A. PROCEDURES FOR APPLICATION 1. The Pinellas Park Police Department is not required to provide additional law enforcement services pursuant to this request but the request shall be approved at the discretion of the Chief of Police or designee based on available staffing levels. Officers assigned to any detail are not allowed to collect money, solicit or sell merchandise or services, conduct any case preparation for a criminal defense or conduct any activities that would be regarded as a private investigation. Details for any type of labor group or organized labor strike will not be approved. 2. All requests for an officer must be submitted by using the attached application. Apply in person, by mail, by email or via Fax (727-369-5703). Requests for service must be received seven (7) days before the event listed on the application, between the hours of 8:00 A.M. and 4:00 P.M. Monday through Friday. Any requests made less than seven (7) days in advance are only processed with the understanding that the assignment may not be filled. B. TYPES OF APPLICATION 1. A Single Event is an event that is held on either one or more consecutive days, but will not reoccur within the same month, or reoccur in the next consecutive month. 2. A Reoccurring Event is an event that is held on either one or multiple consecutive days, but reoccurs, at minimum, on a consecutive monthly basis. 3. Single Events require an application to be filed for each event. Reoccurring Events only require an initial application and will only require a new application for a change in the officers duties, a change in the event s dynamics, or there is a change in the fee schedule by the City. C. PAYMENT METHODS 1. Customer will be billed monthly and must make payment upon receipt of billing by sending a check, cashier s check, money order, or company draft to the Pinellas Park Police Department. Please do not pay in cash unless special arrangements have been made prior to the detail to accept cash. Hired officers are not allowed to accept cash. 2. Officers may work additional hours (time beyond the contracted time) with permission granted by the shift commander or extra duty coordinator. The hired officer can notify the department of the additional time request.
D. UNSCHEDULED HOURS 1. If an officer is required to work additional hours beyond the contracted hours due to a criminal act occurring or investigation while on a detail (e.g. makes an arrest and must file a report), the organization/applicant will not be responsible for payment of the additional costs. E. REFUNDS In cases where refunds are due, a credit or refund will be processed as requested by the customer and approved by the Extra Duty Coordinator. F. RATE SCHEDULE The current rate schedule for all officers (including supervisors) is $47.00 per hour. This rate is set by City administration and is subject to change at any time. An additional $10 per hour will be charged for details worked on any City Holiday, and on last minute details requested within 72 hours of start time. If the rate is changed, a new application or special amendment (MOU) will be required for all reoccurring details. G. STAFFING REQUIREMENTS 1. Staffing will be accommodated per the applicants request. 2. If the Extra-Duty Coordinator determines that the size or type of event warrants extra officers, the customer will work with the Extra-Duty Coordinator to determine the number of officers needed for the assignment. 3. At any event where alcohol will be sold or served, there will be a minimum of two police officers assigned. 4. For any event or detail that requires or has 4 or more officers working at the same time, a supervisor shall also be contracted and assigned to the detail. 5. In cases where the customer significantly underestimated the attendance, the Shift Commander or Extra-Duty Coordinator may notify the customer that additional officers are needed. Whether or not the customer was able to be notified, the additional officers may be called in and the customer will be billed accordingly. 6. Officers assigned to details will have access to all areas of the establishment that are accessible to customers. H. SCHEDULED HOURS CHANGED The Extra Duty Office will try to accommodate schedule change requests if made 48 hours prior to the time of the event.
I. CANCELLATION PROCEDURES 1. Cancellations by the Hiring Authority Cancellations by the customer must be made at least 4 hours before the time the assignment begins or a two (2) hour (per officer assigned) minimum charge will be assessed. Call Detective C. Buchans at 727-369-7828 for cancellations during business hours. If Detective Buchans is not reached, or it is after hours or the weekend, then call the on-duty shift supervisor at 727-369-7864. For a reoccurring detail or event, it is the responsibility of the hiring authority to notify the Police Department if the business or organization will be closed for a holiday or for any other purpose when extra duty officers are normally scheduled. 2. Cancellations by the Pinellas Park Police Department If an assigned officer is unable to fulfill the assignment due to illness or injury and the shift supervisor or Extra Duty Coordinator is unable to obtain a substitute, the assignment may be cancelled or discontinued. In the case of a departmental need or community emergency, the Chief of Police or his/her designee may cancel extra-duty assignments. The extra-duty officers would then be immediately available for service to the department. Only the hours worked, if any, will be billed. J. WORKERS' COMPENSATION/LIABILITY The City of Pinellas Park is insured through the Florida Municipal Insurance Trust for general liability and statutory workers' compensation. Police officers assigned to extra duty work are afforded worker s compensation coverage through the city of Pinellas Park. K. OFFICER NOT REPORTING FOR EXTRA DUTY JOB If an officer was scheduled to work and did not report, the customer should notify the Extra Duty Coordinator at (727) 369-7828 during normal business hours, or a shift supervisor at (727) 369-7864, immediately. The coordinator or supervisor shall attempt to contact a replacement officer. The customer will only be billed for actual hours worked. L. DISCONTINUATION OF SERVICE If the Chief of Police or his/ her designee determines that it is in the best interest of the department to discontinue extra duty services, the customer will be notified immediately.
Legal Nothing contained herein shall be construed to waive the Sovereign immunity of the city of Pinellas Park and the Pinellas Park Police Department as provided in Florida Statutes, Chapter 768, and the constitution of the State of Florida. Additionally the customer agrees to indemnify and hold harmless the City and its employees from any and all actions arising out of the services to be performed under this agreement, including, but not limited to, payment of attorney s fees and costs defending such actions. The terms and conditions contained herein constitute the entire understanding and agreement between the parties, and supersede all previous agreements. No oral representations shall be binding unless reduced to writing and signed by both parties. In the event a court of tribunal of competent jurisdiction finds any term or provision of this contract to be invalid as a matter of law, the offending portion shall be deemed severed from the remaining contract terms. The remainder of the contract shall continue in full force and effect. NOTICE TO CUSTOMERS The officers are at all times subject to the policies of the City of Pinellas Park and the rules and regulations governing employees of the Pinellas Park Police Department (PPPD). A customer has limited authority over police personnel and is restricted to providing only a general assignment of duties to be performed by the officer. Officers are bound to obey PPPD policy or procedures and shall not engage in duties or behavior that would violate PPPD policy. This contract is for security or law enforcement work only and does not exempt Customers from obtaining other necessary permits for their event. The City of Pinellas Park Police Department is NOT obligated to provide extra-duty services. The undersigned customer agrees, individually and on behalf of the named applicant, to the rules as stated in this agreement, and to promptly pay for extra duty services rendered. Further, the undersigned agrees, individually and on behalf of the named applicant to pay all costs, expenses and attorneys fees incurred in the collection of any sums due hereunder. The officer shall refuse to perform any duties deemed to be in conflict with the guidelines established by the Pinellas Park Police Department. As determined by the Department, officers may be recalled from extra-duty to on-duty status. Michael L.
