We are well into our first year as the newly formed Local 158 and we would like to use this as a forum to update you on activities throughout our jurisdiction. In this edition, you will find reports from the District Managers and agents as well as training reports from our three training sites. Additionally, a number of reminders and announcements are included. As you know, Local 158 formally came into existence on January 1, 2011 and consists of Districts 106, 545 and 832. We have jurisdiction for both Construction and Stationary Operating Engineers throughout 42 counties in Upstate New York. At a time of economic uncertainty, anti-labor sentiment and nonunion competition, the combined strength of the three districts positions us well to deal with the many challenges ahead. While change is never easy, it is often necessary. I am pleased to report that the changes that have taken place throughout the merger have gone smoothly. As Local 158 moves forward, we will continue to review the structure and operation of both the union and the training sites with an eye to ensuring that both are providing the best possible service to our membership. As I have discussed at membership and executive board meetings, one of the issues that needs to be addressed due to the merger is the requirement that we have a uniform dues structure for our local and its various branches. A committee has been thoroughly reviewing this and will be presenting a dues proposal for membership approval at the upcoming July semiannual membership meeting. This will be a specially called meeting and a secret vote will be taken. I urge all of you to attend. 3 Traditionally at this time of year we are busy dispatching operators and speculating on how busy a work year we will have. As everyone knows, the national economy has been slow and Upstate New York has suffered with the rest of the country. Despite this, and despite a very wet spring, Local 158 should be very busy this year as you will see by reading the agent reports. Some areas of our local will be busier than others but if you are willing to travel to adjoining districts there should be work for you. A reminder for those operators who do want to work out of their district; you must register on the out of work list for the district in which you want to work. You can be on only one list at a time and you must be available for work, not working somewhere else. We recently negotiated the master Building Agreement with Eastern Contractors Association which covers District 106. The agreement provides for a 4% total package increase and was unanimously ratified at the most recent District 106 meeting. In addition to the master construction agreements, Local 158 is responsible for negotiating individual collective bargaining agreements with the multitude of companies that employ our C and S charter members. At any given time, we are in negotiations with at least one employer. Negotiations this year have been particularly difficult given the economic downturn and the never ending rise in health insurance costs. Despite this, we have generally reached acceptable settlements and anticipate the same in upcoming negotiations. I will close by thanking the committee of retired business managers and presidents of former Locals 106, 545 and 832, who, as a display of solidarity, installed the new officers of Local 158 at the January general membership meeting. For those of you who were not present at the meeting, a list of your officers is printed on the inside cover of the magazine. I hope you all have a safe and prosperous summer. Bill Walsh, District Manager District 106, Albany, NY Albany, Greene, Columbia, Rensselaer, Dutchess With summer approaching, I feel comfortable saying we are off to a good start. A joint venture between Barnard Construction and D.A. Collins was awarded a contract to reface the Gilboa dam and should begin work soon. This is a significant project for us and should provide work for a few years. Thalle Construction which had the first phase of the project should be done within the next four to six weeks. In Albany County, the $360 million dollar Albany Medical Center project is in full swing and is a 10% union job. SUNY Albany is a very busy place these days with several projects ongoing, including new dorms, renovations on several buildings and major infrastructure near the football field. Starting in mid- May, the completion of two new parking lots to welcome the new Business School will get underway. We recently negotiated a PLA for the The Fuller Road Nanotech, a $500 million dollar project. Rifenburg Contracting has the site work and PSI expects to come in late August with two cranes; a 2250 and 16000, for the erection of precast. Rifenburg Construction has the $100 million dollar Thruway Job. Business Manager Dan McGraw and I have had several meetings with Jack and George Rifenburg to discuss this project. From any vantage point in the City of Albany you can spot the tower crane at the Capitol. The Governor would like to expedite work on this site which may require another crane. We still have contractors at the old Stiefels Laboratory in Greene County; a $56 million dollar project. In Columbia County, Callanan was low bidder on a five million dollar DOT project within a couple miles of Calarusso s Plant in Hudson. Nice Job Callanan. We are still waiting to see if a union contractor will end up with the site work at Dutchess Community College. Schultz Construction has a five million dollar DOT tunnel project in Dutchess County at Marist College. It is a pleasure to say that this will be our second job agreement with William Schultz. I have had a two year organizing campaign at P&M Brick (The Port of Coeymans) and