Recor, ICMA-CM, City Manager RE: Department Activity Report DATE: October 13, 2011 The information that follows is intended to keep the Commission abreast of the on-going activities, issues, programs and services within the City. City Manager s Office City Manager The City Manager met with Commissioner Perona to discuss ongoing issues and activities. City Manager met with specific department heads to discuss issues, activities and follow-up status reports. City Manager met with Roy Whitehead and Dale Cawthorn of the Youth Sailing Foundation to discuss potential relocation of the Foundation s facilities. The City Manager met with Mayor Benton and the Code Compliance Manager to discuss animal control issues. The City Manager, City Attorney and the City Engineer met with Brian Good of Kimley Horn and Attorney Brian Seymour of Gunster to discuss stormwater utility matters. The City Manager, Commissioner Perona, the Communications and Marketing Manger, the City Attorney and the Director of Finance met with Bill Thiess, Nina Hurtubise and Koby Koblegard of the FPUA to discuss the Utility Power Cost Adjustment Transfer. The City Manager met with Pam Cully to discuss code enforcement issues in the Hibiscus Park neighborhood. The City Manager facilitated discussion of the City Commission s Conference Agenda on Monday, October 10, 2011. City Manager, City Attorney and the Public Works Director met with representatives from Waste Management to further negotiate contractual terms. The City Manager met with the City Engineer to further discuss the City s stormwater management utility. Communications & Marketing Manager Attended October 3, City Commission meeting. Attended FPUA staff meeting to discuss six percent transfer rate with City Manager, City Attorney, Finance Director and Commissioner Perona.

Public Works Director and I met with Commissioner Alexander regarding Marina Square events during Marina Construction. Brittany Athey, Administrative Assistant, created a new River Walk Center brochure, monthly employee City News and new promotional slides for FPTV 27. City Clerk s Office Gave assistance and answered questions to the walk-in public on various aspects of Business Tax Receipts which include but is not limited to: New Applications: 51 Renewals: 560 Transfers: 5 Gave assistance and answered questions to the walk-in contractors on various aspects of Contractor s Licensing which include but is not limited to: New Applications: 13 Renewals: 202 Gave assistance and answered questions from the public who have contacted office by phone: 507 Assisted public with questions received via e-mail through the City s web-page. Assisted the public by doing research and providing copies of various public records. Assisted Code Enforcement by processing payment received for Tri-County Animal Hospital for animal registrations for August 2011. Assisted Code Enforcement by processing payments received from the Happy Hounds Program. Prepared and submitted report of animal registrations to Code Enforcement for September 2011. On-going updating of contractors records for current Liability Insurance, Workman Compensation Insurance, and State License information. Assisted public and various city departments by providing DVD copies of City Commission Meetings. Checked all paperwork submitted by contractors to go before Board of Examiners of Contractors on October 11, 2011 for completeness and accuracy. Prepared packets for Board of Examiners of Contractors agenda for October 11, 2011. Prepared legal advertisements, letters, resolutions, & ordinances for various departments for upcoming City Commission agenda items. Prepared several Proclamations.

Attended, recorded and transcribed minutes of the September 26, 2011 Special City Commission Meeting pertaining to City Budget. Attended, recorded and transcribed minutes of the October 3, 2011 City Commission Meeting. Revenue Recovery working with Code Enforcement on new businesses that have not applied for a Business Tax Receipt. Daily balancing process of cash receipts and submittal to Finance Department for bank deposit. On-going implementation of scanning City Commission Agenda Packets onto DVD s. On-going implementation of computerization of annexation records. On-going implementation of scanning City Commission Meeting minutes, ordinances, resolutions, and the Fort Pierce Redevelopment Meeting minutes into the Optiview system. Assisted MIS Department in correcting and adding unit numbers to existing address data base. Assisted Finance Department with invoices received from Scripps Newspaper for advertisements and invoices received from St. Lucie County Clerk of Court for recordings, to determine which departments are to be billed. Prepared and delivered various paperwork to SLC Courthouse Recording Division to be recorded. Assisted Code Enforcement by providing certified copies of code liens to be filed by Code Enforcement with the St. Lucie County Clerk of Court. Assisted Finance Department by signing and affixing the City Seal to necessary paperwork associated with release of liens. Assisted Planning Department by researching business tax applications and providing copies of various ordinances. Assisted Public Works Department by researching and faxing copy of Intermodal Agreement with St Lucie County. Assisted Deputy Director of Public Works by preparing title for vehicle being used for trade-in. Assisted FPRA by researching and providing copies of several ordinances. Assisted FPRA personnel by compiling list of new Business Tax Receipts from October 1, 2010 to September 31, 2011. Assisted City Attorney s Office by researching and providing copies pertaining to various city issues. Deputy City Clerk attended telephone conference meeting with Anna Ward, Applications Specialist, MIS Department and Novusolutions Support to address issues pertaining to Paperless Agenda. Deputy City Clerk administered oath to new member of the Fort Pierce Utilities Authority Board at their October 4, 2011 meeting.

