Ministry of Cultural Heritage and Activities and Tourism DIRECTORATE-GENERAL FOR CONTEMPORARY ART, ARCHITECTURE AND URBAN PERIPHERIES ITALIAN COUNCIL PROJECT PUBLIC CALL FOR FINANCING CULTURAL PROJECTS FOR THE PROMOTION, PRODUCTION, AWARENESS AND CIRCULATION OF CONTEMPORARY ITALIAN CREATIVITY IN THE VISUAL ARTS IN ITALY AND ABROAD Art. 1 Premises and Objectives The Directorate-General for Contemporary Art, Architecture and Urban Peripheries, an organism of the Ministry of Cultural Heritage and Activities and Tourism, hereinafter referred to as the DGAAP, is announcing a public procedure to finance projects that promote the production, awareness and circulation of contemporary Italian creativity in the visual arts. Projects may be proposed by Museums, public and private non-profit entities, Universities, Foundations, committees and no profit cultural associations involved in the production of contemporary Italian art as a means to increase Italian public collections. Art. 2 Available Resources and Funding Restrictions The resources available for these activities amount to a total of 450,000.00 (fourhundredfiftythousand/00 Euro). Funds are provided in accordance with Ministerial Decree 4 January 2017, track number 2, Chapter 7707 PG 13 for the fiscal year 2017. The financing available to each applicant is capped at a sum of maximum 150,000.00 (onehundredfiftythousand/00 Euro), including VAT and/or in any case not in excess of 80% of the total project budget. Applicants must demonstrate, on their behalf or that of third parties, their proven ability to support the remaining project costs (20%). The DGAAP reserves the right to evaluate the opportunity of the contributions when the remaining costs (20%) are to be sustained by third parties other than the applicant. Art. 3 Beneficiaries Proposals must result in the production of one or more artworks by an Italian artist. Applications may be submitted by: Italian and/or international public and private non-profit Museums, recognised no profit Foundations with the primary objective of promotion and education in the field of contemporary art, Universities, Italian and/or international no profit committees and cultural associations. In all cases, cultural proposals, which may include artist in residence programmes, must produce a new work of art that will remain of property of the Italian State. Artworks must be destined to State or Civic Contemporary Art Museums in accordance with a regulation that constitutes an integral part of the present Brief. Privilege will be afforded to projects that involve:

- international cultural institutions that, for the exhibition of the artwork, may benefit from a loan of up to 10 years from the date of production of the artwork; - the artist in international events and exhibitions related to the newly produced work. Art. 4 Requirements Museums: Requests will be accepted from Italian and international museums involved in activities related to contemporary art in a continuous manner over the past three years. Italian institutions must not have benefited from specific acquisition programmes financed by the DGAAP during the current year. No profit Foundations, Universities, committees and cultural associations: Requests will be accepted from recognised Italian and international foundations involved in activities related to contemporary art in a continuous manner over the past three years. Artists involved in the project must meet the following requirements: - Italian citizenship; - operation in the specific field of the visual arts, in the broadest sense of the term; - one personal show in an important exhibition space. Art. 5 Admissible Projects Applicants must present one or more project proposals aligned with the objectives outlined in art. 1. Evaluations will be made exclusively of proposals developed in relation to the following structure: 1. Cultural Proposal A complete report describing the proposed project. These proposals may involve the following fields, presented here only as examples: Commission Public artwork commission Public acquisition of an artwork Residency programme to produce an artwork Participation in an exhibition whose objective is the production of an artwork International Promotion: Residency programme to produce an artwork Exhibition whose objective is the production of an artwork Support to production and participation in international cultural events (international exhibitions such as Biennials, Triennials, or specific events such as Manifesta, Documenta, etc.) with the exclusion of those that, during the current year, benefit from specific acquisition programmes financed by the DGAAP. Proposals must describe the objectives and aims of the project. In particular, the report must include the following contents:

