3. Code of Conduct: In order to maintain a high level of service to our users, the JFC enforces a Code of Conduct that all participants must follow. The JFC staff appreciates your cooperation in creating a friendly and positive environment for wellness opportunities in all areas of our facility. Participation in all programs and recreation at the JFC is a privilege. All users who participate in activities or who utilize the JFC facility agree to abide by the following Code of Conduct. Participants are expected to: Adhere to the rules and policies included in this document and set by the JFC staff. Act with character and courtesy while respecting the rights, welfare, and dignity of all others in the JFC facility. Vulgar language and offensive conduct is not allowed. Will adhere to any requests from JFC staff to maintain a safe and pleasant fitness environment. Act in a safe, responsible manner regarding themselves and others. Will not falsify any documentation or communication pertinent to business or membership within Johnson Fitness Center. Not steal or aid in the stealing of Johnson Fitness Center property. Will not use or be under the influence of alcohol, tobacco, or any other unauthorized controlled substance within the Johnson Fitness Center. Will not deliberately counsel or invoke other employees, members, and/or students to violate Johnson Fitness Center Code of Conduct/Misconduct Policy or JFC Operations Manual. Johnson Fitness Center is part of the Northwest College Campus and is therefore subject to all Federal and State Laws. Note: Participants engaging in inappropriate behavior or violating JFC policies in any way may their privileges of participation suspended or revoked at the sole determination of NWC management consisting of the JCF Manager or NWC Administration. Participants whose privileges have been suspended or revoked will not receive a refund. 4. Assumption of Risk: The JFC operates on an exercise at your own risk policy. The use of the JFC facility and its programs are completely voluntary. Each individual utilizing the facility assumes the risk for any harm or injuries sustained. Neither Northwest College, nor the Johnson Fitness Center can assume any responsibilities for injuries incurred through participation in its programs and/or services in or outside the facility. However, all injuries should be reported to the Welcome Desk or Supervisor of the activity area and an accident report completed (Appendix F). It is strongly advised that participants use caution and be aware of potential health risks associated with exercise, and obtain a physical from a physician before beginning an exercise program. It is strongly recommended that every participant of the JFC activities be covered by a health and accident insurance policy. Both Participants and Non-Participants are provided with a release and waiver that must be signed for admission and/or use of the of the JFC facility and/or equipment (Appendix B & C) B. Access/Entrance/Exit:

The JFC is accessible from one main entrance the North outside exit into the weight room. This door will be open during hours of operation. The Trapper Gym is available for extended hours provided classes are NOT being taught. All NWC classes take precedence regarding access to equipment and space usage. Entry and exit of Johnson Fitness Center must always be through the designated main entrance and exit. Individuals entering or exiting through non-designated doors are subject to suspension or revocation of privileges. Members must show their student ID or Johnson Fitness Center card at the Welcome Desk. ID cards are non-transferable and are to be used exclusively by the individual named on the card. Any individual who presents a card other than the rightful member may be subjected to suspension or revocation of privileges. JFC staff reserves the right to check identification at any time. Individuals who are not members, suspended or expired members will not have access into the Fitness Center. Immediate removal and suspension will be issued to any individual who misuses a valid ID and may be subject suspension or revocation of privileges. Photocopies of any IDs will not be accepted. If the ID card does not have a visible photo name and/or ID number, the card will be considered invalid. Cooperation for presenting proper identification is expected at all times. Guests must check in at the welcome desk before entering. C. Memberships: 1. Membership Policy Access to Johnson Fitness Center services, for currently enrolled students, is included in student fees (there are additional fees for specific classes). Community members may also purchase memberships from the business office. Current and retired benefited employees of NWC receive a membership free. For a list of fees please see the membership fee schedule addendum. 2. Membership Categories Student Memberships A non-student summer membership is available for purchase to students who are not enrolled in summer school, but are enrolled for the following fall. Proof of enrollment through a printed class list is required at the time of sale Students enrolled in internet classes only do not pay an activity fee, therefore will need to purchase a membership to utilize the facility. There are additional fees for personal evaluations and personal training services. Student dependent or partner memberships are available at rates as shown in the membership fee schedule addendum. Community Memberships Memberships are available to all members of the community. The list of options and prices can be found in the membership fee schedule (Addendum). 3. Payment i. Payment can be made in advance at the business office (ORB106) or the fitness center. First time members need to pay in the business office in order to obtain their membership card.

