Rules and Regulations I. Aim and Purpose The purpose of BILS 5 th National Moot Court is to provide a platform for the students to display and hone their advocacy skills and increase their knowledge in Law. This is in keeping with Bangalore Institute of Legal Studies aim to reduce the gap between the industry and the classroom. II. Venue and Date The BILS 5 th National Moot Court will be hosted at the Campus of Bangalore Institute of Legal Studies from 23 rd March 2018 to 25 th March 2018. The BILS campus is located in the heart of Bangalore City and has lush Lalbagh Gardens within its proximity. The campus is 38 kms away from the Kempegowda International Airport, and 7 kms from the Krantiveera Sangolli Rayanna Railway Station (SBC) and Kempegowda Bus Station (aka Majestic). For address and location details refer to Annexure IV. III. Language The moot court and all its proceedings and documents will be in English (India) only. IV. Eligibility The competition is open for students who are studying in the Three year LLB & Five year integrated LLB course during the current academic year. Page 3 of 18

V. Team Composition a. Every college can be represented only by one team. Each team should consist of 2 speakers and one researcher. This number cannot be modified under any circumstances. b. The team composition included in the registration form shall be considered final. Any changes will have to be intimated in the form of e-mail to the lex.fortissimus@gmail.com at the earliest date and these requests will only be entertained up to 8 days before the date of registration at the venue. c. Each team will be provided a team code upon registration. Teams should not disclose the identity of their institution; such disclosure shall invite penalties including disqualification. VI. Registration a. To be considered for participation, team must fill in the Registration Form provided in Annexure I of the Rules and Regulation and send a scanned copy of the same. The registration closes by 28 th of February 2018. Participation would be limited to 20 Teams on a first come first serve basis. b. Participants will receive an acknowledgement on successful e-mail submission of Registration Form. A scanned copy of the Demand Draft/ NEFT Receipt of payment of registration fees must be sent by mail to lex.fortissimus@gmail.com within 3 days of receiving the acknowledgement. c. A hard copy of the Demand Draft and the covering letter shall be sent through post with the memorials. Page 4 of 18

VII. Registration Fees: The registration fees for the competition shall be Rs. 3,000/- (Rupees Three Thousand Only) and the DD shall be drawn in the name of The Principal, Bangalore Institute of Legal Studies and should be locally payable. Dress Code All students have to be in court attire of Black and White Formals with Black Coat/Blazer. Students who are not appropriately attired will be barred from presenting their case before the judges. IX. Memorials a. Each team must prepare memorials for both parties to the dispute (Petitioners / Plaintiff/ Appellant & Respondent / Defendant). b. The memorials have to be submitted on typed A 4 size paper printed on one side and must contain: The table of contents The index of authorities The statement of jurisdiction Page 5 of 18

The statement of facts (2 page only and argumentative statement of facts would attract penalties) The statement of issues The summary of arguments (not more than 3 pages) The arguments advanced (not more than 15 pages) The prayer c. The font should be Times New Roman and the font size should be 12 (1.5 line space) and for footnotes it should be Times New Roman size10 (single space). d. 20 th Edition of the Blue Book citation needs to be followed. e. The memorials should be spiral bound. Any other form of binding shall not be accepted. f. The memorial must have a margin measuring one inch on all sides of each page. g. The page numbering should be on the top right side of each page. h. Covers must be placed on briefs as follows: Petitioners / Plaintiff/ Appellant: Blue Color; Respondent / Defendant: Red Color. i. Use of Cellophane sheets over the covers or inside will be penalized. j. The cover page of the memorial must state the following The cause title Page 6 of 18

Identify brief as Petitioners / Plaintiff/ Appellant and Respondent / Defendant as applicable. Team Code. Identity of the institution shall not be revealed anywhere in the memorial. Violation of this provision shall result in penalties including disqualification. k. Soft Copy of the memorials should be sent by 10 th March 2018 to lex.fortissimus@gmail.com by 11.59 P.M. l. Teams shall send Four (4) Copies each of Plaintiff/ Petitioner/ Appellant and Respondent/ Defendant Memoranda on or before 15 th March 2018 via Speed Post or Courier. Late submission will be penalized by one point each for every day of delay after due date. No excuses in respect of delayed courier services will be entertained. m. On mailing the Hard Copy, participants are requested to e-mail to lex.fortissimus@gmail.com providing the relevant Tracking ID or Tracing Consignment Number of the Speed Post or Courier service details. n. Any PLAIGIARISM found in the memorials will invite immediate disqualification. Oral Rounds There will be 4 rounds for the moot court. The first round will be the Preliminary Round, followed by the Quarter-Final, Semi Final and Finals. Page 7 of 18

