Qualification for a design competition: Restricted tender contest with a subsequent negotiated procedure for the award of a contract with a multidisciplinary engineering design group. The Directorate of Public Construction and Property invites engineering design groups to apply for participation in a restricted design competition for the new government block, project 1004901, in Oslo. 1 / 6
2 / 6 II.1.3) The Ministry of Local Government and Modernisation (KMD) has given the Directorate of Public Construction and Property the task of planning the future government block in Oslo. The project shall co-house the ministries and create a joint government block. The project's scope is extensive and it comprises the renovation of existing buildings (approx. 40 000 m 2 ), new buildings (85-90 000 m 2 ), basement and infrastructure (35-40 000 m 2 ) as well as outside areas, park, open spaces and streets. The project's main aims are: To create a flexible and efficient ministry fellowship with good and future orientated workplaces; To create a government block with a sufficient degree of security at the same time as being open and inviting; To create a government block that gives historical continuity and that is well adapted to the complex urban situation. Technical and professional qualifications: Professional qualifications for the engineering design group manager (PGL) Competence and experience: Good competence and experience is required for the management of multi-disciplinary engineering design assignments with a transferable value, especially as regards: Multi-disciplinary extent, complexity, size and type of project; Planning, resource management and cost control (both for engineering design costs and project costs); Professional qualifications ARK Competence and experience: Urbanism and context understanding when building in towns; Architecture quality, including functionality and flexibility; Cultural memorials, protection and transformation; Complex buildings, programme organisation and user understanding; Professional qualifications LARK Competence and experience: Good competence and experience is required from engineering design services for outdoor installations with a Green parks in an urban context; Town areas and open spaces in an urban context; Availability and design; Competence is wanted within handling surface water and integrated security design; Professional qualifications RIB Competence and experience: 2 / 6

The companies' financial and economic standing: Tenderers shall have sound financial implementation ability. 4. Tax certificates: Tenderers shall have their tax and duty payments in order. 5. Ability to handle security graded information: Participants shall, during the competition and in the execution of the contract, have the ability to handle and store security graded information to the extent and degree of security set for the procurement. Selection criteria in this competition: For this competition the contracting authority will select the 4-7 best qualified participants for participation in the design competition, provided that there are a sufficient number of suitable registered participants. The best qualified will be assessed on the following: The qualification requirement technical and professional qualifications, cf. point 3.2.1 in the qualification documentation, in which competence, experience and reference projects with the greatest transferable value to this project will be emphasised; A description of how the composition of the whole group ensures that the engineering design assignment can be solved in a way that fulfils the project's aims. Furthermore, a description of methodology and competence within planning, management and control of major engineering design groups, with a view to multi-disciplinary, efficient and good processes as well as delivery within the time, cost and quality; Ability to handle security graded information. Large parts of the project will be security graded in accordance with the Act dated 20.3.1998 No 10 on preventive security services (the Security Act), as the engineering design services involve the handling and production of security graded information/security graded materials. The Security Act and accompanying regulations have particular requirements that the participants in the competition must comply with. Breaches of the security provisions can lead to criminal liability. The new government block will be exposed to threats of different characters, not least intelligence threats from different states, but also a terror threat. It is, therefore, considered that the procurement is of such a character that it entitles certain exemptions from the procurement regulations in accordance with the EEA contract's art. 123, cf. the Public Procurement Act 3 and the public procurement regulations 1-3 (2). In order to limit the risk of spreading information that is of significant security interest, cf. the mentioned article 123, it is considered to 4 / 6
