In particular, Approval Condition No. 1 9 states that "improvements within State right-of-way shall be inspected and completed to FDOT's satisfaction prior to the issuance of the first Certificate of Occupancy (CO)". As explained in the letter we submitted on October 24,2008, it is anticipated that the Owner of Lot 9 will be requesting a CO approximately 4-6 weeks prior to the completion of the work within the FDOT right-of-way. We have submitted the request for this condition to be modified to allow the issuance of the first CO (for Lot 9) prior to the completion with the FDOT right-of-way. This request has been submitted based on the following: The work within the Highway 54 right-of-way is ongoing, and a performance bond for 100% of the cost of this work has been provided to FDOT. Access is available to the property (Lot 9) fiom Trinity Boulevard. The Trinity Boulevard turn lane has been completed, inspected, approved and accepted by Pasco County. As a follow-up to our telephone conversation on 11110108 and my subsequent comespondenct with Ms Cindy Jolly in an effort to support the request to modify condition # 19 of master plan approved for Trinity Corporate Center, we have reviewed the approved h-affic study for the master plan and developed a site traffic assignment for "Lot 9" only. The site traffic assignment for the Lot 9 was developed based on the approved directional distribution from the master TIS and is listed below: SR-54 at Corporate center Drive - Westbound left turn into site SR-54 at Corporate center Drive - Eastbound right turn into site Trinity Blvd at Corporate Center Drive Westbound right into site Trinity Blvd at Comrate Center Drive - Eastbound left into site Total = 26vph = 35Vpa = Svph = 22wh = 88vph (Inbound Total) Table 1 contains the PM peak hour trip generation table for the Trinity Lot -9 development consistent with the previously approved TIS application for this deuelopment. Based on Graph 1B (Right-Turn LMC Wmants for Four or Six Lane Facilities) from Pasco County's Appendix-A document, the minimum threshold to warrant a right turn lane is 40 right turns in the peak hour. Since the PM Peak Hour eastbound right turning volume at SR 54 and Corporate Center Drive for the Trinity Lot-9 development is projected to be less than 40 vph (i.e.35 vph), an eastbound right turn deceleration lane on SR 54 at Corporate Center Drive is not warranted. Also, plcasc note (hat the approval of the new Barbuque Rwtaurant on the north site of SR 54 at Success Drive is an example of a similar "singjew lot development that did not required any off-site improvements on SR 54.
