Cases for Stage -4 Appraisal

41.1.1 Application for grant of environmental clearance for manufacturing of finished leather @ 22,000 sq.ft./day for your project to be located at 140, Leather Complex, Kapurthala Road, Jalandhar by M/s Crew B.O.S. Products Ltd. M/s Crew B.O.S. Products Ltd. has applied for grant of environmental clearance for manufacturing of finished leather @ 22,000 sq.ft./day for your project to be located at 140, Leather Complex, Kapurthala Road, Jalandhar. The case was considered in the 3 rd meeting of State Expert Appraisal Committee held on 24/3/2008, wherein the Committee approved the certain Terms of Reference for Environmental Impact Assessment Study of the proposed project and the same were conveyed to the project proponent vide letter no. 15191 dated 11/4/2008. considered in the 22 nd The final EIA report submitted by the project proponent was meeting of Committee held on 9/5/2009, wherein the Committee members asked the project proponent to submit the process flow diagram indicating the quantities of all inputs (including water) and out puts (including waste water) on one day basis. The proponent was also advised to give energy balance data, hazardous and solid waste generated during each step of manufacturing activities. The said decisions were conveyed to the project proponent vide letter no. 15645 dated 19/5/2009, subsequent reminder no. 33975 dated 14/10/2009 and no. 666 dated 6/1/2010, but no reply has been received from the industry. The case was discussed in the 40 th meeting of State Expert Appraisal Committee held on 29/5/2010, wherein, it was decided that the industry be asked to submit the documents as already requested and the case be placed in the next meeting of SEAC for its appraisal and it exemption from public hearing being located in leather complex as per 7 (c) of the EIA notification. The matter is placed before committee for appraisal.

41.1.2 Application for grant of environmental clearance for Paramount Mall & Multiplex to be developed by M/s Paramount Buildtech Pvt. Ltd. at Landran Road, Mohali. M/s Paramount Buildtech Pvt. Ltd. has submitted application for grant of environmental clearance for Paramount Mall & Multiplex to be developed at Landran Road, Mohali. The case was considered in the 10 th meeting of State Expert Appraisal Committee held on 9/8/2008. However, no representative of the promoter attended the meeting and the case was deferred. The project proponent was requested vide letter no. 37137 dated 7/10/2008 to clarify whether the project proponent want to pursue its case or not. But no reply was received from the project proponent in this regard so far. The matter regarding disposal of pending cases were discussed in the 22 nd meeting of State Expert Appraisal Committee held on 9/5/2009, wherein, it was decided that all such proponents may be issued a letter to respond to the earlier communication by SEAC within 15 days, failing which the project will be delisted from the list of pending cases with SEAC. Accordingly, the project proponent was given another opportunity vide letter no. 18832 dated 25/5/2009 for submitting the requisite reply, within 15 days. However, the letter no. 18832 dated 25/5/2009 sent to the project proponent through speed post has been received back undelivered without any legible remarks / comments from the Postal Authorities. Environmental Engineer, Nodal Office, Mohali was requested to make efforts to get the letter delivered to the project proponent and report compliance to the Committee vide letter no. 21263 dated 19/6/2009. Subsequently, reminder were issued vide letter no. 22643 dated 3/7/2009, no. 26762 dated 11/8/2009, no. 33964 dated 14/10/2009 and no. 702 dated 6/1/2010. But no reply has been received so far even after telephonic discussion. The case was discussed in the 40 th meeting of State Expert Appraisal Committee held on 29/5/2010, wherein, it was decided that the project

proponent be asked to submit the documents as already requested and the case be placed in the next meeting of SEAC. The matter is placed before committee for appraisal.

41.1.3 Application for grant of environmental clearance for Janta Township a Residential Project to be established by M/s Janta Land Promoters Ltd. at Sector 90-91, Mohali. M/s Janta Land Promoters Ltd. has submitted application for grant of environmental clearance for setting up residential complex named as Janta Township at Sector 90-91, Mohali. The case was considered in 13 th meeting of Committee held on 11/10/2008, wherein the Committee requested the promoter to submit the relevant papers vide which exemption was granted by the Ministry of Environment & Forests from obtaining environmental clearance. He was also requested to clarify whether the project proponent had applied for grant environmental clearance for additional 18.35 acres land or the total project area of is 138.35 acres as in this case, exemption had already been granted by the Ministry of Environment & Forests from obtaining environmental clearance, as claimed by the representatives of the promoter. The decisions of the Committee were conveyed to the project proponent vide letter no. 39372 dated 23/10/2008. 5/12/2008. The project proponent submitted its reply vide letter dated The case was reconsidered in 18th meeting of Committee held on 21/2/2009, wherein the Committee asked the Project Proponent to submit the certain details / data, within one month as requested vide letter no. 8026 dated 4/3/2009. The matter was reconsidered by SEAC in its 23 rd meeting held on 6.6.2009, wherein, the Committee awarded Silver Grading to the project and recommended the project to SEIAA for grant of environmental clearance subject to the conditions as mentioned therein. Thereafter, the case was considered by the Authority in its 19 th meeting held on 27.6.2009, wherein, the authority asked the project proponent to submit the following :-

