RULES AND REGULATIONS I. DEFINITIONS Competition means the Lux-Et-Veritas-6 th National Moot Court, 3 rd Client Counseling Competition, 2 nd Legal Drafting Competition and, 1 st Judgement Writing Competition, 2017. Memorial means the written submissions of each team, submitted according to these Rules. Moot Proposition means the Problem of the Competition released by the Administrator. II. INTERPRETATION The interpretation placed upon these Rules by the Organisers shall be conclusive. The decision of the Organisers regarding the application of these Rules shall be final. In case of any dispute, the decision of the Organisers shall be final. III. ELIGIBILITY All law schools, Faculties of law and other institutions offering three and Five Years LL.B program are eligible to participate in the Competition. Each participating institution shall send only one Team to the Competition. Team members must be bona fide students of the institution they are representing. IV. TEAM COMPOSITION A Participant Team shall have a minimum of three members and a maximum of five members. Each team must Consists of two mooters. 3

Each team must specify the two-team members who would be mooting in a round, prior to the commencement of that particular round.. The Administrators reserve the right to disbar any team from participating in the Competition V. PARTICIPATION AND REGISTRATION The teams interested to participate are required to confirm their participation by sending an email attaching the scanned copy of registration form and soft copy of Demand Draft, duly filled, to luxetveritas2017@gmail.com by 21/01/2017. On receipt of such confirmation email, the Provisional Registration of that Institution/college is deemed to have been accepted and confirmed for participation. The hard copy of the Registration form accompanied with the demand draft must reach the organizers on or before 27/01/2017. Kindly note that such email has to be sent through the university/school/college/ department official email address. Emails sent through personal/non-official email addresses and emails sent to any other address other than the above mentioned shall be invalid. The Registration Fee for the Moot is to be paid through a Demand Draft in the name of The Director BSLS, Faculty Of Law payable at Vadodara. The cover should be marked as Lux et Veritas and should be sent at address mentioned at end. Registration fee is Rs.5000 per team. Demand Draft shall be Non-Refundable. The duly filled Travel Form (Travel Plan form) is to be e-mailed by the teams to luxetveritas2017@gmail.com on or before 20/02/2017. The teams shall solely be responsible for any delay caused. 4

VI. ALTERATION CLAUSE Any alteration of the names of the team members has to be informed via email to Organisers of the Faculty of Law, The Maharaja Sayajirao University, Vadodara, by the team requesting such alteration. However no such alteration in team composition would be allowed after 21 st January 2017. Failure to comply with the rules of the competition shall lead to immediate disqualification of the team. MOOT COURT COMPETITION RULES VII. DRAW OF LOTS The match up of teams in Preliminary and Advanced Rounds shall be determined on the basis of draw of lots. Draw of lots for preliminary round shall take place on 3 rd March, 2017. VIII. MEMORIALS All the memorial submitted for the purpose of the competition shall strictly adhere to the rules stated below: Each participating Team must prepare memorials for the both sides. Memorials shall be in English, and must be printed single-side on A4 size sheets, with equal margins of one inch on all sides. The Memorials for both sides must be emailed in PDF format to luxetveritas2017@gmail.com by 11:59 pm IST (Indian Standard Time) on 22 nd February 2017. For every hour of delay in memorial submission from the prescribed time of submission, one mark shall be deducted. Any memorial submitted 12 hours after the time prescribed above will not be accepted. Note: The above deduction would apply even if the delay is not of a complete hour. 5

