REQUEST FOR PROPOSALS FOR THE OPERATION AND TENNIS CONCESSION AND LESSON SERVICES AT THE LA CIENEGA TENNIS CENTER 1 Introduction The City of Beverly Hills Community Services Department (hereinafter Department ) is pleased to offer an exciting opportunity for a well-qualified business entity to provide professional Tennis Lesson Services and operate and maintain the Tennis Professional Shop at the La Cienega Tennis Center in Beverly Hills, California. The proposing individual or company shall demonstrate the ability to perform in this type of business, clearly articulate achievable plans for operation, and document compliance with appropriate laws and regulations. The selected concessionaire shall demonstrate the ability to implement a concession program that will meet or exceed the objectives of the City of Beverly Hills Community Services Department as well as incorporate innovative ideas that are appropriate for this concession. The Department s goals are to (1) provide the public with the best and most satisfactory service from the concession and tennis lessons, and (2) ensure that the City receives adequate and appropriate compensation from a private business allowed to operate on City property. The purpose of this Request for Proposals is to provide information to prospective professionals detailing the services and deliverables desired by the City, a basic description of the tennis facility and its operation, proposal content, and the City s expectations relative to the proposer s qualifications. 2 Objective of the Request for Proposals The objective of this Request for Proposals ( RFP ) is to award a four (4) year Concession Agreement (hereinafter Agreement ) with two (2) additional four (4) year renewal options or more, exercisable at the sole discretion of the Community Services Department, to an operator who will accomplish the following: Provide professional tennis lessons, tournaments, camps, and clinics to meet or exceed the needs and expectations of the tennis community. Provide a Professional Shop, through creative, aesthetic, efficient and safe design, to meet or exceed customer service expectations and the needs of the tennis community. Optimize visitor participation in the concession to be consistent with the demographic of the La Cienega Tennis Center. Provide professional, friendly service at reasonable prices, thus resulting in the highest possible revenues to the concessionaire and the City of Beverly Hills; Access, provide and install all necessary furnishings and equipment in order to create an attractive and inviting concession. 2

Display awareness of the demographics and special needs of the community this concession serves. Reach out in the community to increase the current usage at the concession through the use of marketing and advertising tools. Consideration of the addition of Pickleball or other short-sided game offerings at the Tennis Center or other City owned tennis courts. Work in unison with the Community Services Department during the normal course of business and as unforeseeable problems arise. 3 Description of Concession The City of Beverly Hills Community Services Department is seeking commercial venture proposals with an emphasis in tennis merchandising and instruction, from qualified vendors interested in leasing and operating the tennis pro shop and providing private and group instruction, tournaments, camps and special events at the La Cienega Tennis Center. The Pro Shop involves dealing with the sales and service of tennis equipment, supplies, apparel and accessories. The effective date for the implementation of this operation is April 1, 2018. The selected concessionaire will provide private and semi-private (u p to four persons) instruction on a maximum of four courts specified by the City of Beverly Hills. Group lessons, Tennis Tournaments and Special Events are also to be provided by the concessionaire. Up to 3,000 hours of group lessons per quarter are available. Two (2 ) major tournaments and social tennis events have been offered each year. The major tournament currently attracts over 300 participants in men s, women s and youth singles and doubles category. The events are normally held over two weekends during the fall and spring. The social events have consisted of social round robins and tennis clinics. A Tennis Camp is offered to ages 3-14 for a maximum of ten (10) weeks during the summer months and during the vacation periods following the Beverly Hills Unified School District calendar, as well as a Competitive Tennis program for Juniors defined as lessons and competitive play for youth. Limited use of two (2) other Beverly Hills tennis facilities, Roxbury Park tennis courts (401 South Roxbury Drive ) and Beverly Hills High School (241 South Moreno Drive) during non-school hours are available for lessons/tournament play. Use of these facilities requires permission of the Community Services Department and is included in the maximum hourly use as outlined. Professional services shall comply with all Local, County, and State codes regulating the operation of a retail business. Tennis professionals currently operating a pro shop or managing a teaching program, who are interested in franchising their current operation to a new location, are also invited to participate in the selection process. 4 Background The La Cienega Tennis Center was opened in late 1990 and consists of sixteen courts, including a center court with a seating capacity of 250. This three level, multi-use facility also has two rooms which the Community Services Department makes available to the public on a rental basis. Additionally, there is an eating and lounging area with outdoor umbrella tables located on the tennis deck. The Tennis Center is open 365 days a year from 7 a.m. 10 p.m. The City operates the public rental of the tennis courts and the room rentals. 3

