She also presented a map showing the location of the property photographs of the property. STAFF FINDINGS Commission staff finds that the proposed work is not incongruous with the character of the Local Historic Lmark the because: 1) The proposed project requests the installation of two, black, wrought iron hrails. The hrails will be located at the front, east entrance at the rear, west porch. The hrails are designed to have a simple flare end with no volute as other railings found in the District. The new railings are designed to be compatible in location, pattern, spacing, configuration, dimension, scale, materials, color with the character of the Lmark building, site the District. (Architectural Metals, Lmark Guideline 6 Railings, Old Salem Guideline 4)

STAFF RECOMMENDATION Based on the preceding findings, staff recommends that the Commission approve COA2018-074 at the Fifth House, Local Historic Lmark #45, located at 434 South Main Street, within the (PIN#: 6835-23-7868.00), with the following conditions: 1) The applicant shall receive, prior to commencement of the work, all other required permits or 2) Commission staff shall review approve any revisions or deviations to any portion of the assubmitted 3) The applicant shall submit the Certificate of Appropriateness Request for Certification of Completed Public Comment Speaking in Favor of the Application: Robbie King, 600 S. Main St, Applicant, Old Salem Museum & Gardens on behalf of owner was sworn for testimony spoke in support of the application. Speaking in Opposition to the Application: None Commission Discussion The Commission discussed the application. Finding of Fact Mr. Allen moved that, based upon the evidence presented in the application during the hearing, finds that the proposed project is not incongruous with the character of the Local Historic Lmark the Old Salem Historic District because: 1) The proposed project requests the installation of two, black, wrought iron hrails. The gate will be constructed of five foot posts mortise tenon joints with wood pegs the hardware of the fence with be 5 x 5 iron butt hinges an 8 3/4 pivoting iron latch. The fence is proposed in a location, configuration, height, material that is compatible with the Lmark building, site the District. The proposed fence will not obscure, damage, or destroy any original or significant building or structural features. She also presented a map showing the location of the property photographs of the property. STAFF FINDINGS Commission staff finds that the proposed work is not incongruous with the character of the Local Historic Lmark because: 1) The proposed project requests the installation of a parking area at the corner of South Cherry Street High Street, where historically there was a portion of the original driveway. The new parking area will be for three spaces, measuring 33 feet by 20 feet. The proposed project includes the planting of shrubbery around the perimeter edges facing South Cherry Street High Street. The material will be asphalt that will match the current driveway material. The proposed parking area will be introduced in a location, configuration, material scale that are compatible with the lmark building site it will not substantially alter the site s topography or necessitate the loss of significant site features. The proposed parking area will not compromise the character-defining elevation of the lmark or significant site features. (Walkways, Driveways, On-Site Parking, Lmark Guidelines 7 8) STAFF RECOMMENDATION Based on the preceding findings, staff recommends that the Commission approve COA2018-076 at the William Allen Blair House, Local Historic Lmark #85, located at 210 South Cherry Street, (PIN#: 6835-14-7811.00), with the following conditions:

1) The applicant shall receive, prior to commencement of the work, all other required permits or 2) Commission staff shall review approve any revisions or deviations to any portion of the assubmitted 3) The applicant shall submit the Certificate of Appropriateness Request for Certification of Completed Public Comment Speaking in Favor of the Application: A. J. Ceberio, 1717 Angelo St, Applicant, was sworn for testimony spoke in support of the application. Speaking in Opposition to the Application: None Commission Discussion The Commission discussed the application. Mr. Allen moved that case COA2018-076 be continued to the November 7, 2018 meeting with a deadline due October 17, 2018 for the submission of materials. Second: Ms. Townes Stewart William R. Soukup, Applicant 1146 West End Boulevard Martin-Cohen House West End Historic Overlay District Request: After-the-Fact Sugar Maple Tree Removal Case #: COA2018-077 Staff Comments: Ms. McCullough presented the staff report. She also presented a map showing the location of the property photographs of the property. STAFF FINDINGS Commission staff finds that the proposed work is not incongruous with the character of the District because: 1) The proposed project requests approval of the removal of a Sugar Maple tree. Lusk Tree Services examined assessed the health of the tree indicated significant limb failure the likelihood of continued deterioration. The location of the tree at the top of the rise increased the risk that he tree could tip toward the house. The tree was considered dangerous. It was not a healthy tree in the opinion of the tree service. (Vegetation, West End Guideline 5) STAFF RECOMMENDATION Based on the preceding findings, staff recommends that the Commission approve COA2018-077 at the Martin- Cohen House, located at 1146 West End Boulevard in the West End Historic Overlay District (PIN#: 6825-74- 9307.00), with the following conditions: 1) The applicant shall grind the stump in its entirety by October 2, 2018; 2) The applicant shall receive, prior to commencement of the work, all other required permits or

3) Commission staff shall review approve any revisions or deviations to any portion of the assubmitted work, that qualifies as a minor work, prior to commencement of that portion of the project. Public Comment Speaking in Favor of the Application: William Soukup, 1146 West End Blvd, Applicant, was sworn for testimony spoke in support of the application. Speaking in Opposition to the Application: John Merschel, 3400 Paddington Lane, Winston-Salem, West End Association- Full Board, was sworn for testimony spoke in support of the application. Will Knott, 424 Springdale Ave, Interest in Urban Trees, was sworn for testimony spoke in opposition of the application. Commission Discussion The Commission discussed the application. Finding of Fact Mr. Allen moved that based upon the evidence presented in the application during the hearing, finds that the proposed project is not incongruous with the character of the West End Historic Overlay District because: 1) The proposed project requests approval of the removal of a Sugar Maple tree. Lusk Tree Services examined assessed the health of the tree indicated significant limb failure the likelihood of continued deterioration. Second: Ms. Abernethy Keith Wheeler, Applicant 710 South Main Street Local Historic Lmark #8 Christoph Vogler House Request: After-the-Fact Site Alterations Case #: COA2018-078 Staff Comments: Ms. McCullough presented the staff report. She also presented a map showing the location of the property photographs of the property.

STAFF FINDINGS Commission staff finds that the proposed work is not incongruous with the character of the Local Historic Lmark the because: 1) The proposed project requests the approval for the after-the-fact installation of a pea gravel, garden path, surrounded by larger stones in the rear yard. The new site feature is in a location configuration that is compatible with the visual, spatial, associative characteristics of the lmark District setting. The new path does not substantially alter or diminish the visual, spatial, or associative characteristics of the Lmark, Site, District. (Setting, Lmark Guidelines 3 4 Walkways Steps, Old Salem Guideline 1 Significant Lscape Features, Old Salem Guidelines 1 2) STAFF RECOMMENDATION Based on the preceding findings, staff recommends that the Commission approve COA2018-078 at the Christoph Vogler House, Local Historic Lmark #8, located at 710 South Main Street, within the Old Salem Historic District (PIN#: 6835-22-9690.00), with the following conditions: 1) The applicant shall mix with the white pea gravel, pea gravel of a darker tan color. The mix should be an approximate 50/50 mix.