1. The project proponent shall submit revised water balance by reducing its wastewater discharge into Patiala-Ki-Rao to the level as minimum as possible, within 7 day. 2. The Punjab Pollution Control Board will re-examine as to whether the project proponent may be allowed to discharge its wastewater into Patiala-Ki-Rao. 3. The Punjab Pollution Control Board be requested to give detailed information of the industries located within 500 meters from the boundary of the project site. A comprehensive site plan of 500 mts radius in this regard may also be submitted. The decisions of the Authority were conveyed to the project proponent vide letter no. 23488 dated 14/7/2009 and to Punjab Pollution Control Board vide letter no. 23488 dated 14/7/2009. The project proponent has submitted revised water balance vide letter dated 18.7.2009. Also, the Environmental Engineer, Punjab Pollution Control Board, Nodal Office, Mohali vide its letter dtd.13.10.2009 has sent the details of the industries located within 500 metres radius of the project site. Regarding discharge of wastewater into Patiala-Ki-Rao, the MS, SEIAA informed that the PPCB has given personal hearing to the project proponent on 23.12.2009 to withdraw the permission for discharge of effluent into Patiala-Ki-Rao and the final report in this regard will be sent to SEIAA after the date of hearing. Meanwhile, the Ministry of Environment and Forests, New Delhi vide its notification no. GSR 826 (E) dtd.16.11.2009 has amended the schedule-vii regarding National Ambient Air Quality Standards; these standards have become effective from the date of its notification i.e. 16.11.2009. The case was reconsidered by the Authority in its 25 th meeting held on 15/12/2009, wherein, the Authority decided that :- 1. The case be forwarded to State Expert Appraisal Committee to reexamine the matter, in view of new notification for ambient air quality standards, reply submitted by project proponent, report of PPCB

regarding industries within 500 m radius of the project site and recommendations of PPCB regarding discharge of effluent into Patiala- Ki-Rao. 2. The PPCB be requested to send the report regarding discharge of effluent into Patiala-Ki-Rao directly to Secretary, SEAC with a copy to Member Secretary, SEIAA. Accordingly, Punjab Pollution Control Board was requested vide no. SEIAA/2009/42215 dated 29/12/2009 to send recommendations of the Board in the matter. The case was reconsidered in the 36 th meeting of State Expert Appraisal Committee held on 23/1/2010. The State Expert Appraisal Committee decided that the project proponent should not be allowed to discharge its wastewater (treated or untreated) directly or indirectly in to Patiala-Ki-Rao, under any circumstances and further observed that any red category industry (air polluting) can establish its plant in the said Industrial Focal Point within 100 m distance from the proposed site., therefore, the Committee decided to ask the project proponent as under :- 1. To submit the authenticated scheme duly marked on the map for utilization of its entire wastewater onto land for plantation, within its township. 2. To submit the revised layout / building plan with 15 m green belt around the boundary of its project adjoining to the said Industrial Focal Point as per Govt. Notification no. 2274 dated 25/8/2007. The layout / building plan should be approved by the Competent Authority. Accordingly, project proponent was conveyed the decision vide letter no. 3394 dated 28/1/2010. The project proponent has submitted the reply vide letter dated 11.5.2010. The case was discussed in the 40 th meeting of State Expert Appraisal Committee held on 29/5/2010, wherein, It was decided that the case be placed in the next meeting of SEAC. The matter is placed before committee for appraisal.