The tennis courts were resurfaced in October, 2017 and funded by the City. Courts are scheduled to be resurfaced every 5 years. Requests for Proposals for new court lighting will be sought in 2018. The La Cienega Tennis Center is the 1992 recipient of the United States Tennis Association s Outstanding Public Facility Award and has been listed as one of the top tennis facilities in Los Angeles Magazine and other tennis publications. The Center is utilized by over 150,000 tennis players annually. Demographically, the Tennis Center provides an excellent upscale market for enhanced goods and services. Geographically, being on a major thoroughfare assures high visibility for the facility, while ease of parking, with access to a ground level parking structure available from La Cienega Boulevard, ensures convenience for the Center users. Other noteworthy aspects of the La Cienega Tennis Center include: - Sixteen lighted courts. - Central Westside location between Olympic and Wilshire Boulevards on La Cienega Boulevard in Beverly Hills, CA. - Facility meets current American with Disabilities Act accessibility standards. - Men s and women s locker room facilities with restrooms, lockers, showers and changing areas. - Three-hundred vehicle parking structure with two-hour free parking weekdays until 4pm and free parking after 4pm and all day on weekends. 5 The Professional Shop The Pro Shop, located inside the main building, is on the second level of the Tennis Center (same level as the tennis courts), and has both stair and elevator access. The Pro Shop is 650 sq. ft. in area and is situated adjacent to the teaching court(s). There will be a minimum of 400 hours per week available to the concessionaire for the teaching of lessons. These hours will encompass four courts, which may be operated every day during hours prescribed by the City. Additional hours are provided for group lessons and competitive tennis. Allocated hours for tennis camps, tennis tournaments and special events are subject to approval. A 100 sq. ft. office space across the hallway from the Pro Shop is also included in the operation. Optional Addendum: Food Service An option is offered to provide or contract a food service, which may include hot/cold nonalcoholic beverages or food. The food service in keeping with the City's aesthetic standards and meets all Municipal, City and County health code standards regulating the operation of food services and sales. 6 Required Operating Responsibilities The following are selected areas of operating responsibilities which will be required of the winning proposal. If selected as the winning proposal, the proposer must be willing and able to commit to the following Required Operating Responsibilities. A Cleanliness Concessionaire shall, at its own expense, keep the Pro Shop and office premises clean and sanitary at all times. 4

B Utilities The City will incur the cost of water, gas, electricity, heat, air conditioning (utility) and trash pickup from the main dumpster during the term of this Concession Agreement. The concessionaire will incur all costs for telephone, cellular, computer and cable expenses and janitorial services for the Pro Shop and Office. Optional Concession improvements Proposer may propose additional physical improvements within the defined premises that shall potentially improve the quality of the concession. If no additional improvements are being proposed, state such in the proposal. As part of the selection process, in conjunction with other proposal items, the Department will consider all concession improvements proposed which are conducive to the enhancement, safety, and increased revenue of the concession. Proposed concession improvements are considered conceptual at the time of evaluation and award, and are subject to negotiation and City approval prior to execution of the Agreement. C Maintenance and Repairs The City at its expense, will keep and maintain all equipment, owned or installed by the City, such as, but not limited to, heating ventilation and air conditioning, fans, controls and electric panels, installed by the City. The Concessionaire will maintain all of the fixtures, plate and mirror glass, interior surfaces, equipment and personal property therein, in good repair and in a clean, sanitary, and orderly condition and appearance. No equipment provided by the City shall be removed or replaced by Concessionaire without the prior written consent of the Community Services Director and if consent is secured, such removal and/or replacement shall be at the expense of Concessionaire. D Instructors Concessionaire shall maintain adequate and proper instructors for all its concession operations. The Concessionaire is required to ensure that all associate professionals are certified by the United States Professional Tennis Association and are experienced tennis instructors. If services under this Agreement involve minors under the age of 18, Concessionaire or Concessionaire s personnel shall be fingerprinted by the City Police Department in order to conduct a State Department of Justice ( DOJ ) background check prior to Concessionaire performing services under this Agreement. City shall waive the administrative cost of fingerprinting and shall pay the DOJ fees. If Concessionaire or any Concessionaire personnel have been convicted of a misdemeanor or felony involving moral turpitude according to the DOJ report, City may terminate this Agreement immediately. E Pricing for Lesson Services and Professional Shop City agrees that Concessionaire's merchandise and lesson services, including its prices for same, shall be within Concessionaire's discretion; subject, however, to disapproval by the Community Services Director if the selection of items offered is inadequate, of inferior quality, or if any of said prices are excessively high or low. All services and merchandise carried in stock, displayed, offered for sale, and/or sold by Concessionaire in said premises shall be of high quality and must be related to the ordinary business of the concession. 5

