I. BACKGROUND The City of Lynwood is approximately 5 square miles, within Los Angeles, California with a current population of 69,899. The community is located between two major freeways, Interstate 710 and Interstate 105, making the City accessible to major airports. Lynwood is approximately 14 miles from the Los Angeles International Airport and nine miles from the Long Beach Airport. Since Lynwood s incorporation in 1921, it continues to move forward on a path of progress. Operating as a General Law City, Lynwood is governed by a five-member City Council, which sets policy under the Council-Manager form of government. The City of Lynwood is a participating jurisdiction under the United States Department of Housing and Urban Development s (HUD s) Community Development Block Grant (CDBG) Program and HOME Investments Partnership Program (HOME). As a recipient of formula funds under HUD programs, the City is required to submit a 5-year Consolidated Plan (ConPlan), Annual Action Plans (AAPs), and Consolidated Annual Performance and Evaluation Reports (CAPERs). ConPlan requirements are enacted through 24 CFR 91 and regulates the formula grant funding intended to provide decent housing; a suitable living environment, and expand economic opportunities for primarily, low to moderate income persons. The ConPlan is the City s strategic plan for addressing the City s priority housing and community development needs over a five-year period. The ConPlan is based on community participation, a public consultation process with residents and local stakeholders, needs assessments and public hearings. In addition to the administration of the CDBG and HOME, applicants of other HUD funding sources are required to certify with the City that their application to HUD is consistent with the local consolidated plan. The Annual Action Plan (AAP) is adopted prior to the beginning of each fiscal year and identifies the programs and funding the City plans to implement in conformance with its Consolidated Plan. The Consolidated Annual Performance and Evaluation Report is completed at the end of each year and reports on the City s progress in implementing the Strategic Plan of the Consolidated Plan and the AAP. All these reports must be prepared and submitted to HUD in compliance with HUD regulations using HUD s Integrated Disbursement and Information System (IDIS). The City wants to engage a consultant to explore eligible areas of the City and the benefits of developing a strategy. As a HUD grantee, the City also must conduct an Analysis of Impediments to fair housing choice to meet the City s obligations to affirmatively further fair housing. 1

II. PURPOSE The Consolidated Plan examines the housing needs of low income persons and other special populations; the current housing market conditions; and the economic and community development needs gathered during a collaboration and coordination process. Priorities, goals, and measurable outcomes are established based upon the needs derived from the collection and analysis of the information gathered. The priorities, goals, and objectives set forth in the ConPlan are actionable and provide direction for annually appropriating entitlement grant funds. Entitlement program funds are appropriated in the Annual Action Plan to programs and activities that meet the ConPlan goals. There are five Annual Action Plans that will be administered under the 2015-2020 Consolidated Plan. Preparing the first Annual Action Plan is a part of the scope of services under this request for proposals. The Analysis of Impediments (AI) to Fair Housing Choice must be conducted at the beginning of each five-year ConPlan cycle. The AI should include an action plan listing the initiatives that the City will undertake to overcome the effects of identified impediments. Proposals are requested from qualified firms or individuals with proven experience in developing Consolidated Plans, Annual Action Plans, fair housing, and/or other strategic planning documents. The ConPlan and AI will cover the period of July 1, 2015 through June 30, 2020. The Annual Action Plan will be for the period of July 1, 2015 June 30, 2016. In addition to meeting the federal requirements and deadlines, the City of Lynwood is encouraging meaningful public participation in the AI, and ConPlan processes. The selected consultant will be expected to confer with a broad spectrum of public and private agencies that provide subsidized and assisted housing, health, employment and social services to low to moderate income persons, seniors, homeless, female heads of households, and disabled persons. The resulting reports should provide a direct link between community goals and objectives, priority needs and include clear actionable direction for implementing the ensuing one-year action plans. 2