41.1.4 Application for grant of environmental clearance for Garden Heights a Residential Complex to be established by M/s Pavani Buildwell Pvt. Ltd. at Vill. Alipur Arian, Sirhind Road Bye-pass, Patiala. M/s Pavani Buildwell Pvt. Ltd. has applied for grant of environmental clearance for proposed residential complex namely Garden Heights to be developed at Vill. Alipur Arian, Sirhind Road Bye-pass, Patiala. The case was considered in the 13 th meeting of State Expert Appraisal Committee held on 11/10/2008, wherein, the Committee decided that the proposal shall be considered for environmental clearance after the receipt of the certain documents / data, which had been conveyed to the project proponent vide letter no. 39373 dated 23/10/2008. Project proponent was issued notice for violation of provisions of EIA Notification, 2006 vide letter no. 43438 dated 12/12/2008 as the project proponent has carried out 25% of the construction of the project without obtaining EIA clearance. Reminded was issued to the project proponent vide letter no. 1331 dated 14/1/2009 and no. 18852 dated 25/5/2009 to submit the documents as desired by the Committee during the 13 th meeting held on 11/10/2008. The case was forwarded to Govt. to take penal action against the project proponent vide letter no. 13469 dated 23/4/2009, for starting construction without obtaining EIA clearance. Thereafter, project proponent submitted its reply vide its letter dated 11/6/2009, which was considered by the Committee in its 26 th meeting held on 25/7/2009, wherein, the Committee decided that: 1. The project proponent shall stop construction activity at site, immediately.

2. The project proponent shall submit reply / documents with regard to observations of the Committee members as above, within 10 days, failing which the case of the project proponent will be de-listed. Accordingly, the project proponent was requested to submit the aforesaid documents vide letter no. 26772 dated 11/8/2009. Project proponent submitted its reply vide its letter dated 19/8/2009, which was considered by the Committee in its 29 th meeting held on 26/9/2009, wherein, it was decided that a final opportunity of 15 days be given to the project proponent for submitting requisite permissions from the concerned authorities, failing which, the application submitted by the project proponent for the environmental clearance will be delisted from the cases before the State Expert Appraisal Committee. Accordingly, the Committee decided to defer the case, which was conveyed to the project proponent vide letter no. 33768 dated 13/10/2009. Project proponent was again requested vide letter no. 41163 dated 17/12/2009 to submit the aforesaid documents, within 15 days. The matter was reconsidered as general item by the Committee in its 39 th meeting held on 1/5/2010. A final opportunity of 30 days time was given to the project proponent to submit the complete reply / documents vide letter no. 23203 dated 18/5/2010. The case was discussed in the 40 th meeting of State Expert Appraisal Committee held on 29/5/2010, wherein, it was decided that final opportunity has already been given to project proponent on 18/5/2010 to complete the documents. The case be placed in the next meeting of SEAC. No reply has been received from project proponent so far. The matter is placed before the State Expert Appraisal Committee for appraisal.

41.1.5 Application for grant of environmental clearance for Vision Apartments a Residential Group Housing Project to be established by M/s Vision Promoters & Builders Pvt. Ltd. at Mubarakpur, Dera Bassi, Distt. Mohali. M/s Vision Promoters & Builders Pvt. Ltd. has applied for grant of environmental clearance for proposed Residential Group Housing Project namely Vision Apartments to be developed at Mubarakpur, Dera Bassi, Distt. Mohali to be developed by M/s Vision Promoters & Builders Pvt. Ltd. The case was considered in the 13 th meeting of State Expert Appraisal Committee held on 11/10/2008, wherein it was observed that there is one red category industry namely M/s PCPL within 500 metre radius of the project site. However, NOC of Punjab Pollution Control Board has already been obtained and provision of 15 metre green belt has been made towards the red category industry. After deliberations, the project proponent was asked to submit the following details: - 1. The list of all structures like industries, other buildings, Roads and any other important project within 500 metre radius. 2. As there is one red category industrial unit in the 500 metre radius of the project site, the project proponent will provide data of ambient air quality at the site for at least four different days in a month and the incremental pollution load in the proposed group housing project and the nearby residential area, if any, will be submitted as per dispersion modeling. 3. The promoter will calculate the terrace area required for installation of solar water heating system and submit the proposed terrace plan in this regard. 4. The promoter will provide details of parking area requirement in the project area and the parking space provided for this purpose.

5. The project promoter should provide wind breaking curtains and water sprinkling system to minimize dust emissions, during the construction phase. 6. The promoter should also provide adequate safety measures for the construction workers during the construction phase. 7. The promoter will also submit affidavit to constitute an Environment Monitoring Cell. 8. The project proponent should submit construction schedule (CPM / PERT chart). These observations were conveyed to the project proponent vide letter no. 39377 dated 23/10/2008 and vide reminder no. 18849 dated 25/5/2009. The project proponent submitted its reply vide its letter dated 4/6/2009. Accordingly, the case was again considered in the 26 th meeting of State Expert Appraisal Committee held on 25/7/2009. The reply submitted by the project proponent vide letter dated 4/6/2009 was discussed in detail and observed as under :- 1. The project proponent has not submitted the status of industrial unit existing in the vicinity. 2. The parking details have not been submitted. 3. The CPM / PERT chart submitted by the project proponent is not proper. As such, the Committee decided to constitute a sub-committee, who will visit the proposed site to check the status of industrial unit existing at a distance of 30 m from the unit in question. The sub-committee visited the site of the proposed residential group housing on 1/10/2009 and observed that : i) The distance of the boundary of the proposed site from the boundary of the nearby industry located on the Opposite side of Mubarikpur- Dera Bassi road is 42 m.