7 Non-Mandatory Pre-Proposal Meeting Date Monday, December 11, 2017 Time l0:00 a.m. Location La Cienega Tennis Center, Rodeo Room 325 South La Cienega Blvd. Beverly Hills, CA 90211 The purpose of the meeting is to clarify the contents of this RFP and to discuss the La Cienega Tennis Center Tennis Professional Concession s needs. Although attendance is not mandatory, 5 points will be awarded to all proposals with a representative in attendance. A site walk of the facility will be conducted after the conclusion of the meeting. It is highly recommended that prospective proposers read the complete RFP prior to the meeting and begin preparation of their proposal in order to maximize the benefits of the meeting. 8 Instructions to Proposers A Submitting a Written Proposal To be considered for award of this concession agreement, proposing entities must submit a sealed, written proposal in response to the Proposal Items indicated herein. Proposals provide information about background, current business practices, applicable experience, and plans for this concession. Proposals are evaluated based on several evaluation criteria as indicated in this RFP. Proposers may wish to consider the following guidelines in preparing their proposals: Make sure your proposal is well-organized and easy to read. Verify that your proposal is complete and that you have completely responded to all proposal items in the RFP. Make sure your proposal demonstrates that your financial projections and cost estimates are realistic and sustainable. Clearly describe what your management team will bring to the concession. Resumes of key staff who will be assigned to management and oversight of the tennis facility operation and personnel is requested. Provide professional references that can speak to your experience, particularly, your experience operating a tennis facility owned by a public agency, like the City of Beverly Hills. If there are significant risks in your business strategy, include plans to mitigate those risks, addressing any contingencies that may arise. Description of your professional liability insurance coverage. Your written submittal in this RFP process will be the primary basis on which the City will consider its award for the Agreement; therefore, proposers should be as thorough and as detailed as possible when responding to each proposal item and assembling a proposal. In the written proposal, proposers must include responses to ALL proposal items requested herein below. Proposers will not be able to add to or modify their proposals after the proposal submittal deadline 6

B Number of Copies Please provide one (1) original and four (4) copies of the proposal and one (1) non-bound reproducible copy. Plainly identify the respective documents. A reproducible copy is one which can readily be reproduced through a photocopier. C Important Notices Proposers who mail their proposals should allow adequate mail delivery time to ensure timely receipt of the proposals. Late proposals will not be considered for review. At the day and time appointed, all timely submitted proposals will be opened and the name of the proposer(s) announced. No other information about the proposals will be made public until such time as a recommendation concerning proposals is made to the Recreation and Park Commission. All proposals submitted in response to this RFP become the property of the City of Beverly Hills Community Services Department. D Proposal Submittal Information Deadline for Submission To be considered, proposals must be received in the Community Services Department Office on or before Monday, January 22, 2018 by 5:00 p.m. E Where to Submit your Proposal The complete proposal package shall be placed in a sealed envelope or box labeled Proposal for the Operation of Tennis Concession and Lesson Services at the La Cienega Tennis Center. A. Ability to Finance (15 - points possible) Proposer must demonstrate the means and resources to finance, operate, and sustain the concession operation as proposed, including all start-up costs, pre-opening costs, inventory, sufficient working capital, and improvements: Evidence of financial capability to fund the operation. Demonstrates evidence to sustain the financing of the operation. Background and Experience (20 points possible) Proposer must provide information on the following: Years and quality of experience in similar and relevant businesses. Proven performance of the proposing entity as a whole. 7

