Harrington, Director, Department of Public Works Subject: Contract: Westland Contractors, Inc. for Sanitary Sewer Manhole Rehabilitation FY 2017 RECOMMENDATION Adopt a Resolution approving plans and specifications for the Sanitary Sewer Manhole Rehabilitation FY 2017 Project, located at various locations throughout the City, and authorizing execution of a contract with Westland Contractors, Inc. and any amendments, extensions, or other change orders until completion of the project in accordance with approved plans and specifications in an amount not to exceed $430,232. FISCAL IMPACTS OF RECOMMENDATION Funding is available in the FY 2017 Sanitary Sewer Fund 830-5213-432-6510 (17SR02 Sanitary Sewer Rehabilitation Project) and no other funding is required. Low bid by Westland Contractors, Inc...$391,120 10% Contingency. $ 39,112 Total construction cost $430,232 The contract has been assigned CMS No. X585P. CURRENT SITUATION AND ITS EFFECTS This sanitary sewer project is part of the City s ongoing program to rehabilitate or replace its aging sewer system thereby eliminating potential health hazards to the public. As shown on the map appended to this report (Attachment 2), this project will be sited at various locations throughout the City where the sanitary sewer collection system needs immediate repair to prevent future structural failures, sewer blockages, and leakage problems. Field investigations indicated poor structural walls, deteriorated manhole bases, and root infiltration from City trees. These manholes should be replaced or rehabilitated to reduce inflow and infiltration of storm-water, and to prevent sewer blockages and leakage problems. The planned scope of work also includes provision for emergency/urgent work related to acute sewer system defects at other locations that may arise during FY 2017. As required by Environmental Protect Agency (EPA) and Regional Water Quality Control Board (RWQCB) Consent Decree (Consent Decree), 1 such acute defects must be addressed within one year of being identified. The contract s eightyfive working day term includes a forty working day performance period, and an additional forty-five working days for project closeout. A 10% contingency is included for construction related events. BACKGROUND To remain in compliance with the Consent Decree, the City has implemented a mandated long-term Sanitary Sewer Capital Improvement Program to eliminate Sanitary Sewer Overflows (SSOs) and reduce storm water infiltration and inflow into the sanitary sewer system. Through this Program, the City utilizes a comprehensive asset management approach based on complex and evolving hydrologic and hydraulic modeling and condition assessments to repair, replace, or upgrade the City s sanitary sewer system. Ultimately, these actions will assist the East Bay Municipal Utility District (EBMUD) in its goal of eliminating discharges from its Wet Weather Facilities by the end of 2035. This is the third year of the twenty-two year Consent Decree program, which stipulates the City shall perform Collection System Repair and Rehabilitation to control infiltration. This is in support of, and in addition to ongoing work previously identified in the City s Sanitary Sewer Management Plan (SSMP) and Asset Management Implementation Plan (AMIP). An Invitation for Bids (Spec. No. 17-11105-C) was released on January 24, 2017, and three non-local bids were received ranging from $391,120 to $547,020 (Attachment 3). The engineer s estimate for the project was $448,000. Westland Contractors, Inc. (Westland) of Burlingame, California was the lowest responsive and responsible bidder with satisfactory review and references. The Living Wage Ordinance does not apply to this project as Public Works construction contracts are, pursuant to City policy, subject to State prevailing wage laws. Westland submitted a Certification of Compliance with the Equal Benefits Ordinance. The Community Workforce Agreement (CWA) does not apply to this project as estimated project value does not exceed $500,000. As a result, the successful bidder and all subcontractors will not be required to sign agreeing to be bound by the terms of the CWA. ENVIRONMENTAL SUSTAINABILITY Improvements to the City s sanitary sewer system will protect water quality by reducing 1 Consent decree issued July 28, 2014 Page 2

RATIONALE FOR RECOMMENDATION Contracted services are required for these large projects, as the City lacks the in-house expertise and equipment resources needed to complete scheduled sanitary sewer rehabilitation and replacement projects. Further, the City must take timely action to address urgent/emergent sewer repairs without delay. Finally, the City remains subject to potential fines and penalties under the Consent Decree that demands repair of acute sanitary sewer defects within one year of their discovery. ALTERNATIVE ACTIONS CONSIDERED No reasonable alternative exists as Sanitary Sewer Manholes in the City sewer system are in poor condition and need timely rehabilitation to prevent infiltration and inflows, future sanitary leakages, and backup problems. FOR SANITARY SEWER MANHOLE REHABILITATION FY 2017 WHEREAS, the Sanitary Sewer Project is part of the City s on-going Sewer Capital Improvement Program to replace the aging and deteriorated sanitary sewer system; and WHEREAS, the Capital Improvement Program is a requirement of compliance with the National Pollution Discharge Elimination System Permit and California Regional Water Quality Control Board Consent Decree; and WHEREAS, the City has neither the staff nor the equipment necessary to undertake this Sanitary Sewer Project and other urgent/emergent sewer repairs; and WHEREAS, an invitation for bids was duly advertised and Westland Contractors, Inc. was found to be the lowest responsive and responsible bidder; and WHEREAS, funds are available in the FY 2017 Sanitary Sewer Fund 830 and the contract has been entered as CMS No. X585P. NOW THEREFORE, BE IT RESOLVED by the Council of the City of Berkeley that the Plans and Specifications No. 17-11105-C for the Sanitary Sewer Manhole Rehabilitation Project FY 2017 are approved. BE IT FURTHER RESOLVED that the Council authorizes the City Manager to execute a contract and any amendments, extensions or change orders with Westland Contractors, Inc., until completion of the project in accordance with approved specifications for the Sanitary Sewer Manhole Rehabilitation Project FY 2017 at various locations throughout the City, in an amount not to exceed $430,232 including a 10% construction contingency. A record signature copy of said agreement and any amendments will be on file in the Office of the City Clerk.
