RESOLVED: That the apologies are received. The minutes were taken as read. (Josie Scott/Maria Horne) Carried RESOLVED: To accept the Annual General Meeting minutes of 16 September 2012 as a correct record of that meeting. (Norma Sturley/Veronica Butterworth) Carried No matters arising. Anaru Te Amo read out his Chair Report on page eight of the Annual Report and made a specific mention to both Paul Tapsell and Larissa Wharepouri for all the work they have put into the cross claim issues. RESOLVED: The Chair Report be accepted. (Josie Scott/Betty Herewini) Carried Maru Tapsell mentioned the Rakitu claim on behalf of Tunohopu and the difficulty in applying for legal aid through OTS. He is unhappy with the objections taken with Ngai Te Rangi who are now claiming into Maketu. Larissa Wharepouri provided clarification on Ngati Whakaue s position in regards to Ngai Te Rangi. Both parties have met and agreed to certain clauses however OTS have not been forthcoming in recording the agreement. Komiti Nui is working through this process with OTS and Ngai Te Rangi. Tony Wihapi referred to page eight of the Annual Report regarding the Communications sub-committee and its function. He believes there are too many sub-committees. Komiti Nui said they would update the website on where the negotiations are at but instead the AGM should be a forum to update the people. He mentioned his concerns Annual Report 2014 3
with only having 759 registered members as the level of recognition from OTS will be given based on the level of registered members. He was also concerned to hear that Rakitu are representing themselves. He queried why the same trustees are on the sub-committees. Tony would like to add Rakitu and the Tuhono database as special items for discussion later in the hui. Hoki mentioned the difficulty in accessing the Tuhono database and Pauline mentioned that there is still a process to go through to ensure we have the permission of those registered with Tuhono. Financial Statements Glenn Hawkins presented the financial statements for the year ended 31 March 2013. 31 March 2013 He confirmed that the audit was completed by Iles Casey and a clear audit opinion had been achieved. Glenn confirmed that income of $447,012 was received from CNI Iwi Holdings Ltd being the annual rental. Previously, Ngati Whakaue Tribal Lands gave $60,091 for the purpose of communications of which the remaining $15,445 has been spent in this year. Interest received on term deposits was $13,880. Glenn gave an overview of the expenses and mentioned that the majority of legal fees were related to settlement issues of which are exempt activities and are subject to tax. The overall result for the year was a net profit of $191,925. A distribution of all surplus funds has been made to the Assets Trust, this includes $33,586.87 of Maori Authority Tax Credits still to be claimed. Glenn detailed the statement of financial position and noted that the Net Assets was $4,525. For clarification, the funding has come from CNI Iwi Holdings Ltd as being the annual rental. These funds are used for operational purpose with the balance at the end of the financial year being paid to the Assets Trust for tax purposes. OTS Funding of $945,000 has been committed to assisting Ngati Whakaue with their comprehensive settlement. Komiti Nui has received $108,404 for the first milestone, the deed of mandate and is in the process of Terms of Negotiation (TON). On finalisation of the TON, a second milestone payment will be made and so on. Ana Morrison asked if the OTS funding was free money. Anaru said that it was. Tony commented on the level of trustee fees and requested better accountability and drive to increase the registration base. RESOLVED: To accept the financial statements for the year ended 31 March 2012. (Wiremu Keepa/Meteria Clarke) Carried RESOLVED: To re-appoint the auditors Iles Casey, Chartered Accountants. (Monty Morrison/Pauline Tangohau) Carried General Business Hoki referred back to the Rakitu discussion and mentioned that Hamu Mitchell and John Kahukiwa are assisting with this claim. Hoki confirmed that the Rakitu claim will be settled under the Komiti Nui umbrella. Anaru reiterated that all claims that have a Ngati Whakaue content, will be settled under Komiti Nui. Maru further discussed the Rakitu claim, their grounds for grievance and his concern with the Ngai Te Rangi claim. Larissa mentioned that Komiti Nui have met with Ngai Te Rangi and have come to an agreement however it has come unstuck due to the OTS process challenging that claim. Maria asked for clarification on other cross claims. Larissa mentioned that Komiti Nui have been meeting with the individual iwi as their claims reach the table of the Crown. Komiti Nui receives an invitation to meet with the iwi to discuss any cross claim issues. 4 Annual Report 2014