Hence, for example, a Memorial submitted at 12:01 am would still be subject to a 1-mark deduction. It is hereby clarified that teams, which fail to submit Memorials within the deadline specified, i.e. within 12 hours from the prescribed time of memorial submission, would automatically be disqualified from the competition. The text font for the main body must be Times New Roman, size 12, with 1.5 line spacing. The text font for the footnotes must be Times New Roman, size 10, with 1.0 line spacing. Character spacing should not be condensed in any manner. The Memorial must contain all of, and only, the following components: a) Cover page b) Table of Contents c) Table of Abbreviations d) Index of Authorities e) Statement of Jurisdiction f) Statement of Facts g) Issues Raised h) Summary of Arguments i) Arguments Advanced j) Prayer Non-compliance with above criteria shall result in penalty of one mark per missing section. The Cover Page must be printed on BLUE paper for the each Appellant Memorial, and RED paper for each Respondent Memorial. The Cover Page of each Memorial must contain the following information: o The name of the forum before which the proceedings are being conducted; o The name and year of the Competition; o The name of the case; o The title of the memorial (either Memorial for Claimant or Memorial for Respondent ). The Team Registration code in the upper right-hand corner of the Memorial. 6

While sending the memorials by an email in PDF format, kindly mention your team registration code and name of the college is to be mentioned in cover letter. The Statement of Jurisdiction, Statement of facts, Summary of Arguments, Arguments Advanced and Prayer must not exceed 25 pages. The team has to use citation method as stated in the 19 th edition of the Harvard Blue Book, for throughout the memorial, with strict adherence. Footnotes may not include any substantive pleadings, examples or any text other than the citation itself. Teams are required to submit Seven printed copies of the Arguments and Respondent memorials each when they arrive for the competition. ORAL ARGUMENTS Each Oral Round shall, subject to the discretion of the Judges, consist of sixty (60) minutes of argument, which shall be presented in English only. The Appellant and the Respondent shall be allotted twenty (20) minutes each for preliminary rounds, Quarterfinals and Semi-final round and five (05) minutes would be allotted for rebuttals and sur-rebuttals would be subject to discretion of judges. Both members designated as Speakers from each Team shall make oral presentations in each round. Provided that judges, in so exercising their discretion shall allot equal time to both teams. In the Final Round, the Appellant and the Respondent shall be allotted thirty (30) minutes each and ten (10) minutes would be allotted for rebuttals and sur-rebuttals would be subject to discretion of judges.. X. COMPETITION FORMAT & PROCEDURE The Competition shall consist of Preliminary Rounds, Quarterfinal Rounds, Semi-final Round and Final Round. Marks of Memorials would be calculated only for preliminary rounds. 8

Each team shall argue in two Preliminary Rounds: o Once as Appellant and o Once as Respondent. QUARTER FINAL ROUND: o The top eight (8) ranking teams in the Preliminary Rounds will qualify for the Quarterfinal Round. o In event of tie for the eights position, the team scoring more marks in Memorials would qualify for Quarterfinal round. o The top four teams of the Quarterfinal shall advance to the Semi-final Round. SEMI FINAL ROUND: o In event of tie for the fourth position, the team scoring more marks in Memorials would qualify for Semi-final round. o The two teams of the Semi-finals shall advance to the Final. FINALS: o The Winner of the Final Round shall be declared the Winner of the Moot Competition. Teams, their members, or any person associated with a team, are not permitted to be present at, or hear, or in any way observe, a round in which that team is not participating. This rule will not apply to Final Round. Scouting in any form shall entail disqualification of the team. Teams must not reveal their university, or country of origin, or names of the participants, anywhere in the Memorial or in the course of the Oral arguments. Teams must also not make use of or display in any manner whatsoever any logo, pins, badges etc. in the Memorials or during the course of the oral arguments. A Team must be identified only by the Team Number that shall be allotted to it, a few days before the submission of the memorial. Violation of the above rule at any point will lead to automatic disqualification. However, that Speaker may refer to themselves and other Speakers in an oral round by their respective names. 9

