GP 98-01 was ssued under authorty of Secton 404 of the Clean Water Act (Publc Law 95-217, 33 U.S.C. 1344 et. Seq) and authorzes the dscharge of fll materal nto waters of The Unted States (U.S.), ncludng wetlands, wthn certan lots n the Wrangell Industral Park Subdvson. The Subdvson s located wthn Secton 24, T. 62 E., R. 83 S., Copper Rver Merdan; Lattude 56.475 N., Longtude -132.375 W.; on the northeast edge of the Cty of Wrangell, Alaska. PURPOSE: The GP was developed to streamlne the permttng process for ndustral development on certan lots wthn the Wrangell Industral Park Subdvson. AUTHORIZED ACTIVITIES: placement of dredged and/or fll materal, and structures, nto wetlands assocated wth ndustral development n the Wrangell Industral Park Subdvson. Authorzed actvtes nclude foundaton pads, assocated drveways, parkng areas, and lot utltes. The General Permt area ncludes the followng lots wthn the Wrangell Industral Park Subdvson (a map of the project area s attached):

Block 61 63B 64 65 66 Lot 3A, 7A, 8A, 9 8 3, 8A 3 7-13 WATER QUALITY CERTIFICATION: The GP wll not be ssued untl a certfcaton or waver of certfcaton, as requred under Secton 401 of the Clean Water Act (Publc Law 95-217), has been receved from the Alaska Department of Envronmental Conservaton (ADEC). ADEC ssued a Certfcate of Reasonable Assurance for GP 98-01 to the USACE on August 5, 1998, (amended on August 2, 2000) and ncluded seven stpulatons. That certfcaton expred on January 22, 2006. On July 6, 2006, ADEC ssued a new Certfcate of Reasonable Assurance to accompany the re-ssued GP that ncluded eght stpulatons. That certfcaton expred on February 19, 2013, wth the expraton of the re-ssued GP. The 2013 GP re-ssuance was ssued a 401 Waver by ADEC, whch ncluded a requrement to contnue to utlze the prevous eght stpulatons. MITIGATION: Mnmzaton: Pror to begnnng constructon, the lmts of the proposed excavaton and fll areas must be staked and/or flagged to prevent the nadvertent encroachment of fll materal nto adjacent wetlands. Eroson control measures, such as slt fencng, sedment traps, or water dverson structures, must be properly deployed and nstalled. Durng constructon, slt and sedment from the ste work must be prevented from enterng wetlands or water bodes outsde the authorzed project lmts. Ste preparaton, excavaton, and fll placement must be conducted n a manner to prevent adverse hydrologc effects. Natural dranage patterns must be mantaned usng approprate dtchng, culverts, storm dran systems, and other measures, wthout ntroducng pondng or dryng. Compensatory Mtgaton: Mtgaton for the ntal unauthorzed development ncluded preservng a 485-foot x 50-foot greenbelt south of Howell Avenue. Issuance of the orgnal GP 98-01 ncluded preservng a 300-foot x 100-foot area near Fourth Avenue as green space. Modfcaton of the GP n January 2001 ncluded puttng 18 addtonal lots and portons of three other lots and the area desgnated as Msson Street nto a "Restrctve Covenant" wth the ntent of retanng the area n ts natural, wetland condton. BACKGROUND: Development n the Wrangell Industral Park Subdvson began n 1997 by the Cty of Wrangell under DA permt POA-1997-00702 whch authorzed exstng nfrastructure as well as road constructon and utlty work. General Permt 98-01 was subsequently developed and ssued to the Cty of Wrangell on December 10, 1998. The GP was later transferred from the Cty to "other prvate or publc enttes" to drect admnstraton of the GP from the Cty back to the USACE. On January 22, 2001 the GP was modfed to create a vegetated buffer on the west sde of the subdvson by puttng several lots nto a Restrctve Covenant. Table 1 summarzes the type of actons and assocated acreage authorzed by ths GP durng the 18 years the GP was n effect. GP 98-01-M3 expred on February 18, 2018, The Corps of Engneers (Corps) ssued two tme extensons, wth the newest extendng the GP to June 10, 2019. -2-