with the help of our membership, we are finally looking at being recognized as the exclusive bargaining agent for the employees there. I encourage all members to please call me with any questions about any job in Albany, Rensselaer, Columbia, Dutchess, and Greene Counties. In closing I would like to thank all members who showed up for the proposed black top plant issue in the City of Rensselaer and the picket lines in Troy. I would also like to congratulate our Business Manager Daniel J. McGraw on his recent election as 12 th Vice President of the International Union of Operating Engineers. Phil Dobie District 106 will be busy manning two of the larger jobs within Local 158; the multi-billion dollar microchip plant and the Hudson River remediation project. Global Foundries is the owner of a chip fab plant, being built in Malta, N.Y. This job started in the summer of 2009 and is expected to be completed and ready to start production in early 2013. Most of the work for us will be winding down in the next few months but we currently have 30 to 40 operators running fork lifts, lulls, elevators, and a few remaining cranes supporting the 1500 tradesmen on site. Hopefully by the time you are reading this, work will have begun on the new 5 story administration building and associated parking lot. Many of us believe that a second chip farbrication plant will be built in the near future. We are starting to dispatch operators for the Hudson River PCB remediation project. This project has been delayed quite a bit due to the large amount of snow melt and rain we have had this spring. Shaw Environmental was selected as the contractor for the operation of the dewatering / filter press facility. When it is fully manned we should have about 50 operators on site for this portion of the Washington, Saratoga 5 project. Jay Cashman Marine has the contract for the dredging of the PCBs from the Hudson River. We are working with our sister Local 25 on this portion of the project and anticipate having 150 to 200 operators with Cashman. Hopefully this phase of the project will provide us with work for the next 6 years. Congratulations to our new Business Manager Dan McGraw and also to Terry Hogle, Richard Ross and the rest of our new team. Good times and good things are in our future with Local 158. Jeff Kellogg January 1, 2011, the date of the merger of three upset locals to create Local 158, was the end of one era and the beginning of another. We were all proud to be members of our respective locals and change is always hard to accept. I look forward to working closely with all of our Brothers and Sisters in all three Districts to make this Local the finest in the Country. I believe this is the beginning of something our sons, daughter and grandchildren will be proud of as we move forward as Local 158. Work continues on the Crown Point Bridge with Flatiron Constructors. The bridge is scheduled to open on October 9, 2011. The area where they are going to build the center span arch of the bridge is still under several feet of water and construction is on hold until the lake goes down. I would once again like to thank all of the operators who have worked on this bridge over the last year through the many cold days and nights and have demonstrated a great amount of skill and professionalism. The Marble River wind farm project still has not started as they are waiting on one more permit. They are expecting to start some of the roads by the end of June. We are still talking with Laurentian Aerospace and Cianbro Corporation about work on the $175 million project at the former Plattsburgh Air Force base. They are building a maintenance hangar that will be big enough to service two 747 jumbo jets at the same time. The bidding process has not started but should be taking place in the next few weeks. The St. Lawrence gas pipeline has not gone out to bid yet. This is a 50 Franklin, Clinton, Essex, Warren, Hamliton mile pipeline with 8, 6 and 4 pipe. It starts in Norfolk, St. Lawrence County, and ends up in Chateagay, Franklin County. Bid proposals should go out soon. There are also many smaller projects that are out to bid throughout the North. I would like to welcome Running Deer Construction as a new signatory contractor. They are located in Hogansburg, NY and I look forward to working with them for years to come. All we have to do is wait for the rain to stop so we can get it going. Please do not get discouraged, the work is there and must get done. In light of some of the large projects in our area we are a bit concerned about having enough skilled operators for our local contractors. Hopefully the other districts will have members willing to travel. It is important that our signatory contractors have the confidence they will get skilled operators who can interact with their existing workforce and look out for the best Rob Aikens Despite the weather, things are starting to pick up in the southern tier. Gorick has the work at the Broome county landfill and Economy Paving picked up three bridges in the area. Maxim is still working at SUNY Binghamton and bids are in for new dorms on campus. We have quite a bit of pipeline work scheduled this summer if we can get it started. Otis Eastern should be starting the 10 mile Laser Midstream Line soon. The project has been delayed a bit awaiting air quality permits for the compressor station. interest of the union contractor. This will be a good year for younger or less experienced operators to get out and develop their skills. Theoretically, the more practice you have the better operator you will become. Remember, attitude is a little thing that makes a big difference! Please remember to set a good example when working with these