According the Minnesota Statutes, Chapter 429, a resolution by the City Council is required to order the Feasibility Report. Therefore, in order to fulfill the legal requirements of a 429 Project, Resolution 2012-40 needs to be adopted. Recommendation: A motion to adopt Resolution 2012-40, a resolution ordering a feasibility report for the 2013 Year-One Mill and Overlay Project.

Chapter 20 of the City Code pertains to fees charged by the city for services and licenses provided. STAFF MEMO City Council City of Norwood Young America To: From: CC: Honorable Mayor Diedrick and Members of the City Council Chelsea Alger, Community Development Director Tom Simmons, City Administrator Diane Frauendienst, City Clerk/Treasurer Date: October 22, 2012 Agenda Item: Reduced Trunk Fee Incentive for Oak Lane Annexation Properties Requested Action(s): A motion to approve reduced water and sewer trunk fees for Oak Lane Annexation Properties through 2014 Background: Annually for the last three years the City Council has considered and approved reduced water and sewer trunk fees for new residential construction as a development incentive. At a previous Council meeting it was discussed as to whether this would apply to the residents on Oak Lane who will be annexed as part of the Orderly Annexation Agreement with Young America Township, effective January 1, 2013. Part of the agreement allows the residents to wait up to 10 years to connect to the City s sewer and water, paying the required connection fees that pertain to the time in which they connect. Though the Council may consider extending this trunk fee reduction incentive again, Staff would like to provide the Oak Lane residents some incentive to consider connection to sewer and water earlier rather than later in the 10 year time frame. As such, it would be recommended the Council consider allowing Staff to offer this reduction to Oak Lane residents through 2014 (two years from the date of annexation) if they connect in that time period. After that time their ability to capture reduced rates would be dependent on whether the Council chooses to continue offering the incentive. Staff is currently drafting a letter to the residents, as a reminder of the upcoming annexation and would like to provide this incentive as part of the letter if approved by the Council, inclusive of the following language: As part of the approved resolution you have up to ten (10) years from this date to connect to the City s sewer and water system. Fees associated with the connection will be charged pursuant to the fee schedule in place at the time of connection and the Schedule of Availability Charges spreadsheet for SAC and WAC fees. Should you decide to connect by December 31, 2014 the City is offering a reduced rate on the water and sewer trunk fees, which would equate to a total savings in 2013 of $3,650 off of connection charges. Recommendation: A motion to allow for reduced water and sewer trunk fees ($2,000/each) to Oak Lane residents through December 31, 2014. Attachments: None

City of Norwood Young America DATE: October 22, 2012 TO: FROM: Re: Honorable Mayor Diedrick and Members of the City Council Diane Frauendienst, City Clerk 2 a.m. Closing License for the Pour House Ryan Finnerty and John Barnes, owners of The Pour House Pub LLC, have submitted an application for an Optional 2 a.m. Closing liquor license. The applicant has submitted the proper documentation including the signed application and the applicable fees. The City Council is asked to approve the license application. Once the council has approved the license, the information will be forwarded to the State of Minnesota Liquor Control Board for approval. Lastly, the City issues the license. This license will be for the period from when the State of Minnesota approves the license until June 30 th, 2013. The applicant will need to renew the license in June 2012. The city license fee for a 2 a.m. closing license is $500, the applicants will be at the meeting to answer questions regarding the application and to request the council prorate the license fee to reflect the length of the license. Recommendation: A motion approving the Optional 2 a.m. closing liquor license for The Pour House Pub at 325 Elm Street West, and prorate the $500 license fee to $333.33 to reflect the license period.