4. Cancellations and Refunds i. Cancellations and refunds will be prorated based on usage unless a membership has been suspended or revoked due to failure to follow the membership handbook. Suspended or revoked memberships are not eligible for refunds. 5. Waivers Northwest College does not waive membership fees. 6. Guest Policy i. Monthly, weekly, and Daily passes are intended to accommodate individuals who would like to use Community Fitness for a short period of time. Guest passes do not need to be purchased in advance (but can be) and are available at the Welcome Desk. In order to participate as a guest the following must occur: 1. Guests must sign a liability waiver form. 2. Community Fitness reserves the right to approve or deny any day pass transaction. 3. Day Pass Fees/day (See membership fee schedule). 4. Weekly Pass Fees (See membership fee schedule). 5. Monthly Pass Fees (See membership fee schedule). 7. Conflicts i. Conflicts regarding membership status shall be referred to the Fitness Center Manager. 8. Non Participant Policy i. The JFC allows current members to bring non-participatory guests to use the Trapper Gym at no cost. All minors under the age of 15 years MUST remain in the Trapper Gym with adult supervision at all times. All non-participatory guests must be wearing appropriate footwear and follow all footwear requirements. The staff of the JFC reserves the right to ask any non-participant to exit the building at any time. 9. Minor Policy a. Definitions o Minors are defined as members less than 18 years old. b. Unaccompanied minors policy o Members ages 14 to 18 who complete the health history and waiver and who complete a New Member Orientation meeting with a trainer and are approved to use the Johnson Fitness Center without direct parental, guardian, or other adult supervision. c. Minor/Minor Guest Policy o Minors (under 14 years of age) must have a health history and waiver signed by a parent or legal guardian. The minor must be supervised by a parent, guardian, or someone 14 or older at all times. Without proper supervision, minors will be denied access to the facility. o An adult or guardian of the minor or minor guest will be notified immediately to provide direct supervision to their minor or the minor may be asked to leave if they have not completed the required forms and orientation meeting. Minors or minor guests may be asked to leave at any time if they are not following the membership handbook and are subject to membership suspension or revocation as applicable. D. Policies, Rules, and Regulations

1. General Policies All areas and equipment within the JFC shall be used for the intended purposes. No bicycles, skateboards or scooters are allowed in the facility. Only service animals are allowed in the facility. All other pets are strictly prohibited. Requests to take pictures/videos must be approved through the JFC Manager. Pictures/videos may NOT be taken in the locker rooms or restrooms. It is recommended that picture/video requests be placed at least 24 hours in advance with the JFC Manager. The photographer needs to sign in at the Welcome Desk and is restricted to the specific event they are covering. The photographer verbally alerts the group that they are being photographed, telling them how the photo will be used asking for permission and allowing anyone who does not want to be photographed to step out of the picture. Spitting in the common areas or activity areas such as courts, drinking fountains, trash cans, etc., is not permitted. Personal items should not be left unattended, placed on the floor or on equipment; please use the locker rooms. Personal items are not the responsibility of the JFC. Staff members cannot hold equipment or valuables for any participants. Facility wide audio system: music selections made by Wellness Center staff only; personal music will not be played on the public audio system. Television use: the TV s will be set by JFC Staff. Requests are welcome. A closing announcement will be made approximately 15 minutes prior to closing. All participants are expected to finish their activity, re-rack all weight equipment, return any checked out equipment, finish showering, and exit the JFC by closing time. It is requested that members report any concerns about the facility and/or equipment to the JFC staff as soon as possible. 2. Accidents/Injuries Please contact a member of the JFC staff should an accident and/or injury occur. The staff member who is contacted about the accident/injury must fill out an incident report (Appendix F). 3. American Disability Act (ADA) Statement Northwest College encourages participation in activities by individuals with disabilities. If you are an individual with a disability who requires accommodation in order to utilize the center, please contact the Welcome Desk in advance at 307-754-6439. 4. Alcohol, Tobacco and Other Drugs The JFC is a substance free facility. Possession of alcohol, illegal drugs, and tobacco (this includes smokeless tobacco) are not allowed and possession of such items will result in removal from the facility and further disciplinary action and/or suspension or revocation of privileges as deemed appropriate by the JFC Manager or Northwest College Administration. The JFC reserves the right to check liquid substances in personal beverage containers. 5. Attire and Footwear