5 / 6 be necessary to set requirements on, amongst other things, Norwegian personnel clearance and requirements on how and where suppliers handle security graded information. Thus, for security reasons, foreign authorities' security clearance of their citizens will not be accepted. Requirements for security in the competition phase security contract and authorisation: In the design competition, parts of the tender documentation and the submitted material can be security graded at level Restricted (hereafter R), cf. the Security Act 11. The Directorate of Public Construction and Property will therefore enter into security contracts at 1 or several companies at the participants who are pre-qualified. The participants will choose, in consultation with the Directorate of Public Construction and Property, which company/companies a security contract shall be signed with. The company that a security contract is signed with is required to have premises in Norway for handling graded material at level R. In order to achieve a security contract, there will also be a check on the company that uses the premises, in which, amongst other things, the conditions of the owners, board and manager will be assessed (including nationality), as well as a check of the premises' suitability for security. All who are given access to the tender documentation/security graded information, must be authorised at level R beforehand, cf. the Security Act 19 and the regulations on personnel security, in particular see chapter 5, and 2-1 to 2-2. The Directorate of Public Construction and Property will hold authorisation discussions with the manager of the company/companies a security contract will be signed with, and central key personnel in the company/companies. The discussion will take place to give information on the actual security provisions and to assess the person's security conduct. Security conduct will be assessed based on the Security Act 21 and 22, as well as the regulations on personnel security, particularly 2-2, 3-7, 5-2, 5-5 and 5-8. The security contract with the actual companies, as well as authorisation of the daily manager, must be in place within 5 weeks of the company being notified that they are pre-qualified. Participants who do not achieve this by the deadline risk losing the right to participate in the design competition. Requirements for security during the subsequent service contract for engineering design services personnel clearance and authorisation, as well as security contract and authorisation: The execution of the service contract and the engineering design services for the new government block will involve that access is given to security graded information on level Confidential (hereafter C). This has led to it being necessary to set requirements that all those who shall work on the project must be able to get Norwegian personnel clearance and authorisation up to and including level C. The minimum number of employees with relevant competence who can achieve personnel clearance and authorisation is in the qualification documentation. For security reasons, foreign authorities' security clearance of their citizens will not be accepted. In practice the requirement for Norwegian personnel clearance means that it will mainly be Norwegian citizens who can get clearance and work on the project. Foreign citizens will also be able to get personnel clearance and authorisation, but only Norwegian citizens are deemed as sufficiently loyal and having associations to Norway. The importance of the home country's security will also be relevant. Foreign citizens who do not live or who have never lived in Norway, or who are only in Norway for work, will not normally be cleared. In addition to this, the degree of loyalty and association, including the home country's security importance, will be particularly emphasised when assessing personnel clearance. During the personnel clearance, information is also obtained on, amongst other things, personal finances, associations with other countries, health and any criminal records see the Security Act 21 and 22, as well as the regulations on personal security, particularly chapters 3 and 3-4. The actual clearance and authorisation will take place after the contract has been signed. These processes take time and if there are negative security conditions attached to an applicant, the processing time is longer. Attention is drawn to the fact that it will be the participants' risk that personnel clearance and authorisation is 5 / 6
6 / 6 VI.3) VI.3.1) VI.3.2) VI.3.3) VI.4) refused or not achieved within specific deadlines that the Directorate of Public Construction and Property will set, based on the ordinary processing time for applicants for clearance and authorisation. Detailed sanction rules for a breach of security provisions, missing clearance, loss of clearance, etc. will be in the invitation to the negotiated procedure, but we would like to mention here that the conditions can be deemed as a significant breach, which in the worst case, can lead the contract being cancelled. In the engineering design phase the Directorate of Public Construction and Property will establish a separate project office in Norway with a security certified ICT network. Personnel clearance will be a requirement for getting permanent access to the project office and the ICT network. The engineering design services will mainly be carried out in these premises, so it is expected that there is no need for supplier clearance of the company. However, it cannot be ruled out that the engineering design services up to level R must take place at an estimated 1 or 2 or the companies that are awarded the engineering design assignment, and then in premises that are in Norway. These companies must, therefore, fulfil the requirements for signing a security contract at level R, including having premises in Norway. The participants have, in the same way as for personnel clearance/authorisation, the risk of the necessary security contract/authorisation being achieved after the contract is signed, cf. the information above. Koro: The tenderer that is awarded the contract will be obliged to carry out works for Koro or the artist relating to public art for this construction project. Koro and the artist will be able to place orders subject to the same conditions as Statsbygg can place supplementary orders under in accordance with the contract.
