Driver s license, vehicle license plate, and motor vehicle registrations are done by the City and County of Honolulu. It is prohibited to issue a driver s license to any person that is not legally in the United States and limits the term of the issued licenses only for the period that the applicant is temporarily authorized to be in the United States. The Legal Presence Act was also passed in March 2012, anyone applying for an original or renewal of their Hawaii driver s license Idaho Illinois or permit must show proof of legal presence in the U.S. Page 2 of 7

I am following up on an on-going issue we have in Indiana. Indiana is still experiencing an issue related to folks forming business entities in order to plate a vehicle in the business s name. This allows them to avoid having to provide the same documentation that an individual is required to provide when plating a vehicle. We have seen this issue in relation to immigrants who are in the country illegally and also from individuals who have been convicted of driving while intoxicated, who otherwise cannot obtain a license. My understanding is that California, Colorado, Connecticut, Delaware, DC, Hawaii, Illinois, Maryland, Nevada, New Mexico, Utah, Vermont and Washington have processes which allow unauthorized immigrants to obtain a driver s license. I assume once they receive a license they are then able to plate their vehicle as well. If I have missed any states that should be included in the list above, please let me know. they cannot provide the documentation required for individuals?