October 17, 2011 City Commission Meeting Page 4 Administrative Services Department Meetings 1. Attended PBA Union Meeting. Procurement 1. Prepared FPUA agenda items for October 4 th Board Meeting. 2. Opened one solicitation FPAT Web Design Proposal. 3. Discuss the Hillsborough County Linking Agreement for Purchasing Card Program. 4. Discussed implementation of using e-payables through the Bank of America Purchasing Card Program. 5. Modified the PBA Contract and forwarded to City Attorney for approval. 6. Processed and/or completed awards to vendors/contractors approved by Commission/FPUA Board and processed FY 2012 annual contracts/fpua & City. Risk Management 1. Collaborated with Walgreens to administer flu shots on-site. 2. Completed Webinar - How the Economy is Affecting Employment Law & the Risks Associated. 3. Collaborated with Florida League of Cities to close WC claims. 4. Filed subrogation against several insurance companies 5. Processed new WC claims. 6. Processed day to day Risk management duties. Human Resources 1. Coordinated pre-employment physicals and background checks. 2. Created several Personnel Action forms for employees. 3. Distributed monthly reports to each department such as accrual register, time sheets and payroll register to Police Department. 4. Processed purchase orders and requisitions. 5. Verified payroll. 6. October 2011 employee monthly evaluations. 7. Completed Verification of Employment/Loss of Income forms. Finance Department Met with Chief of Police. Attended Final Public Hearing. Met with City Manager. Attended Florida Public Pension Trustee Conference. Prepared documents for TRIM submission. Prepared Financials for Month End Closing. Began Preparation for Year End Closing.

October 17, 2011 City Commission Meeting Page 5 MIS Department Working with Engineering on new plotter issues. Completed end of fiscal year procedures for 75% of SunGard HTE applications including posting interest on pension for current employees, entered Fiscal year 2012 budget in system. Urgent need to secure funding for additional routers citywide or connectivity problems will escalate. Working parallel with regular manual agenda and the NovusAgenda (paperless agenda package). Working on Blade Center servers and remote site servers. Met with SunGard HTE technical staff to secure contractual services to complete setup of the Blade Center. Severe virus attack Citywide. We are tightening computer controls while updating employees PCs with current applications including anti-virus software to help mitigate attacks (ongoing). Working with Public Works/Fleet Maintenance and Finance on a resolution to our fuel system. Software integrations citywide (on-going). Working with Diebold on security issues. Database to security system was replaced but still having issues with updated application including locking of outside doors when City Hall is closed. Working with State of Florida DMS, GSI Hosting and SunGard HTE on Click2Gov Building Permits. Working with AT&T and State of Florida on the fiber optic installation preparation for Public Works/Solid Waste (ongoing). Lotus Notes IQsuite e-mail spam, and archiving (ongoing). Processing the firewall upgrades for all sites to enhance network security (ongoing). Updating MIS documentation and procedural policies (on-going). Received fifty seven (57) new work orders and completed sixty two (62) work orders. Police Department PBA Contract Staff has concluded negotiations with the PBA and forwarded the final contract proposal to the City Attorney's office for review. Pet Sterilization Grant (License Plate) - Unexpected increases in sterilization costs from the Humane Society caused some initial concern with our ability to carry out the grant requirements. Staff has met with local volunteers and secured an alternate source for sterilization, which will allow us to proceed with no impact to the grant or funding. Dancing with Our PALS - The Second Annual Dancing with our PALS event was held at the Fenn Center on October 8, 2011. This event was sponsored and organized by the League of Women Voters and raised over $40,000 for PAL.