new faces and help them out whenever you can. Work in Schenectady County is off to a good start. LeChase has the Battery Plant at GE and is using Northeast Erectors as well as Keller and Dan s Demolition. Hohl Industries is working at the main GE plant in Schenectady and All union contractors are in place for the pipeline and compressor station. We also have about 10 miles of the Bluestone Line. All of the right away in New York is in place and they hope to have their permits by August 1 st. Otis Eastern has also picked up some maintenance work on the Tennessee Line in Schoharie County east through Massachusetts. We think a lot of this work is in anticipation of the Marcellus Shale Hydrofracking. If we get the green light on the hydrofracking we will have an enormous Herkimer, Fulton, Montgomery, Schenectady signed an agreement with us and Testa Demolition is dong work at the American Locomotive Works at Freeman Bridge. In Montgomery County work is finishing up at the Target Distribution Center. Right next door Rig-All is doing the roof collapse repair at the new Beechnut Plant. Callanan has work on the Thruway and in Canajoharie. In Fulton County Keller is doing the site work at the Fage Yogurt factory. Further west in Herkimer county we have Tuscarora performing work for Brookfield Power in Little Falls while work continues on the windfarm on the district 106/545 border. Make hay when the sun shines. Broome, Chenango, Tioga amount of work for the foreseeable future. The I-86/Route 17 project is scheduled to be bid in August of this year. The first phase has an engineer s estimate of about $150 million dollars. We have been pushing very hard for a PLA on this project. A feasibility study was conducted which documents significant cost savings for the state if a PLA is used. DOT has the study and will ultimately make the decision. 7 Terry Hogle, District Manager This year, District 545 has gotten off to a later start than we anticipated due to the extensive rain in April and May. However, work at 9 Darryl Merriam Mile in Oswego has been a good start to the season and some additional maintenance continues to offer good employment for many operators. A number of other projects including the Massena GM Demolition Project, the CSO44 Sewer Separation, the Honeywell Lake Remediation Project, the Tug Hill Wind Farm maintenance and the completion of the Hardscrabble Wind Project have gotten started but probably won t be in full swing until June. A number of large projects are being bid soon including the St. District 545, Syracuse, NY Lawrence Gas Extension Pipe Line and the Trolley Lot underground storage tanks in Syracuse which will be built as tunnels. The Galloo Island Wind Farm, the Fort Drum Training Center and the Alexandria Bay Border Crossing have not been bid but are being watched closely. For those members in District 106 and 832 who I have not had the opportunity to meet, I look forward to talking with you at the meetings and please feel free to attend any of our 545 annual events. Seneca, Cayuga, Madison, Oneida, Herkimer Economy Paving has work in several parts of the district, although weather is causing some slow starts and CFR will be paving the Thompson Road job. The Utica School PLA is gearing up for work this year at Proctor High School and J.F.K Junior High. There will be more work to do at Hardscrabble Wind Farm. The roads need Bill Shelly The GM clean up has started after years of delay. The first phase of the project is the removal of the building and water tower only. Most of the metal is being cut up, sorted and loaded onto railroad cars to be shipped off site. Most of phase one should be completed by September and phase two will be bid on shortly thereafter. Phase two will include removal of concrete floors, tunnels under the floors and the contaminated soils. Brandenburg is the contractor at this point for the project. T.J. Fiacco is finishing up at Heuvelton School and then will be starting up a job in Potsdam at the Mayfield to be finished once the area dries out some. Some pipeline work is beginning now. Otis Eastern has a spread in Morrisville, and Price-Gregory has a series of dig ups and re-routes in five counties, starting in Cortland. LeTourneau is doing the land clearing for both lines. Regarding shops and quarry CBA s, the members have accepted an offer from Apartments, which will include driveways, parking lots and sidewalks. Perras has some work at SUNY Canton, Alcoa and miscellaneous work for Brandenburg at GM. Harvey Excavating picked up work in Potsdam for Clarkson University. They are also the general contractor for work at Massena Central School. J.E. Sheehan is doing work for the senior citizen High Rise Apartments in Potsdam, a new teacher s union building and has started the shoreline stabilization project for the NYS Power Authority along the St. Lawrence River. American Callanan at Oxbow Quarry which is going to print now. OCRRA talks are still proceeding slowly. Vantage Equipment is underway and the On- Center is starting now. With so much Hazmat work coming, it is imperative that you stay certified. I hope to see you at the Training Site. St. Lawrence, Jefferson, Lewis Bridge is replacing the steel decking on the middle section of the Ogdensburg International Bridge. Alcoa is starting to do some maintenance work this spring and Murnane has picked up some of this work thus far. Congressman Bill Owens has sent a letter to Homeland Security requesting a PLA on the border crossing at Alexandria Bay. He is also looking at a PLA project for Fort Drum. The Congressman is a true friend of ours and is looking to keep local labor working in our area. So if you happen to see him, please thank him for his help.

