JAMMU AND KASHMIR LEGISLATIVE ASSEMBLY SECRETARIAT 12 th Legislative Assembly (4 th Session) January-February, 2017 B U L L E T I N Saturday, January 21, 2017 (1 st Sitting) The House met at 10.00 A.M. in the J&K Legislative Assembly Hall, Jammu. Sh. Kavinder Gupta, Hon ble Speaker in the Chair. At the commencement of the day s proceedings, Hon ble Member Mr. G. M. Saroori, Congress stood up from his seat and raised the issue of inconvenience faced by the people of Doda District due to recent snowfall resulting in road blockade and demanded the opening of Nashri Tunnel shortly for their convenience. Hon ble Member Mr. Usman Abdul Majeed, Congress raised the issue of a person namely; Mohammad Ayoub Banaia S/o Shah Wali Banaia R/o Maliknar, Bandipora whose house has allegedly gutted in fire during the intervening night and sought compensation from the Government in his favour. Hon ble Members viz; Mr. Vikar Rasool Wani, Mr. Mohammad Amin Bhat, Mr. Asgar Ali Karbalaie of Congress, Mr. Mohammad Yousuf Bhat, PDP, Mr. Javed Ahmad Rana and Sheikh Ishfaq Jabbar of National Conference protested against the alleged power shortage/ defunct transformers in their Constituencies and sought intervention of the Government. Hon ble Member Mr. Altaf Ahmad Wani, NC drew the attention of the Chair towards the three families in Aaroo, Pahalgam whose houses were allegedly damaged in an encounter some days back and demanded ex-gratia relief from the Government for the affected families. Hon ble Member Sh. Devinder Singh Rana, NC raised the issue of lathi-charge on Anganwadi/ Asha workers who are observing strike for the last many days for enhancement of their honorarium and sought intervention of the Government in this behalf. Taking cognizance, the Hon ble Speaker directed the Government to look into the issues raised by the Hon ble Members. Hon ble Member Er. Ab. Rashid, Independent sought statement from the Government with regard to the detention of 14 year old boy under PSA. Without getting any response from the Chair, the agitated member continued his protest and came into

the Well, he was joined by Hon ble Member Mr. Mubarak Gul, NC. In response, Mr. Abdul Rehman Veeri, Hon ble Minister for Parliamentary Affairs and R&B informed the House that Government will give a statement at 12:00 Noon in this behalf. However, the agitated Hon ble Members continued their protest in the Well of the House. Intervening, the Hon ble Speaker informed the agitated members that Government will come up with a statement in this behalf during the day s business. Hon ble Member Mr. M. Y. Tarigami, CPIM drew the attention of the Chair towards the workers of Coal Mines in Kalakote who are observing hunger strike for the last so many days for regularization of their services and sought intervention of the Government. Hon ble Member Mr. Bashir Ahmad Dar, PC protested for not being allowed to raise his issue and amid protest came into the Well of the House. Hon ble Member Sh. Satpaul Sharma, BJP joined by Hon ble Member Ch. Sukhnandan Kumar, BJP drew the attention of the Chair towards the death of five family members on Akhnoor road near Kangrial due to the pit hole dug by Sterlite Company and demanded ex-gratia relief to the next of kin of the deceased besides, stringent action should be taken against the said company. Taking cognizance, the Hon ble Speaker desired the Government to look into the matter. STARRED QUESTIONS Out of 26 Starred Questions set down in the Question List, only 6 Questions were called and orally answered. 