THE JAMMU AND KASHMIR STATE POLLUTION CONTROL BOARD SPCB Order No. Date: --.--.2016 In exercise of the powers conferred by sub-section (3A) of Section 12 of the Water (Prevention and Control of Pollution) Act, 1974, the Jammu and Kashmir State Pollution Control Board, with the approval of the State Government, hereby makes the following regulations, namely:- 1. Short title and commencement.- a) These regulations may be called the Jammu and Kashmir State Pollution Control Board Service (recruitment and conditions of service) Regulations, 2016. b) 1 They shall come into force from the date of publication in the Government Gazette. 2. Definition.- In these regulations unless the context otherwise requires:- a) Board means the Jammu and Kashmir State Pollution Control Board constituted under section 4 of the Water (Prevention and Control of Pollution) Act, 1974; b) Cadre means the sanctioned strength of service, class, category and grade; c) Chairman means the Chairman of the Board nominated by the Government under Section 4 (2)(a) of Water (Prevention and Control of Pollution) Act, 1974; d) Government means the Government of Jammu and Kashmir; e) Member of service means a person appointed to a post in the service under the provisions to these regulations; f) Member Secretary means the Member Secretary of the Board appointed by the Government under Section 4(2)(f) of Water (Prevention and Control of Pollution) Act, 1974; g) Regulations means Jammu and Kashmir State Pollution Control Board Service (recruitment and conditions of service) Regulations, 2016; h) Schedule means the schedule(s) annexed to these regulations; i) Service means the Jammu and Kashmir State Pollution Control Board Service. Words and expressions used in these regulations but not defined shall have the same meaning as assigned to them in the Jammu and Kashmir Civil Services 1 These regulations have been published in Government Gazette on

(Classifications, Control and Appeal) Rules, 1956 and Jammu and Kashmir Civil Service Regulations, 1956. 3. Organization.- The service shall comprise the posts, classes, categories and grades as are indicated in Schedule I. 4. Cadre.- The cadre of the service shall consist of such posts and such number of posts as may be fixed for each of its classes from time to time by the Board. Provided that at the commencement of these regulations the cadre of each class shall consist of posts as shown in Schedule I. 5. Qualifications.- No person shall be eligible for appointment or promotion to any class, category or grade unless he/she possesses the qualifications prescribed in the Schedule II appended to these regulations. Notwithstanding anything contained in principal clause of this regulation, a person substantively holding any post in the Board under order of the competent authority on the date of coming into force of these regulations, shall be deemed to be a member of the service under the said Schedule II. 6. Recruitment.- (1) Except in respect of the posts appointments against which have to be made by the Government or in consultation with the Government, recruitment to the posts under the Board shall be by:- (a) direct appointment from amongst the persons who are permanent residents of Jammu and Kashmir State; (b) promotion or transfer of persons already in the service of the Jammu and Kashmir State Pollution Control Board; (c) borrowing from the Central Government or the State Government or an Industrial Undertaking or a Local Body or other authority within or outside the State; (d) appointment on contract basis of a person for such periods as may be determined by the competent authority in the interest of the functioning of the Board. (2) In making appointments to posts under the Board, whether by direct recruitment or by promotion, the Board shall provide for special representation to candidates belonging to the Scheduled Caste/ Scheduled Tribes or for any other category or class of permanent residents of the State for whom reservations have been or may be provided under the order of the Government in the same manner as is prescribed from time to time in this behalf by the Government. (3) All employees already in the employment of the Board and possessing the requisite qualifications and experience prescribed against direct recruitment shall be eligible 2

to compete for selection alongwith those from outside the Board who may apply for posts in response to advertisement. 7. Appointments.- (1) The Board may constitute or authorise constitution of such committee(s) for direct recruitment to the posts belonging to various cadres/ categories as it may deem fit from time to time. Notwithstanding anything contained in principal clause of this regulation, the board may refer vacancies to the Jammu and Kashmir State Public Service Commission or the Jammu and Kashmir State Service Selection Board, as the case may be. (2) Appointment by promotion shall be made by the competent authority on the recommendations of the Departmental Promotion Committee as are constituted by the Board from time to time. 8. Antecedents.- (1) No person, who has been dismissed from the service of the Board or has earlier been dismissed by any Government Department, any other Government Corporation or Undertaking, or who has been convicted by any criminal Court or tribunal for an offence involving moral turpitude shall be appointed as employee in the Board. (2) In the event of appointing authority or the Chairman, as the case may be, coming to know, subsequent to the appointment of an employee that his antecedents are such as would have made him ineligible for employment under sub-rule (1) above, may terminate the services of the employee after affording him adequate opportunity to explain his conduct. 9. Record of age.- (1) The Board shall record the age of every employee. The Matriculation Certificate shall be deemed to be satisfactory proof of age at the time the employee enters the Board s service:- (2) The age of an employee as recorded with the Board at the time of employment shall not thereafter be altered. 10. Age Limit.- (1) The age of recruitment will be the same as prescribed by the Government from time to time. (2) A person who has not attained the prescribed age or whose age exceeds the age limit, shall not ordinarily be admitted into the service of the Board, provided that the Board may, for reasons to be recorded, relax the age bar in individual cases up to a period of two years. 11. Probation.- Persons appointed to the service by direct recruitment shall be on probation or trial for two years. The Board may in certain cases extend the period of 3