The JFC maintains a positive, healthy environment. It is expected that all users dress appropriately and the JFC reserves the right to determine the acceptability of all exercise attire. Jewelry, belts and other garments that may become caught in the machinery are not allowed. JFC staff decisions concerning appropriate clothing will be final. 6. Cell Phones Cell calls for recordings and talking is not allowed in locker rooms or while using weight equipment. Cell phones are allowed, but not encouraged on cardio equipment. Out of respect for others, we ask that you limit your cell phone use to public areas. 7. Damages Participants using the JFC facility and equipment assume the liability and agree to pay for any damages that occur as a result of misuse or damage other than normal wear and tear. 8. Privilege Revocation/Suspension Failure to follow JFC policy will result in ejection from the facility. Upon ejection, the individual will remain suspended until a decision regarding disciplinary action, and/or suspension or revocation of privileges is determined by the JFC Manager and NWC administration. 9. Equipment Checkout A valid driver s license, cell phone or keys must be presented to checkout equipment. Members may check out the following equipment: Item Replacement Cost Basketball $25.00 Volleyball $25.00 Boxing Gloves $60.00 Weighted Rope $150.00 TRX Suspension System $299.00 The Lebert Equalizer $100.00 Replacement - The person checking out the equipment is responsible for the item(s). If the equipment is lost, damaged, or not returned, then the individual who checked it out is responsible for the replacement cost. The individual s JFC membership will be suspended until the charge is paid. 10. Food and Beverages Food is NOT allowed at any time in any activity. Water and sports drinks in closed containers may be used in the exercise or gym areas. All containers are subject to substance check at any time by the staff. Glass containers are prohibited at all times. Chewing gum is not allowed. 11. Locker Usage Large, medium and small lockers are available for members on a first-come, first serve basis. A locker check is performed twice a year. JFC will notify ALL members of when those checks will take place. Members using the lockers will be expected to empty the locker for the check. Information regarding locker availability can be inquired at the Welcome Desk.

12. Lost and Found JFC is not responsible for lost or stolen items. DO NOT KEEP VALUABLES IN THE JFC LOCKERS. Lost and found items should be turned into the Welcome Desk. Campus Security needs to be contacted for ipods, keys, phones, rings, and jewelry if lost or stolen. Any inquiries about lost and found items may be made at the front desk. Items that are not claimed after 14 days will be given to a charity. Individuals who lose an item or find an item will fill out a form at the Welcome Desk (see Appendix). 13. Posting and Solicitation No outside postings are allowed. Solicitation is strictly prohibited unless the individual is a college employee acting under the terms of their contract. 14. Area Specific Policies a. Cardio Equipment i. Individuals are asked to wipe down the machine when finished, including the seat and hand rails, using the cleaning towels and spray provided. ii. Workouts are limited to 60 minutes if someone is waiting for a cardio machine. iii. Report broken equipment to Welcome Desk. b. Multi-Purpose Gymnasium i. Non-marking athletic shoes only. ii. Hanging on the rims or nets is not permitted. iii. No kicking or throwing of equipment towards the ceiling and/or walls. Equipment should be used only for the intended purpose. iv. Members are not to turn on the lights or tamper with the panel boxes; requests or problems should be referred to the JFC Staff. v. Equipment is available for checkout, with proper identification, at the Welcome Desk. vi. Gymnasium priority scheduling: Classes and athletic teams have first priority. c. Weight Area i. Free weights must be restacked and barbells and dumbbells must be returned to the racks after use. Any member found NOT racking there weights after 3 times of reminders from staff is subject to suspension of membership for the remainder of the semester. Free weights should not be placed near or against mirrors or walls or on benches. ii. Do not lift beyond your capabilities know your limits. If necessary use a spotter and/or ask the floor supervisor for spotting assistance. iii. Absolutely no slamming of weights set them down properly. iv. When crowded, do not occupy a select weight station for more than 10 minutes. v. Report any irregularity of equipment to the Welcome Desk or let appropriate staff member know. a. Harassment Policy b. Introduction: Harassment in any form hinders a student s, members, and client s ability to function and fully participate in all forms and functions within the Wellness Center. Likewise, harassment is in violation of every student s, members, and client s