III. IV. CITY OF LYNWOOD RESPONSIBILITIES City of Lynwood staff will be available to coordinate activities with the consultant. The selected consultant should prepare the proposal with the assumption that it will have primary responsibilities for activities such as gathering and updating demographic data, coordinating meetings with representatives of target groups, public and private consultation with agencies, and development of strategies. City of Lynwood staff will assist with identifying resources, strategies, and stakeholders. City staff will arrange meetings with elected public officials, schedule public hearings, prepare public notices and agenda reports, and review draft plans in a timely manner. V. CONSULTANT RESPONSIBILITES The selected consultant should prepare the proposal with the assumption that it will have primary responsibilities for coordination of activities, technical data gathering, surveys, analysis, maps, conclusions and optional actions that may be undertaken by the City. The selected consultant will be responsible for carrying out all aspects of the development of the Analysis of Impediments, Consolidated Plan and Annual Action Plan in accordance with the Scope of Services described below. In addition to the citizen participation and consultation process, the selected consultant may be required to attend public meetings / hearings as part of performance duties for the analysis of impediments, and consolidated planning process. VI. SCOPE OF SERVICES The City of Lynwood s completed consolidated plan and annual action plan will follow regulations set forth by Title 24 CFR Part 91 et seq., and in accordance with instructions, notices, and guidelines prescribed by HUD, including tables and narratives. Specifically, a consultant will be selected to prepare the following documents: Analysis of Impediments to Fair Housing Choice 2015-2020 Consolidated Plan FY2015-16 Annual Action Plan The scope of work to be performed by the consultant for the development of an Analysis of Impediments to Fair Housing Choice in accordance with HUD requirements and guidance is as follows: Comprehensively review the City s 2005 and 2010 Analysis of Impediments (AI) documents. Work cooperatively with area fair housing organizations in the implementation of audits (fair housing testing); collection of data, and any necessary information to complete the IA. 4

Work cooperatively with the City of Lynwood and regional groups to collect and analyze data. Involve the general public, community-based organizations, housing providers, realtors, lenders, community planning officials, and any other participants necessary to produce the AI. Inclusion and development of tabular data maps indicating concentrations of minority residents, residents living in poverty, availability of public transportation, lending rates (HMDA data), Section 8 rental assistance, groups homes, and other information required in the Fair Housing Planning Guide issued by HUD. Development and inclusion of conclusions and recommendations for a proposed Action Plan. Information and analysis of the effects of: a. Building, occupancy and health and safety codes on housing choice, and the b. use of accessibility standards in local construction. c. Applicable zoning and land use laws and policies that place restrictions on d. group homes. e. Policies concerning the application of local neighborhood or site standards f. on new construction especially assisted housing development. g. Policies and practices that connect transportation and available social services with housing opportunities. h. Policies and practices that affect the equal provision of governmental services. i. Policies concerning activities causing displacement, which may affect opportunities to select housing inside and outside areas of minority concentration, or housing which is accessible. j. Policies and practices that affect the representation of minorities and disabled on the planning commission. k. Policies and practices of the local housing authority and other housing assistance providers with respect to applicant selection, landlord outreach, l. reasonable accommodation, and delivery of services. m. Policies and practices regarding the sale and rental of real estate, such as steering or blockbusting, all adult issues, deed restrictions, inaccessible design, local occupancy standards and practices, local lending practices, n. real estate appraisal practices, insurance underwriting practices, and segregated housing conditions. o. Assist City staff with two community meetings (these meetings should be combined with ConPlan meetings). p. Deliver a final original and five copies of the AI along with a MS Word version on compact disc. 5