a) general content of the proposal, (max. 1320 words); b) detailed information about the proposal, including the curriculum vitae of the artist promoted, without any limitations on the medium (max. 1650 words); c) possible strategy for the exhibition of the artwork (max. 660 words); d) production schedule demonstrating completion of the artwork within 10 months from awarding of the financing, and the relative promotion of the artwork. The artist must formally communicate the beginning of production within 30 days from awarding of the financing (max. 660 words); e) promotion and communication strategy (max. 330 words); f) proposal for events and educational and training activities related to the production of the artwork (max. 660 words); g) proposal for a possible catalogue or other printed materials (max. 660 words); h) contacts, website links, curricula necessary to describe the activities undertaken over the course of the past three years, demonstrating the applicant(s) relevance to contemporary issues (max. 1650 words including images and/or illustrated examples) 2. Project Budget A detailed financial proposal of all costs related to the production and promotion of the artwork (max. 330 words). 3. Curriculum vitae of the organisers, letters of accreditation and acceptance of the conditions outlined in the brief from potential partner institutions involved in the proposal (max. 1650 words). Art. 6 Methods and Terms for the Presentation of Applications and Required Attachments Requests for financing, signed by the applicant s legal representative, must be submitted exclusively online, using the form available at the following website: www.aap.beniculturali.it/italiancouncil/ after registration, which must be completed no later than 12 noon on 30 June 2017. Complete applications must not exceed five MB in size and must not be password-protected. Pdf is the required electronic format for the text and pdf or optimized jpeg is the required electronic format for pictures. Applications must be accompanied by all of the documentation listed in art. 5 of the Brief. Art. 7 Application Review, Evaluation and Selection Criteria Applications received in accordance with the methods and terms outlined in art. 6 of the present Brief will be verified to ensure they are complete and correct. Successively, accepted applications will be evaluated by a Committee that will draw up a ranking based on a points system. During the review phase, if necessary the Committee may request clarifications from applicants in relation to the documents presented, in order to ensure the completeness of the project and guarantee maximum participation. Points will be awarded to accepted applications based on the following criteria:

7.1 Quality, originality and key aspects of the cultural project, in terms of their response to the objectives outlined in the brief. Max points 30 7.2 Strategies of promotion and communication related to the artwork 7.3 Expected results in Italy and abroad 7.4 Agreements with final beneficiaries of the artwork, as per art. 3 Max points 25 Max points 20 Max points 15 7.5 Identification of a definitive home for the artwork Max points 10 Art. 8 Financing and Accounting Methods Financing will be awarded on a priority basis in relation to the ranking provided by the Committee. The DGAAP reserves the right not to distribute the full amount of the present announcement in the event that the Committee does not consider the applications worthy of financing. The eventual remaining sum will be used to increase the value of the successive announcement. Financing and accounting for all projects will develop in three phases: - a first phase consists of the announcement to the winners of the sum deliberated by the Committee and acceptance of the proposed project; the approval of site specific works in public spaces is subject to the issuance of permission from the Soprintendenza Archeologia Belle Arti e Paesaggio responsible for the territory in which the project is located. Failure to provide this document will result in the exclusion of the proposal. - a second phase, following the period of control by appointed bodies, concerns the issuance by the DGAAP of the first 50 (fifty) percent of the sum assigned to the winning project, payable upon receipt of a regular expense note detailing all costs sustained by the artist (travel and lodging, site visits, materials, etc.); - a third phase, at the end of the project, presupposes the issuance of the remaining 50 (fifty) percent of the assigned financing, upon receipt of a final expense note demonstrating: o the fulfillment of all requirements; o the submission of the certificate of authenticity of the artwork made by the artist; o submission of the artwork use and conservation manual, signed by the artist; o submission to the DGAAP and the Institution to which the work has been assigned, of one or more images of the artwork free of copyright. Art. 9 Control The DGAAP reserves the right to carry out verifications and controls at any moment during the realisation of the projects it has financed, according to the methods it considers opportune.