ii) During visit, it has also been observed that there are number of industrial units existing in the vicinity of the proposed site. The site plan already submitted by the project proponent, showing projects / industries in a radius of 500 m from the boundary of proposed site is not as per ground realities. The case was again considered in the 31 st meeting of State Expert Appraisal Committee held on 24/10/2009 and observed that the promoter has concealed the facts regarding the industries falling within 500 m distance from the periphery of proposed project. The project proponent has not submitted the information regarding parking details and construction schedule on CPM/ PERT Chart as already requested vide letter no. 26759 dated 11/8/2009. As such, the Committee asked the project proponent to submit following details, within one month, positively:- i) A revised map of area featuring industries as well as other important feature within the 500 metres radius from its periphery. ii) Fresh ambient air quality monitoring data for 15-days (twice a week). iii) Parking details. iv) CPM/ PERT Chart. These observation were conveyed to the project proponent vide letter no. 37038 dated 12/11/2009. But project proponent not submitted any reply even after issuance of reminded vide letter no. 698 dated 6/1/2010 to submit the requisite details. The matter was considered as general item by the Committee in its 39 th meeting held on 1/5/2010. A final opportunity of 30 days time was given to the project proponent to submit the complete reply / documents vide letter no. 23198 dated 18/5/2010. The case was discussed in the 40 th meeting of State Expert Appraisal Committee held on 29/5/2010, wherein, it was decided that final opportunity has already been given to project proponent on 18/5/2010 to complete the documents. The case be placed in the next meeting of SEAC for its appraisal.

No reply has been received from project proponent so far. The matter is placed before the State Expert Appraisal Committee for appraisal.

41.1.6 Application for grant of environmental clearance for Knowledge Park to be established by M/s Emaar MGF Land Ltd. at Ludhiana-Ferozepur Road, Ludhiana. M/s Emaar MGF Land Ltd. has applied for grant of environmental clearance for Knowledge Park Project to be developed by at Ludhiana-Ferozepur Road, Ludhiana in an area of 750 acres. The case was discussed in the 14 th meeting of State Expert Appraisal Committee held on 1/11/2008, wherein, the Committee decided that the project proponent shall submit change of land use certificate from the Competent Authority for the project area before his application is considered by State Expert Appraisal Committee for grant of environmental clearance. Thereafter, the project proponent was again requested vide letter no. 41231 dated 18/11/2008 and no. 433 dated 7/1/2009 to submit the CLU from the concerned authority. The project proponent vide its letter dated 15/1/2009 requested to consider his case prior to issuance of CLU, as the land of the project forms part of Master Plan of Ludhiana, which has been notified on 22/2/2008. The case was reconsidered in the 21 st meeting of State Expert Appraisal Committee held on 11/4/2009, wherein, it was decided by the Committee that the project proponent should get the change of land use from the Competent Authority and submit it to the Committee. Thereafter, the project proponent was again requested vide letter no. 13360 dated 23/4/2009 and no. 33967 dated 14/10/2009 to submit the above said documents, but, project proponent failed to submit the said documents. The matter was considered as general item by the Committee in its 39 th meeting held on 1/5/2010. A final opportunity of 30 days time was given to the project proponent to submit the complete reply / documents vide letter no. 23209 dated 18/5/2010. The case was discussed in the 40 th meeting of State Expert Appraisal Committee held on 29/5/2010, wherein, it was decided that final

opportunity has already been given to project proponent on 18/5/2010 to complete the documents. The case be placed in the next meeting of SEAC for its appraisal. Mohali. The case was discussed in the 14 th meeting of State Expert Appraisal Committee held on 1/11/2008, wherein, the Committee decided that the project proponent shall submit change of land use certificate from the Competent Authority for the project area before his application is considered by State Expert Appraisal Committee for grant of environmental clearance. Thereafter, the project proponent was again requested vide letter no. 41233 dated 18/11/2008 and letter dated 7/1/2009 to submit the CLU from the concerned authority. The project proponent vide its letter dated 15/1/2009 requested to consider his case prior to issuance of CLU as the land of the project forms part of Master Plan of Mohali which has been notified on 12/1/2009. The case was reconsidered in the 21 st meeting of State Expert Appraisal Committee held on 11/4/2009, wherein, it was decided by the Committee that the project proponent should get the change of land use from the Competent Authority and submit it to the Committee. Thereafter, the project proponent was again requested vide letter no. 13362 dated 23/4/2009 and no. 33966 dated 14/10/2009 and no. 667 dated 6/1/2010 to submit the above said documents, but, the project proponent failed to submit the documents.

