THE HISTORY CHANNEL DESPERATE CROSSING ESSAY CONTEST 2006 OFFICIAL RULES NO PURCHASE NECESSARY. VOID WHERE PROHIBITED. 1. CONTEST DESCRIPTION: THE HISTORY CHANNEL DESPERATE CROSSING ESSAY CONTEST ( Contest ) is a skill contest in which teachers ( Participants ) of participating sixth, seventh and eighth grade students ( Contestants ), with the approval of their students parents/legal guardians, submit the students one (1) page essay of 500 words or less answering a question about American history. Between 12:00:01 AM (ET) on November 20, 2006 and 11:59:59 PM (ET) on December 20, 2006 ( Contest Period ), participating teachers must visit http://www.history.com/mayflower to view the Contest question. Entry submissions will be accepted beginning November 20, 2006. All entries must be postmarked no later than December 20, 2006, and received no later than December 27, 2006. Student entry may only be submitted by a teacher who is teaching the student during the Contest Period. 2. ELIGIBILITY: This Contest is open only to sixth, seventh and eighth grade students attending school during the 2006-2007 school year, who are legal residents of the fifty (50) United States or District of Columbia. Employees of A&E Television Networks ( Sponsor ), NMA Entertainment & Marketing, Inc. ( Administrator ), and each of their parents, affiliates, subsidiaries, advertising and promotional agencies, prize providers, participating retail locations and each of their respective officers, directors, employees and members of the immediate family and persons living in the same household of each are ineligible. Contest ends at 11:59:59 PM (ET) on December 20, 2006. 3. TO ENTER: There is one (1) way to enter THE HISTORY CHANNEL DESPERATE CROSSING ESSAY CONTEST. (1) MAIL-IN: During the Contest Period, teachers ( Participants ), should visit http://www.history.com/mayflower to view the Contest question: After watching Desperate Crossing: The Untold Story of the Mayflower along with your parents, how would you compare and contrast both yours and your parents knowledge of events with the depiction in Desperate Crossing? In order to participate in the Contest, Contestants must write an essay, five-hundred (500) words or less, typewritten in 12-point font, double spaced on 8.5 x 11 paper, answering the Contest question. Contestants must submit
their essays, along with a completed parent/legal guardian consent form found at http://www.history.com/mayflower, to their teachers. Participants must submit each Contestant s essay, along with the Contestant s parent/legal guardian signed consent form, also available,via mail to: THE HISTORY CHANNEL DESPERATE CROSSING ESSAY CONTEST, c/o NMA Entertainment & Marketing, 460 Park Ave. South, 6 th. Floor, New York, New York 10016. Entries must be postmarked no later than December 20, 2006 and received no later than December 27, 2006. Entry, for these purposes, is defined as Contestant s essay, along with a completed consent form signed by Contestant s parent/legal guardian. Handwritten entries will not be accepted. Essays must be written in English, must be original, truthful, unpublished, created solely by the submitting entrant, must not have been submitted in any other competition, and must not infringe upon any rights of any third party, including but not limited to copyright, trademark, and rights of privacy and publicity. Contestant s parent or legal guardian contact information will be required for entry into the Contest as will Contestant s name, school name and address, grade level and teacher s name. Contestant s information will be used solely for identification purposes. Limit one (1) essay per Contestant for the duration of the contest. Entry must be in keeping with the Sponsor s image and will not be defamatory, libelous, pornographic or obscene in Sponsor s sole discretion. No additional materials (photos, artwork, samples, etc.) will be accepted with the submission. If additional materials are sent, they will be discarded prior to judging. Each Contestant grants to Sponsor, its successors, licensees and assigns the irrevocable, non-exclusive right to use the entry submission in connection with the Contest and any advertising, publicity, and promotion, in any manner at any time or place, in any present or future media, throughout the world in perpetuity. Sponsor shall have the right, in its sole discretion, to edit, composite, morph, scan, duplicate or alter the entry submission for any purpose which Sponsor deems necessary or desirable. Sponsor is not responsible for malfunctions or delays of the U.S. Postal Service, electronic equipment, computer hardware, software, malfunctions of the Participant s email provider, lost, late, incomplete, misdirected entries or entries not received within the required timeframe. Entries not containing the required information, entries in excess of the stated limit by the same person, and entries not submitted in the required format will be
