One member shall be affiliated with the Boca Raton Coast Guard Auxiliary, two members shall be recreational boaters, one member shall be an owner of a single-family residence adjacent to inland waterways (residence shall be the owner s primary residence), and one member shall be a unit owner in a condominium adjacent to inland waterways (which unit shall be the owner s primary residence). Both residence owners may be a boater or non-boater. One member shall have experience in marine industries or coastal planning matters and one member shall be licensed by the U.S. Coast Guard to operate a commercial or passenger vessel upon the navigable waters of the United States. One member shall be an environmentalist.

DIVISION 15. - MARINE ADVISORY BOARD Sec. 2-285.20. - Board created. There is hereby created the marine advisory board. (Ord. No. 4571, 1, 2-27-01) Sec. 2-285.21. - Membership; appointment; term; quorum. The marine advisory board shall consist of 8 qualified electors of the city, to be appointed by the city council. The term of office for members shall be for 3 years; provided, however, the terms shall be staggered, so that no less than 2 terms regularly commence each year. One member shall be affiliated with the Boca Raton Coast Guard Auxiliary. Two members shall be recreational boaters. One member shall be an owner of a single-family residence adjacent to inland waterways (which residence shall be the owner's primary residence), and the owner may be a boater or non-boater. One member shall be a unit owner in a condominium adjacent to inland waterways (which unit shall be the owner's primary residence), and the unit owner may be a boater or non-boater. One member shall have experience in marine industries or coastal planning matters. One member shall be licensed by the U.S. Coast Guard to operate a commercial or passenger vessel upon the navigable waters of the United States. One member shall be an environmentalist. Members of other city advisory boards having 1 or more of the above qualifications may serve on the board. Four members shall constitute a quorum. The affirmative vote of a majority of members present at a meeting at which a quorum is present is required for the board to take formal action. The members of the board shall serve without compensation. (Ord. No. 4571, 1, 2-27-01; Ord. No. 5236, 1, 6-25-13) Sec. 2-285.22. - Meetings and procedures; minutes. (1) An organizational meeting of the marine advisory board shall be held as soon as is practicable after appointment and in July of each year thereafter for the purpose of selecting a chairman, vice-chairman and secretary for the following 12-month period. Officers shall be elected for a term of 1 year by the board from its membership. The board shall adopt rules of procedure to govern the conduct of its business. At least 4 regular meetings of the board shall be held each year, and special meetings may be called by the chairman or by any 3 members of the board. (2) Minutes shall be kept of the proceedings at each meeting and shall be a record of the official actions taken by the board. Approved minutes of each meeting shall be filed with the city clerk within 30 days of the date of the meeting at which the minutes are approved. (Ord. No. 4571, 1, 2-27-01) Sec. 2-285.23. - Powers and duties. The powers and duties of the marine advisory board shall be as follows: (1) To make recommendations to the city council regarding the proper management, use, and regulation (by the appropriate federal, state and/or local agency) of: (1) the Intracoastal Waterway and inland waterways within the territorial limits of the city which are directly connected to the Intracoastal Waterway (the "inland waterways"), and the Boca Raton Inlet extending to the 30-foot contour line east, from the north city boundary to the south city boundary (hereinafter, including the inland waterways, referred to as "Boca Raton waterways"); (2) bridges spanning inland waterways; and (3) existing and future city-owned or operated recreational boating facilities adjacent to Boca Raton waterways (hereinafter referred to as "the general purposes of the board"). All recommendations to the city council shall be made to the city manager, including without limitation recommendations regarding the following: (a) The management, use, and regulation of Boca Raton waterways; and (b) The management, regulation and operation of bridges spanning inland waterways; and Page 1

(c) The management, regulation and development of city-owned or operated recreational boating facilities adjacent to Boca Raton waterways; and (d) Regulation of commercial vessels, recreational vessels, houseboats, and personal watercraft operating on or located on Boca Raton waterways by the appropriate federal, state or local agencies; and (e) Establishment of no wake zones, speed zones, and bridge opening policies; and (f) Scope of operations and priorities of the marine unit of the police services department; and (g) Management and operation of the Boca Raton Inlet, including dredging, permits and design; and (h) Appropriateness of new city ordinances or amendments to existing city ordinances regulating Boca Raton waterways; and (i) (j) Proposed changes to federal, state or local laws, rules, regulations, ordinances, or policies, and enforcement policies regarding the matters in (a) through (h) in order to accomplish the general purposes of the board; and Coordination of the activities of various federal, state and local agencies regarding the matters in (a) through (h) in order to accomplish the general purposes of the board; and (k) The education of citizens, boaters and the general public regarding matters in (a) through (h) in order to accomplish the general purposes of the board. The city manager shall determine the manner and timing of presentations of board recommendations to the city council. (2) To make recommendations to the environmental advisory board regarding marine and environmental matters, including without limitation, development of a manatee protection plan; and (3) To perform such other duties as may be assigned by the city council. The actions, decisions and recommendations of the board shall not be final or binding on the city council or city manager, but shall be advisory only. (Ord.