13 Supplementary Questions were raised and answers given. UN-STARRED QUESTIONS Written replies to 23 Un-starred Questions set down in the Question List were placed on the Table of the House. Note (i): At this stage, Hon ble Member Mr. Ab. Majeed Larmi, NC staged a walkout from the House in protest alleging that he was not allowed to raise a supplementary in respect of AQ No.401 at S.No.6. (ii): Not satisfied with the reply of the Government in respect of AQ No.613 regarding power supply, Hon ble Members of National Conference viz; Mian Altaf Ahmad and Sh. Devinder Singh Rana came into the Well of the House and protested against the power crisis in the valley and subsequently all the Hon ble Members of National Conference and Congress staged a walkout from the House in protest. DISCUSSION AND VOTING ON DEMANDS FOR GRANTS FOR THE YEAR 2017-2018 Ch. Lal Singh, Hon ble Minister for Forest, Ecology & Environment moved:- Demand No. 21

That a sum not exceeding Rs. 83837.86 lakh be granted to Government to defray the charges which will come in course of payment during the year ending 31st March, 2018 in respect of 2402-Soil and Water Conservation, 2406-Forestry and Wildlife, 3435- Ecology and Environment, 4402-Capital Outlay on Soil and Water Conservation, 4406- Capital Outlay on Forestry and Wildlife, 5425-Capital Outlay on Other Scientific and Environmental Research. Cut Motion Notices whereof given by S/Sh. Ali Mohammad Sagar, Mubarak Gul, Hakeem Mohammad Yaseen, Mohammad Akbar Lone, M. Y. Tarigami, Nawang Rigzin Jora, G. M. Saroori, Aijaz Ahmad Khan, Shamim Firdous, Usman Abdul Majeed, Vikar Rasool Wani, Er. Ab. Rashid, Altaf Ahmad Wani, Sheikh Ishfaq Jabbar, Ab. Majeed Larmi, Pawan Kumar Gupta, Mohammad Amin Bhat, Gulzar Ahmad Wani and Asgar Ali Karbalaie were deemed to have been moved in the House. Mr. Mohammad Akbar Lone, NC (11:40 hrs to 11:49 hrs) =9 Minutes; 6. Raja Manzoor Ahmad, PDP (11:49 hrs to 11:58 hrs) =9 Minutes; 7. Sh. Dina Nath, BJP (11:58 hrs to 12:13 hrs) =15 Minutes. Note (i): (ii): At this stage, Mr. Abdul Rehman Veeri, Hon ble Minister for Parliamentary Affairs and R&B read out a statement with regard to the issue of detention of a 14 year old boy and quashment order of the detainee raised by Er. Ab. Rashid, Independent. Not satisfied with the reply, the agitated Hon ble Member continued his protest. Taking cognizance, the Hon ble Deputy Speaker directed the Watch & Ward staff to take him away from the House. Furthermore, he was suspended for attending the day s proceedings of the House. Mr. Abdul Rehman Veeri, Hon ble Minister for Parliamentary Affairs and R&B informed the Hon ble Member Mr. Altaf Ahmad Wani, NC regarding the compensation to the affected families of Aaroo, Pahalgam alleging that the Divisional Commissioner, Kashmir has been directed to look into the matter. 8. Shakti Raj Parihar, BJP drew the attention of the Chair towards a boy killed by a wild beast in Doda and sought compensation for the kin of the deceased. Hon ble Member Mr. Javed Mustafa Mir, PDP requested the Chair to review the decision of the Hon ble Deputy Speaker with regard to the suspension of Hon ble Member Er. Ab. Rashid, Independent. 11. DISCUSSION AND VOTING ON DEMANDS FOR GRANTS FOR THE YEAR 2017-2018 Mr. Naeem Akhter, Hon ble Minister for Education moved:- Demand No. 7 That a sum not exceeding Rs. 784400.88 lakh be granted to Government to defray the charges which will come in course of payment during the year ending 31 st March, 2018 in respect of 2202-General Education, 2204-Sports and Youth Services, 4202-Capital Outlay on Education, Sports, Art and Culture. Demand No. 27 That a sum not exceeding Rs. 135818.51 lakh be granted to Government to defray the charges which will come in course of payment during the year ending 31 st March, 2018 in respect of 2202-General Education, 2203-Technical Education, 2230-Labour & Employment, 4202-Capital Outlay on Education, Sports, Art and Culture, 4250-Capital Outlay on Other Social Services.