The matter was again considered as general item by the Committee in its 39th meeting held on 1/5/2010. A final opportunity of 30 days time was given to the project proponent to submit the complete reply / documents vide letter no. 23208 dated 18/5/2010. The case was discussed in the 40 th meeting of State Expert Appraisal Committee held on 29/5/2010, wherein, it was decided that final opportunity has already been given to project proponent on 18/5/2010 to complete the documents. Tira, Jhampur, Taraili, Raipur, Behlopur, Daun, Banmajra, Balongi and Ballomajra, Distt. Mohali. The case was discussed in the 14 th meeting of State Expert Appraisal Committee held on 1/11/2008, wherein, the Committee decided that the project proponent shall submit change of land use certificate from the Competent Authority for the project area before his application is considered by State Expert Appraisal Committee for grant of environmental clearance. Thereafter, the project proponent was requested vide letter no. 41234 dated 18/11/2008 and no. 430 dated 7/1/2009 to submit the CLU from the concerned authority before its case is considered by the State Expert Appraisal Committee. The project proponent vide its letter dated 15/1/2009 requested to consider his case prior to issuance of CLU as the land of the project forms part of Master Plan of Mohali which has been notified on 12/1/2009. The case was reconsidered in the 21 st meeting of State Expert Appraisal Committee held on 11/4/2009, wherein, it was decided by the Committee that the project proponent should get the change of land use from the Competent Authority and submit it to the Committee. Thereafter, the project proponent was again requested vide letter no. 13338 dated 23/4/2009, no. 33967 dated 14/10/2009 and no. 668 dated 6/1/2010 to submit the above said document, but, the project proponent has failed to submit the same.

The matter was considered as general item by the Committee in its 39 th meeting held on 1/5/2010. A final opportunity of 30 days time was given to the project proponent to submit the complete reply / documents vide letter no. 23206 dated 18/5/2010. The case was discussed in the 40 th meeting of State Expert Appraisal Committee held on 29/5/2010, wherein, it was decided that final opportunity has already been given to project proponent on 18/5/2010 to complete the documents. The case be placed in the next meeting of SEAC for its appraisal. No reply has been received from project proponent so far. The matter is placed before the State Expert Appraisal Committee for appraisal.

41.1.9 Application for grant of environmental clearance for DLF Premium Homes a Residential Group Housing Project to be developed by M/s DLF Premium Homes Pvt. Ltd. at Vill. Khajurla, Distt. Kapurthala. M/s DLF Premium Homes Pvt. Ltd. has applied for grant of environmental clearance for proposed Residential Group Housing Project namely DLF Premium Homes to be developed at Vill. Khajurla, Distt. Kapurthala. The case was discussed in the 17 th meeting of State Expert Appraisal Committee scheduled held on 3/1/2009, wherein project proponent was to submit the following details: - 1. The project proponent shall submit approval regarding change of land use for the project site, from the Competent Authority. 2. The project proponent shall submit copy of approved layout plan from the Competent Authority. 3. The project proponent will submit details of land where the 126 m 3 /day of treated sewage will be used for horticulture purposes, 150 m 3 /day of treated sewage will be used onto land for irrigation and the location of this land viz-a-viz the project site should be marked on the layout plan of the project. Accordingly, project proponent was requested to submit the above said details / data vide letter no. 5480 dated 13/2/2009. The project proponent was again reminded vide letter no. 33969 dated 14/10/2009 to submit the requisite details / documents / data within 10 days. The project proponent informed vide letter dated 23/11/2009 that due to global economic meltdown, the development of the project has been delayed. The project proponent, requested to give three months time to take a decision on the development of the project and obtain required clearances. In view of the request made by the project proponent, three months time was given to the project proponent vide letter no. 3396 dated 28/1/2010 to submit the requisite information / details. But, no reply was received.