ability to participate to their full potential within the Wellness Center. As a result, harassment in any form will not be permitted within the Johnson Fitness Center. All reported and observed cases of suspected harassment will be investigated promptly. Consequences facing employees may include reprimands, suspensions without pay, reductions in responsibilities, or expulsion. c. Harassment Defined: Harassment in any form will be defined as follows: Sexual Harassment: This includes any unwelcome sexual advances, requests for sexual favors, or any other physical or verbal conduct that impedes a member s, student s, client s, staff s participation within the facility. Discriminating against race and beliefs: Physical or verbal conduct that impedes a members, students, clients, and staff s participation within the facility. No such acts discriminating a person s race, color, creed, religion, ethnicity, ancestry, gender, sexual orientation, age or disability will be permitted on Johnson Fitness Center property. Such acts create a demeaning, intimidating, and threatening environment for a victim. Other: Any perceived act that creates a hostile environment for any person within Johnson Fitness Center in which their participation is altered will not be tolerated. d. Complaint Procedure: Complaints can be submitted a number of different ways. All reports will remain autonomous for confidentially/security of victim: i. Email: tiffany.phister@nwc.edu. ii. Call the Johnson Fitness Center at 307-754-6439 and press the appropriate department to which the incident applies. iii. Complete a Complaint/Grievance of Harassment Form. The form can be taken from the Johnson Fitness Center Operation Manual Appendix. Forms can be submitted as an attachment to tiffany.phister@nwc.edu or handed directly to the appropriate department to which the incident applies. iv. NWC Care Link nwc.edu/services/cares.html v. Depending on the severity of incident, further investigation may be needed for clarity. Each case will be handled promptly and proper measures will be taken by management to ensure a safer environment for the alleged victim to enrich their quality of life to its fullest potential. 15. Sex Offender Policy Members should not feel uneasy or unsafe using the Wellness Center. All reported and observed cases of suspected involvement will be investigated promptly. Due to JFC being a part of NWC campus, it is required that all registered sex offenders report to Campus Security to receive access to JFC.

The undersigned, for themselves or, if signing for the following named minor, do hereby agree as follows: (Print name of minor) Participation and use of the facilities and/or equipment at the Northwest College Johnson Fitness Center (hereinafter JFC ) is voluntary and I agree that in consideration of the privilege and consent by Northwest College to allow me to utilize the JFC facility and/or equipment, I do on behalf of myself, my heirs, successors and/or assigns, and/or the above-named minor, agree to fully release and waive any and all liability claims I may be able to make against Northwest College, its board of trustees, agents, representatives, employees, volunteers or insurers (hereinafter Released Parties ) from any and all liability, claims, damages, expenses, or attorney fees which I have or could have as a result of any personal injury, including death or damage, lost or stolen property. Northwest College Johnson Fitness Center Appendix E Community Fitness Tour Guidelines Northwest College and Johnson Fitness Center provides organizational tours for groups or individuals upon request. Groups or individuals may contact the Welcome Desk (phone 307-754- 6439) to establish an appointment for a tour. Tours will be conducted by JFC Staff. Use of the facility is not included with a tour. Individuals who are interested in a membership will be able to tour the facility during facility hours.

Northwest College Johnson Fitness Center Appendix F Campus Public Safety Incident Report Procedure Reporting Incidents All incidents relating to the Johnson Fitness center should be reported to the JFC Manager or the Human Resources Director (ext. 6401) if needed. Procedures Incident Report Forms A Northwest College Incident Report form should be completed and submitted to the following location: Johnson Fitness Center (JFC ) Claims and Loss Reporting The following procedures will be adhered to regarding injury/illness claims occurring on campus or the Johnson Fitness Center: 1. The JFC manager will complete the form and notify Human Resources, that an incident has occurred. This applies whether or not medical treatment is required by the injured party. 2. The Human Resources will receive the report from the JFC Manager and will notify the Facilities Director to inspect the area of the incident, taking note of conditions, and taking necessary photographs. 3. If medical attention is needed, the JFC Manager will contact 911 as appropriate or follow up with the participant to report what happened. This information will be forwarded to the business office for submission to insurance if applicable.
