDEMNITY Under study INSURANCE May be required for project that exceeds certain limit (cost, etc) 23

9.0 APPEAL Applicants are entitled to appeal in writing and must be received by Secretariat within 1 month from date of rejection letter issued by DOE 24

10.0 RELATED FEES Processing fee of RM500 (USD 150) for EIA Consultant application and RM300 (USD 85) for Subject Consultant and Assistant Consultant 25

10.0 REGISTRATION RENEWAL EIA Consultants Renewal every three years RM300 (USD 85) No minimum number of EIA Reports required Must fulfill 5 qualifying EIA experiences (in 3 years) Minimum 50 hours CPD peryear (Appendix 5 : CPD Log sheet) 26

Continuous Evaluation Process Using special form with set of criteria and guidelines Evaluation by DOE officers will be channeled to Secretariat and individual file Comments will be considered for renewal purpose 30

11.0 REGISTRATION UPGRADE Assistant Consultant needs to submit fresh application under EIA Consultant category Subject Specialist may apply to be registered as EIA Consultant after fulfilling all related criteria 32

12.0 TEMPORARY REGISTRATION DG may grant temporary registration to foreign expert, as Subject Consultant Minimum requirements are applicable Proven with supporting documents 33

13.0 DEREGISTRATION AND SUSPENSION May be deregistered/ suspended if; Fail to comply with Code of Conduct Fail to fulfill minimum CPD/ qualifying EIA experience Other reasonable grounds Decision by committee appointed by DG So far, a number of consultants registration have been revoked & suspended 34

14.0 CONFIDENTIALITY All information and materials submitted to DOE are confidential. However, for purpose of ensuring the provision of correct information to potential users, DOE may publish relevant information on registration scheme website. 35

15.0 PROFESSIONAL INDEMNITY INSURANCE All registered individuals are encouraged to obtain Professional Indemnity Insurance 36

16.0 DOCUMENTATION Additional documentation to be submitted: Portfolio of Work (EIA Consultant/ Subject Consultant) Referee Assessment Form CPD Log Sheet (*for renewal) EIA Log Sheet (*for renewal) 37

17.0 TRAINING Registered consultants and potential applicants are required to attend EIA Induction Course and other relevant trainings In 2009, a total of 7 courses have been conducted; and attended by about 300 consultants In 2010, a total of 11 courses will be conducted Need to pass the course assessment In 2011, the effort has been continued Those who did not attend, were dropped from the list 38