q. Provide a resource binder to include, at a minimum, a list of data sources, copy of data collected, consultations, records, and any other supporting documentation used to develop the AI. r. Assist staff with developing a system to track and document the actions taken to eliminate identified impediments. The scope of work to be performed by the consultant for the development of a 2015-2020 Consolidated Plan and FY2015-16 Annual Action Plan in accordance with HUD requirements is as follows: 1. Prepare a Consolidated Plan and Annual Action Plan which addresses each required element pursuant to federal regulations and follows the guidelines established by HUD. 2. Perform relevant consultations and data collection to complete the required HUD tables and the analysis of housing and non-housing needs. 3. Perform a community needs assessment as necessary to develop new strategies, goals, and priorities. 4. Prepare an Executive Summary for the Consolidated Plan. 5. Assist City staff with development of new strategies, objectives, priorities, and programs for inclusion in the Consolidated Plan. 6. Develop and incorporate a performance measurement component as required by HUD regulations. 7. Conduct consultations with private agencies, public agencies, and community groups as required. 8. Assist City staff with the following: - Conduct no less than two (2) community meetings. - Develop and circulate one (1) community survey. - Complete other additional specific actions as required by HUD. - Prepare draft and final plans in IDIS using HUD s templates. - Provide a resource binder to include, at a minimum, a list of data sources, copy of data collected, consultations, records, and any other supporting documentation used to develop the Consolidated Plan and Annual Action Plan. - Assist staff with responding to HUD questions or issues throughout the HUD approval process. VII. FIXED FEE SCHEDULE FOR SCOPE OF SERVICES Your proposal must include your fee for the completion of each major task using the chart provided in the Forms section of the RFP. The rate shall be all inclusive with no extra charges for travel, meetings, document preparation, training, employee compensation, etc. Unless otherwise indicated, the rate should be a flat rate for each task, not an hourly rate. 6

VIII. PROPOSAL FORMAT AND CONTENT All valid proposals shall include the following information: Completed Questionnaire Fee Schedule Signed Certification & Noncollusion Affidavit forms A summary of approach that will be used to perform the scope of work outlined above. Include a description of the proposed work plan with a timeline for each phase of the work plan. Brief explanation on the consultant s ability to adhere to a strict timeline, which may be required to meet HUD s submittal deadline. Description of your firm s knowledge and experience in preparing Consolidated Plans, Annual Action Plans, Analysis of Impediments, Strategic Plans, and/or other related planning and fair housing documents. Identify all personnel that will be assigned to work on the project. Provide their qualifications, relevant experience, and time they will be assigned to specific project tasks and the project overall. Include any experience drafting plans in IDIS. Provide a list of at least three (3) public agencies, including the contact person s name and a phone number, for which similar or relevant work projects have been completed and ultimately approved by HUD within the last five years. GUIDELINES & GENERAL CONDITIONS Proposals may be withdrawn at any time prior to the Submittal Date. Revised proposals may be resubmitted up until the Submittal Date. No proposal may be submitted or withdrawn after the Submittal Date. Firms are advised to become familiar with all conditions, instructions, and specifications of this contract. Once the award has been made, a failure to have read the conditions, instructions, and specifications herein shall not be cause to alter the terms of the contract or for the selected firm to request additional compensation. The selected firm will be responsible for complying with all conditions of this RFP and any all subsequent formal agreements. All responses provided should be as detailed as possible to provide the proposal evaluators with enough information to make a fair assessment of the firm s services. 7

The selected firm will be required to enter into the City s standard Professional Services Agreement. The City may award a contract to the most qualified firm in accordance with the provisions of the Lynwood Municipal Code. The City reserves the right to accept any proposal or part thereof. The City may reject all proposals and reissue this request. The City is neither obligated to award a contract following proposal evaluation, nor to pay any costs incurred by participants in the selection process. The City may change or modify any of the criteria and information set forth herein without notice. Issuing Officer The Request for Proposal is issued by the City Manager of the City of Lynwood. Receipt of Proposal Proposals shall be time stamped when received and will be accepted up to and no later than the time indicated in the Request for Proposal. All proposals received after the time stated above will not be considered and will be returned to the proposer. The proposer assumes the risk of any delay in the mail or the handling of the mail by employees of the City. Whether sent by mail or by means of personal delivery, proposers assume responsibility for having proposal deposited on time at the place specified. Proposal Signature If the proposal is made by an individual, it shall be signed and full name of proposer with complete address shall be given; if made by a firm, it shall be signed with the copartnership name by a member of the firm who shall sign name and the name and address of each member shall be given; and if it is made by a corporation, the name of the corporation shall be provided and signed by its duly authorized officer or officers attested by the corporate seal, and the names and titles of all officers of the corporation shall be given. Economy of Preparation Proposals should be prepared simply and economically, providing any deviation from specifications. Issuance of the Request for Proposal does not commit the City to award any contract. The City shall not be liable for any costs incurred in response to this request for proposals, including any pre-contract interviews or meetings. All costs shall be borne by the person or organization responding to the request. The person or organization responding to the request shall hold the City and its employees harmless from any and all liability, claim or expense whatsoever incurred by or on behalf of that person or organization. 8