disqualified. Proof of delivery or receipt of entry will not be deemed by Sponsor (defined below) as proof of entry. Any attempted form of entry other than described herein is void. Sponsor reserves the right to modify, suspend or terminate the Contest for any reason that compromises the legitimacy of the Contest or otherwise affects Sponsor s ability to fairly administer the Contest, including in the event that it becomes infected by a computer virus or is otherwise technically impaired and award prizes from among all eligible entries received prior to cancellation or termination. Entries become the property of Sponsor and will not be returned. Limit one (1) entry per Contestant. Subsequent entries submitted by a single Contestant will be void. 4. JUDGING/WINNER SELECTION: One (1) Grand Prize Winner will be determined from among all eligible entries received. All entries will be judged and winner determined based on the following criteria: Historical accuracy and grasp of historical context (25%), Familiarity with and reference to the Desperate Crossing program (25%), Clarity and organization (25%) and Creativity (25%) Judging will be performed by NMA Entertainment & Marketing, Inc., an independent judging organization and The History Channel, whose decisions are final in all matters relating to this Contest. The entry with the highest score will be declared the Grand Prize Winner, subject to verification. In the event of a tie, the entries involved in the tie are subject to review by an additional judge who will serve as a tiebreaker and who will evaluate entries according to criteria listed above. Winning Contestant will be notified via phone or express or regular mail on or about February 8, 2007. As a condition of winning the Grand Prize, the Parent or Legal Guardian of Contestant will be required to sign and return, within fourteen (14) days of notification, an Affidavit of Eligibility and Release from Liability for a Minor ( Release ) and a statement affirming the winner s grant of all rights in the submission and the right to (where legal) use winner s name, likenesses and entry in all media for promotional purposes to Sponsor and certifying that the submission is the original submission of the entrant, the entrant has full rights to the submission, that it has not been previously published, released or distributed, does not infringe any third party rights and is suitable for publication. Failure to return any documents within the time specified or failure to respond to notification attempts or return of any prize notification as undeliverable will result in disqualification and
selection of an alternate winner. Prize awarded to minor will be awarded in the name of parent or legal guardian, who must execute the Release on behalf of the winner. 5. PRIZES: One (1) Grand Prize winner will receive a Five Thousand Dollar ($5,000) College Scholarship (Estimated Retail Value ( ARV ): $5,000.00). Scholarship will be awarded in the form of a check. All sponsor decisions relating to the cash prize will be final. The Grand Prize will be awarded, provided there are a sufficient number of eligible entries received. No transfer or substitution for the prize will be permitted, except at Sponsor's sole discretion due to prize unavailability for any reason, and only then for a prize of greater or equal value determined by Sponsor shall be allowed. Each participating teacher ( Participant ) will receive a History Channel DVD while supplies last ( ERV: $24.95 each). There is a limit of One-Hundred (100) number of DVD s to be distributed during the Contest Period. 6. GENERAL: Contest is governed by the laws of the State of New York, with venue and jurisdiction in New York, NY and all claims must be resolved in the courts of New York, NY. By entering, Participant/Contestant agrees: (1) to release Sponsor and Administrator from all liability, loss or damage arising out of their participation in the Contest and with respect to their acceptance and use/misuse of the prizes; (2) to be bound by these official rules; (3) that the decisions of the judges are final and binding on all matters relating to the Contest; and (4) where legal, to the use of their names, likenesses and entry submissions for advertising and promotional purposes in all media worldwide (including online) without additional compensation, except in Tennessee and where otherwise prohibited by law. Winner is responsible for all federal, state and local taxes. Parent/Legal Guardian, on behalf of Winner, will be issued an IRS 1099 Income Tax Form in the amount of the Scholarship. An entry, except where prohibited by law, constitutes a grant of permission to the Sponsor or its agents to include winners names on the http://www.history.com site and in connection with a Winners List without further notice or without additional compensation. 6.