October 17, 2011 City Commission Meeting Page 6 Building Department Developments 1. Pappy s Liquors 6945 Okeechobee Rd: The Certificate of Occupancy was issued for this project last week. The permit was issued in 2003 and it is encouraging to see this project come to a successful completion. 2. Heathcoat Botanical Gardens 210 Savannah Rd: The Certificate of Completion was issued for this project last week. 3. Waste Pro. Prosperity Dr.: The site work drawings were submitted for review. At present the project does not have an address assigned by the Property Appraisers Office and the Planning Department. The contractor was informed that this issue must be resolved before the plans can be routed for review. 4. Mt. Bethel S 37 th Street: The site work drawings were submitted for review. At present the project does not have an address assigned by the Property Appraisers Office and the Planning Department. Dr. Vakani Orthodontist Office 1900 S US 1: Doctor Vakani, an Orthodontist based in Stuart, has submitted plans for the construction of a new office at the above address. This site was previously occupied by the Miami Subs restaurant; which will be demolished in order to construct the new office. Public Works Department PAL Park Public Works personnel provided construction progression photographs to the City Commission showing the improvements currently being implemented. The grand opening celebration has been tentatively scheduled for the week of Thanksgiving 2011, and the first Police Athletic League event at this park and facility will be the SLC Toy Run to be held December 11, 2011. Energy Efficiency & Conservation 1. Public Works Department staff has only one energy conservation measure remaining for City Hallas part of the U.S. Energy Department Energy Efficiency & Conservation Block Grant (EECBG) Program. The lighting retrofit project is currently being performed within City hall by Facilities Maintenance personnel on an interim basis as time permits. A formal bid will be advertised for a lighting system upgrade at the Sunrise Theatre that is scheduled to reduce their energy consumption. 2. The Energy Efficiency & Conservation Team has received proposals, requested reference documentation, and listened to presentations in order to evaluate the eight firms vying to provide energy savings performance contracting services. Authorization to enter into negotiations with the highest ranked firm is tentatively scheduled for the October 17, 2011 City Commission Meeting. Solid Waste Disposal Options The City Manager, City Attorney, and Director of Public Works are scheduled to meet with Waste Management on October 10, 2011 to attempt to resolve contractual negotiations in order to reduce disposal expenditures and potentially increase future recycling revenues.

