EXECUTIVE BRIEF MOTION AND TITLE: Staff recommends motion to: (A) Approve an lnterlocal Agreement to reinstate and amend the Original lnterlocal Agreement with the Palm Beach County Sheriff's Office (PBSO), (R2012-0263); (B) Receive and File Grant Adjustment Notice to purchase capital items; a.r-o (C) Receive and File Grant Adjustment Notice extending the expiration date to July 31, 2013. SUMMARY: Grant funds previously covered the cost of security at the Juvenile Assessment Center (JAC). The Department of Juvenile Justice assumed that responsibility beginning September 1, 2012. Remaining JAG grant funds from FY 2012 are being redirected to equipment and capital outlay to support the JAC which relocated in late December 2012. An extension of time is required to fully complete the purchasing of equipment. The Grant Adjustment Notice has been executed on behalf of the Board of County Commissioners (Board) by the County Administrator/Executive Director of the Criminal Justice Commission in accordance with Resolution R2011-1213, and is now being submitted to the Board to receive and file. Countywide (PGE) BACKGROUND: In 1997 the Florida Legislature enacted legislation providing a local option to create JAC's across the state. After research determined that such a Center would immensely benefit the County, the CJC brought together local agencies to identify a site. With the assistance of the County's Facilities Management Division and the BCC, a building was chosen adjacent to the Palm Beach International Airport. This building was owned by the County and was vacant at the time. The JAC has recently relocated to 1100 45 th Street in West Palm Beach adjacent to the Juvenile Detention Center. The PBC JAC opened in November 1998 as a collaborative partnership between the Florida Department of Juvenile Justice, the CJC, Palm Beach County School District Youth Court, the State Attorney's Office, and PBSO among others. The PBC JAC is managed and governed by the participating agencies, consistent with respective statutory requirements of each agency. The JAC is a local option program that provides a "one-stop-shop" for the delivery of juveniles taken into custody and the processing of all juvenile delinquency cases in the County. Its' benefits are numerous and inlcude: (1) law enforcement officers spend less time processing juveniles, freeing their time for patrol and other duties; (2) on-site assessments identify the reasons causing the problem behavior and occur immediately; (3) a determination is made immediately on how best to involve the criminal justice system in motivating against and/or punishing problem behavior; and ( 4) timely referrals for intervention and diversion programs are made for those juveniles - not referred for court action. INTERLOCAL AGREEMENT BETWEEN PALM BEACH COUNTY THE PALM BEACH COUNTY SHERIFF'S OFFICE REINSTATING AND AMENDING THE TERMS OF INTERLOCAL AGREEMENT (R2012-0263), AS AMENDED This lnterlocal Agreement dated reinstates and amends the lnterlocal Agreement dated February 7, 2012 (R2012-0263, as amended) (hereinafter "Original Agreement") by and between the Board of County Commissioners, Palm Beach County, a political subdivision of the State of Florida (herein referred to as the COUNTY), and the Palm Beach County Sheriff's Office, West Palm Beach, Florida (herein referred to as PBSO), each one constituting a public agency as defined in Part I of Chapter 163, Florida Statutes. W I T N E S S E T H: WHEREAS, the Parties entered into the Original Agreement on February 7, 2012, with an expiration date of March 31, 2013, which was extended until June 30, 2013; and WHEREAS, The Criminal Justice Commission (CJC), continues its commitment to the Juvenile Assessment Center (JAC); and WHEREAS, JAG grant funds provided for a portion of the required security at the JAC for FY 2012, with the remaining funding coming from the Juvenile Assessment Center Donation Fund reserves and the Department of Juvenile Justice; and WHEREAS, PBSO is the fiscal agent for security services; and WHEREAS, through no fault of either party there are unexpended dollars in the amount of $18,000 that are not needed for security; and WHEREAS, the parties mutually desire to reinstate the terms of the Original Agreement, as amended to use the unexpended dollars. NOW THEREFORE, in consideration of the mutual representations, terms, and covenants hereinafter set forth, the COUNTY and PBSO hereby agree as follows: 1. The terms of the Original Agreement (R2012-0263) as amended, are reinstated in their entirety. 2. The Original Agreement is further amended to extend the expiration date from June 30, 2013 until July 31, 2013, or until all funds remaining have been expended, whichever first occurs. 3. The unexpended JAG dollars in the amount of $47,677 are to be used on COUNTY approved JAC services, equipment or program supplies. All other provisions of said Original Agreement, as amended, are hereby confirmed, and except as provided herein, are not otherwise altered or amended and shall remain in full force and effect. 1 Attachment# /
