Labor Options LOCAL Interstate Agricultural Job Order H2A Intrastate

Agricultural Recruitment System & H-2A LOCAL INTRASTATE INTERSTATE H2-A The ARS system can function by itself, but the H2-A program relies on outcomes from ARS.

Agricultural Recruitment System What is it Helps agricultural employers recruit qualified workers on a temporary or seasonal basis. Provides workers seeking temporary agricultural employment with opportunities for such employment. The Wagner-Peyser Act provides authority for the ARS (20 CFR 653.500-653.503) How it works Local Intrastate Interstate

H2A Program What is it The H2A program allows agricultural employers to bring in foreign labor where there is a lack of available workforce. The Agricultural Services unit processes these temporary alien certification requests in NC. Agricultural Services staff provide training as well as updates to the H2A process to employers and local workforce office staff. Assist growers and Farm Labor Contractors with questions concerning the various farm labor rules and regulations. The Fair Labor Standards Act (FLSA) The Migrant and Seasonal Agricultural Worker Protection Act (MSPA) Housing Regulations Wages Field sanitation standards Child Labor Laws Record Keeping

Register Farm Labor Contractors Before performing any farm labor contracting activity, farm labor contractors must register with the U.S Department of Labor (DOL) and obtain a certificate of registration. If farm labor contractors intend to provide housing or transportation, then they must register to request the following: Driving Authorization Transportation Authorization Housing Authorization Applications for registration can be made at workforce offices of the NC Department of Commerce/Division of Workforce Solutions No cost registration.

Provide Outreach Services to Migrant and Seasonal Farm Workers (MSFW) Assist farm workers by locating agencies that can provide them with services that they may need. Help agencies that offer assistance to the agricultural community locate people who can utilize their services. Coordinate services with other supportive services agencies.
