Yamhill County Sheriff s Office Concealed Handgun License Frequently Asked Questions Q: What are the requirements for obtaining a concealed handgun license (CHL) in the State of Oregon? A. You must apply for a CHL, in person, within the county in which you reside. However if you own property in two different counties, it is your choice which county you apply to; but you can only have one CHL issued by one county (an OR CHL is good throughout the entire state). a. You must be a U.S. Citizen, or a legal alien who can document continuous residency in the United States for at least six months and have declared, in writing, to the INS your intent to acquire citizenship (e.g. Form N300). b. You must be 21 years of age. c. Have no legal condition that would prohibit you from possessing a firearm under either Oregon or Federal law. d. Have no outstanding warrant(s) for your arrest. e. If you served in the Armed Forces and were not dishonorably discharged. f. Not be an unlawful user of, or addicted to, a controlled substance. g. Not be on any form of pre-trial release. h. Not be required to register as a sex offender in any state. i. No convictions of a misdemeanor, or found guilty of a misdemeanor within four years prior to application, except under ORS 151.295. j. Not been ever convicted of a felony or found guilty, except for insanity under ORS 161.295, of a felony. k. Not be subject to a citation issued under ORS 163.735 or an order issued under ORS 30.866, 107.700 to 107.723 or 163.738 (e.g. Stalking or Restraining Order). l. Demonstrate competency with a handgun by any of the following: i. Completion of any hunter education or hunter safety course approved by the State Department of Fish and Wildlife or a similar agency of another state if handgun safety was a component of the course; ii. Completion of any National Rifle Association firearms safety or training course if handgun safety was a component of the course; iii. Completion of any firearms safety or training course or class available to the general public offered by law enforcement, community college, or private or public institution or organization or firearms training school

utilizing instructors certified by the National Rifle Association or a law enforcement agency if handgun safety was a component of the course; iv. Completion of any law enforcement firearms safety or training course or class offered for security guards, investigators, reserve law enforcement officers or any other law enforcement officers if handgun safety was a component of the course; v. Presents evidence of equivalent experience with a handgun through participation in organized shooting competition or military service; vi. Is licensed or has been licensed to carry a firearm in this state, unless the license has been revoked; or vii. Completion of any firearms training or safety course or class conducted by a firearms instructor certified by a law enforcement agency or the National Rifle Association if handgun safety was a component of the course. How do I meet the residency requirement to apply for a CHL in Yamhill County? A. You may apply for a CHL in Yamhill County by meeting one of the following residency requirements (ORS 166.291(9)): a. Possess a current Oregon driver s license showing a residence address in Yamhill County. b. Show proof of voter registration in Yamhill County and have a precinct memorandum card showing a residence address in Yamhill County. c. Provide documentation that you currently own or lease real property in Yamhill County. d. Provide documentation that you filed an Oregon tax return for the most recent tax year with a residence address in Yamhill County. Q. When can I apply for a new CHL once I complete my handgun safety course; and how much does it cost? A. Acceptable forms of payment are cash, check, money order, or Visa/MasterCard (to include debit cards).

Q. What if I am in the military, or a veteran who qualified with a handgun during my service; do I still need to take a handgun safety course? A. If you are on active duty and qualified with an M9 or other small arms (i.e. handgun), you need to provide documentation of your training record or certificate of training affirming that qualification. If you are a veteran, you would need to either provide documentation (e.g. if it is not stated on your Form DD 214, a copy of your training record or certificate of training affirming handgun qualification) that specifically states pistol, sidearm, small arms, or handgun training is required. If you were an officer in any branch of service, or Military Police (Security Police), all that is required is a copy of your Form DD 214 showing rank and/or MOS, respectively (i.e. it is automatically presumed you qualified with a handgun since that is/ was your standard duty sidearm as a part of your military duties). Should you be unable to obtain any documentation affirming you qualified with a handgun during your military service, you would be required to take the handgun safety course before applying for a CHL. Q. If I am a resident of another state and travel through Oregon regularly, will Yamhill County issue me a CHL? A. It depends on what state you live in and the nature of your travel through Oregon. Under ORS 166.291(8), the county sheriff may waive the residency requirement in subsection (1)(c) of this section for a resident of a contiguous state who has a compelling business interest or other legitimate demonstrated need. If you reside in a contiguous state and can articulate a compelling business interest or other legitimate demonstrated need, you may do so in writing a letter to the sheriff requesting a waiver of the residency requirements based on that reason. Once that letter is received and reviewed, you will be notified of the Sheriff s decision. Q. What if I already have a CHL and I either need to renew it or change my address, even if I moved from another county? A. You may renew your CHL up to but no sooner than 30 days prior to the expiration date.