The DGAAP remains extraneous to any nascent relationships with third parties depending on the realisation of the projects it has financed. The beneficiary is obliged to conserve and make available all documentation relative to the artwork financed, including all receipts demonstrating payments and costs sustained. Art. 10 Revocation and Recovery of Financing Any financing and/or sums eventually paid will be revoked and/or recovered under the following circumstances: - in the event that the works and the cultural project, even for reasons not imputable to the applicant, are not physically completed within the period of 10 (ten) months from the date of communication of the beginning of production, which must take place within 1 (one) month from the date of communication of the winning project; - for deformities in the project, unless authorised previously by the Committee. Art. 11 Reference Offices Interested applicants may request clarifications regarding the present announcement by forwarding their questions to the following email address: italiancouncil@beniculturali.it no later than 12 noon on 15 June 2017 The Ministry will publish an anonymous list of the most frequent questions for clarification and/or further substantial information relative to the procedure on the website: www.aap.beniculturali.it/italiancouncil/ Art. 12 Reasons for Exclusion from the Ranking and Financing 1) incongruence between the proposed project and the objectives of this announcement; 2) failure of the project to respect the requirements. Art. 13 Safeguard Clause Until the moment it adopts measures to issue the financing, the DGAAP reserves the right to revoke the present call at any time, together with all consequent acts, without giving rise to any right by applicants to pretend anything in relation to the financing of their proposed projects. Art. 14 Postponements For all conditions not explicitly described in this announcement, reference is to be made to currently applicable legislation, State accounting laws, Legislative Decree 22 January 2004, n. 42 as amended, and the regulations of the Italian Council dated 10 March 2017, n. 265. Art. 15 Controversies All controversies that may arise between the Parties in the interpretation and/or fulfilment of the present act will fall under the exclusive jurisdiction of the Law Courts of Rome.

Ministero dei beni e delle attività culturali e del turismo DIREZIONE GENERALE ARTE E ARCHITETTURA CONTEMPORANEE E PERIFERIE URBANE REGULATION OF THE ITALIAN COUNCIL FOR THE PROGRAMMING AND IMPLEMENTATION OF PROJECTS TO PROMOTE CONTEMPORARY ITALIAN ART IN ITALY AND ABROAD CONSIDERING the Decree issued by the President of the Council of Ministers on 29 August 2014, n. 171, art. 16, instituted the Directorate-General for Contemporary Art, Architecture and Urban Peripheries (hereinafter the DGAAP); CONSIDERING that as per letters g) and h) of comma 2 of art. 16 of the aforementioned D.P.C.M., the DGAAP promotes an awareness of contemporary Italian art abroad, as well as contemporary creativity and the production of contemporary art, raising awareness and promoting the work of young artists, also through competitions; GIVEN that the Ministry s official guidelines concerning the identification of political priorities for the three-year period 2016-2018 dated 7 August 2015 provide for investments in the sectors of contemporary architecture and art for their promotion in Italy and abroad ; GIVEN the official guidelines of the Ministry of Cultural Heritage and Activities and Tourism dated 16 November 2016 which identify political priorities for the year 2017, with a three-year projection for 2017-2019; GIVEN the consequent strategic objectives assigned to the DGAAP within the performance plan for the three-year period 2016-2018 related to the promotion and support of contemporary art and architecture through innovative projects for territories ; IT IS CONSIDERED strategic, in coherence with the above, to institute an internal body of the DGAAP known as the Italian Council, provided with public resources and private funding, with the precise role, through the publication of competition briefs, of promoting the production, awareness and circulation of contemporary Italian creativity in the visual arts, in order to continue to increase public collections; CONSIDERING that art. 3 of law n. 29 from 2001 instituted the Plan for Contemporary Art with the objective of... consenting an increase in the public heritage of contemporary art, also through the acquisition of works of art by Italian and foreign artists ; GIVEN the opinion expressed by the Legislative Office in note n. 23777 dated 8 August 2016, according to which the Italian Council project may also receive financial resources under chapter 7707 PG 13 relative to the Plan for Contemporary Art cited in art. 3, c. 1of Law 23 February 2001 n. 29, under the condition they are directed toward increasing the public heritage of contemporary art, as expressly requested by the aforementioned legislation and that they are not used exclusively for purposes of promotion and valorisation.