Preliminary Round Each team will get a total of 30 minutes to present their case. An additional 5 minutes is allotted for rebuttal and sur-rebuttal. The division of time is at the discretion of the team members, subject to a maximum of 15 minutes per speaker. Division of time shall be informed to the court officer before the arguments begin. Passing of notes to the speakers by the researcher during the rounds is allowed. Top 8 teams shall qualify to the Quarter-Finals. Quarter-Finals Each team will get a total of 30 minutes to present their case. An additional time of 5 minutes is allotted for rebuttal and sur-rebuttal. The division of time is at the discretion of the team members, subject to a maximum of 15 minutes per speaker. Division of time shall be informed to the court officer before arguments begin. Passing of notes to the speakers by the researcher during the rounds is allowed. The Quarter-Finals will be a knock out round. Semi-Final and Finals Each team will get 45 minutes to present their case that will include rebuttal and sur-rebuttal time. Page 8 of 18

The division of time is at the discretion of the team, with a maximum of 25 minutes per speaker. Passing of notes to the speakers by the researcher during the rounds is allowed. Semi-Finals will be a knock out round. Scouting Teams will not be allowed to observe the orals of any other teams. Scouting is strictly prohibited. Scouting by any of the team members shall result in disqualification. X. Guidelines for Submissions A. Written a. The memorials shall be marked on a scale of 1-100 points each. b. Any revisions, supplements or additions to the memorials after submission shall not be entertained. c. Award of the points shall be based on the following parameters: Neatness, legibility, no typographical errors or format errors Logical progression of ideas Effective use of headings to outline arguments Understanding essential legal issues presented Focus on essential (not collateral) issues Clear, concise and unambiguous writing style Forceful and persuasive presentation Page 9 of 18

Integration of facts into legal argument Understanding of strengths and weaknesses of case Discussion of viable alternative arguments Understanding and analysis of authority Proper use of citations and citation form Effective use of authority to support arguments Ability to distinguish adverse cases d. Non- compliance of the rules mentioned above shall attract severe penalties. B. Orals The parameters for judging the oral presentation on a scale of 0 100 points are: a. Knowledge of facts b. Logic and reasoning c. Organization and clarity d. Persuasiveness e. Deference to the court f. Proper and articulate analysis of the issues arising out of facts g. Understanding of the legal principles directly applicable to the issues h. Ability to explain clearly the legal principles in general keeping to the time allotted i. Knowledge and use of legal sources and authorities and general principles of national law j. Ingenuity (ability to argue by analogy from related aspects of law) Page 10 of 18

XI. Anonymity a. Student council may introduce her/himself to the court in the usual manner and may also state her/his names. However, the team's college / institution affiliation may not be mentioned at any time before the awards ceremony. b. Further, all team members shall refrain from identifying a team s school at any time and in any manner, including, but not limited to, wearing any identifying items, such as school clothing, ties, patches, or pins or carrying identifying material (such as a book with a college logo, or college seal). XII. Any violation of aforementioned rules will attract severe penalties. XIII. Decision of the Judges is Final. XIV. Copyright a. The copyright over the memorials submitted for participation in the competition is assigned by participants and shall also vest completely and fully in Bangalore Institute of Legal Studies. b. The participants shall certify in writing the originality of materials contained therein and shall be responsible for any claim or dispute arising out of the further use and exhibition of these materials. Further use and exhibition of these materials, electronically or otherwise, shall be the exclusive right of Bangalore Institute of Legal Studies and they shall not be responsible for any liability to any person for any loss caused by errors or omissions in this collection of information, or for the accuracy, completeness, or adequacy of the information contained in these materials. c. Distribution of these materials on affiliated websites does not constitute consent to any use of this material for commercial redistribution either via the Internet or using some other form of hypertext distribution. Links to the collection or individual pages in it are welcome. XV. Accommodation Accommodation will not be provided by the organizers but the organizers will assist the students by providing information regarding the Lodges/Hotels that are available in the neighborhood of the college. XVI. Awards 1. Winning Team: Rs. 15,000 2. Runner Up Team: Rs. 10,000 3. Best Advocate: Rs. 3,000 4. Best Memorial: Rs. 3,000 A certificate of participation will be awarded to all participants on successful participation in the BILS 5 th National Moot Competition. Participants are required to collect their Certificates during the Valedictory. The Certificates will not be sent through post under any circumstances. Page 12 of 18
