INTRODUCTION The Florida Department of Education (FDOE) collects school discipline and school safety data through the FDOE Automated Information Data Base. The reporting formats are the: Student Discipline/Referral Action, and School Environmental Safety Incident Report (SESIR). These data are compiled into two reports the Statewide Report on School Safety and Discipline and the Florida School Environmental Safety Incident Reporting (SESIR) System Incidents and Resultant Disciplinary Actions Report. In an on-going effort to improve the quality of data collection and reporting, the Office of Safe Schools has updated the Disciplinary Referral Actions elements and the SESIR definitions and related elements based on frequently asked questions, common reporting errors, and legislative mandates for the convenience of all school districts. An accurate picture of crime, violence, and disruption in district schools provides the basis for identifying areas of student behavior in greatest need of improvement, provides data necessary for public and private funding opportunities for appropriate interventions, and is necessary to measure prevention and intervention program effectiveness. It is through the continued efforts of the school districts that the accuracy of school safety and discipline data collection and reporting has improved. Changes for the 2008-2009 system elements and SESIR guidelines (which are presented at the FDOE Information Data Base Workshop each June), are posted on the FDOE Education Information and Accountability Services (EIAS) Web site in June of each year. The Web link to this site is in Appendix A. Governor Charlie Crist signed House Bill 669 into law on June 10, 2008, creating Chapter 1006.147, Florida Statutes, prohibiting bullying and harassment of any student or employee of a public K-12 educational institution. For more information on this law, please refer to the Web link in Appendix A. Louise Rill, SESIR Data Quality Coordinator with the Florida Safe and Drug-Free Schools Quality Data Management Grant previously contracted to Florida State University, has recently retired. Any future questions or comments regarding SESIR should be directed to Brooks Rumenik in the Office of Safe Schools, Bureau of Family and Community Outreach. SUMMARY OF CHANGES For the school year 2008-2009, some system updates and changes resulted in revisions to the following: The School Environmental Safety Incident Reporting (SESIR) System Definitions and Guidelines document Appendix P, Definitions for Incident Reporting in the FDOE Information Data Base Requirements, Volume I: Automated Student Information System The Automated Student Data Elements document, and The Office of Safe Schools, School-wide Discipline and Climate Web site. Specific changes to the SESIR system for the 2008-2009 school year are: Modifying the definition and example for the incident Drug Possession/Use 1

The definition was modified to read, The use or possession of any drug, narcotic, controlled substance, or any substance when used for hallucinogenic purposes. The drug use/possession example was changed to, Student or other possessing or being under the influence of illegal drugs at school, at school-sponsored events, or on school transportation. Student possessing or observed swallowing prescription drugs that are not prescribed for him/her. Student found inhaling or ingesting intoxicants, glue, solvents, or aerosols for hallucinogenic purposes. A-2 Within the data element Weapon Descriptions, what changes were made? Examples of weapon descriptions were added to Firearm, Other and Weapon, Other as follows: (F) - Firearm, Other (incendiary devices, explosives, bombs, grenades, etc.), and (O) Weapon, Other (objects can become weapons when used for bodily harm, i.e., scissors, letter openers, air-powered guns, etc.). Additionally, reference to code (Z) Not Applicable was added. A-3 What changes were made to reporting Bullying/Harassment incidents? In Appendix P, Bullying/Harassment (BHA) was corrected to reflect ** two 2

asterisks (meaning that incidents of bullying/harassment must be reported to SESIR but may not need to be reported to law enforcement). Appendix P for 06-07 erroneously reflected one * asterisk (meaning that incidents of bullying/harassment must be reported to SESIR and are expected to be reported to law enforcement). A-4 Within the data element Incidents, Reported to Law Enforcement, what changes were made? The data element Incidents, Reported to Law Enforcement was changed to read: An incident should be coded as reported to Law Enforcement if an official action was taken by a School Resource Officer (SRO) or local Law Enforcement Officer, such as a case number was assigned, a report was filed, an affidavit was filed, an investigation was conducted and found to be an incident reportable to SESIR, or an arrest was made. The presence of, notification of, or consultation with a Law Enforcement Officer or SRO is not sufficient for an incident to be coded as Reported to Law Enforcement. A-5 What is the new definition of Incident, Gang-Related and why was it changed? The definition of Incident, Gang-Related was expanded to enable districts to better understand, interpret, and report gang-related incidents. The new definition states an Incident is gang-related if gang affiliation/association caused the incident or was a contributing factor to action that happened during the incident. For example, an incident of vandalism or robbery might be part of an initiation into a gang or a fight might be caused by group rivalry. Report an incident as gang-related only if you are sure that gang affiliation/association contributed to that incident. Factors to be considered when determining whether the incident is gang-related include, but are not limited to the following: A gang is a somewhat organized group of some duration, sometimes characterized by turf concerns, symbols, special dress or colors. The group is recognized as a gang by its members and others. One or more of those involved in the incident admits to gang affiliation/association or admits that gang affiliation/association was a contributing factor to the incident. One or more involved were wearing clothing, tattoos or a style of dress known to be associated with gangs. Students/witnesses to the incident alleged that the incident or one or more of those involved in the incident was gang-related or affiliated/associated with a gang. The determination of whether or not the incident was gang-related should be based on a reasonable interpretation of the totality of the circumstances. A-6 Within the data element Incident, Hate Crime-Related, what changes were made? The definition was updated to read, An act, or attempted act, to cause physical injury, emotional suffering or property damage through intimidation, harassment, racial/ethnic slurs and bigoted epithets, vandalism, force or the threat of force, motivated all or in part by hostility to the victim s real or perceived race, religion, color, sexual orientation, ethnicity, ancestry, national origin, political beliefs, marital status, age, social and family background, linguistic preference or mental/physical disability. Creates an intimidating, hostile, or offensive educational environment. The motivation (intent) behind the act is the key element in determining whether an incident is hate-related. The definition was changed to incorporate key elements from various state definitions of hate crimes. A-7 Why was the data element Student, Involved in Gang deleted? The data element Student, Involved in Gang was deleted to prevent students involved in gang activity from being identified. 3