Interpretation of Proposal Documents Should a proposer find discrepancies in, or omissions from the specifications, or should proposer be in doubt as to their meaning, proposer shall notify the City immediately. Should it be found necessary, a written addendum will be sent to all proposers. Addenda issued during the proposal period shall form a part of the contract and shall be included with the proposal. Addenda to the Request for Proposal The City reserves the right to make such changes in the Request for Proposal, as it may deem appropriate. Any and all changes in the Request for Proposal shall be made by a written addendum, which shall be issued by the City to all prospective proposers who have been issued or obtained a copy of the Request for Proposal. No oral changes will be permitted. Addenda issued during the proposal process shall become a part of the original proposal. Compliance with Laws The proposer shall comply with all applicable laws, ordinances, and codes of the State of California and U.S. Department of Housing and Urban Development (HUD) and the policies of the City of Lynwood, all regulations and rules relating to affirmative action, and shall commit no trespass on any public or private property in performing any of the work embraced by this contract. Responsibility for Compliance with Legal Requirements Successful proposers shall be in full compliance with all applicable Federal, State and local regulations, standards, and ordinances, regardless of whether or not they are referred to by the City. Supplements to Request for Proposal If the evaluation of any proposal indicates minor noncompliance or variance with the Request for Proposal, the City may, but need not, make written request to the proposer for a supplement to the submitted proposal. Such request will attempt to identify the noncompliance or variance, and will establish a date by which the supplement to the Request for Proposal shall be submitted. If so requested, the proposer may submit a supplement to the Request for Proposal responsive to such request, within the time period established, which the City will evaluate in conjunction with the Request for Proposal. Any supplement to the Request for Proposal will be deemed to be an integral part of the proposer s submittal. 9

Evaluation Upon receipt of proposals, the City will evaluate all proposals to determine whether proposals are acceptable based on the criteria established in the Request for Proposal. Validity Period The Request for Proposal shall be considered valid for a period of 90 days after the due date and shall contain a statement to that effect signed by an officer of the firm authorized to bind firm for this period. Public Record After the award of the contract has been made by the City Council or appropriate staff, all findings and information considered in determining which proposal best meets the needs of the City and will be most advantageous with respect to price, conformity to the specifications and other factors will be made available for public inspection. Time of Delivery Time of delivery is a part of the consideration and must be stated in definite terms. Proposals are subject to acceptance any time within 90 days after opening unless otherwise stipulated. Interest of Member of the City No member of the governing body of the City of Lynwood, and no other officer or employee of the City who exercises any functions or responsibilities in connection with carrying out this project to which this proposal pertains, shall have any personal interest, direct or indirect, in this contract. Interest of Proposer The successful proposer covenants that it presently has no interest and shall not acquire any interest, direct or indirect, in the City or any other interest which would conflict in any manner or degree with the performance of this contract, and no person having any such interest shall be employed. Penalty for Collusion If at any time it shall be found that the person, firm or corporation to whom a contract has been awarded has, in presenting any proposal, colluded with any other party or parties, then the contract so aware shall be null and void. The contractor and the contractor s bonding company shall be liable to the City for all loss or damage that the City may suffer thereby. The City may advertise for a new contract for said services. 10