There are no lsted or elgble propertes n the vcnty of the Wrangell Industral Park. Consultaton of the AHRS consttutes the extent of cultural resource nvestgatons by the Dstrct Engneer at ths tme, and he s otherwse unaware of the presence of such resources. Ths applcaton s beng coordnated wth the State Hstorc Preservaton Offce (SHPO). Any comments SHPO may have concernng presently unknown archeologcal or hstorc data that may be lost or destroyed by work under the requested permt wll be consdered n our fnal assessment of the descrbed work. ENDANGERED SPECIES: No threatened or endangered speces are known to use the GP 98-01 project area. It was prevously determned that the descrbed actvty would not affect threatened or endangered speces, or ther crtcal habtat desgnated as endangered or threatened, under the Endangered Speces Act of 1973 (87 Stat. 844). ESSENTIAL FISH HABITAT: GP 98-01 was evaluated for possble effects to Essental Fsh Habtat (EFH) pursuant to the Magnuson Stevens Fshery Conservaton and Management Act of 1996 (MSFCMA), 16 U.S.C. et. seq and assocated federal regulatons found at 50 CFR 600 Subpart K. It was determned that the descrbed actvty wthn the proposed area would not adversely affect EFH, ncludng anadromous fsh and federally managed fshery resources. TRIBAL CONSULTATION: The Alaska Dstrct fully supports trbal self-governance and government-to-government relatons between Federally recognzed Trbes and the Federal government. Trbes wth protected rghts or resources that could be sgnfcantly affected by a proposed Federal acton (e.g., a permt decson) have the rght to consult wth the Alaska Dstrct on a government-to-government bass. -3-

Vews of each Trbe regardng protected rghts and resources wll be accorded due consderaton n ths process. Ths Publc Notce serves as notfcaton to the Trbes wthn the area potentally affected by the proposed work and nvtes ther partcpaton n the Federal decson-makng process regardng the protected Trbal rght or resource. Consultaton may be ntated by the affected Trbe upon wrtten request to the Dstrct Commander durng the publc comment perod. PUBLIC HEARING: Any person may request, n wrtng, wthn the comment perod specfed n ths notce, that a publc hearng be held to consder ths applcaton. Requests for publc hearngs shall state, wth partcularty, reasons for holdng a publc hearng. EVALUATION: The decson whether to ssue a permt wll be based on an evaluaton of the probable mpacts, ncludng cumulatve mpacts of the proposed actvty and ts ntended use on the publc nterest. Evaluaton of the probable mpacts, whch the proposed actvty may have on the publc nterest, requres a careful weghng of all the factors that become relevant n each partcular case. The benefts, whch reasonably may be expected to accrue from the proposal, must be balanced aganst ts reasonably foreseeable detrments. The outcome of the general balancng process would determne whether to authorze a proposal, and f so, the condtons under whch t wll be allowed to occur. The decson should reflect the natonal concern for both protecton and utlzaton of mportant resources. All factors, whch may be relevant to the proposal, must be consdered ncludng the cumulatve effects thereof. Among those are conservaton, economcs, aesthetcs, general envronmental concerns, wetlands, cultural values, fsh and wldlfe values, flood hazards, floodplan values, land use, navgaton, shore eroson and accreton, recreaton, water supply and conservaton, water qualty, energy needs, safety, food and fber producton, mneral needs, consderatons of property ownershp, and, n general, the needs and welfare of the people. For actvtes nvolvng 404 dscharges, a permt wll be dened f the dscharge that would be authorzed by such permt would not comply wth the Envronmental Protecton Agency's 404(b)(l) gudelnes. Subject to the precedng sentence and any other applcable gudelnes or crtera (see Sectons 320.2 and 320.3), a permt wll be granted unless the Dstrct Commander determnes that t would be contrary to the publc nterest. The Corps s solctng comments from the publc; Federal, State, and local agences and offcals; Indan Trbes; and other nterested partes n order to consder and evaluate the mpacts of ths proposed actvty. Any comments receved wll be consdered by the Corps to determne whether to ssue, modfy, condton or deny a permt for ths proposal. To make ths decson, comments are used to assess mpacts on endangered speces, hstorc propertes, water qualty, general envronmental effects, and the other publc nterest factors lsted above. Comments are used n the preparaton of an Envronmental Assessment and/or an Envronmental Impact Statement pursuant to the Natonal Envronmental Polcy Act. Comments are also used to determne the need for a publc hearng and to determne the overall publc nterest of the proposed actvty. -4-