The case was discussed in the 40 th meeting of State Expert Appraisal Committee held on 29/5/2010, wherein, it was decided that the industry be asked to submit the details as already requested and the case be placed in the next meeting of SEAC. appraisal. The matter is placed before State Expert Appraisal Committee for 41.1.10 Application for environmental clearance for Hotel, Shopping Mall cum Multiplex to be developed by M/s Best City Infrastructure (India) Pvt. Ltd. at Old Civil Hospital Site, Mall Road, Bathinda. M/s Best City Infrastructure (India) Pvt. Ltd. has applied for grant of environmental clearance for proposed Hotel, Shopping Mall-cum-Multiplex to be developed at Old Civil Hospital Site, Mall Road, Bathinda. The case was considered in the 21 st meeting of State Expert Appraisal Committee held on 11/4/2009, wherein project proponent was asked the project proponent to submit the following details:- 1. The list of all structures like industries (specifically red zone) and structures lying in the zone, within 500 metre radius from the periphery of the project alongwith site plan indicating relative location of these features. 2. The project proponent will submit layout and building plans approved by the Competent Authority. 3. The project proponent will submit the topography map of the area showing contour plan. 4. The promoter will calculate the terrace area required for installation of solar water heating system and submit the proposed terrace plan in this regard. 5. The promoter will provide details of parking area requirement in the project and the parking space provided for this purpose alongwith copy of norms of Competent Authority, which has been taken by the project proponent for calculation of parking area. 6. The promoter shall also submit affidavit regarding :

i) Constitution of Environment Monitoring Cell ii) Use of ready mix concrete or use of fly ash during construction. iii) To provide Fire Fighting System iv) To provide adequate safety measures for the construction workers during the construction phase. 7. The project proponent should submit construction schedule (CPM / PERT chart). 8. The project proponent should submit construction status at site alongwith latest photographs of the site from all the four sides. 9. The project proponent should submit following certificates from authorized departments regarding : a) State Boundary not within 10 Km. b) Project not lying in eco-sensitive and protected area including wild life sanctuaries. c) Not lying in the critically polluted areas. 10. The project proponent should submit data of ambient air, noise analysis and ground water quality (32 parameters as per BIS: 10500, both for ground water and canal water) for one month from NABL accredited laboratory alongwith accreditation certificate of the laboratory. 11. The project proponent should submit site plan of the project for the following ; i) Location of Sewage Treatment Plant ii) Solid waste and hazardous waste storage area. iii) Green belt iv) Parking space v) RWH and water recharge pits vi) Fire fighting equipment layout vii) First aid room viii) Location of Tubewells

12. The project proponent should submit following written permissions from the Competent Authority ; i) Water and Sewerage connection ii) Collection and disposal of solid waste iii) Use of Ground Water / canal water 13. The project proponent should submit quantification of energy saved and renewable energy devices used. Accordingly, project proponent was requested to submit the above said documents vide letter no. no. 13287 dated 22/4/2009. Thereafter, the project proponent was again requested vide letter no. 33971 dated 14/10/2009 and no. 665 dated 6/1/2010 to submit the above said documents, but, project proponent failed to submit the above said documents. The matter was considered as general item by the Committee in its 39 th meeting held on 1/5/2010. A final opportunity of 30 days time was given to the project proponent to submit the complete reply / documents vide letter no. 23199 dated 18/5/2010. The case was discussed in the 40th meeting of State Expert Appraisal Committee held on 29/5/2010, wherein, it was decided that final opportunity has already been given to project proponent on 18/5/2010 to complete the documents. The case be placed in the next meeting of SEAC. No reply has been received from project proponent so far. The matter is placed before the State Expert Appraisal Committee for appraisal.

41.1.11 Application for grant of environmental clearance for Construction of Residential Township to be developed by M/s HPCL Mittal Energy Ltd. at Village Raman & Tarkhanwala, Distt. Bathinda. M/s HPCL Mittal Energy Ltd. has applied for grant of environmental clearance for Residential Township to be developed at Village Raman & Tarkhanwala, Distt. Bathinda. The project was considered in the 22 nd meeting of State Expert Appraisal Committee held on 9/5/2009. The Committee requested the project proponent to submit certain documents, within 15 days. The project proponent vide letter dated 12/5/2009 submitted the reply of observations raised during 22 nd meeting held on 9/5/2009. The reply submitted by project proponent was placed before the State Expert Appraisal Committee in its 23 rd held on 6/6/2009 for its consideration, wherein, the Committee observed that the project proponent had provided adequate and satisfactory clarifications. After detailed deliberations on the project / reply submitted by the project proponent, the Committee awarded Gold Grading to the project and recommended to forward the project to State Environment Impact Assessment Authority for grant of environmental clearance subject to the certain conditions, only after the receipt of following documents from the project proponent and satisfactory acceptance of same by the Chairman and Secretary of State Expert Appraisal Committee:- i) The project proponent shall submit revised layout plan of the complex ii) indicating the area where the municipal solid waste will be collected. The project proponent is required to upgrade the water balance chart for rainy season. Accordingly, the project proponent was requested to submit the said documents vide letter no. 2988 dated 17/6/2009. The project proponent vide letter dated 20/7/2009 has submitted the layout plan indicating solid waste segregation area and water balance chart for