Proven performance and qualifications/experience of each member of its proposed management team. Demonstrated ability to successfully operate all aspects of a similar business. Track record of creative, innovative, resourceful management. Evidence to sustain the financing of the operation. B. Proposed Business Plan (20 points possible) The Proposer's plan for the concession (including the pro shop and lesson services), that demonstrates an understanding of the City's objectives and requirements as identified in this RFP, and demonstrates the ability and clear commitment to implement the components of the plan in a comprehensive and effective manner. Soundness of planning. Quality of services, products, and merchandise to be offered. Price schedules and pricing policies. Professional and employee staffing, qualifications, and training plans. Customer service plans, marketing, promotion, and advertising. Other tennis-related services and/or amenities. Realistic and achievable financial projections and planning. C. Proposed Rent Payment (20 points possible) Proposer details an appropriate rental payment to the City: Appropriateness of rent proposal basis. Sustainability of proposed rent over the term of the contract. Practicality and soundness of proposed rent from new amenities or services. Competitive rent proposal. D. Concession Improvements (10 points) The Proposer details any improvements proposed for this concession. Sound, practical, and sustainable improvements for the facility. Feasibility; potential to be completed within the proposed time and budget. Monetary value; amount of investment. Potential to increase revenue and service. E. Interview (15 points) Responsive proposals will be scored in each of the items A through D and ranked according to scores. Interviews of the top proposers by an evaluation panel will be scheduled at a later date for the purpose of clarifying matters in the proposals or responding to questions by the evaluation panel. All proposals will be evaluated solely on the basis of the criteria listed above and the ranking of a review panel will serve as a basis to formulate the Community Services Director's recommendation, setting forth the reasons for recommendation in a Recreation and Parks Commission Report and City Council Report. The Community Services Director recommends contract awards to the Recreation and Parks Commission. The Community Services Department shall notify all proposers in writing of the Community Services Director's recommendation. The Recreation and Parks Commission will consider the Community Services Director's recommendation during a 8

public Commission meeting and may accept or reject the Community Services Director's recommendation in making their decision as to the selection. Once the award is approved, the selected concessionaire will complete and submit the additional documents as required by this RFP, City Ordinance, State and/or Federal laws within 30 days of written notification by the Department. Contractual Arrangements The proposer selected to perform the services outlined in this RFP will enter into an Agreement, approved as to form by the City Attorney, directly with the City of Beverly Hills. Verification of Information The Department reserves the right to verify the information received in the proposal. If a proposer knowingly and willfully submits false information or data, the Department reserves the right to reject that proposal. If it is determined that an Agreement was awarded as a result of false statements or other data submitted in response to this RFP, the Department reserves the right to terminate the Agreement. Cost of Preparation All costs of.proposal.preparation shall be borne by the.proposer. The City shall not, in any event, be liable for any expenses incurred by the proposer in the preparation and/or submission of the proposal. All proposers who respond to solicitations do so solely at their own expense. 10 Contractual Provisions The following are selected contractual provisions which will be required of the winning proposal. If selected as the winning proposal, the proposer must be willing and able to commit to the following Contractual Provisions. A Term The term of the Agreement will be four (4) years, and may be renewed with two (2) additional four (4) year terms or more, exercisable at the sole discretion of the Community Services Director. B Hours of Operation Courts designated for use by the Concession and hours of operation will be: Courts 2, 3, 4, 8 Monday through Friday 7am to 10pm Courts 3, 4, 8 Saturday/Sunday 7am to 10pm Court 2 Saturday/Sunday 12pm to 10pm Pro Shop Monday through Thursday 8am to 9pm Friday 8am to 7pm Saturday/Sunday 8am to 6pm 150 or more additional hours per week may be available to the Concessionaire for additional private lessons and group lessons and at the discretion of the Community Services Department. 9

The Concessionaire shall inform the City s Tennis Clerk when the Professional Courts will not be used for concession activities in order to allow the courts to be rented to the public. Proposers may propose a variation to the basic hours of court use and Pro Shop hours keeping in mind service to the public as a priority, but should not anticipate use of more than 150 additional court use hours in preparing the pro forma financial documents. C Insurance The selected Concessionaire shall acquire and maintain the established insurance and liability limits for this Concession. If the scope of a proposed Concession operation differs substantially from the present Concession operation, the actual coverage and limits required are subject to change at the sole discretion of the Community Services Director. Evidence of coverage shall be provided on the City's insurance endorsement forms wherein the City of Beverly Hills shall be named as additionally insured. Concessionaire's insurance must be approved by the City prior to operation of the Concession. D Taxes The Concessionaire shall pay all taxes of whatever character which may be levied or charged upon the Concessionaire to use the premises, or upon the improvements, fixtures, equipment or other property, or upon the operations under the Agreement. E Business Tax Registration Certificate The selected Concessionaire will be required to demonstrate compliance with the City's business tax laws. This compliance must be in force during the entire period of the agreement.