General Permt 98-01-M4 Wrangell Industral Park Subdvson INTRODUCTION Ths General Permt (GP) authorzes the placement of dredged and/or fll materal, and structures, nto wetlands assocated wth ndustral development n the Wrangell Industral Park Subdvson. Authorzed actvtes nclude foundaton pads, assocated drveways, parkng areas, and lot utltes. The General Permt area ncludes the followng lots wthn the Wrangell Industral Park Subdvson (a map of the project area s attached): Block: 60 61 63B 64 65 66 Lot: 5 7A, 8A, 9 8 3, 7A, 8A 3, 4 7, 8, 9-13 All actvtes must be performed n accordance wth the condtons of the GP, a copy of whch s attached. Falure to comply wth the terms and condtons of the permt may result n suspenson, modfcaton or revocaton of the permt and/or mposton of penaltes as provded by law. REQUIREMENTS FOR USE OF THE GP The attached Specal and General Condtons descrbe the crtera whch must be met for work to be accomplshed under ths GP. An ndvdual wshng to perform work under the GP must carefully revew these condtons. If the proposed work does not meet the requrements or the condtons, the GP wll not apply, and an ndvdual Department of the Army permt applcaton must be submtted. PROCEDURES Indvduals wshng to perform work under ths GP shall submt, n wrtng, to the Dstrct Engneer, the followng nformaton: 1. The Block and Lot number of the Wrangell Industral Park Subdvson of the proposed actvty; 2. A descrpton of the work ncludng the sze of fll pads, drveways and any other features or structures requrng fll; 3. Plan drawngs, ncludng a plan vew and a cross-secton vew of the project, showng the layout of the drveway, pads, and structures n relaton to other features. The drawng must nclude stream locatons, dranage patterns, and topography. Plans must show the locaton and sze of culverts or other water bodes/dranage crossng structures; 4. The type and source of materal to be used and the dsposal ste for any excavated materal must also be ncluded; 5. Other nformaton ncludng photographs that would verfy that the proposed work meets the terms and condtons of the GP. 1

The nformaton provded wll be revewed by ths offce for complance wth the terms and condtons of the GP. Normally, wthn 15 days of recevng the requred nformaton, a letter wll be sent from ths offce to the applcant statng whether or not the proposed project s authorzed by the GP. Copes of the provded nformaton wll be furnshed to other nterested partes. No fll placement actvtes can begn untl the applcant has receved wrtten verfcaton from the U.S. Army Corps of Engneers (USACE) that the project s authorzed. Modfcaton of the work authorzed by the GP, ncludng changes n the sze or locaton of the footprnt of the project, or the amount or type of fll materal, requres submttal of revsed plans for revew and approval pror to dong any work. TIME PERIOD TO COMPLETE PROJECTS AND PROJECT TIME EXTENSIONS The permttee has two years from the date of the verfcaton letter from the Dstrct Engneer to construct the project. If the verfcaton letter s dated wthn the last two years the GP s n effect (between 3 and 5 years from the sgnature date), the project must be completed by the GP expraton date (5 years from sgnature date). If any permttee, whose work s already underway, requres addtonal tme to complete a project, a request may be made to the USACE. The USACE wll grant up to 12 months of addtonal tme to complete the project. The permttee s tme extenson request must be receved 30 days pror to the GP expraton date. PROJECT MODIFICATIONS If changes to the verfed project are necessary for any