Item No. 19.3.1 Application for grant of environmental clearance for Spangle Condos a Residential Complex to be established by M/s Sandwoods Infratech Projects Pvt. Ltd. at Vill. Gazipur, old Ambala-Kalka Road, Zirakpur, Distt. Mohali. The application of the project proponent was placed before the Committee in its 13 th meeting held on 11/10/2008. The observations of the Committee as well as the reply submitted by the project proponent vide its letter dated 23/12/2008 and received in this office on 26/12/2008 (copy of reply enclosed as Annexure-I) in annotated form are as under:- S.No. Observations Remarks 1 The list of all structures like industries, other buildings, Roads and any other important project within 500 metre radius alongwith site plan indicating relative location of these features within 500 metre radius of the proposed project, as per Form 1A. 2 All the data should be reported in SI system of units. 3 The promoter will submit photographs of the project site from all the four angles. 4 The distribution of floor area on different floors should be given. 5 The water balance chart is not proper. The water usage for green area is very high and practically not feasible. Therefore, the project proponent should submit revised water balance chart. 6 The promoter will provide quantification of energy saved in the proposed project, by taking the proposed energy conservation measures 7 The promoter will calculate the terrace area required for installation of solar water heating system and submit the proposed terrace plan in this regard. 8 As the construction of the project has already been started, the project promoter should provide wind breaking curtains and water sprinkling system to minimize dust emissions. 9 The promoter should also provide adequate safety measures for the construction workers during the construction phase. 10 The promoter should submit parking plan, storm water management plan and fire fighting plan of its project. 11 The project proponent should submit written permission from Municipal Council, Zirakpur for disposal of excess sewage into the municipal sewer. 12 The project proponent should submit written permission from Municipal Council, Zirakpur for lifting and disposal of solid waste generated from the colony. 13 The promoter should submit an affidavit on non-judicial stamp paper of Rs. 100/- that he will obtain permission of Central Ground Water Board for extraction of ground water 14 The promoter will also submit affidavit to constitute an Environment Monitoring Cell. 15 The project proponent should submit construction schedule (CPM / PERT chart). The application of the project proponent was taken back from MOEF on 14/2/2006 and was placed before the Committee in its 7 th meeting held on 4/6/2008 and again in its 14 th meeting held on 1/11/2008. Item No.19.3.11 Application for environmental clearance for residential colony namely AKME Polis to be developed by M/s AKME Projects Ltd. at Vill. Jandiali, Ludhiana-Chandigarh Road, Distt. Ludhiana. It is submitted that M/s AKME Projects Ltd. has applied for grant of environmental clearance for its proposed residential colony namely AKME Polis to be developed at Vill. Jandiali, Ludhiana-Chandigarh Road, Distt. Ludhiana. The case was considered in the 12 th meeting of State Expert Appraisal Committee held on 27/9/2008 and the Committee forwarded the project to SEIAA for consideration for grant of environmental clearance with the conditions approved by SEAC in its 12 th meeting. However, the case was considered by SEIAA in its 11 th meeting held on 17/10/2008, wherein the Authority observed as under :- 1. The project site is located very near to focal point, as such the effect of various types of industries located in this focal point need to be assessed. 2. The commercial part of the project is shown an un-determined plan in the plans approved by the competent authority, which can not be considered for grant of environmental clearance at this stage. 3. The project has been granted change of land use for establishment of residential/commercial project, whereas as per the master plan of the Ludhiana city this area has now been earmarked for light industries. 4. The four acre land earmarked for disposal of treated effluent is not included in CLU. Accordingly, the Authority referred back the case to the SEAC for reconsideration of the same in light of above mentioned points and to give its revised recommendation accordingly. The case was reconsidered in 16 th meeting of SEAC held on 6/12/2008 and it was decided that committee of officers from Punjab Pollution Control Board, Regional Office, Ludhiana should visit the project site, verify the submissions made by the promoter, check feasibility of land for disposal of treated sewage and send their recommendations to decide the application of the promoter for grant of environmental clearance. Accordingly, a committee of the following officers was constituted for inspection of the project site, as per decision taken in 16 th meeting of SEAC. 1. Sh. R.K. Gupta, Environmental Engineer 2. Sh. S.P. Garg, Environmental Engineer 3. Sh. Shiv Kumar, Assistant Environmental Engineer