probation up to a maximum of four years, if it appears during or at the end of the period of two years that the performance of the member of service has been satisfactory, or he/she has not passed the prescribed examination or training if any. he/she shall be discharged from the service. A candidate appointed to the service by direct recruitment shall be allowed the minimum of time scale during the first year and the second stage of that scale during the remaining period of probation/trial. Where the period of probation/trial is extended beyond two years for reasons not directly attributable to the probationer he/she shall be allowed to draw the second and third increments after expiry of 2 nd and 3 rd year of probation/trial. 12. Eligibility of Government Servants for direct recruitment.- A person already in Government Service may apply through proper channel for direct recruitment to a vacant post in any particular class or category in the service if he possesses the educational and other qualifications prescribed for recruitment to such class or category of post. The upper age limit of for such candidates shall be as provided in the regulations. Provided that in the case of a post which requires a higher degree of specialization or experience, the Board may prescribe a higher age limit. 13. Maintenance of seniority list.- Seniority of the members of the service shall be regulated under the Jammu and Kashmir Civil Service (Classification, Control and Appeal) Rules, 1956. The Member Secretary shall maintain an up to date and final seniority list of the members of the service. 14. Residuary matters.- In regard to matters not specifically covered by these rules, the members of the service shall be governed by rules/ regulations and orders applicable to the State Civil Service in general. 15. Pay allowances, leave salary, Pension and other conditions of service. The conditions of service in respect of pay and allowances, leave, pension, record of service, joining time, seniority, G.P.F., age of superannuation, retirement benefits,medical facilities & conduct of the employees of the Board shall be applicable to the officers and other employees of the Board as per rules and orders governing the post of corresponding scale of pay under the Government. 16. Retirement.- I). Compulsory Retirement:- It shall be compulsory for every member of the staff of the Board to retire from services on attaining the age of superannuation fixed by the Government for its employees for such retirement. II). Premature Retirement: Notwithstanding anything, contained in the above rule, the Board may require any person serving on the staff of the Pollution Control Board than the one included in Class IV of the Schedule annexed hereto, retire at any time after he/she has completed 25 years/ 50 completed six monthly periods of qualifying 4

service or on attaining 50 years of age, if such retirement is considered necessary in the public interest/mis- conduct, provided that the Chairman shall give in this behalf a notice in writing to the person concerned at least three months before the date on which he is required to retire: Provided that such person shall be granted pensionary benefits admissible to the employees of the Govt. under the Jammu and Kashmir Civil Service Regulations on the basis of qualifying service put in by him and if at the date of such retirement on attaining 50 years of age, the person concerned has not completed 25 years of qualifying service, he shall be granted pensionary benefits on the basis of qualifying service equal to 25 years or such service as he would put in, had he retired at the normal age of superannuation, i.e., 58 years, which ever may be less, on the emoluments qualifying for pension drawn by him before the date of such retirement. III). Voluntary Retirement: A person serving on the staff of the Pollution Control Board may voluntary retire from service at any time after completing 25 years/50 years completed six monthly periods of qualifying service or 50 years of age, provided that he shall give in this behalf a notice in writing to the pension sanctioning authority at least three months before the date he wants to retire: Provided that such officer shall not be entitled to pensionary benefits in excess of what is admissible to him under the Jammu and Kashmir Civil Service Regulations on the basis of qualifying service rendered by him; Provided further that the right conferred under this rule shall not available to an employee who has been placed under suspension and/or against whom some enquiry or investigation is pending or is contemplated to any charge of administrative or criminal nature. Note 1 A person serving on the staff of the J&K State Pollution Control Board who opts for voluntary retirement after 25 years qualifying service will not be permitted to retire under this rule until after the fact that the person concerned has completed 25 years qualifying service has been verified in consultation with the Accountant General. Note 2 A person serving on the staff of the J&K State Pollution Control Board who has elected to retire under this rule and has given necessary intimation to that effect to the competent authority shall be precluded from withdrawing his election subsequently except with the specific approval of the authority competent to make the appointment, provided his request for withdrawal is made within the intended date of retirement and he is in a position to establish that 5

there has been a material change in the circumstances in consideration of which the notice was originally given: 17. Training and Departmental Examination.- Persons appointed in the service shall be required to undergo trainings and/or pass examinations from time to time during the course of the service as the Board may prescribe. 18. Repeal and saving.- (1) All standing orders and notifications corresponding to these regulations and in force immediately before the commencement of these regulations are hereby repealed. (2) Notwithstanding such repeal, any appointment made or action taken under the orders or notifications so repealed shall be deemed to have been made or taken under the corresponding provisions of these regulations. 19. Interpretation.- If any question arises relating to the interpretation of these regulations, the decision of the Board thereon shall be final.
