California State Personnel Board Meeting Notice and Agenda July 6, 2017 Non-Hearing Items Attachment 2 The following proposals are made to the Board by either CalHR or SPB. It is anticipated that the Board will act on these proposals without a hearing. Anyone with concerns or opposition to these proposals should submit, in writing, a notice to the Executive Officer clearly stating the nature of the concern or opposition. Such notice should explain how the issue in dispute is a merit employment matter within the Board's scope of authority as set forth in the State Civil Service Act (Government Code Section 18500 et seq.) and Article VII of the California Constitution. Matters within the Board's scope of authority include, but are not limited to, personnel selection, employee status, discrimination and affirmative action. Matters outside the Board's scope of authority include, but are not limited to, compensation, employee benefits, position allocation, and organization structure. Such notice must be received not later than close of business on the Monday before the Board meeting at which the proposal is scheduled. Such notice from an exclusive bargaining representative will not be entertained after this deadline, provided the representative has received advance notice of the classification proposal pursuant to the applicable memorandum of understanding. In investigating matters outlined above, the Executive Officer shall act as the Board's authorized representative and recommend that the Board either act on the proposals as submitted without a hearing or schedule the items for a hearing, including a staff recommendation on resolution of the merit issues in dispute. A. Requests to Establish, Revise or Abolish Classifications, Alternate Range Criteria, etc. 1. ABOLISH 92 CASUAL EMPLOYMENT PARENTHETICAL CLASSIFICATIONS AND CLASSIFICATION SPECIFICATION REVISION CalHR proposes to abolish 26 Skilled Trades Apprentice (Casual Employment), 37 Skilled Trades Journeyperson (Casual Employment), 27 Skilled Trades Supervisor (Casual Employment), one Wood Caulker Historic Ships (Casual Employment) and one Labor Supervisor-Casual Employment classifications. In addition, CalHR requests a specification revision to create a Casual Employment series with three generalist Skilled Trades classifications. B. Requests to Abolish Eligibility Lists that have Existed for less than 12 Months CalHR proposes to abolish the following eligibility lists, which have been in existence less than 12 months. ABOLISH 57 VACANT CLASSIFICATIONS CalHR noticed all interested stakeholders that these classifications would be abolished absent object. In addition, we request a specification revision to createe a Casual Employment series with three generalist Skilled Trades classifications. The proposal is supported by the California Department of Human Resources (CalHR) Strategic Plan initiative to update and strengthen the state s classification plan to align with the state s needs. Further, this proposal is consistent with the Classification Consolidation Recommendations Report (CCRR) presented to the Board on January 8, 2015. FIVE-MEMBER STATE PERSONNEL BOARD July 6, 2017 NOTIFICATION: The Association of California State Supervisors (ACSS) was notified and indicated no opposition. CLASSIFICATION CONSIDERATIONS: Statewide Casual Employment classes were established to provide skilled tradespersons to appointing authorities on short notice for construction and maintenance projects of short duration. In order to facilitate recruitment on short notice, a compensation plan based on local prevailing wages (trade rates) was established so that hiring from local union halls would be possible. The classes are designated as temporary appointments of less than six months. There are currently 95 Skilled Trades (Casual Employment) classes in state service, covering the apprentice, journey and supervisory levels in a variety of building, construction and general labor classes. The current classification structure for Skilled Trades (Casual Employment) has a significant number of parenthetical classifications with duties and characteristics that overlap with other similar classifications. This duplicative structure was established over a period of many years under general guidelines that focused on classification specificity, uniqueness and titles that reflected each specialized craft or trade. CalHR has conducted an occupational analysis of the Skilled Trades (Casual Employment) classifications by reviewing existing minimum qualifications, typical duties and responsibilities, and the required knowledge, skills and abilities for state classifications within the occupational category. In light of the goal to streamline and update the state s job classifications, we have determined many of these existing classifications can be consolidated into a broader classification structure while still adhering to Government Code section 19818.6, which states that positions may be considered part of the same classification only when: 1) The positions are sufficiently similar in respect to duties and responsibilities that the same descriptive title may be used; 2) Substantially the same requirements as to education, experience, knowledge, and ability are demanded of incumbents; and 3) Substantially the same tests of fitness may be used in choosing qualified appointees. This classification item consolidates the parenthetical classifications used by several state departments and eliminates the need for a specialized parenthetical for each trade. As noted, there are currently 95 separate casual employment classes with similar minimum qualifications for entry into these classes. Under the proposed classification structure, appointing authorities will continue to have qualified individuals that can be recruited and appointed to one of three generalist classifications. In addition to the 95 classes included in this classification item, there are two other casual employment classes that CalHR recommends retaining. The Laborer-Building Trades (Casual Employment) (6226), and the State Fair Worker (Casual Employment) (5999) cannot be consolidated with the Skilled Trades classes due to the nature of the work performed. Skilled Trades refers to apprenticeable crafts or trades; whereas, class code 6226 performs manual 2 SPB 2 of 11

FIVE-MEMBER STATE PERSONNEL BOARD July 6, 2017 labor as a helper in connection with a variety of building construction operations, and class code 5999 performs various duties in support of the annual California State Fair. This differs from the Skilled Trades classes as these positions are not learning a skilled trade, nor are they apprenticing in a trade or craft. There are currently 14 incumbents in class code 6226, and 252 incumbents in class code 5999. STATUS: The trades classifications are designated as a non-testing class so that temporary authorization utilization (TAU) hiring is possible. Because of the TAU appointment status, incumbents in the proposed abolishment classes are non-status employees. Pursuant to Government Code section 19059, a temporary employee shall not acquire any permanent status or rights. No permissive or mandatory reinstatement rights apply to these employees. If the proposed Skilled Trades (Casual Employment) package is adopted, CalHR proposes to instruct departments to reallocate incumbents to one of the three existing classes in order to continue their current employment with the state. RECOMMENDATIONS: 1.