rainy season, accordingly, the case file of the project forwarded to State Environment Impact Assessment Authority for grant of environmental clearance subject to certain conditions mentioned therein. The case was considered in 23 rd meeting of State Environment Impact Assessment Authority held on 7/11/2009 wherein, the project proponent was asked to submit the following documents vide its letter no. 37430 dated 16/11/2009. 1. Approved layout plan or documentary evidence from the Competent Authority regarding exemption from obtaining approval of layout plan. 2. Water balance for the rainy season including details for justification regarding quantity of water to be used/wastewater to be generated and adequacy of land for disposal of wastewater. 3. Safety report from the competent authority to the effect that the distance of township from the refinery unit is adequate. Reminder was issued to the project proponent vide letter no. 39811 dated 7/12/2009. The project proponent submitted pointwise reply to State Environment Impact Assessment Authority vide its letter dated 1/1/2010. Accordingly, the Authority in its 26 th meeting held on 15/1/2010 decided that the case may be forwarded to SEAC to re-examine the same in view of new notification dated 16/11/2009 for AAQM standards as well as the reply dated 1/1/2010 submitted by the project proponent to the observations of the Authority. The case of the project proponent was considered in the 38 th meeting of State Expert Appraisal Committee held on 2/4/2010, wherein the representative of the promoter informed that the monitoring of Ambient Air Quality as per notification dated 16/11/2009 issued by Ministry of Environment & Forests has been started and the analysis results would be submitted within a period of 45 days. He further informed that as far as exemption from approval of layout plan of the project from the Deptt. of Town & Country Planning/PUDA is concerned, they have got a letter from PUDA in this regard. But it was not clear from that letter as

to whether they have been allowed exemption from approval of layout plan from PUDA or not. After the detailed deliberations on the reply submitted by the project promoter, the SEAC decided as under: 1. The project proponent shall submit the Ambient Air Quality Analysis data for one month period (samples to be collected twice a week for 24 hours at uniform intervals) from the NABL / MoEF accredited lab as per notification no. GSR. 826(E) dated 16/11/2009 issued by the Ministry of Environment & Forests, New Delhi. 2. PUDA be requested to intimate as to whether the project proponent is exempted from obtaining approval of layout plan from it or not and if yes, whether the letter No.PUDA/CA/BTI/2009/243 dated 27.2.2009 issued by it is good enough to take care of this exemption aspect. 3. The project proponent shall provide a storage tank of 30 days capacity for storage of treated wastewater during no demand period and/or rainy season. 4. The project proponent shall submit basic information as per amended Form-I as prescribed vide notification no. SO 3067(E) dated 1/12/2009. Accordingly, project proponent was requested to submit documents vide letter no. 18202 dated 13/4/2010 and PUDA was requested vide letter no. 18201 dated 13/4/2010 to intimate whether project proponent is exempted from obtaining approval of layout plan from it or not. If yes, whether letter no. PUDA/CA/BTI/2009/243 dated 27/2/2009 issued by them is good enough to take care of this exemption. The project proponent vide letter dated 22/4/2010 has submitted its reply. On examining the case, it was observed that as per CLU issued by the CTP, Punjab vide its letter no. 9588 dated 11/12/2008, project proponent is required to get the building plan approved from the Competent Authority as intimated by Additional Chief Administrator, Bathinda vide his letter no. 563 dated 30/4/2010.

The case was discussed in the 40 th meeting of State Expert Appraisal Committee held on 29/5/2010, wherein, it was decided that the industry be asked to submit the complete documents as already requested and the case be placed in the next meeting of SEAC for its appraisal. The matter is placed before State Expert Appraisal Committee for appraisal.