A-8 What are the new data element reporting requirements for 2008-09? Based on new reporting requirements, the Florida Department of Education (FDOE) is required to collect and report data on Violent Incidents without Physical Injury and Violent Incidents with Physical Injury to the USDOE. A-9 How will FDOE collect the new SESIR data requested by USDOE? In order to collect this data, FDOE has: 1) Identified SESIR incidents considered to be Violent Incidents, 2) Identified SESIR incidents considered to be Violent Incidents If They Result in Bodily Injury, 3) Added a new related element Incident, Injury-Related to SESIR that must be reported with all SESIR incidents that meet the definition of Violent Incidents or Violent Incidents if They Result in Bodily Injury, and 4) Included codes within the new Incident, Injury-Related that indicate whether the incident involved bodily injury and to what degree. A-10 What SESIR incidents have been identified as Violent Incidents? FDOE has identified the following SESIR incidents as Violent Incidents : Kidnapping, Homicide, Battery, and Sexual Battery. A-11 What SESIR incidents have been identified as Violent Incidents if They Result in Bodily Injury? FDOE has identified the following SESIR incidents as Violent Incidents if They Result in Bodily Injury : Arson, Bullying/Harassment, Breaking and Entering, Disruption on Campus-Major, Fighting, Other Major Offenses, Robbery, and Sexual Harassment. A-12 What is the definition of the new Incident, Injury-Related data element and where can it be viewed? The definition of an Incident, Injury-Related is A code indicating whether or not the incident involved serious bodily injury. The data element is further broken down into three separate codes as follows: Code A More Serious Bodily injury which involves a substantial risk of death; extreme physical pain; protracted and obvious disfigurement; or protracted loss or impairment of the function of a bodily member, organ, or mental faculty. 18 U.S.C. 1365(h) (3). Code B Less Serious Bodily injury which requires immediate first aid or subsequent medical attention that does not meet the definition in code A above. Code Z None The incident did not involve serious bodily injury. NOTES: - The person(s) injured could be a student, a non-student, or both. - Incident type Homicide (HOM) must always be coded as an A - (More Serious) in the Incident, Injury-Related element. This definition is provided in the SESIR Definitions and Guidelines document and within the data elements under Incident, Injury-Related. A-13 Within the data element Incident, Type, what changes were made? In order to differentiate those SESIR incidents that must be reported to USDOE, asterisks were added to the three-character incident codes listed in the Incident, Type data element. *One asterisk identifies Battery, Homicide, Kidnapping, and Sexual Battery as Violent Incidents. ** Two asterisks identify Arson, Bullying/Harassment, 4