October 17, 2011 City Commission Meeting Page 7 Engineering Department Jetty Park Reconstruction Staff is currently preparing the FDOT LAP Certification items relating to the award of this $1.6 million dollar Scenic Highway grant. The proposed A1A roundabout at Seaway and South Ocean has been relocated to a locale which would eliminate any impacts to the Jetty Park property. Final plans will be submitted to FDOT the end of November. City Marina Reconstruction Phase I The selection committee has short listed the proposals and will be conducting technical interviews October 11, 2011. Street Resurfacing City has been divided into maintenance sections. Currently preparing maps and assessment roles to address all city streets in poor condition. 13th Street (Orange Ave to south of Ave D) Continued work with Contractor and FDOT on Project close-out. A1A Phase I Roadway construction is on-going along South Ocean from Seaway to Gulfstream. Northbound traffic has been detoured onto the west side of South Ocean between Avalon and Seaway and the contractor has begun the reconstruction on the east half of the roadway. The stabilized subgrade is currently underway and the Type F curb and gutter should be installed the week of October 17 th. Storm drainage construction and sanitary sewer lateral installations are underway along the west side of the South Ocean Drive roadway between Avalon and Gulfstream. The underground electric conversion is on-going along Seaway and water service conversions are scheduled to recommence next week. Oleander Ave./Sunrise Blvd. Sidewalk and Bike Paths Bi-monthly progress meetings on-going between the consultant, FDOT, County, and City. A project field meeting was conducted on October 3, 2011 with representatives from FDOT, SLC, FPUA, City, AT&T, and the design-build firm present for the all day walk-thru. Requests for alternative designs were brought up in order to lessen impacts to residents and existing trees within the right-of-way. 90% design plans are scheduled for submittal on October 25, 2011 and construction commencement is slated to begin January 2012. 29th Street (Orange Ave to Ave Q) FDOT awarded this design/build project under the same contract as the Oleander/Sunrise project. 90% design plans have been reviewed and comments submitted to FDOT. Construction commencement is scheduled for November 2011. Development Reviews Intake of four Building Permits, Site Plans, and Certificate of Occupancy reviews. 10th Street Reconstruction SLC has received final approval by the Department of Community Affairs and the project is now slated to be advertised for bid by the County. A tentative mandatory pre-bid meeting is scheduled for October 21, 2011. As mentioned in previous updates the proposed work includes the reconstruction of 10 th Street from Citrus Avenue to Moore s Creek. The 10 th Street improvements include the undergrounding of electric, infrastructure replacement, sidewalks, curb & gutter, street lighting, and landscaping in accordance with the $1.9 million CDBG Grant. Final construction completion May 2012. Pinecrest Subdivision Drainage Improvements SLC is in the process of awarding the construction contract. The low bidder was Guettler and Sons Construction. The project is a CDBG Disaster Fund project being done through a joint partnership with St. Lucie County. Project entails canal widening, bank stabilization and drainage infrastructure improvements. Frances Avenue Storm Drainage Replacement Plans have been forwarded to Public Works and FPUA for review. The bid document preparation is underway. Atlantic Avenue Storm Drainage Replacement Preparation of design plans for the retrofit of the existing decrepit storm drainage system along Atlantic Avenue from 5 th Street to 7 th Street. Avenue F and 6th Street Drainage Improvements Plans have been forwarded to Public Works and FPUA for review. Bid plans and cost estimate are 100% complete.

October 17, 2011 City Commission Meeting Page 8 Engineering Department contd. Avenue E at Snake Ditch Plans have been forwarded to Public Works and FPUA for review. Stormwater Division - Proposal received from consultant for review of stormwater utilities fee collection methodology. Meeting held with City Manager, consultant engineer, and stormwater legal consultant on October 6 th. We have received a public records request from attorney Harold Melville requesting numerous SMU documents and specifically a list of all parcels charged a SMU fee, not draining to a City maintained system. Traffic Control We are working with FDOT to develop a new JPA for the enhancement of our traffic control system. S. 21st Street / Havana Ave. Sidewalk Project Funding has been approved by FDOT for FY 2015. Garden Avenue Sidewalk and Pedestrian Bridge - This project is being funded by a transportation enhancement grant through the SLC TPO. The project entails sidewalk on both sides of Garden Ave from Oleander Ave to the Mayflower Canal and a pedestrian bridge crossing Mayflower Canal connecting the neighborhood with Sabal Palm Shopping Plaza. A design contract is being submitted to the City Commission on October 17, 2011 for survey and design. Urban Redevelopment Housing staff attended a three day Florida Housing Coalition SHIP meeting in Orlando. Staff had a series of meetings on economic development initiatives. Served on the Fort Pierce Housing Authority Developer Selection committee for the new senior housing project. Two pre-construction meetings for SHIP remodeling projects, 1 SHIP mortgage assistance loan. Staff acquired additional $40,000 funding for King Plant brownfield cleanup. Issued notice to proceed on Atlantic Avenue NSP home rebuild. Prepared Communitywide Council agenda for monthly meeting. Prepared year-end reconciliations and closings for all funds, including Sunrise Theatre. Received "Fish Florida" grant to teach 200 children about fishing, furnish rods and reels, t-shirts, etc. Began work on year end CAPER, FCT and other grant-related program reports. Drafted agenda and held FPAT monthly meeting, continued to work on marketing and development of programs. Continued work on Florida Hardest Hit mortgage program (now handling 76 cases). Interviewed, on camera, for documentary on the Highwaymen painters. Got positive press coverage (two stories) of HUD monitoring report on department activities.

