NOTICE OF BOND ELECTION TO THE RESIDENT QUALIFIED VOTERS OF FABENS INDEPENDENT SCHOOL DISTRICT: NOTICE IS HEREBY GIVEN THAT an election will be held within the Fabens Independent School District, on Tuesday, November 4, 2014, as ordered by the Board of Trustees of Fabens Independent School District, a substantial copy of which order is printed below: AN ORDER BY THE BOARD OF TRUSTEES OF FABENS INDEPENDENT SCHOOL DISTRICT CALLING A BOND ELECTION TO BE HELD FOR SAID DISTRICT; PROVIDING FOR THE CONDUCT AND THE GIVING OF NOTICE OF SAID ELECTION; AND CONTAINING PROVISIONS NECESSARY AND INCIDENTAL TO THE PURPOSES HEREOF WHEREAS, this Board of Trustees finds and determines that it is necessary and advisable to call and hold an election for and within Fabens Independent School District (the "District") on the propositions hereinafter set forth; and WHEREAS, it is further found and determined that the meeting at which this order was adopted was open to the public, and public notice of the time, place, and purpose of said meeting was given, all as required by the Texas Government Code, Chapter 551; Now, Therefore BE IT ORDERED BY THE BOARD OF TRUSTEES OF FABENS INDEPENDENT SCHOOL DISTRICT: Section 1. Findings. The statements contained in the preamble of this Order are true and correct and adopted as findings of fact and operative provisions hereof. Section 2. Election Ordered; Date; Propositions. An election shall be held for and within the District on November 4, 2014, at which election the following propositions shall be submitted in accordance with law: PROPOSITION NO. 1 Shall the Board of Trustees of Fabens Independent School District be authorized to issue the bonds of the District, in one or more series, in the aggregate principal amount of $7,000,000, for the purpose of the construction, renovation, acquisition and equipment of school buildings in the District and the purchase of new school buses, with said bonds to mature, bear interest, and be issued and sold in accordance with law at the time of issuance; and shall the Board of Trustees be authorized to levy and pledge, and cause to be assessed and collected, annual ad valorem taxes, on all taxable property in the District, sufficient, without limit as to rate or amount, to pay the principal of and interest on said bonds? PROPOSITION NO. 2 Shall the Board of Trustees of Fabens Independent School District be authorized to issue the bonds of the District, in one or more series, in the aggregate principal amount of $1,400,000, for the purpose of refunding said District's Maintenance Tax and Revenue Note, Series 2014 that was issued pursuant to Section 45.108, Texas Education Code, as amended, with said bonds to mature, bear interest, and be issued and sold in accordance with law at the time of issuance; and shall the Board of Trustees be authorized to levy and pledge, and cause to be assessed and collected, annual ad valorem taxes, on all taxable property in the District, sufficient, without limit as to rate or amount, to pay the principal of and interest on said bonds, and the costs of any credit agreements executed in connection with the bonds? Section 3. Precincts and Polling Places. The election precincts for said election, and the polling place for each such precinct on election day, are hereby established and designated in Exhibit A attached hereto, which is incorporated herein by reference and made a part hereof for all purposes. Section 4. Early Voting. The Main Early Voting Polling Place and the Branch Early Voting Polling Places for conducting early voting by personal appearance and the address for early voting by mail for said election are hereby designated as set forth in Exhibit A attached hereto. Exhibit A shall be modified to include additional or different early voting locations as may be designated by the El Paso County Elections Administrator and to conform to the Joint Election Agreement with the El Paso County Elections Administrator.