41.1.12 Application for grant of environmental clearance for "Rajgadh Estates" Residential Group Housing Project to be developed by M/s Dev Arjuna Promoters & Developers (P) Ltd. at Village Birmi Road, Sidhwan Canal, Ludhiana. M/s Dev Arjuna Promoters & Developers (P) Ltd. has applied for environmental clearance for establishment of a Residential Group Housing Project namely "Rajgadh Estates Phase-II" to be developed at Village Birmi Road, Sidhwan Canal, Ludhiana. The case was considered in the 22 nd meeting of State Expert Appraisal Committee held on 9/5/2009. After detailed deliberations, the Committee observed that the project proponent has not submitted certain documents. Accordingly, project proponent was requested to submit the documents vide letter no. 15644 dated 19/5/2009. The project proponent vide its letter dated 19/5/2009 has submitted additional 13 sets of documents already submitted by him. The case was reconsidered in the 24 th meeting of State Expert Appraisal Committee held on 13/6/2009. The Committee members observed that the project proponent has provided adequate and satisfactory clarifications. After detailed deliberations on the project / reply submitted by the project proponent, it was decided that Secretary (SEAC) will verify from Central Ground Water Authority / MOEF as to whether prior clearance of Ground Water Authority is required with respect to this project or not. The project may be held up by that time. If the clearance of CGWA is required, then the case be placed back before the Committee for consideration, if it is not required, then the case may be forwarded to State Environment Impact Assessment Authority with Silver Grading for grant of environmental clearance subject to the certain conditions. MoEF has been requested vide letter no. 22655 dated 3/7/2009 no. 32414 dated 5/10/2009, no. 35032 dated 26/10/2009 to clarify whether prior clearance / permission of Central Ground Water Authority is required before the appraisal of the case by State Expert Appraisal Committee. But no reply has been received so far.

The case was discussed in the 40 th meeting of State Expert Appraisal Committee held on 29/5/2010, wherein, it was observed that no information has been received from MoEF despite reminder regarding CGWA permission. Case be placed before SEAC in its next meeting. The matter is placed before committee for appraisal.

41.1.13 Application for grant of environmental clearance for the Married Accommodation project to be established by Executive Engineer, CPWD, Amritsar at New Amritsar Military Station State- Amritsar Attari Road, Amritsar. The Executive Engineer, CPWD, Amritsar has applied for grant of environmental clearance to set up a Married Accommodation at New Amritsar Military Station State - Amritsar Attari Road, Amritsar. The project proponent was requested to submit 14 additional sets of documents complete in all respect vide letter no. 39024 dated 22/10/2008 and no. 40665 dated 11/11/2008. The project proponent vide its letter dated 19/2/2009 submitted the 14 sets of EIA report of the project and accordingly, the case was considered in the 22 nd meeting of State Expert Appraisal Committee held on 9/5/2009. After detailed deliberations, the Committee observed that the project proponent has not submitted certain documents. Accordingly, project proponent was requested vide letter no. 15643 dated 19/5/2009 and no. 34281 dated 16/10/2009 to submit Form 1 & 1A alongwith documents as desired by the Committee so that further necessary action may be taken in the matter. Central Public Works Department has informed vide its letter no. 20(MAP)/Amritsar/452 dated 1/11/2009, which was incomplete, as per the check list prepared by the Committee for pre-appraisal of the project. Accordingly, the project proponent was again requested vide letter no. 38370 dated 23/11/2009 and subsequent reminded vide letter no. 691 dated 6/1/2010 to submit the certain documents / information / data, within 10 days. The matter was considered as general item by the Committee in its 39 th meeting held on 1/5/2010. A final opportunity of 30 days time was given to the project proponent to submit the complete reply / documents vide letter no. 23197 dated 18/5/2010. The case was discussed in the 40 th meeting of State Expert Appraisal Committee held on 29/5/2010, wherein, it was decided that final

opportunity has already been given to project proponent on 18/5/2010 to complete the documents. The case be placed in the next meeting of SEAC. No reply has been received from project proponent so far. The matter is placed before the State Expert Appraisal Committee for appraisal. 41.1.14 Application for environmental clearance for Group Housing cum Retail Complex namely CAMELOT to be developed at Vill. Kansal, Tehsil Kharar Mohali by M/s Tata Housing Dev. Co. Ltd. M/s TATA Housing Development Co. Ltd. has applied for environmental clearance for establishment of a Group Housing-cum-Retail Complex namely Camelot at Vill. Kansal, Tehsil Kharar, Mohali. The case was considered in the 23 rd meeting of State Expert Appraisal Committee held on 6/6/2009. After detailed deliberations on the project / reply / documents submitted by the project proponent, the Committee awarded Gold Grading to the project and recommended to forward the project to State Environment Impact Assessment Authority for grant of environmental clearance subject to the certain conditions after the receipt of building plan from the project proponent, approved by the Competent Authority. The project proponent was requested to submit building plan approved by the Competent Authority vide letter no. 20987 dated 17/6/2009, subsequently project proponent was again reminded vide letter no. 33965 dated 14/10/2009. The project proponent submitted its reply vide its letter dated 23/10/2009 mentioning that the approval of building plans is under process with the Competent Authority and will be submitted immediately after its receipt.