Memorandum To: Mayor and City Council CC: Tom Simmons, City Administrator From: Christie Rock, Economic Development Coordinator Date: 10/16/2012 Re: EDC / Chamber of Commerce request for additional MNDOT way-finding signage The Norwood Young America Chamber of Commerce and the Norwood Young America Economic Development Commission are asking the Norwood Young America City Council for permission to file an appeal / variance request with the Minnesota Department of Transportation (MNDOT) to allow for additional way-finding signage on U.S. Highway 212 to direct motorists to the community s north business district. Current MNDOT policy allows a city to sign only one business district, the city s primary business district. The city of Norwood Young America already has way-finding signage on U.S. Highway 212 directing motorists to the south business district. MNDOT conducted a field investigation in Norwood Young America this past summer. During the investigation process, MNDOT concluded that there is room for additional way-finding signage for the north business district at Tacoma Avenue and Faxon Road; however, in order to get permission to install the signage, the city must go through the variance process. The MNDOT field investigation also revealed that the city has way-finding signage on Highway 5 directing motorists to the north business district; however this signage violates MNDOT policy and will likely be removed, pending the outcome of the variance process. Without a variance, the city will need to choose which business district it would like to sign, the north or the south. Finally, the MNDOT field investigation discovered that the existing way-finding signage for the south business district is smaller than what current MNDOT policy allows. The city can pay to replace the current signs with larger signs without pursuing a variance. Attached please find a letter to Tiffany Kautz at MNDOT Traffic Engineering, which would start the variance process. If the variance request receives approval from MNDOT staff, the city will have the opportunity to appeal MNDOT s way-finding signage policy to the External Sign Variance Committee. 1
October 16, 2012 If the External Sign Variance Committee grants approval of the city s request, and MNDOT staff does not overrule the variance committee, the total cost to replace the existing way-finding signs on Highway 212 and Highway 5 with larger signs, as well as the cost for the additional north business district way-finding signs on Highway 212 would be $6,282.50. If the City Council decides not to proceed with the variance request, the cost for replacing the existing south business district way-finding signage on Highway 212 with larger signs would be $2,061.60. Recommendation: Three possible options 1. Motion to approve submitting the variance request letter to MNDOT with the understanding of the total cost to add and replace signs. 2. Motion to deny submitting the variance request letter to MNDOT, but approving the replacement of the south business district way-finding signs with larger signs. 3. Motion to deny submitting the variance request letter, and no replacement of the south business district way-finding signs at this time. 2
October 22, 2012 Ms. Tiffany Kautz, PE Minnesota Department of Transportation Metro District Traffic Engineering 1500 County Road B2 Roseville, MN 55113 RE: City of Norwood Young America way-finding signage variance request Dear Ms. Kautz: We are writing to you on behalf of the Norwood Young America Economic Development Commission and the Norwood Young America Chamber of Commerce. The EDC and the Chamber have asked us to appeal to the Minnesota Department of Transportation to allow for additional way-finding signage on Highway 212 for the city s north business district. MNDOT s sign policy only allows a city to have way-finding signage for one business district. The city of Norwood Young America currently has way-finding signage for the south business district on Highway 212 at Reform Street and Morse Street, and the north business district on Highway 5 at County Road 34. The EDC and the Chamber are requesting additional way-finding signage for the north business district on Highway 212 at Tacoma Avenue and Faxon Road. According to a field investigation conducted by MNDOT this past summer, there is room for wayfinding signage at both of these locations. We are appealing to you on behalf of the NYA EDC and the NYA Chamber of Commerce to break from MNDOT policy and allow the city of Norwood Young America to have way-finding signage for both its north and south business districts on Highway 212. In addition, the City would like to retain the existing north business district way-finding signage on Highway 5. The city of Norwood Young America s situation is unique to any community in Minnesota. The cities of Norwood and Young America merged in 1997; creating a new community with two downtown business districts. Unlike many small cities in Greater Minnesota that have a State or County highway serving as main street; Highway 212 divides the city of Norwood Young America in half, thus creating many challenges and hardships for the city s downtown business districts. Many typical main street businesses have moved to the highway (i.e. the local banks, post office, hardware store, etc ), due in part to increased visibility, but also because of a lack of signage directing travelers to the two downtown business districts. The EDC and the Chamber are hopeful that the additional signage will direct more travelers on Highway 212 to the north business district to help support the businesses that are there, as well as spur new business activity. To: Mayor and City Council From: Tom Simmons City of Norwood Young America Cc: Diane Frauendienst and Chelsea Alger Date: 10/22/12 Re: Authorize Purchase of Ford 550 Pickup The Public Works Department is requesting authorization to purchase a demo 2012 Ford 550 pickup to replace their present 2001 Ford 350 pickup. The 2001 pickup is scheduled to be replaced in 2012 and this vehicle is one of the few Capital Improvement items which received funding in 2012 through the Special Capital Projects fund. The purchase of this vehicle was discussed with the city council in 2011 in workshops for setting the 2012 budget and also this year in budget workshops. Presently we have budget reserves of $57,328 to cover the cost of a replacement vehicle. The cost of the demo 2012 Ford 550 pickup is $54,573. Because there is not much trade-in value for the 2001 pickup, we would try to sell it at a Fahey s consignment auction, where we have had good luck in the past. Recommendation: A motion to authorize the purchase through the Minnesota State Bid Program of a demo 2012 Ford F 550 pickup from Midway Ford Commercial at a total cost of $54,573.88 including sales tax & license. Funding to come from the Street Department Capital Improvement Plan, Line Item Pickup 350 (Replace 2001).