Section 5. Voting Hours. (a) On election day the polls shall be open from 7:00 A.M. to 7:00 P.M. (b) The dates and hours for early voting by personal appearance at the Main Early Voting Polling Place and the Temporary Branch Early Voting Polling Places shall be as set forth in Exhibit A hereto. Section 6. Election Officers. The election officers designated by the El Paso County Elections Department are hereby appointed and confirmed to hold said election at said polling places, in accordance with the agreement between the El Paso County Elections Department and the District for the El Paso County Elections Department to conduct the election. As determined by the El Paso County Elections Department, the Presiding Judges shall appoint qualified election clerks to serve and assist in conducting said election; providing that if a Presiding Judge for a polling place actually serves as expected, the Alternate Presiding Judge for such polling place shall be one of such clerks. An early ballot board is hereby created to process early voting results, and the individual designated by the El Paso County Elections Department is hereby appointed the presiding judge of said board. The presiding judge shall appoint at least two other members of the board. Javier Chacon, El Paso County Elections Administrator, shall serve as early voting clerk for the election. Section 7. Official Ballots. (a) Voting at said election on election day and early voting by personal appearance and by mail shall be by the use of a touch screen voting system. (b) The official ballots for said election shall be prepared in accordance with the Texas Election Code so as to permit the electors to vote "FOR" or "AGAINST" the aforesaid propositions, which shall be set forth substantially in the following form: PROPOSITION NO. 1 THE ISSUANCE OF $7,000,000 OF BONDS BY FABENS INDEPENDENT SCHOOL DISTRICT FOR THE CONSTRUCTION, RENOVATION, ACQUISITION AND EQUIPMENT OF SCHOOL BUILDINGS IN THE DISTRICT AND THE PURCHASE OF NEW SCHOOL BUSES, AND THE LEVYING OF THE TAX IN PAYMENT THEREOF PROPOSITION NO. 2 THE ISSUANCE OF $1,400,000 OF BONDS TO REFUND FABENS INDEPENDENT SCHOOL DISTRICT MAINTENANCE TAX AND REVENUE NOTE, SERIES 2014, AND LEVYING THE TAX IN PAYMENT THEREOF Section 8. Bilingual Election Materials. The election materials enumerated in Tex. Elec. Code Ann. 272.001, et seq., shall be printed and furnished in both English and Spanish for use at the polling places and for early voting. Section 9. Conduct of Election. Said election shall be conducted in all respects in accordance with the Texas Election Code, and all resident qualified electors of the District shall be entitled to vote at said election. Pursuant to the federal Help America Vote Act and the Texas Election Code, each polling place shall be provided at least one voting system equipped for individuals with disabilities. Section 10. Notice of Election. (a) A substantial copy of this Order shall serve as proper Notice of said election, and the President of the Board of Trustees shall cause said Notice to be published one time, not earlier than the 30th day or later than the 10th day prior to the date set for the election, in a newspaper published in said District or, if none is published in said District, in a newspaper of general circulation in said District. The President of the Board of Trustees shall also cause said Notice to be continuously posted (i) during the period beginning on or before the 21st day before the election through election day (A) on the bulletin board used for posting notices of meetings of the Board of Trustees, (B) at three other public places in the District and (C) on the District's Internet website and (ii) on election day and during early voting by personal appearance in a prominent location at each polling place. (b) Such notice, as posted and published, shall include and constitute a schedule stating the location of the temporary branch early voting polling places for said election, the election precincts served by the temporary branch polling places and the dates and hours that temporary branch voting will be conducted.
Section 11. Required Information. In accordance with the provisions of Section 3.009(b), Texas Election Code, it is hereby found and determined that: (a) The proposition language that will appear on the ballot is set forth in Section 7 hereof. (b) The purpose for which the bonds are to be authorized is set forth in Section 2 hereof. (c) The principal amount of the bonds to be authorized is set forth in Sections 2 and 7 hereof. (d) As set forth in Sections 2 and 7 hereof, if the bonds are approved by the voters, the Board of Trustees will be authorized to impose and levy annual ad valorem taxes, on all taxable property in the District, sufficient, without limit as to rate or amount, to pay the principal of and interest on the bonds. (e) Based upon the bond market conditions at the date of adoption of this Order, the maximum interest rate for any series of the bonds is estimated to be 5.00% as calculated in accordance with applicable law. Such estimate is based on advice received from the District's financial advisor, which advice takes into account a number of factors, including the issuance schedule, maturity schedule and the expected bond ratings of the proposed bonds. Such estimated maximum interest rate is provided as a matter of information, but is not a limitation on the interest rate at which the bonds, or any series thereof, may be sold. (f) As set forth in Section 2 hereof, if the bonds are approved, they may be issued in one or more series, to mature over a period not to exceed 40 years. (g) The aggregate amount of the outstanding principal of the District's bonds (all of which are secured by an unlimited tax levied for debt service purposes) as of the beginning of the District's 2013-2014 fiscal year is $24,455,000. (h) The aggregate amount of the outstanding interest on the District's bonds as of the beginning of the District's 2013-2014 fiscal year is $15,564,747.
