As a proud native of West Virginia, it is an honor to personally invite you to explore the many filming opportunities that exist in the Mountain State. Here, you will find film friendly services and unmatched hospitality. In addition, spectacular scenery is the first, last, and middle name of our state, where million dollar views outnumber towns. West Virginia is Location Driven we are home to hundreds of untapped venues ready for their 15 minutes of fame. Whether you need historical towns and villages, spa towns, metropolitan scenes, coal towns, Civil War battlefields, or rocky cliffs, West Virginia s diverse cities, towns and landscapes can go from the serene to the extreme. From the picturesque towns of the Eastern Panhandle to the rolling hills of the Ohio Valley, from the heavy industrial cities of the Northern Panhandle to the unspoiled, rugged mountains of the Potomac Highlands, West Virginia s abundant, distinct locations make them ideal for any type of production activity. For references, just ask Warner Bros., Magnolia Pictures, Paramount Pictures, DreamWorks, Walt Disney Pictures, National Geographic, The History Channel, and hundreds of other studios, production companies, filmmakers, and television and commercial producers who have captured West Virginia over the decades for the world to see. I invite you to join them in discovering new surprises around every bend. The staff at the West Virginia Film Office stands ready to assist your production in doing business in West Virginia. Ask the Film Office for details about our state s economic incentives, talented workforce, locations, support services, and accessibility. We look forward to being your host! Sincerely, Joe Manchin III Governor 3

A MESSAGE TO FILM INDUSTRY PROFESSIONALS The West Virginia Production Services Directory (PSD) is a comprehensive resource guide for filming in the Mountain State. With a few incentives to entice you and generous hospitality to greet you, we are confident you will enjoy your experience in West Virginia from the initial scouting process all the way through to the wrap. Among other categories, such as how to do business in West Virginia, profiles of geographic regions, and support services available across the state, the PSD identifies West Virginia s skilled workforce. From major motion pictures, such as We Are Marshall (Warner Bros.), to television programs for National Geographic, our workforce exhibits professionalism and industry knowledge and has been hired on dozens of projects that have selected West Virginia locations for filming. We encourage you to always consider hiring from our labor pool. Incentives for choosing our grand locations for your next commercial, music video, television, or motion picture production include: sales tax exemption for purchases (including rentals) of tangible personal property or services directly used in production (no cap imposed; no minimum spend required); exemptions from state and local hotel/motel taxes after 30 consecutive days; and River On Demand TM provides an open filming window in November on the Gauley River for approved projects that need control of whitewater (courtesy of the U.S. Army Corp of Engineers, Huntington District). As a section under the West Virginia Department of Commerce, Division of Tourism, the West Virginia Film Office is the best resource for your production team because the office utilizes an established statewide network of governmental agencies and economic development, tourism, and community representatives. Working with this network, the West Virginia Film Office ensures that all channels of communication are properly navigated, that prompt and knowledgeable responses to production inquiries are provided, and that cooperation remains at the forefront before, during, and after your shoot. The Film Office staff is available at a moment s notice to assist with your next production by scouting for the perfect location, assisting with logistical and technical support services, coordinating itineraries, securing site access, and providing additional supportive services as needed. Need locations not already in the digital Locations Library (home to thousands of images)? Let us know and we will tailor a production package for you. As Governor Joe Manchin proclaims, West Virginia is Open for Business. Let us show your production team the true meaning of film friendliness. See you soon! (Note, however, that food, beverages alcoholic and non-alcoholic and motor fuel are taxable.) Registration with the Tax Department is required, and with the exception of Sole Proprietors, all vendors must also register with the WV Secretary of State s Office (for details, see Doing Business in West Virginia below). As a complimentary service made possible by the drawdown of Summersville Lake by the U.S. Army Corps of Engineers, Huntington District, the West Virginia Film Office is able to offer an open filming window on the Gauley River between November 1 and November 30 for motion picture and television productions that require special whitewater releases. Flood control of the region, and other safety issues, will always take precedence, and advance notice is always required. The West Virginia Film Office exploits an established statewide network of governmental agencies and economic development, tourism, and community leaders to secure attractive rates on many services. PERMITS The West Virginia Film Office does not require permits, but depending on the selected filming location, various state and federal agencies may require permits/agreements and/or advance notice, especially if filming involves special needs (such as, road closures, use of pyrotechnics, etc.). In all situations, the West Virginia Film Office is the best first resource to act as a liaison among appropriate agencies. Special Effects and Explosives. All Entertainment Production Projects are reviewed on a case-by-case basis. If the production is closed and does not involve the public, no permit is required. For proximate audience and class D fireworks, one or more permits may be necessary. A license for the pyrotechnic operator may also be required. Permits are day/event specific. In the low-lying areas and valleys, including the western regions of the state and the Eastern Panhandle, winters are quite mild and summers warm. In the central, more mountainous areas of the state (particularly, the Potomac Highlands), winters are much colder, with greater amounts of snow, and summers are pleasant and mild. Income Tax Withholding. The information below is based upon those statutes and reciprocity practices in effect at the time of printing. Amendments may occur that would cause these instructions to change. Instructions for Residents of Kentucky, Maryland, and Ohio. If your WV income during a calendar year was from wages and/or salaries only, you may file the Special Nonresident Form IT-140NRS as a claim for refund of any West Virginia income tax withheld during a calendar year. If you had WV income from a source other than wages and/or salaries, you must file the Nonresident Form IT-140NR/PY. You are not allowed a Schedule E credit against your WV income tax whenever your WV income is other than wages and/or salaries. You should apply for the appropriate credit on the income tax return filed with your state of residence. 14

If you had WV income from a source other than wages and/or salaries, you must file the Nonresident Form IT- 140NR/PY. You are not allowed a Schedule E credit against your WV income tax whenever your WV income is other than wages and/or salaries. You should apply for the appropriate credit on the income tax return filed with your state of residence. A Schedule E credit would not be allowed on the WV return. You should apply for the appropriate credit on the income tax return filed with your state of residence.] SPECIAL NOTE: Residents of KY, MD, OH, PA, and VA may be relieved from filing an annual claim for refund of WV taxes withheld from their wages and/or salaries by requesting Form WV/IT-104 (WV Certificate of Nonresidence) from their employer. Form WV/IT-104 may be completed and returned to the employer who would then be authorized to stop withholding WV income tax on wages and/or salaries earned in WV. Subject to certain limitations, you should be allowed a credit against your resident state s personal income tax for any WV income tax imposed for the taxable year on income derived from sources within WV. The purpose of the credit is to prevent dual taxation of such income. West Virginia reciprocates by offering its residents a similar credit for income taxes legitimately paid to other states. After completing the business registration application for the WV Tax Department (which includes a section for Unemployment Compensation on page 3 of the form), the Tax Department automatically forwards an electronic copy of the application to the WV Bureau of Employment Programs, even if the applicant has no employees. After review, the WVBEP will determine whether additional information is needed and will contact the employer at that time.
