Narratives Subject: OVI Type Date Time Author Approving Officer Initial Report 05/06/2015 0532 Pierson, Jon Edward While on scene at Columbus Ave. and Bogart Rd. for a traffic accident I spoke with the driver, Joshua Thompson, in regards to the events that had occurred. While speaking with Thompson I could detect the odor of alcoholic beverages emanating from his person. When I asked Thompson if he had anything to drink he advised he had two drinks earlier at Excuses Lounge. I could see Thompson was unsteady on his feet and his eyes were glossy. After gathering information from the parties involved at the crash location (report number 15-2300) I escorted Mr. Thompson back to the station for further testing. While on station Mr. Thompson was put through field sobriety testing to help determine if he was impaired. During the HGN test Thompson was explained the test and advised he understood the directions. While checking for equal tracking of the eyes Thompson had difficulties holding his head steady. He was also unsteady on his feet and swaying back and forth slightly. Thompson also showed signs of nystagmus in both eyes during all testing phases. During the walk and turn testing phase Thompson was advised of the test directions and advised he understood the test. During the demonstration of the test Thompson was unsteady on his feet and using the wall as a prop to hold himself steady with the heel of his left foot. Thompson was advised to step forward and not use the wall for support. While testing Thompson stumbled at step 5 and 6 and was unsteady on his feet throughout the test. Thompson was also raising his arms for balance after being told to keep them at his side during the testing explanation. On step 8 Thompson failed to touch heel to toe. During the one-legged stand Thompson was advised to use whichever leg he was comfortable with after advising he had slight leg pain in one of his legs. While testing Thompson lost balance on his count of 7 and placed his foot down twice. After picking his leg back up and continuing Thompson counted the number 13 twice during the test. Thompson was swaying while counting. Thompson was then advised he was under arrest for OVI and was read the BMV 2255 form which was witnessed by Lt. Hilton. Thompson was then advised of the Datamaster BAC testing procedure and asked if he would take the test. Thompson accepted the test and BAC testing was administered. Thompson was advised the legal limit was.08 and his results indicated he was at.151. Thompson was charged with OVI and also cited for the Failure to Control for the crash. After completing the involved paperwork Thompson was given a court date of 5/7/2015 and he signed his papers. Thompson was given his copies and released to Susan Crum on station.