Project Organization The successful proposer must provide a project manager to act as a liaison with City staff, who will coordinate written reports and see the project through to satisfactory conclusion. City staff shall be responsible for the direction, review and approval of all work. Execution of Contract The proposer to whom award is made shall execute a written contract with the City on the form of the agreement provided, and shall secure all insurance and bonds required by the City within ten (15) days from the date of the award. Failure or refusal to enter into a contract as herein provided, or to conform to any of the stipulated requirements in connection therewith, shall be just cause for the annulment of the award. Award shall then be made to the next proposer as determined by the City and that firm shall fulfill every stipulation as if it were the party to whom the first award was made. Findings Confidential Until such time that the City Council awards the contract, all reports, information, data, etc., prepared or assembled by the proposer under this proposal are confidential and the proposer agrees that such proposal shall not be made available to any individual or organization without the prior written approval of the City. Changes The City may require changes in the scope of the services to be performed by the contractor hereunder. All such changes, which are mutually agreed upon by and among all the parties, shall be incorporated in written amendments to this contract. All such amendments shall state any increase or decrease in the amount of the compensation due the contractor for the change in scope. Additions/Deletions of Service The City reserves the right to add and/or delete services to this contract. Should a service requirement be deleted, payment to the contractor will be reduced proportionally to the amount of service reduce in accordance with the proposal price. Should additional services be required from this contract, prices for such additions will be negotiated between the contractor and the City. Incorporation of Proposal into the Contract The contents of this proposal and the selected firm s response are to be incorporated, in total, into the contract. 11

Amendments All amendments to this contract must be in writing and signed by both parties. Contract Compliance Monitoring City staff shall monitor the contractor s compliance with, and performance under, the terms and conditions of the contract. The contractor shall make available for the inspection and/or copying by the City all records and accounts relating to the work performed or the service provided under this contract. Contractor s Responsibility The contractor shall be responsible for any damages whatsoever to City Property as applicable when such property is the responsibility of or in the custody of the contractor, his/her employees or subcontractors. Disputes In the event a dispute arises concerning any matter under the contract, the party wishing resolution of the dispute shall submit a request in writing to the City Manager. The City Manager shall consider the request and respond within ten (10) days giving his or her findings and the reasons for the findings. Any party dissatisfied with the findings of the City Manager may appeal to the City Council in any objection. The City Council shall consider any matter appealed at a hearing within thirty (30) days. The decision of the City Council shall be final upon matters of fact unless clearly erroneous or procured by fraud. Rejection of Proposals The City reserves the right to reject any, or any part of a proposal, to waive any informality in the proposal and to select the services, which shall be deemed in the best interest of the City. It shall be emphasized that award of contract will not necessarily be based on price alone, but rather on a combination of qualifications, price, services, references, and responsiveness to the proposal specifications. Proposers Interested in More than One Proposal More than one proposal from an individual, firm, partnership, corporation or association under the same or different names will not be considered. Reasonable grounds for believing that any proposer is interested in more than one proposal for the work contemplated will cause the rejection of all proposals in which such proposer is interested. If there is reason for believing that collusion exists among more than one proposer, all proposals will be rejected, and none of the participants in such collusion will be considered in future proposals. 12

A person, firm or corporation who has submitted a sub-proposal or who has quoted prices on materials to a proposer is not thereby disqualified from submitting a proposal or quoting prices to other proposers. Permits, Regulations, and Ordinances The successful proposer shall give all notices necessary in connection with the performance of the contract, shall secure and pay for all necessary licenses and permits to do the work and shall comply with all laws, ordinances, rules and regulations, bearing on the conduct of the work. Any work performed that does not conform to said laws, ordinances, rules and regulations shall be changed to conform thereto by the contractor at his sole expense. X. EVALUATION CRITERIA & SELECTION PROCEDURE Proposals will be ranked based on the following criteria: 1. Experience with fully preparing and successfully submitting HUD approved Strategic Plans, Consolidated Plans, Analysis of Impediments, and/or other required documents. 2. Relevant qualification of personnel. 3. Cost estimate. 4. Information obtained from references and firm s reputation. 5. Overall approach to preparation of documents and public outreach. 6. Familiarity with applicable local, state, and federal laws. 7. Responsiveness to this RFP and ability to satisfy HUD s submittal deadlines and requirements. A materially incomplete or non-responsible proposal will be rejected. A proposal evaluation committee comprised of City staff will review each proposal. The most qualified firm(s) may be invited to participate in an interview with City staff to review qualifications prior to selection. Therefore, the award of the contract could be as much as three months after the RFP submission deadline. Final selection will be contingent upon approval of a sufficient budget for this project and City Council approval. Therefore, the Consultant shall be bound by its proposal for a period of 90 days commencing August 25, 2014. 13