I would like to thank Phil Dobie and Mark Mincher for all of their help with our classes. The year started with nearly 300 members renewing their HAZMAT, and 19 members taking the initial HAZMAT course. This year in addition to an OSHA 10 class, we held our first OSHA 30. Both classes had very good turnouts. Thanks to Marty Swauger, 832 Training Coordinator, for assisting with the OSHA 30. It was extremely informative to the members. With the help of Mark Mincher, the 1 week crane class was a huge success. Everyone from the class who took the NYS written exam passed and will soon take the practical exam. The 5 week hands-on crane class was also very informative and well attended. I would like to thank Vinnie Fay and Hugo Emma for all of their help with the class. Please check your forklift certifications. They need to be updated every 3 years. Starting in May, a forklift class will be held every first Monday of the month. Also, new to the training department is a Caterpillar D-4 equipped with GPS. Training on the Trimble GPS System will be coming soon. Please check the 158 website. District 545 training site 814 Co. Rt. 23 Constantia, NY 13044 Phone (315) 623-7176 Fax (315) 623-7194 Staff: RICH DOBIE, COORDINATOR Training season is winding up as the snow ends and the monsoon season begins. Luckily, the gravel here in Constantia can take a lot of rain before it becomes a problem for training. We had a very busy season, with most classes enjoying very good attendance. A lot of members capitalized on the opportunity to take OSHA 10-hour Construction Safety this year in order to keep their cards up to date. The scraper we got last year seems to work very well. Brother Karl Button helped the members by providing some very valuable training tips for the scraper operator as well as the operator of the push-cat. We recruited some new apprentices recently and hope to have them trained and out working in their new careers very soon. I expect to be hosting a 40 Hour Hazmat Class in the near future, as well as another OSHA 10 hour Construction Safety Class for members who need or want them in order to be more employable. District 832 training site 121 State Rt. 70 Dansville, NY 14437 Phone (607) 545-8654 Staff: MARTY SWAUGER, COORDINA- TOR This year s training season proved to be one of great challenges and even greater successes. We began in the early month of January with our CDL class and really kicked things into high gear. Along with our usual schedule of classes which showed great member participation and feedback, we incorporated a new Steward Class and Signaling Class. Our Steward Class and Rigging and Reeving classes were conducted under the National Training Fund and were both well received by members. We ended with our first CDL Class A class with much appreciation to our brothers in Syracuse for lending us their truck to train our members. We had an annual apprentice recruitment which resulted in bringing in three apprentices, two who are currently working. Thank you to all that were involved in making this a successful recruitment. At the close of this season, I traveled to Albany to teach alongside fellow instructor Bill Gray for the OSHA 30 Hour Course. This was a great opportunity and I met some great members from different areas. I would like to extend a thank you to all who were involved in this year s training season, particularly our instructors and members for being so enthusiastic and dedicated.