Tony requested that a list of the original claimants, their areas of interest and any issues effecting Ngati Whakaue, be outlined at the next AGM. Rawiri requested support from Komiti Nui for the Rakitu claimants. A letter will be submitted to Komiti Nui for consideration. Pauline mentioned that the claims team will meet with the claimant groups at some stage. Tony said that although Komiti Nui has access to the Tuhono Database, the database we need to access is Pukeroa Oruawhata Trust s. Pauline mentioned that the issue with accessing other databases is the privacy issue. Wikitoria Kake-Flavell mentioned the issue with the database. She has registered before however her name is still not on the register. Komiti Nui to follow up with Tangatawhenua.com. Maria Horne mentioned that Ngati Whakaue have a representative on the Western BOP Council and the District Council for tangata whenua. If anyone would like to communicate anything to make contact with the Te Runanga o Ngati Whakaue ki Maketu. She is meeting with the Tauranga Eastern link and will ask about any lands currently under Crown ownership. Lauren James asked if Komiti Nui is looking at a service management agreement with the government like Tuhoe and has there been discussions with Raukawa regarding their areas of interest as their settlement will be legislated soon. Anaru explained that Komiti Nui have met with Raukawa regarding their area of interest. A clause has been added to their area of interest map which explains that they do not have mana whenua in certain areas, in particular, Ngati Whakaue s area. Waireti Tait who is also a trustee on Te Kotahi a Tuhoe referred to the service management agreement they have with the government. She said that they are currently looking at capabilities for the roles within Tuhoe. She will discuss with Tamati Kruger about having discussions with Ngati Whakaue regarding Tuhoe s unique service management agreement. Anaru requested an endorsement from the people to continue the work that Komiti Nui is mandated to do. RESOLVED: That this annual general meeting endorse the mandate, conferred on Te Komiti Nui o Ngati Whakaue in 2009, to engage with the Crown to negotiate and settle the extant historical claims of Ngati Whakaue, as expeditiously as possible. CHAIRMAN S REPORT I am pleased to update you on the work of Te Komiti Nui on the negotiation of the settlement of our historical claims for the year ended 31 March 2014. Settlement Negotiations update Terms of Negotiation Developing the Terms of Negotiation with the Crown has been our major focus this year. The largest challenge in agreeing the terms was overcoming the significant difference between ourselves and the Crown around the scope of the Ngati Whakaue settlement. Despite this, I can now advise that the Terms of Negotiation (signed just a few days after the reporting period for this report on 3 April 2014) provides a strong platform for Ngati Whakaue moving forward into the negotiations phase of the settlement process. The Terms of Negotiation outline the scope, objectives, principles and procedures for formal negotiations with the Crown. Of particular interest are the areas that are still unresolved with the Crown: Clauses 2.6 and 2.7 which show the differences in views around the claims relating to the Fenton Agreement; and Clauses 18.3 and 18.4 stating the claimant definition, which will be agreed before the signing of the Agreement in Principle. I encourage you to review these terms, a link to which is available on our website www.whakaue.org. I also recommend that you engage with your delegate on Te Komiti Nui o Ngati Whakaue if you have any questions or concerns. Parallel to negotiating the Terms of Negotiation, Te Komiti Nui also undertook work to prepare itself for the Agreement in Principle phase of negotiations. Overlapping Claims Te Komiti Nui has been involved in an overlapping claims process with the Hauraki Collective. We have met kanohi ki te kanohi with the cross claiming groups in an effort to resolve any issues and look forward to embarking on our own overlapping claims process as we progress with negotiating our settlement. Central North Island Iwi Collective Katie Paul and I are the Ngati Whakaue representatives on CNI Iwi Holdings Limited. This year we have been primarily focussed on the Mana Whenua process and the formal agreement reached with the Rotorua District Council to decommission the existing land treatment system. Mana Whenua Process As a result of extensive deliberations undertaken by the Central North Island (CNI) Iwi Collective, it was agreed that the nine blocks of Kaingaroa forest lands should go to adjudication. Kaingaroa Forest comprises the vast majority of settlement land. The Iwi Collective also agreed by unanimous resolutions passed on 15 May 2012 and 11 December 2013, that the remaining twelve forest Lands (Satellite Forests) will be subject to the kanohi ki te kanohi approach. 6 Annual Report 2014