The site was visited by the team on 14/1/2009 and observed that on east and north side, the red category industries are situated along the boundary. One induction furnace exists on west side which is more than 100 m from the boundary and one poultry farm also exists which is less than 100 m from the boundary of the project. The report submitted by the committee is enclosed (As Annexure-XI) and placed before the State Expert Appraisal Committee for consideration of the committee.

Item No. 19.3.12 Application for grant of environmental clearance for ATS Golf Meadows Prelude a Group Housing Project to be developed by M/s ATS Infrastructure Ltd. at Vill. Madhopur, Tehsil Dera Bassi, Distt. Mohali. The application of the project proponent was placed before the Committee in its 14 th meeting of State Expert Appraisal Committee held on 1/11/2008. The location of land reserved for vermi-composting pits is not satisfactory and is adjoining to the residential area. Therefore, this location should be shifted to an appropriate location. 12. The project proponent should submit attested copies of written permissions from M.C., Dera Bassi for the disposal of treated domestic effluent and solid waste generated by it. 13. The project proponent shall also submit an affidavit to use fly ash as building material in the construction activities as per the provisions of fly ash notification of September 1999 and its amendment as on August 2003. Accordingly, the case is placed before the State Expert Appraisal Committee for reconsideration in view of reply given by the project proponent.

Item No. 19.4.1 Application for grant of environmental clearance for Maya Gardens a Residential Group Housing Project to be established by at Chandigarh-Ambala Road, NAC, Zirakpur M/s Barnala Builders & Property Consultant. As per application submitted the details of the Project are as under: 1. This is a Residential Group Housing Project namely Maya Gardens to be established at Chandigarh-Ambala Road, NAC, Zirakpur, Mohali by M/s Barnala Builders & Property Consultant. 2. The total area of the proposed site is 20775 sq meter (2.07 ha) and the expected cost of the project is Rs. 54 crores. The build up area will be 41243 Sq mt. 3. The site falls under Municipal Corporation limits of Zirakpur. 4. The present land use of the area is agriculture and proposed land use is residential. 5. Total water required for the project is approx. 187 Kl/day. Municipal supply is there, if required, the water demand shall be met through tubewell (stand by source). 6. Sewage generated from the present project shall be 150 kl/day (80% of the total water consumption). 7. A sewage treatment plant of 150 KLD capacity shall be installed. 8. The treated effluent @ 18.0 Kl/day will be used for irrigating area under parks in the colony, 63 KLD will be used in flushing. The remaining sewage will be discharged into Municipal sewer line. 9. Around 554 Kg/day of domestic solid waste will be generated. 10. The project will require approx. 1770 KW of electricity. One generator of 125 KVA capacity is proposed for emergency operations only. 11. The project promoter has applied for screening category 8 (a) of the schedule attached to EIA notification dated 14/9/2006.) 12. The other details of the project including Environment Management Plan (EMP) have been given in the Form 1 & 1-A submitted by the promoter (Annexure-XIII). The case is placed before the State Expert Appraisal Committee for consideration.