Breaking and Entering, Disruption on Campus-Major, Fighting, Other Major Offenses, Robbery, and Sexual Harassment as Violent Incidents if They Result in Bodily Injury. A-14 What changes were made to the School Environmental Safety Incident Reporting (SESIR) Format? The SESIR Format was updated to include a new field for Incidents, Injury- Related. 2008-2009 DISCIPLINARY/REFERRAL ACTION CODE CHANGES B-1 What two changes were made to the Student Discipline/Referral Action Format? The two changes made to the Format are: 1) additions to Paragraph 1 so records for (N)-Non Students or (U)-Unknown Persons are not reported. It reads, A Student Discipline/Referral Action record should not be submitted for SESIR incidents with an Incident, Involvement Type of (N) or (U), and 2) the data element School Number, Where Incident Occurred was added to the format as follows: If the disciplinary/referral action is related to a SESIR incident, then the Incident Identifier and the School Number, Where Incident Occurred should be the same on both records. B-2 What change was made to the definition of the Disciplinary/Referral Action Code (U) Change in Placement? The definition was changed to read: (U) - Change in Placement (not to exceed 45 days) due to a unilateral decision by school personnel following a drug, weapon, or serious bodily injury offense. (This code is for students with disabilities only.) B-3 What notes were added to the Disciplinary/Referral Action Codes page? CODE U: Use Code U only for those students with disabilities involved in drug, weapon, or serious bodily injury offenses who were unilaterally removed to an interim alternative education setting by school personnel other than the IEP team, in lieu of suspension/expulsion. CODE H: For survey 5, districts should update records coded as H to E, F, or P. The update is based on School Board action. (This note is a reminder to districts that Code (H) - Suspension Extended, Pending Hearing must be updated to (E) - Expelled, Without Continuing Educational Services, (F) - Expelled, With Continuing Educational Services, or (P) - Placement in an Alternative Educational Setting code for survey 5, based on the final school board decision.) B-4 What note was added to Appendix P regarding the use of Code (U)? An explanation of when to use Code (U), which includes students with disabilities involved in serious bodily injury. The following SESIR reports are available to districts: 1) The Statewide Report on School Safety and Discipline and 2) the School Environmental Safety Incident Reporting (SESIR) System and Resultant Disciplinary Actions Report. These reports summarize the data collected through the SESIR system and the school disciplinary/referral action files. C-2 What is the Statewide Report on School Safety and Discipline and where can it be viewed? This report is a summary of the most recently reported SESIR and discipline data from all districts to the FDOE for the past three years, and includes the most recent frequencies and rates of all SESIR incidents of crime, violence, and discipline. Please refer to the report s introduction for more information. Both may be viewed at the Web link in Appendix A. C-3 What is the Florida School Environmental Safety Incident Reporting (SESIR) System Incidents and Resultant Disciplinary Actions Report and where can it be viewed? This report is a summary of data collected through the SESIR system and the school disciplinary/referral action files. It provides school and district administrators with information on the relative prevalence of crime and violence in their schools, allows schools to find over and under reporting errors, and to determine match rates between reported SESIR incidents and corresponding disciplinary actions reported. It is a tool for districts to check and improve the quality of data reported to FDOE. Please refer to the report s introduction for more information. Both may be viewed at the Web link in Appendix A. SCHOOL ENVIRONMENTAL SAFETY INCIDENT REPORT AND DISCIPLINARY QUALITY DATA REVIEWS D-1 Why is it important for districts and schools to review the quality of data reported to the FDOE? Districts are encouraged to examine the quality of data submitted to the FDOE for accuracy on an on-going basis. Having a quality data review process in place at the school and district levels is a way of improving the quality of reporting processes for SESIR incidents and their matching resultant disciplinary actions. Furthermore, it is a means of identifying over-reporting, under-reporting, and incorrect reporting of SESIR or disciplinary data to the FDOE. D-2 How can the District-Specific SESIR Data Quality Review Report be used to review data quality? The District-Specific SESIR Data Quality Review Report provides summative information for each school district regarding issues of data reporting accuracy and uncharacteristic data reporting. It is an adjunct tool provided to district level administrators to improve the quality of reporting processes for SESIR incidents, as well as their matching resultant disciplinary actions. This report focuses on ways to examine district level data in order to uncover potential reasons for: 1. Sharp fluctuations in SESIR incidents from year to year, and 6

2. Discrepancies that sometimes occur between SESIR incidents reported and their appropriate matching resultant disciplinary actions. D-3 What sources are used to develop these district-specific reports? These reports include: Trend data for the last four years on total number of SESIR incidents A comparison of district SESIR incident rates to the state mean rate Trend data for the last four years on the percentage of matched SESIR incidents to appropriate disciplinary actions Data on specific schools with clear over-reporting of SESIR incidents that likely could be coded as local-level incidents D-4 Have the 2006-07 District-Specific SESIR Data Quality Review Reports been disseminated? Yes, these reports were sent to SDFS Coordinators, and upon request, were provided to district superintendents by the Florida Safe and Drug-Free Schools Quality Data Management Project in August 2008. If you would like a copy, please contact your district SDFS Coordinator. SESIR WEB-BASED TRAINING E-1 What is the purpose of the Online SESIR Web-based Training? The SESIR web-based training provides district personnel with online, interactive SESIR incidents to review. Participants then complete an Event and Discipline Report based on the SESIR incident presented. Immediate feedback to their answers is provided after each scenario. This training is expected to be updated to include 2008-09 changes. However, districts are highly encouraged to go through the current modules to familiarize themselves with the basics of SESIR (keeping in mind that the 2008-09 updates are not yet included.) E-2 Who should participate in the Online SESIR Web-based Training? District personnel responsible for SESIR training, including Safe and Drug-Free Schools Coordinators, district SESIR trainers, and/or SESIR coordinators should participate in the SESIR Online Training. Superintendents are also highly encouraged to complete the training. E-3 Who is the FDOE contact person for Online SESIR Web-based Training information? Yes, an online version of the poster will be provided on the Schoolwide Discipline and Climate website. See Appendix A for the Web link. UPDATING SESIR DISTRICT CONTACT INFORMATION G-1 Why is it essential for districts to update their SESIR contact information as it changes? The Office of Safe Schools uses this information to communicate essential SESIR information and to distribute SESIR posters to each district contact. There are often delays in providing this information to contacts, if the information on record is inaccurate. Whenever there is a change in district personnel responsible for SESIR training, including Safe and Drug-Free Schools Coordinators, district SESIR trainers, and/or SESIR coordinators responsible for school safety and discipline data reporting, please update the contact information.