reason, revsed plans should be submtted to the USACE promptly. Federal law requres approval before constructon s begun; f the modfcaton s unobjectonable, approval wll be ssued wthout delay. GENERAL CONDITIONS 1. You must mantan the work authorzed by ths GP n good condton and n conformance wth the terms and condtons of ths permt. You are not releved of ths requrement f you abandon the permtted actvty. Should you cease to mantan the authorzed actvty or abandon t wthout a good fath transfer, you must obtan a modfcaton of ths permt from ths offce, whch may requre restoraton of the area. 2. If you dscover any prevously unknown hstorc or archaeologcal remans whle accomplshng the work authorzed by ths GP, you must mmedately phone ths offce of what you have found at 1-800-478-2712. We wll ntate the Federal and State coordnaton requred to determne f the remans warrant a recovery effort or f the ste s elgble for lstng n the Natonal Regster of Hstorc Places. 3. If you sell the property assocated wth ths GP, you must contact the USACE to valdate the transfer of ths authorzaton. 4. You must allow representatves from ths offce to nspect the authorzed work at any tme deemed necessary to ensure that t s n complance wth the terms and condtons of ths GP. SPECIAL CONDITIONS 2

1. Pror to begnnng constructon, the lmts of the proposed excavaton and fll areas must be staked and/or flagged to prevent the nadvertent encroachment of fll materal nto adjacent wetlands. 2. Pror to constructon, eroson control measures, such as slt fencng, sedment traps, or water dverson structures, must be properly deployed and nstalled. Durng constructon, slt and sedment from the ste work must be prevented from enterng wetlands or water bodes outsde the authorzed project lmts. 3. Ste preparaton, excavaton, and fll placement must be conducted n a manner to prevent adverse hydrologc effects. Natural dranage patterns must be mantaned usng approprate dtchng, culverts, storm dran systems, and other measures, wthout ntroducng pondng or dryng. Excessve pondng and/or dewaterng of areas adjacent to fll areas wll ndcate non-complance wth ths condton. 4. Durng excavaton and fll placement, heavy equpment must not be operated n wetlands outsde the authorzed excavaton and fll area. 5. Dredged or fll materal must not consst of unsutable materal (e.g., trash, metal debrs, overburden materal, wood waste, etc.) and must be free from petroleum products. All materal dscharged must be free of toxc pollutants n toxc amounts as defned by Alaska State Law and Toxc Pollutants Lst n Secton 307 of the Clean Water Act. 6. Temporary storage of excavated and/or excess materal on-ste must be managed to prevent sedment from beng carred nto adjacent wetlands and waters and to prevent leachate from causng odor problems or degradaton of water qualty. 7. Excavated areas must be flled wthn the shortest reasonable tme, so that ground s not left exposed for extended perods. Excavaton of overburden must take place on successve unts suffcently lmted n sze so that placement of fll can occur expedtously. 8. Dsturbed areas not covered wth rock fll must be stablzed and re-vegetated wth natve speces n a tmely manner to mnmze eroson and sedmentaton. 9. Unusable or excess materal must be dsposed of at an approved dsposal ste. 10. The proposed actvty must not adversely affect any speces lsted as threatened or endangered under the Endangered Speces Act of 1973, as amended (ESA), or endanger the crtcal habtat of such speces. In addton, the proposed actvty must not jeopardze the contnued exstence of any proposed speces or result n the destructon or adverse modfcaton of proposed crtcal habtat. 11. The State of Alaska Department of Envronmental Conservaton (ADEC) ssued a Secton 401 Water Qualty Certfcate of Reasonable Assurance (Certfcate), for ths General Permt on. All alternatve measures (condtons) lsted n the Certfcate must be compled wth, and are fully enforceable condtons of ths GP. A copy of the ADEC Certfcate s attached to ths permt. LIMITS OF THIS AUTHORIZATION 1. Ths permt does not obvate the need to obtan other Federal, State or local authorzatons requred by law. 2. Ths permt does not grant any property rghts or exclusve prvleges. 3