9 Dick Ross, District Manager District 832, Rochester, NY Our merger is complete and, as expected, our three organizations have come together to make the transition from three separate autonomous locals into one as seamless as possible, making us stronger and better able to compete in today s fiscally challenging environment. I look forward to the new opportunities that this merger will provide to all Local 158 members. Grant Malone It seems that the rain has finally stopped for the time being here in the Rochester area. Now, hopefully we can move forward with some of these overdue projects. Our Monroe County Water Authority Project is well under way. The tunnel portion is half way completed under Lake Ontario. Quality Structures will be breaking ground soon on the Water Treatment Plant project. The pump station, in conjunction with the tunnel, should start mid to late June. I would like to congratulate Matt Feil, Tom Flynn, Andre Mathis, David Wentworth and Ezekiel Allen on successfully completing our 4100 hour Operating Engineer Apprenticeship program. We welcome you as journey level operators and wish you all safe and productive careers. Please take advantage of all of our new training opportunities at our training facility including CDL License training, disaster site worker training, first aid, crane hand signaling and enhanced rigging and reeving. It is this very training that provides us with the skill sets needed to outperform our nonunion competition. Kranes Inc. of Central New York, our up and coming crane rental house, has added its latest addition to its fleet, an 18 ton Potain MDT302 topless tower crane and is working at The University of Rochester. The Pike Company is adding two floors to the existing Golisano Cancer Center at the University of Rochester Medical Center. The University, Rochester s number one employer, has plans to spend a half a billion dollars over the next ten years. This will expand their foot print here in services, which means building new facilities. This definitely helps the Operating Engineers and all the other skilled trades here in putting their members to work. Please take note of our new office hours: 8:00 am to 4:30 pm. These are the hours when member services will be provided. Certainly, you can still contact your Business Representative as you always have by cell phone at any time. If you would like a copy of our new Local 158 By-laws, they are available at our District office. In closing, I would like to remind members that now more than any other time in recent history, it is important to register to vote and, in fact, to vote! There is an assault on organized labor and the middle class and our ability to have representation in the workforce that we haven t seen since the early 1900 s. It is vitally important for you and members of your families who are eligible to vote to have your voices heard. Have a safe and productive year. Monroe, Ontario, Wayne, Yates, Genesee, Livingston, Ontario Quality Structures is half way through with its new $15 million dollar field house project at SUNY College at Brockport. They struggled with the weather this past winter to get the steel erected with Fast Trek Steel, Inc. from Albany. Quality Structures is moving forward on their Erie Harbor Housing Project on Mt. Hope Ave. for the City of Rochester. Unfortunately, the City did the demolition portion of that project with an out of town non-union contractor. Working with the City of Rochester, we were able to secure the new construction there with one of our local union contractors, Quality Structures, to put our operators to work. MCWA tunnel project

10 THE UPSTATE NY ENGINEER MAY 2011 Tom Schweizer On the shop side, Manitou Concrete has begun work on a new five bay maintenance facility/office complex on Jefferson Road. This new building will house both mechanics from Jefferson Road and Penfield with the eventual closing of the Penfield facility. All Hanson locations in Victor, Batavia, Honeoye Falls, Phelps and the many concrete plants in our area have completed member call backs. All of the plants are either up and running or doing maintenance at this time. Milton Cat in Batavia is seeing an increase in business as the economy slowly improves. They have been adding technicians to their workforce in the past couple of months. Paul McCormick Quality Structures is back on the project at Schlumberger. They also have work at the Corning, Inc. plants. Ramsey Construction has various bridge replacements throughout the Southern Tier. L.C. Whitford has the Main Street rehabilitation project in Andover and various bridge maintenance projects. Wenzel Construction started a site job for a housing project and they are also working in the Corning, Inc. plants. The Howard Wind Farm project that was postponed in 2010 has commenced. A Project Agreement was signed with Delaney. There are 25 turbines to be erected there. JPW will provide the crane for the erection on the project. JPW, along with Barnhart, is currently doing maintenance at the Cohocton Wind Farm. Alfred State College is building a new student leadership center. Christa is the General Contractor. The site package went to a non-union contractor. I have been in discussions with them and they are willing to talk Caterpillar is also introducing a new line of on road trucks this year. When enough of these trucks are out on the road, our technician s workload should increase further. We are currently in various stages of negotiations with Five Star Equipment, Monroe Tractor, and Anderson Equipment. Employers are using the poor economy as leverage against us to hold down wages and benefits. To combat this, we must work harder to secure fair settlements for these highly skilled technicians. Please make sure when