Item No. 19.4.2 Application for grant of environmental clearance for Savitry Towers a Housing Project to be established at Village Lohgarh, NAC Zirakpur, Tehsil Dera Bassi, Mohali M/s N.K. Sharma Enterprises Ltd. An application for environmental clearance for housing colony namely Savitry Towers to be developed at Village Lohgardh, NAC Zirakpur, Tehsil Dera Bassi,Distt. Mohali has been received from M/s N.K. Sharma Enterprises Pvt. Ltd., as per application, the project details are as under: &#61623 A total of 194 flats & 24 pent houses & 1 Kindergarten School & 10 Shops are proposed. &#61623 The total area of the proposed site is 1.46 hectare and the expected cost of the project is Rs. 16.28 crores & cost of land of Rs. 4.0 crore. The built up area is 68906.84 mt. sq. &#61623 The project promoter has applied for screening category B (B2) of the schedule attached to EIA notification dated 14/9/2006.) &#61623 &#61623 The project site is within the limits of Nagar Panchayat, Zirakpur. The water requirement of project is 172 Kl/day which will be met through tubewells. &#61623 Sewage generated from the present project shall be 128 kl/day (75% of the total water consumption). A common STP of 350 kl/day of three housing projects Savitry Enclave, Savitry Heights-I and Savitri Towers, by the same developers. All three projects are located adjacent to each other is proposed. The Sewage Treatment Plant based on activated sludge process shall be provided. &#61623 The solid waste about 350 kg/day shall be generated @ 0.3 kg/capita. The promoter has proposed that the Bio-degradable component of the solid waste shall be engaged through composed system as verminculture. &#61623 Total energy requirement project is 1250 KW, which is proposed to be provided the electricity department and one generator of 250 KVA capacity is proposed for stand by use, in which HSD will be used as fuel. The D.G. sets shall be of in built Acoustic enclosure as approved by CPCB. During the meeting, the Committee awarded Silver Grading to the project and recommended to forward the project to State Environment Impact Assessment Authority for grant of environmental clearance, with the certain conditions. Accordingly, the case file of the project proponent was forward to State Environment Impact Assessment Authority for grant of environmental clearance, with the certain conditions. The case was considered by SEIAA in its 14 th meeting held on 10/2/2009, wherein, the authority observed that the project proponent has given four options for location of Sewage Treatment Plant (STP) and the option-iv, which is the proposal for installation of STP in the basement, has been recommended by SEAC. The authority was of the opinion that the location of STP in the basement need to be re-examined as the STP in its non-operational condition can generate methane gas and other foul smell. Accumulation of methane gas in basement if not properly ventilated can cause accident. This provisions will also involved extra pumping of treated effluent for disposal. Accordingly, the authority decided that the SEAC may be requested to reconsider the matter regarding location of STP as per above said observation of the authority and submit its report/recommendation on priority. The extract of the proceedings pertaining to the said item is placed below as per Annexure-XVI. Accordingly, the case is again placed before the State Expert Appraisal Committee for reconsideration in view of reply given by the project proponent.

Regarding comments of State Expert Appraisal Committee on the draft notification no. S.O. 195 (E) dated 19/1/2009 issued by Ministry of Environment and Forests. The brief resume of subject cited meeting held under the Chairmanship of Secretary (E&F) with Chairmen and Member Secretaries of the State Environment Impact Assessment Authorities (SEIAAs) and Chairmen and Secretaries of State Expert Appraisal Committees (SEACs) held on 29/1/2009, New Delhi was circulated to the Committee members during the 18 th meeting of State Expert Appraisal Committee held on 21/2/2009. The above said brief resume as well as draft notification no. S.O. 195 (E) dated 19/1/2009 issued by Ministry of Environment and Forests as per draft given below is placed before the Committee for perusal and discussions. Draft amendments to the EIA Notification, 2006 : i) Construction projects containing built up area > 20,000 sq. mt. and or developing area more than 50 ha shall be treated as activity 8(a) or 8(b) as the case may be, instead of increasing it as > 50,000 sq. mt. for construction purposes and area 100 ha for developing area. ii) Categorization of the projects B, and B2 may be based on pollution potential of the proposed project, irrespective of cost of project to ensure the sustainable development in the State. Monitoring mechanism for approved cases : After the detailed deliberations on the item, Committee members were of the view that compliance of conditions of environmental clearance granted to the industry / construction projects / development projects shall be monitored by the panel of experts to be constituted, which may include 8 to 10 members, of which atleast three members may monitor the compliance of conditions of environmental clearance granted to any industry / construction project / development project.