3. Ths permt does not authorze any njury to the property or rghts of others. 4. Ths permt does not authorze nterference wth any exstng or proposed Federal Project. LIMITS OF FEDERAL LIABILITY In ssung ths permt, the Federal Government does not assume any lablty for the followng: 1. Damages to the permtted project or uses thereof as a result of other permtted or unpermtted actvtes or from natural causes. 2. Damages to the permtted project or uses thereof as a result of current or future actvtes undertaken by or on behalf of the Unted States n the publc nterest. 3. Damages to persons, property, or to the permtted or unpermtted actvtes or structures caused by the actvty authorzed by ths permt. 4. Desgn or constructon defcences assocated wth the permtted work. 5. Damage clams assocated wth any future modfcaton, suspenson, or revocaton of ths permt. RE-EVALUATION OF PERMIT DECISION The Corps may re-evaluate ts decson to ssue a GP verfcaton to any person or agency at any tme the crcumstances warrant. Crcumstances that could requre a re-evaluaton nclude, but are not lmted to the followng: 1. The permttee fals to comply wth the terms and condtons of the permt; 2. The nformaton provded by the permttee n support of the applcaton proves to have been false, ncomplete or naccurate; 3. Sgnfcant new nformaton surfaces, whch ths offce dd not consder n reachng the orgnal publc nterest decson. Such a re-evaluaton may result n a determnaton to use the suspenson, modfcaton and revocaton procedures contaned n 33 CFR 325.7 or enforcement procedures such as those contaned n 33 CFR 326.4 and 326.5. The referenced enforcement procedures provde for the ssuance of an admnstratve order requrng you to comply wth the terms and condtons of your permt and for the ntaton of legal acton where approprate. You wll be requred to pay for any correctve measures ordered by ths offce, and f you fal to comply wth such drectve, ths offce may, n certan stuatons, accomplsh the correctve measures by contract, or otherwse bll you for the cost. PENALTIES FOR VIOLATIONS Falure to comply wth the terms and condtons of the GP may result n suspenson of the work, revocaton of the permt, removal of the dredged and/or fll materal or other structures, drected restoraton of waters and/or wetlands, and/or mposton of penaltes as provded by law. 4

The dscharge of dredged and/or fll materal not n accordance wth the terms and condtons of ths GP s a volaton of Secton 301 of the Clean Water Act (33 U.S.C. 1319), and upon convcton thereof s punshable. Secton 309 of the Clean Water Act (33 U.S.C. 1319), provdes penaltes of up to 25,000 per day for neglgent volatons and/or by mprsonment for up to 1 year, and penaltes of up to $50,000 per day for knowng volatons and/or mprsonment for up to three years for any person who knowngly volates Secton 301 of the Clean Water Act. TERM, EXTENSION, AND REVOCATION OF THE GENERAL PERMIT GP 98-01-M4 may be revoked by the ssuance of a Publc Notce at any tme the Dstrct Engneer (DE) determnes that the ndvdual or cumulatve effects of the actvtes authorzed theren are havng an unacceptable adverse effect upon the publc nterest. Followng such revocaton, all new applcatons wll be processed under ndvdual permt applcaton revew procedures, and the DE wll decde on a case-by-case bass f prevously authorzed actvtes should be revoked, suspended, or modfed. The tme lmt for authorzng work under ths GP ends fve years from the sgnature date. Any actvty verfed by ths GP before the expraton date must also be completed by that date unless actvtes are underway or wll be completed wthn twelve months of the expraton date, and the permttee notfes the Corps of hs/her ntent to contnue work on the project. A further tme extenson may be consdered on a case-by-case bass under provsons of 33 CFR 325.6. If you fnd that you need more tme to complete the authorzed actvty, submt your request for a tme extenson to ths offce for consderaton at least one month before the expraton date.
