3 ELEVATOR ADVISORY BOARD Enforcement Division Staff Report January 18, 2018 Case Highlights In April 2017, the Department s records automatically flagged ten passenger elevators, fifteen escalators, two freight elevators, and fourteen units only identified as new equipment located in a mall in San Antonio because the equipment had not been inspected since dates ranging between April 2015 to May Additionally, the Department discovered that five units had been inspected in March 2017, but the reports and fees had not been remitted to the Department timely. The Department originally sought $73,000 in penalties against the building s owner, New Rivercenter Mall II, L.P. This was the owner s second violation of the elevator and escalator law and rules. The owner brought all equipment into compliance with the Department in July 2017, therefore the Department offered to settle the case for a reduced penalty. The owner accepted the offer, and an Agreed Order issued on September 1, 2017 for $18,375, which the Respondent is still making payments on. In May 2017, the Department s records automatically flagged an elevator located in an office building in Weslaco because the elevator had not been inspected since February Additionally, the Department discovered that the building owner, Nandipaty Family Limited Partnership, had failed to file the inspection report and pay the applicable fee for the inspection conducted at the facility in November 2014, failed to obtain an annual inspection for the equipment in 2015, and failed to file the inspection report and pay the applicable fee for the inspection conducted at the facility in February The Department sought $6,000 in penalties against the building owner. The owner obtained a late inspection in July 2017, filed the missing inspection reports, and paid the applicable fees, so the Department offered to settle the case for a reduced penalty. The owner accepted the offer, and an Agreed Order issued on September 1, 2017 for $3,750, which was paid in full. In January 2016, Chief Elevator Inspector Jim Murnan discovered that an elevator in a medical center in San Antonio had not been timely inspected. The Department sought $2,000 in penalties against the building s owner, Medical Center SW, LTD. The owner removed the elevator from service on July 18, 2017, so the Department offered to settle the case for a reduced penalty. The owner accepted the offer, and an Agreed Order issued on September 15, 2017 for $750, which was paid in full. In February 2017, Chief Elevator Inspector Jim Murnan discovered that eleven elevators in a building in Richardson had been altered, but not timely inspected after the alterations were completed. The Department sought $11,000 in penalties against the building s owner, Lakeside Campus Partners LP; $1,000 for each of the eleven units that had been altered and not timely inspected. The owner obtained late inspections for all of the units, filed the missing inspection reports, and paid the applicable fees, so the Department offered to settle the case for a reduced penalty. The owner accepted the offer, and an Agreed Order issued on October 2, 2017 for $2,750, which was paid in full. 1 Enforcement Division January 18, 2018
4 In May 2017, the Department received an anonymous complaint that stated that the elevator inspection for passenger elevator decal number was past due. During the Department s investigation of the complaint, the Department discovered that the inspection for another passenger elevator in the building, decal number 80145, was also past due. The Department sought $4,000 in penalties against the building s owner, Board of Regents of the University of Texas System, charging $2,000 for each of the two units that had not been timely inspected. The owner obtained late inspections for the units in July 2017, so the Department offered to settle the case for a reduced penalty. The owner accepted the offer, and an Agreed Order issued on September 7, 2017 for $2,000, which was paid in full.