Inlet Linear Park South A1A work installing new stormwater connections affecting Inlet Linear Park have been completed with the exception of restriping bike lane. 3. Jetty Park Study of new 30% A1A roundabout design on how it will affect the approved Jetty Park design and the open space created on the south side of Seaway Drive and the Jetty Park phase II plans. 4. Melody Lane Fishing Pier Waiting for approval of FIND Grant application and working on combining it with the reconstruction of the SLC courthouse parking lot and associated stormwater issues. 5. Heathcote Botanical Gardens/Park Completed review of the 90% master plans from AECOM and waiting for the Engineering Department and/or Public Works to coordinate the SFWMD stormwater grant application for the new park and construction of the Phase I elements. 6. IDI Conservation Area - St. Lucie BOCC has officially waived the Right of First Refusal to accept ownership and management responsibility for the SFWMD s Conservation Easement in the City of Fort Pierce s Developer s Agreement with IDI. Working on plan for the City to take ownership of the Conservation Easement. 7. Everglades Restoration Project Research of the C-44 Reservoir and stormwater treatment area project planned for construction in Martin County east of Lake Okeechobee. Official ACOE groundbreaking will be October 28, 2011. 8. Planning GIS Work Continuing beach erosion and multipurpose trail system data collection with Trimble GIS recorder. 9. Marina Oversee daily operations for City Marina and Fisherman's Wharf Marina. Working with seasonal dockage and events (see weekly email "Marina Happenings" newsletter for updates). Working on master plan for marina expansion. Short listing contractors that will be responsible for construction. In process of creating 1st Annual Oyster and Seafood Fest - April 7, 2012. Continuing to install security cameras throughout marina. Working with Fish Florida Grant to provide rods, reels, tackle, and a seminar for 200 children. Sunrise Theatre Performances and events in the Black Box included the Fort Pierce Jazz and Blues Society and the Sunrise Theatre co-presented Jazz Jam on September 27; Groucho's Comedy on Saturday, September 24. Performances on the main stage included: A near sell-out for the first performance of the 2011/12 Season on Tuesday, October 4, by Lindsey Buckingham, founding member of the band Fleetwood Mac. New shows have recently been added to the 2011/12 Season, on the Main Stage: Larry Gatlin and the Gatlin Brothers on October 28; Todd Rundgren's Utopia on November 3; Sinbad on December 17; 38 Special on February 25. In the Black Box: Late Nite Catechism will appear for 5 performances the weekend of November 4-6; And Sister's Easter Catechism will appear for 5 performances the weekend of March 16-18.

On a daily basis offers and contracts continue to be negotiated with artists and their representatives as part of the programming process for the 2011/12 Season and requisite memberships (both new and renewed) are coming in at this time. Memberships, both new and renewed, have totaled nearly $95,000. Tickets went on sale to members on Monday, August 8. Sales for the 2011/12 Season have reached $420,000. This year s memberships and sales are outpacing last year s figures which were the best to date, with each of the last four years being greater than the year before. Sales are up for this coming season with fewer shows on sale at this time than last year. Additional shows and events will be announced over the next few weeks. The Jazz Jam schedule will change this month, running every Tuesday evening through May 2012. Groucho s Comedy Club concluded its agreement with the Sunrise at the end of September and The Comedy Corner (Improv-West Palm Beach) is the new partner with the Sunrise Theatre in presenting monthly comedy shows. We will kick off the first show on Saturday, October 8. Assistance with future rental events and co-presentations continue with various community groups including, but not limited to, BlueBird Educational Productions presentation of BK Jackson on October 15, Alpha Kappa Alpha's Fashionetta on November 5, and a production of A Tribute to Benny Goodman in January with the Fort Pierce Jazz and Blues Society. Budget projections and adjustments for this and next year s fiscal continue to be reviewed and implemented.
