PLANNING BOARD MEETING MINUTES TUESDAY, JANUARY 16, 2018 ERWIN, NORTH CAROLINA The Town of Erwin Planning Board, with Chairperson Nancy Jackson presiding, held its regular meeting in the Town Hall at 100 West F St. Erwin, NC on Tuesday, January 16, 2018 at 7:00 PM. Board members present were: Chairperson Nancy Jackson, William Schuh, Pat Cameron, Melinda Alvarado, Roger Chavis, In Town Alternate Judy Price, Out-of-Town-Members Norman Avery, Ray Rogers and Out-of-Town-Alternate Michael Shean. Board members absent were: In Town Member Elizabeth Pate and In Town Alternate Alan West. Town Manager Snow Bowden and Town Clerk Cynthia Patterson were present. Board Member Norman Avery gave the invocation. Those present recited the Pledge of Allegiance. CONSENT ITEMS Board Member Mindy Alvarado made a motion to approve the minutes of December 18, 2017 and was seconded by Board Member Norman Avery. Motion Unanimously Approved. OLD BUSINESS UPDATES Town Manager Snow Bowden informed the Board that the (2) public hearings that were scheduled for January 4, 2018 were postponed until February 1, 2018 due to inclement weather. Will update you at our next meeting on the outcome of those public hearings. CONDITIONAL USE PERMIT CU-2017-07 TO ALLOW A VEHICULAR SERVICE AT 404 JACKSON BLVD., ERWIN, NC. 28339 (HC PIN# 1507-24-4207) Mr. Bowden informed the board that he spoke to Mr. Mohamed, the applicant of this conditional use request. Mr. Mohamed was unable to be at this meeting however he would like to restore the existing building on this parcel. He is aware that the building is in bad shape. He is willing to spend whatever it takes to restore the building. He wants the building to look appealing because he knows that if it does not look good people will not buy vehicles at his lot. Mr. Mohamed spoke with someone with NCDOT that said there should not be an issue with where he wants to place two driveways however Mr. Bowden has been unable to reach the person at NCDOT to confirm this. 2

MINUTES CONTINUED FROM JANUARY 16, 2018 Chairperson Nancy Jackson stated that at the last meeting the board decided to table this item until this meeting in hopes that the applicant would be here to give us an update. Based on what Mr. Bowden has said it wasn t much of an update from the last meeting. After some discussion, the board moved forward with the Findings of Facts 1. Board Member William Schuh made a motion that Yes, the use requested is listed among the conditional uses in the district for which application is made and was seconded by Board Member Ray Rogers. Motion Unanimously Approved. 2. Board Member Ray Rogers made a motion that Yes, the requested use is essential or desirable to the public convenience or welfare and was seconded by Board Member Mindy Alvarado. Motion Unanimously Approved. 3. Board Member Norman Avery made a motion that Yes, the requested use will not impair the integrity or character of the surrounding or adjoining districts, nor be detrimental to the health, morals, or welfare and was seconded by Board Member Roger Chavis. Motion Unanimously Approved. 4. Board Member Roger Chavis made a motion that Yes, the requested use will be in conformity with the Land Development Plan and was seconded by Board Member Norman Avery. Motion Unanimously Approved. 5. Board Member Mindy Alvarado made a motion that Yes, there is adequate utilities, access roads, and drainage, sanitation and/or other necessary facilities have been or are being provided and was seconded by Board Member Ray Rogers. Motion Unanimously Approved. 6. Board Member Judy Price made a motion that Yes, adequate measures have been or will be taken to provide ingress and egress so designed as to minimize traffic congestion in the public streets and was seconded by Board Member Mindy Alvarado. Motion Unanimously Approved. 7. Board Member Pat Cameron made a motion that Yes, the conditional use shall in all other respects conform to the applicable regulations of the district in which it is located except as such regulations may in each instance be modified by the Board of Commissioners pursuant to the recommendations of the Planning Board and was seconded by Board Member Mindy Alvarado. Motion Unanimously Approved. Board Member Mindy Alvarado made a motion to recommend that the proposed conditional use application meets all the Findings of Facts in the affirmative and was seconded by Board Member Norman Avery. Motion Unanimously Approved. Board Member Mindy Alvarado made a motion that the proposed amendment is consistent with those documents that constitute the officially adopted land development plan and other applicable plans and was seconded by Board Member Pat Cameron. MINUTES CONTINUED FROM JANUARY 16, 2018 Board Member Mindy Alvarado made a motion to recommend approval of CU-2017-07 to allow a Vehicular Services at 404 East Jackson Blvd, Erwin, NC (HC PIN# 1507-24- 4207) and was seconded by Board Member Norman Avery. Motion Unanimously Approved. ORANIZATIONAL MEETING TO APPOINT CHAIRPERSON AND VICE-CHAIRPERSON Board Member Mindy Alvarado made a motion to re-appoint Board Member Nancy Jackson as Chairperson and was seconded by Board Member Norman Avery. Motion Unanimously Approved. Board Member Norman Avery made a motion to re-appoint Board Member Ray Rogers as Vice-Chairperson and was seconded by Board Member Roger Chavis. Motion Unanimously Approved. NEW BUSINESS CONDITIONAL USE PERMIT CU-2018-01 TO ALLOW A MANUFACTURED CLASS A HOME AT 715 NORTH 15 TH STREET, ERWIN, NC (HC PIN# 0597-57-7548) Mr. Bowden informed the board that an application has be submitted to place a Manufactured Class A home at 715 North 15th Street. This parcel is in the R-6 Zoning District, and a Manufactured Class A home is a conditional use in this district. The purpose of the R-6 Zoning District is to provide areas for a mixture of single-family and multifamily dwellings. The Board then went through the Findings of Facts 1. Board Member Pat Cameron made a motion that Yes, the use requested is listed among the conditional uses in the district for which application is made and was seconded by Board Member Mindy Alvarado. Motion Unanimously Approved. 2. NEW BUSINESS Erwin Planning Board REQUEST FOR CONSIDERATION AGENDA ITEM NUMBER 5A To: Planning Board Members From: Snow Bowden, Town Manager Date: February 19, 2018 Subject: Conditional Use Permit CU-2018-02 To Build Six Townhomes at 202 North 6 th Street, Erwin, NC. (HC PIN# 1507-04-6727.000) Mr. Peregoy has applied for a conditional use permit to build six townhomes at 202 North 6 th Street. Currently, there is an old barn building and an old foundation on this lot that will be removed. He is seeking a conditional use permit to build six townhomes on this property. As you can see on the site there will be two structures that will have three townhomes in each one. This proposed use would be an improvement to this parcel. This parcel is in an area that was set aside for medium intensity development, and this proposed use would fit that desire. The preliminary site plan shows the proposed property dimensions for each parcel. If this proposed use is approved they will need a waiver to the R- 10 dimensional requirements, and have the dimensions for each parcel approved as shown on the site plan. Attachments CU-2018-02 Application Site Plan House Plans Suggested Motions: For legal purposes, Staff recommends that 3 separate recommendations be made: 1. I move to recommend that the proposed conditional use application: a. Meets all the Findings of Fact in the Affirmative, or b.