JUDGEMENT WRITING RULES One candidate from each team shall take part in the Judgement Writing competition. However candidate participating in judgement writing competition cannot participate in Client Counseling and Drafting Competition. There shall be an on spot judgment writing competition. The judgment has to be written be in English. The structure of the judgement shall reflect the forum/court in which the case was/is set and argued. The participant shall submit the judgment in hand written format. Language and style should be consistent. Relevant documents along with the case shall be provided on the spot. The participant shall be given 45 minutes to write judgement. The participants shall not be provided with reference material. However the participants can bring their own reference material and access Internet and other electronic gadgets to be arranged by them. The Organisers shall not provide internet access or charging point facility for using electronic gadgets. The Judgement shall be evaluated on following criteria: o Facts in brief o Framing of issues o Interpretation of law and facts o Ratio Decidendi (Decision on issues framed or points formulated.) o Operative order/part o Grammar and language 10

CLIENT COUNSELING RULES Two candidates from each team shall take part in the Client Counseling Competition. However candidate participating in Client Counseling competition cannot participate in Legal Drafting, Judgement Writing and Moot Court Competition. The participant would be provided with a factual situation. The participants shall conduct an interview with a person playing the role of the client. Participants are expected to elicit the relevant information from the client, explore with the client his or her preferred outcome, outline the nature of the problem, and present the client with a means (or range of alternatives, if appropriate) for resolving the problem Client Counseling Competition is divided into four rounds: o Preliminary Round o Quarter Final Round o Semi-Final Round o Final Round Each Counseling Session/Round is divided into three parts: o Consultation o Post-Consultation o Critique Consultation: o The consultation period shall be for fifteen (15) minutes for preliminary rounds, Quarterfinal and Semi-final round and twenty-five (25) minutes for Final Round. o The time period will start from the moment the client enters the chamber. o The time period is meant to be used for inter alia consultation with the client during which participants are expected to elicit the relevant information, outline the problem, find the clients expectations and propose a solution or 11

other means of resolving the problem. o During the consultation and post-consultation, the team may use books, notes and other materials. The team may also use office props (Dictaphones, Files, desktop, furnishings, bookshelves etc.) and any other material to furnish their consultation room or for other relevant purposes. (Materials to be arranged by participant themselves and Organisers would not be responsible to provide such materials) o The time period is to be strictly adhered to, after which the client would necessarily leave and the post-consultation period would begin. Post Consultation: o Participants may summarize the interview, indicate the scope of the legal work to be undertaken, and state the legal issues that should be researched. o If the participants feel that some documents are appropriate, like a letter to the client confirming their retention as attorneys, the fee arrangement etc, or a letter to opposing counsel or to the party with whom the client is having their legal problems etc., they may dictate such a document at the post consultation stage. o The time period for post consultation is ten (10) minutes for preliminary rounds, Quarterfinal and Semi-final round and twenty (20) minutes for Final Round. o The time period is to be strictly adhered to, after which the participants would necessarily have to stop the post-consultation period. o Post-Consultations discussion should be audible enough to enable the judges to hear it. Critique: o After the completion of the Post-Consultation period, the judges will review the performance of the participants during the consultation and post-consultation 12

period. o The time period for this session is ten (10) minutes for preliminary rounds, Quarterfinal and Semi-final round and fifteen (15) minutes for Final Round. The evaluation of participants in Client Counseling competition shall be done on the basis of following: - o Understanding of Client s Goals and expression o Summarizing the interview o Problem analysis o Courses of Action Suggested o Client s Informed choice o Moral and ethical issues o Working atmosphere and professionalism The top eight (8) ranking teams in the Preliminary Rounds will qualify for the Quarterfinal Round. The top four (4) ranking teams in the Quarterfinal Rounds will qualify for the Semifinal Round. The top two (2) ranking teams in the Semifinal Rounds will qualify for the Final Round. The Winner of the Final Round shall be declared the Winner of the Client Counseling Competition. Laws Applicable: - The problems shall be broadly based on but not completely limited to the following laws and participants are expected to have knowledge of any other ancillary laws and procedures: o Family Law o Civil Law o Criminal Law o Constitutional Law o Company Law 13