Ngati Whakaue interests are primarily in the satellite forests of Horohoro and Whakarewarewa. As such, discussions are on-going with Te Pumautanga o Te Arawa, Ngati Rangitihi and Raukawa to agree our interests. Milestones achieved 20 December 2013: Adjudication panel appointed and rules of engagement agreed; Stage 1 accomplished: Identification of Mana Whenua interests over CNI forest Land on 12 February 2014; Stage 2 accomplished: CNI iwi embarked on kanohi ki te kanohi negotiations; and Stage 3 accomplished: Adjudication Panel decision reached on the allocation of Kaingaroa Forest Lands on 26 June 2014. Agreement with the Rotorua District Council Through the CNI Iwi Land Management Company, we engaged with the Rotorua District Council on reviewing the current land treatment system. I am happy to advise that this engagement culminated in the Council signing a deed with CNI Iwi Holdings Limited on 6 June 2014. The deed commits the Council to ending the discharge of wastewater into the Whakarewarewa Forest by December 2019. Looking forward I am looking forward to the next phase of negotiations and what I will be able to report back at this time next year. Te Komiti Nui is keen to engage with Ngati Whakaue members as we negotiate our Agreement in Principle. TRUSTEES Anaru Te Amo Koromatua representative Anaru is the Chairman of the Trust and affiliates to the six koromatua of Ngāti Whakaue. Anaru has been involved in Treaty Settlement issues for the past 20 years and by profession, is an experienced office administrator, also has extensive experience in the forestry and communications sectors and has 25 years experience with Trusts. Pauline Tangohau Koromatua representative Pauline is the Deputy Chair. She is married to Walter Tangohau and has two daughters and two mokopuna. Her parents are Whakarato and Rerekura John Waetford, her Grandparents are Rangipahere and Retimana Paul, her Great Grandparents are Taiporutu and Te Aomihi Mitchell and her Great Great Grandparents are Whakarato Taiehu and Henry Walker Mitchell. Pauline is Senior Advisor, Programme Management at Te Puni Kōkiri. Te Kiri Mitchell Koromatua representative Te Kiri affiliates to Ngāti Hurungaoterangi, Ngāti Tunohopu, Ngāti Pukaki, Ngāti Te Rorooterangi and Ngāti Taeotu. Te Kiri s koroua and kuia are Niramona Tireni Taiehu Mitchell (Mitere) and Nataria Rotohiko Haupapa (Mitchell). Her matua and whaea are Hamuera Taiporutu Mitchell (Mitere) and Rangipawa Te Kahu Kopeka Haimona (Mitchell). Te Kiri is married to Ike Retimana. They have two children, Zane Hamuera Taiporutu Mitchell and Shaloh Kaiser Octavious Mitchell. Te Kiri and Ike have two mokopuna, Aleisha and Shikyra. Kingi Biddle Koromatua representative Kingi was born and raised in Rotorua, he and his family live in Koutu, Ōhinemutu. His wife Wendy comes from Tainui, Mataatua and they have four beautiful tamariki and two strikingly amazing mokopuna. Kingi is the son of Robert Bully and Linda Biddle, both of Ngāti Whakaue and descends from the two Tupuna, Pango through his son Hamuera and Te Amohau through his son Paora. Being on the Committee is a way to seal the past and future for our iwi. Hokimatemai Kahukiwa Koromatua representative Hoki was born in Rotorua and raised between Ohinemutu and Koutu. He is from Ngati Tunohopu, Ngati Rangiiwaho, Ngati Taeotu, Ngati Turipuku o Ngati Te Rorooterangi. Hoki served in the Royal New Zealand Infantry for 22 years. He served in Malaysia and Vietnam. Hoki attained the rank of Warrant Officer 1st Class. 18 Annual Report 2014
Hamuera Mitchell Koromatua representative Ray Pou Poasa Ngapuna representative Veronica Butterworth Ngapuna representative Veronica was born in Rotorua and raised in Ngapuna. She is married to Dennis (Ngāti Porou) and they have three children. Her parents are Viti Miriama Ammunson and Frederick Carrington. Veronica s tupuna kuia is Wenarata Hona, her koroua is Herewini Te Ruahuihui Ngamahanga. Veronica has worked as a registered nurse and as a Public Health Nurse in Rotorua and the wider community. She has also worked for the Ministry of Education in the Special Education area. Veronica is currently the Service Development Manager for the Te Arawa Whanau Ora Collective. Paora Tapsell Horohoro representative Paora is currently a Professor and Dean of Te Tumu School of Māori, Pacific and Indigenous Studies at the University of Otago. He holds a variety of directorships and trusteeships throughout New Zealand. Paora holds the following degrees; BA, PGDip (Bus), MA (Auckland), DPhil (Oxford). Larissa Wharepouri Maketu representative Larissa was born and raised in Auckland, her mum is of Ngāti Whakaue, Ngāti Pikiao, Ngāti Raukawa descent, and her dad is of Ngāti Paoa, Ngāti Pukenga, and Tapuika descent. Larissa has worked in the Health and Disability sector for over 15 years, predominately in the Bay of Plenty. Larissa holds a BA (Auckland), MA (Waikato) and MBA (Massey). Annual Report 2014 19
