Corn Cob Pipe 2. Bag containing Marijuana Involved - 1. Julie A. RAMSEY 2. Roberta A. STRANG I responded to 3507 Cleveland Rd E for a complaint of an intoxicated male operating vehicles in the area. Upon arrival, myself and Dep. Heery met with the complainant, Julie Ramsey. Julie advised she witnessed her live in boyfriend, Robert Lippus Jr, operate her vehicle and his vehicle throughout Colonial Village. Julie further advised she came home around 4:00 p.m.. on this date and discovered Robert heavily intoxicated inside their residence. Julie informed me her and Robert began arguing because of his level of intoxication. Julie advised during the argument, Robert hit a glass cup out of her hand and stated "I am going to kill you". At this point, Julie stated she was in fear for her life and ran to her friend, Roberta Strang's residence and contacted this agency. Julie advised Dep. Heery and I that Robert was still inside of their residence. Dep. Heery and I spoke to Robert at the residence. While speaking to Robert I observed signs of impairment, he was unsteady on his feet, had slurred speech and glassy eyes. Robert stated he operated two vehicles prior to our arrival. Robert advised he backed up Julie's van out of his driveway and across the street into a grassy area. It should be noted, the van was still parked across from his residence upon speaking with Robert. Robert stated once he moved Julie's van, he pulled his vehicle into a parking spot, driving across the street again. Deputy Heery spoke to Robert further and discovered he had driven both vehicles across US 6; see Deputy Heery's supplement for additional details. Robert was offered and agreed to submit to Standard Field Sobriety Tests (SFTS). I explained

the three (3) tests to Robert and that he would be beginning with the Horizontal Gaze Nystagmus (HGN) test. In the testing position, I instructed Robert to look at the tip of a pen as a stimulus being held twelve (12) inches away. I began moving the pen left to right discovering equal tracking in both eyes. I then began checking for lack of smooth pursuit and at this point, Robert began swaying and turning his head instead of following the pen with his eyes. Next, I began the Distinct and Sustained Nystagmus at Maximum Deviation, in which Robert continued to move his head left to right instead of his eyes. In the nystagmus prior to forty five (45) degrees portion of the exam, I noticed Robert unable to stand still and continued to move his head left to right seeming disoriented while talking to himself. Next, the Walk and Turn test was explained. Robert was wearing only socks. The testing surface was the paved portion of a driveway. I instructed Robert to take nine (9) steps along a straight line, touching heel to toe on each step and counting his steps out loud. I further instructed Robert to stop and turn with the opposite foot that he started walking with and take nine (9) heel-to-toe steps back while counting his steps out loud. Robert began the exam without being told to and was unable to keep his balance walking on the straight line. Robert failed to touch heel-to-toe on several steps as instructed. I then advised Robert to perform the One Legged Stand test. I instructed him to put his feet together, with his arms down at his sides and using the foot of his choice, hold the foot six (6) to eight (8) inches parallel to the ground and count in one thousands out loud until I told him to stop. Robert once again began the test without being instructed to do so. Robert was having difficulty keeping his balance, seemed very disoriented while counting, and could not successfully complete the test due to repeating numbers and frequently stopping to put his foot down. Robert also only held his foot 1 to 2 inches off the ground during the test. After the SFST's, Robert agreed to submit a Portable Breathalyzer Test (PBT) which showed Robert's BAC to be 0.151%. Robert was placed under arrest for OVI. I handcuffed Robert, checking for spacing and double locking the handcuffs. Robert was searched incident to arrest and placed in the rear of my marked cruiser. Robert was transported to the Huron Police Department for the opportunity to take the Datamaster test. Robert was provided a copy of the BMV 2255, while I read the Consequences of Test and Refusal Section in the presence of Sgt. Graham. Robert signed the form acknowledging he understood. After the twenty minute observation period, Sgt. Graham offered Robert the BAC Datamaster test. Robert advised he would take the test, and at 20:50 hours he submitted to the test. The BAC Datamaster showed Robert's BAC to be.204 grams of alcohol per 210 Liters of breath. Robert was advised he was now under an administrative license suspension and read the notice of suspension. His license was confiscated and sent to the BMV. Robert was issued citation (#297084) for the above listed offenses, and advised of his mandatory court appearance. While having Robert in my custody, Julie took Dep. Heery inside the residence and provided him with a bag containing a small amount of loose leaf marijuana and a corn cob pipe containing marijuana residue, and stated it was Roberts. When I asked Robert about the marijuana and paraphernalia being his, Robert denied ownership. Julie advised Deputy Heery

that Robert was smoking the marijuana earlier in the day. Robert was provided a summons for the drug paraphernalia and possession of marijuana. The evidence was later placed into evidence locker #10 on station for processing. I transported Robert to the Erie County Jail where he was turned over to Corrections Officers without incident. I constructed the above listed charges and served them to Robert in the jail. It should be noted Robert has three prior OVI convictions.