o Torts o Sale of Goods o Contract Act o Specific Relief Act o Procedural Laws o Intellectual Property Rights o Environmental Law o Arbitration and Mediation o Consumer Protection o Transfer of Property LEGAL DRAFTING RULES One candidate from each team shall take part in the Legal Drafting Competition. However candidate participating in Legal Drafting competition cannot participate in Client Counseling and Judgement Writing Competition. The participant would be provided with a factual situation. The participant shall draft a petition/complaint/plaint/conveyancing deeds, as the case may be. The statement of fact shall be given at the time of the competition and the participant shall draft the petition/complaint/plaint/conveyancing deeds as per the standard procedure observed in the courts of India. The statement of facts shall be given at the time of the competition and the draft shall be handwritten in the sheets provided by the organizers. Duration for legal draft shall be one hour. The participants shall not be provided with reference material. However the participants can bring their own reference material and access Internet and other electronic gadgets to be arranged by them. The Organisers shall not provide internet access or charging point facility for using electronic gadgets 14

Ø The participants shall also identify the competent court and they are free to use their prudence while drafting the cause title and other related elements, which are involved in the process of drafting. Ø Borrowing study materials or any other substances from other participants is prohibited. Ø The participants shall draft within the ambit of the statement of facts. The drafts of participants shall be evaluated on the basis of following: - o Analytical Thinking. o Legal Knowledge. o Application of Law to Facts. o Flow of Thoughts. o Precision in drafting. o Drafting in Conformity with Procedural Laws. o Relief Sought. o Legible Drafting. AREAS OF RESEARCH: - The statement of fact supplied by the organizers would require the knowledge of following subjects for drafting: o Family Law o Civil Law o Criminal Law o Constitutional Law o Contract Law o Company Law o Torts o Sale of Goods o Specific Relief o Procedural Laws 15

o Intellectual Property Rights o Environmental Law o Transfer of Property XI. TRANSPORTATION, FOOD AND ACCOMODATION Accommodation will be provided to all the teams. Additional members are not permitted. Accommodation will be provided from 8:00 p.m., 2 nd March 2017 till 10:00 a.m., 6th March 2017. Teams arriving before 3 rd and staying after 5 th will have to arrange for their transportation and food themselves. Conveyance will be provided to all the teams from 8:00 p.m., 2 nd March 2017, the Station/Airport on their arrival to the accommodation. Conveyance will be provided to all the teams to and from the university to the accommodation. No conveyance shall be provided under any circumstance for dropping any team to the Station/Airport after 5 th March 2017. Teams must send scanned copies of their travel plan. Food for all the days of the competition will be provided to all the teams. XII. CLARIFICATIONS All requests for clarifications to the Problem must be emailed to luxetveritas2017@gmail.com by 27 th January 2017. The clarifications will be released by 8 th February 2017. Questions submitted/clarification sought through any other means other than by email shall not be entertained. 16

XIII. ANONYMITY OF TEAMS Teams must not reveal their university or names of the participants, in any of the competitions. Teams must also not make use of or display in any manner whatsoever any logo, pins, badges etc. in any of the competitions. Violation of the above rule at any point will lead to automatic disqualification. XIV. CODE OF CONDUCT Participants will be disqualified from the competition, if they are found: a. Smoking or consuming/ carrying drugs or alcohol in the campus or accommodation. b. Misbehaving, or causing nuisance, or making abusive statements, showing disrespect towards judges, co-participants or members of the host institution. XV. DRESS CODE For moot court competition: The participants shall adhere to following dress code when present in any courtroom during the Competition. a. Ladies: White kurta and black leggings or white shirt and black trousers/skirt along with black coat and black shoes and white socks. b. AWARDS AND PRIZE MONEY v The awards and the prize money are as follows: For Moot Court Competition: v Winning Team Award: The winning team will receive a trophy and a prize of Rs.15000. v Runners - up Award: The 1st runners up will get a trophy and a prize of Rs. 10,000. v Runners - up Award: The 2 nd runners up will get a trophy and a prize of Rs. 7,500. v Best Advocate: The best Advocate will get trophy and prize of Rs. 10,000. v Best Memorial: The team with best Claimant memorial will receive trophy and a prize of Rs. 10000.