calling our office that we have your current phone number. There is nothing worse in our business than missing an opportunity because you changed phone numbers and did not notify us. Allegany, Chemung, Livingston, Ontario, Yates, Schuyler, Steuben about the possibility of working with us. I will be watching this project closely if they chose not to work with us. ASC has more projects planned in the future. Otis Eastern was awarded 15 miles of 24 pipe in Corning, NY. Michaels Corp. will be the horizontal directional drill contractor for the project. There is a 3000 directional drill. They are waiting on a Federal Energy Regulatory Commission (FERC) environmental permit to start. Utility Line Service was awarded 1.5 miles of take-up and re-lay in Victor and Canandaigua with various valve change-outs. They are also waiting on an environmental permit. C.J. Hughes has been awarded pipeline work for Dominion Transmission in Lindley, NY. This project involves relocation of three pipelines. The approximate start date is the end of May. Joe Agnello We are almost halfway through 2011 and it finally appears as the economy is starting to respond slowly. Nowhere is it being felt more than when we are in negotiations with our employers. They have been using the economic climate against us by trying to hold down wages and benefits, but it is hard to stomach when we see them constructing new buildings and expanding businesses. There is a new Math/ Science building going up at Nazareth College and the University of Rochester is opening its new CTSB building, along with bright futures at Highfalls Brewery and Upstate Farms Cooperative. We keep hearing about double digit increases in the cost of health insurance and that affects what the companies are Jim Glathar Brothers and Sisters, you all know what a tough year it has been. In fact, the last couple of years have put everyone to the test. We have had some especially trying negotiations over the last few years, with a few negotiations almost ending up with our members on strike. Although the news coming out of Washington has not been good, there is a feeling out there that we are returning to normalcy. We are starting to negotiate willing to offer in benefit and wage increases at the table. The Upstate Cooperative, Highland Hospital, Rochester General Hospital, Parma Highway Department and Bolton Point Water Plant are examples of a few where we ve done this without compromising the benefit packages that have been in place. We now are preparing for our upcoming negotiations with the University of Rochester, which will be starting sometime in June with the contract due to expire in mid August. Not only are the companies feeling the pinch of the economic climate, we feel it as well. With the cost of gas, groceries and utilities escalating, we try to increase the total package to benefit all of positive outcomes for our members. We are currently starting negotiations with the University of Rochester s two bargaining units; Central Utilities and the Maintenance Skilled Trades Group. Although the Town of Canadice s collective bargaining agreement doesn t expire until the end of the year, they are ready to start negotiations. We have negotiations for the Town of Naples and the Town of Parma highway departments coming up at the end of this 11 Stationary Engineers our members. The stewards at the U of R will be passing out proposal sheets for your input. Please return them as soon as possible as we would like everyone to have a voice. I will be meeting with the stewards to assemble our proposal package and will keep you informed as negotiations proceed. One final note, I would like to thank Paul Sanderson for his many years of service as Union Steward at the Eastman School of Music. Members like Paul make the workplace what it is today. He has achieved many benchmarks for future stewards to try and emulate. The Union would like to wish him all the best in his retirement and in all of his future endeavors. Stationary Engineers year. Unity Hospital, which operates Park Ridge Hospital and St. Mary s Hospital along with the Town of Amity and Rochester Genesee Regional Transit Authority negotiations will be keeping us busy. 12 THE UPSTATE NY ENGINEER MAY 2011 Mike Lyons District 106 - Shops, Quarries, Surveyors The past couple years, as touched upon in several of the other reports, have been harsh in the arena of negotiations. It seems that we have been at the bargaining table constantly all year due to the uncertainty with health insurance and the future economic landscape. Watching the news or reading the paper, one can t avoid witnessing the constant attack on organized labor throughout the country and this is not only prevalent in public sector but in the private as well. In lieu of all this, we have persevered more so than not to negotiate collective bargaining agreements that enhance or at least maintain the wage and benefit levels for our C and S charter members. We are currently in negotiations with Callanan Industries for our members working at the Cropseyville, Pattersonville and Ravena plants. We are also putting together a first contract for the King Road facility which falls under the Callanan/Oldcastle umbrella. C & C Ready Mix, the Town of Vestal and the City of Albany are also contracts that we are currently in negotiations with and we hope to get them wrapped up as soon as possible. We have countless other agreements coming up, so rest assured that the District 106 negotiating team will be working hard to obtain fair and equitable contracts. I d like to thank all of our members working under the C and S charters for their strength and understanding during these trying times and keeping the faith that the economy will make an upswing in the near future.