To renew your CHL, or change your address (ORS 166.295), you may come into the Yamhill County Sheriff s Office any day of the week between 8:00 and 5:00 p.m. The cost to renew your CHL is $50 for 4-years. The cost to change your address, either within Yamhill County or coming from another county is $15 (your address must be changed on your driver s license before the replacement CHL reflecting the address change is approved). The cost to replace a lost CHL is $15. ALL FEES ARE NON-REFUNDABLE. Only checks, money order, cash, and Visa/MasterCard (to include debit cards) are acceptable forms of payment. NOTE: When renewing or changing your address on your CHL, you must do so in person and be prepared to have a new photograph taken. NOTE: If your CHL has already expired, you cannot carry until you receive your valid CHL; however if you were still current at the time of renewal, your receipt will be stamped with a 45 day extension allowing you to carry concealed until your valid CHL arrives in the mail. Q. What if I am in the military and cannot renew my CHL in person? A. Active members of the Armed Forces, National Guard, or the Oregon National Guard may submit a renewal application by mail; and provides a completed application with proof of the licensee s military orders and a copy of the licensee s military identification (ORS 166.295(1)(a)(A) and (B)). Q. If I was a legal resident who provided proof of the intent to acquire citizenship and was approved and received my initial CHL, when I come in to renew, do I need to provide proof that that citizenship was obtained? A. Yes. Upon renewal you will need to bring either your Naturalization documentation or U.S. Passport; otherwise your renewal application may be denied if you cannot provide proof of citizenship since you would not meet the statutory requirement of citizenship (ORS 166.291(1)(a)(A)).

Q. How long is an Oregon CHL valid, and does Oregon recognize any other state s concealed handgun license/permit? A. A valid Oregon CHL is good for four years; and no, Oregon does NOT recognize any other state s concealed handgun license/permit at this time. Q. Does a CHL allow me to carry any weapon? A. No. A valid CHL is just a license giving you the privilege to carry a handgun concealed. For the definition of a handgun see ORS 166.210(4). Q. Where can I find more information about Oregon s CHL laws? A. Oregon s CHL laws can be found at www.leg.state.or.us/ors/166.html Q. Are there places I can t carry my handgun concealed? A. Yes. A complete list and explanation of each place where you are authorized and NOT authorized to carry concealed can be found here: www.leg.state.or.us/ors/166.html (specifically ORS 166.370). If you plan to carry your handgun concealed in certain locations, it is important to research the requirements that these locations before you go. If in doubt, contact the facility you plan to visit directly to obtain their policy. For information regarding the Portland airports, please contact the Port of Portland legal department. You should check with the Port Authority of each airport as other airports in Oregon are under other jurisdictions.

Q. What do I do if I change my name, and what would be the cost to change it on my CHL? A. You would first need to change your name with the Department of Motor Vehicles so it is reflected on your driver s license; and at the time of application to change your name on your CHL, we would need documentation reflecting that name change (e.g. marriage certificate, civil judgment affirming the name change). The cost of the name change on your CHL would be the same as a replacement CHL: $15. Q. Will I receive notification that my license will expire? A. No. If you expire before renewing your CHL, you are not penalized nor do you have to take the handgun safety training again. All you need to do is come into our business office Monday through Friday between 8:00 a.m. and 5:00 p.m. and complete the renewal application process. NOTE: If your CHL is expired upon renewal, you will not be able to carry concealed until you receive your valid CHL. If you renew PRIOR to your expiration date, your receipt will be stamped with a 45 day extension allowing you to continue to legally carry concealed until your new CHL arrives in the mail. Q. What happens if I have a CHL but do not have it on my person if I am stopped by a law enforcement officer and have a concealed handgun in my possession? A. This is a criminal offense and can result in your arrest with the seizure and revocation of your CHL. ORS 166.292(2) states, Failure of a person who carries a concealed handgun also to carry a concealed handgun license is prima facie* evidence that the person does not have such a license. *(prima facie is Latin for on its face )

Q. If I have been fingerprinted before and on record with the Oregon State Police, do I have to be fingerprinted again as a new applicant? A. Yes. Under ORS 166.291 we are required to fingerprint all new applicants. However if you are renewing or changing your address on your CHL, you are exempt from the requirement to submit fingerprints (ORS 166.295(1)(a)). Q. How long does it take to get my new CHL? A. ORS 166.292 allows the Sheriff 45 days to review your application and conduct a background check before issuing or denying your application for a CHL. Q. How will I know if my application was denied or my CHL was revoked? A. If your CHL application is denied or subsequently revoked; you will receive a certified letter advising you of that fact and the reason for the denial or revocation. Q. Can I appeal a denial or revocation to the Sheriff? A. No. However ORS166.293 (5) provides that you may petition the circuit court in the county of your residence to review the denial, nonrenewal or revocation.
