In order to get started, we will need to authorise your fundraising activity. Please note that you cannot commence fundraising on behalf of MPI without written approval. Please read through the Fundraising Terms of Agreement attached. To proceed, sign and complete all sections of the Fundraising Proposal Agreement Form. # FUNDRAISING TERMS AND AGREEMENT The Australian Government has developed legislation governing the conduct of fundraising. Under the 1991 Charitable Fundraising Act in each state, anyone wishing to raise money for charitable purposes must hold an authorisation letter issued by the organisation, in this case, Madiba Project Inc. To obtain approval for authority to raise funds for MPI, the following Fundraising Terms and Conditions need to be accepted and a Fundraising Proposal Agreement Form completed and submitted for consideration and approval. MPI will issue you or your organisation with an authorisation letter (Approval to Fundraise) which will then enable you to undertake fundraising on behalf of MPI when: A. A written and signed copy of the Fundraising Proposal Agreement Form has been received; B. MPI is satisfied that the fundraising event/activity will produce appropriate return after expenses have been deducted; C. MPI is satisfied that the fundraising event/activity fits in with the aims and values of MPI; and, D. $ FUNDRAISING TERMS AND AGREEMENT 1. The organiser of any fundraising event or activity needs to abide by all State/Territory charities legislation and apply for any permits and authorities that may be required. This is inclusive of all raffles, bingo, vending tickets, other games of chance or any public appeal. Different states have their own legislation, which should be checked beforehand. If you require guidance in this area, please phone Madiba Project Inc. (MPI) Copies of any permits must be sent to MPI. 2. The Fundraiser and its employees and agents are not employees or agents of MPI, nor are they acting in any other representative capacity of MPI. All aspects of financial liability, public liability and public safety are the sole responsibility of the Fundraiser and the fundraising event/activity is undertaken by the Fundraiser on its own behalf and at its own risk. 3. It is the responsibility of the Fundraiser to ensure the safety of the fundraising event/activity, including organising appropriate public liability insurance and providing first aid services if deemed necessary. 4. MPI s insurance policy does not cover activities conducted by outside organisations and groups. All insurance cover required is the sole responsibility of the Fundraiser. 5. The Fundraiser agrees to indemnify and keep indemnified MPI and its representatives to the fullest extent possible under law (whether arising under statute, the laws of negligence, strict liability or otherwise) for all claims, loss and damage incurred by any person in relation to the fundraising event/activity except to the extent such liability arises because of the negligence of MPI.!#$%&'#($)#*+,-./0$1/,+*,+#0.(23#$%4/,'''''''56,1.&'78'9:;9'<=>'9>;''''''''?@A&'BC';CD'>:='EBB''''''''FGAH<C><9''''''

% 6. The Fundraiser must not represent itself as having any partnership, agency, joint venture or any other relationship with MPI. 7. The Fundraiser must notify MPI of any changes to the running or organisation of the fundraising event/activity. 8. The Fundraiser is not permitted to use the name or logo of MPI without written approval. At no time can your fundraising event/activity be advertised as an MPI event. However, it can be referred to as an event supporting MPI. 9. MPI can allow you to use the tag line proudly supporting on your promotional material. For instance, this event is proudly supporting MPI or funds raised will be donated to MPI. 10. All promotional material, advertisements, media materials and press releases to be used by the Fundraiser in relation to the activity need to be submitted to MPI for written approval before public distribution or circulation. 11. The Fundraiser is solely responsible for any expenses relevant to the fundraising event/activity. The Fundraiser must not incur any expenses in the name of MPI. 12. The Fundraiser must maintain accurate records of income and expenditure relating to the fundraising event/activity. Monies received in the course of the fundraising event/activity must be immediately paid into a separate bank account. Expenses necessary to conduct the fundraising event/activity may be deducted from the proceeds, provided they are properly documented. 13. All monies, which have been raised for MPI by the fundraising event/activity, and details of actual income and expenditure of the fundraising event/activity, must be remitted to MPI within 14 days of the closure of the fundraising event/activity.!#$%&'#($)#*+,-./0$1/,+*,+#0.(23#$%4/,'''''''56,1.&'78'9:;9'<=>'9>;''''''''?@a&'bc';cd'>:='ebb''''''''fgah<c><9''''''

& 14. The Fundraiser agrees and acknowledges that MPI has complete discretion over the expenditure and distribution of any funds raised by the Fundraiser, which are donated to MPI. 15. Individual tax-deductible receipts can only be issued by MPI for people making monetary donations of $2.00 or more. If a donor would like a receipt, please send a list including the name; address; phone number and donation amount and a receipt will be issued from MPI following the receipt of said funds. Please note that MPI cannot provide tax deductible for non-tax deductible items such as sponsorship, ticket purchases, entry to an event, donation of goods or services, raffle tickets and auction purchases. However, letters of acknowledgment can be provided for donations of goods. 16. The Fundraiser must not do or permit anything to be done which is detrimental to the goodwill, name or reputation of MPI. 17. MPI reserves the right to assess each application to fundraise and to decline to authorise a potential fundraiser. MPI may withdraw any Approval to Fundraise it has previously granted at any time and without prior notice where it believes that these conditions are not being complied with or otherwise to protect its reputation.