Ministero dei beni e delle attività culturali e del turismo DIREZIONE GENERALE ARTE E ARCHITETTURA CONTEMPORANEE E PERIFERIE URBANE CONSIDERING that, in light of the abovementioned opinion, in addition to the resources assigned to the DGAAP by Ministerial Decree 4 January 2017 administrative codice azione 2 chapter 7707 PG 13, the use of other financial resources is not excluded, such as those assigned in the same chapter on PG 10, PG 11 and PG 12 and administrative codice azione 3 chapter 7709 PG 1; CONSIDERING that the line of private financing for the unrestricted provision of funding, or sponsorships via public museums will follow, respectively, the procedure described in art. 1 of Legislative Decree 31 May 2014 n. 83 (Art Bonus) converted into Law n. 106 dated 29 July 2014 and art. 19 (Sponsorship Contracts) and art. 151 (Sponsorships and Special Forms of Partnership) of Legislative Decree 18 April 206 n. 50; HAVING ACQUIRED a positive opinion on the initiative from the Consiglio Superiore during its 14 November 2016 sitting; GIVEN Law n. 232 dated 11 December 2016 art. 1 commas 587 & 588 that, as foreseen by the Ministry of Foreign Affairs and International Cooperation, institutes a fund for the promotion of Italian culture and the Italian language abroad; The following articles are established pursuant to the above REGULATION Art.1 Italian Council The present regulation disciplines the Italian Council, a project by the DGAAP, created to promote the production, awareness and circulation of contemporary Italian creativity in the visual arts. Art.2 Objectives The Italian Council project supports and promotes subjects operating in the contemporary arts in all of its many and variegated expressions, operating in collaboration, based on successive agreements, with the Ministry of Foreign Affairs and the international network of Italian Institutes of Culture around the world. Art.3 Methods of Implementation The Italian Council project will be implemented through public competitions announced by the DGAAP, in a minimum number of two and a maximum number of four, each year, and examined by a Committee as described under the following article 4. Art. 4 Committee The Committee, with an elevated scientific profile, consists of the President, directly named by the sitting General Director, by one member ex-officio in the person of the sitting President of the Technical- Pagina 2 di 5

Ministero dei beni e delle attività culturali e del turismo DIREZIONE GENERALE ARTE E ARCHITETTURA CONTEMPORANEE E PERIFERIE URBANE Scientific Committee for contemporary art and architecture and by other members, widely recognised for their work in relation to the visual arts and/or the management of Cultural Heritage. The Committee will be nominated, after speaking with the Minister, in a Decree issued by the General Director AAP, for a period of three years, with the possibility for only one term of reconfirmation. The Committee is responsible for: - establishing annual guideline themes; - approving the annual competitions and their relative criteria of evaluation; - evaluating proposals received. The members of the Committee are asked to fulfil their roles free of charge, with an entitlement solely to the reimbursement of travel expenses, upon receipt of suitable documentation and within the limits of expenditure foreseen by applicable legislation and annually available resources. The members of the Committee will be asked to declare, as per art. 1 comma 9 letter a) of Law 6 November 2012 n. 190, that there is no conflict of interest with the results of each competition. Secretarial functions are performed internally by the Directorate-General. Art.5 Financing The Italian Council project will be served by public and private financial resources. Public financing will be provided from the resources assigned to the DGAAP by Ministerial Decree 4 January 2017, administrative codice azione 2, chap. 7707, PG 13 for the entire quota issued to the DGAAP, including propaedeutic and management activities (art. 3 L. 23/02/2001 n. 29). The Italian Council project may also draw on financing assigned to the DGAAP by Ministerial Decree 4 January 2017, administrative codice azione 2, chap. 7707, PG 10, PG 11 and PG 12 and administrative codice azione 3, chap. 7709, PG 1. With regards to private financing from unrestricted funding, or sponsorships, via public museums, the Italian Council project will follow, respectively, the procedure described in art. 1 of Legislative Decree 31 May 2014 n. 83 (Art Bonus) converted into Law n. 106 dated 29 July 2014 and art. 19 (Sponsorship Contracts) and art. 151 (Sponsorships and Special Forms of Partnership) of Legislative Decree 18 April 206 n. 50; Art.6 Beneficiaries For the objectives of the Italian Council project as per art. 1 of the present Regulation, the beneficiaries of competitions for the issuance of public funding are: artists, curators and critics, though only when in possession of the requisites indicated in each competition brief; public and private non-profit entities, universities, no profit foundations and committees and cultural associations. Art. 7 Procedural Guidelines The following procedure will be used for public financing from the quota of resources as per administrative codice azione 2, chap. 7707, PG 13: - issuance of a competition brief by the DGAAP; - receipt of projects; - examination of projects received by the Committee; - identification of winning subjects and issuance of a Decree from the General Director; - forwarding of the Decree to controlling bodies; - positioning of the work of art that, as per L. 23/02/2001, n. 29, art. 3, will consent an increase in the public heritage of contemporary art, also through the acquisition of works of art by Italian and foreign artists, and as per the content of the opinion expressed by the Legislative Office (note prot. 278 dated 26/01/2017), provided to: State Museums of Contemporary Art, Italian Cultural Institutes outside of Italy, civic museums.
