7 CENTRAL AMERCA UPDATE SUBJECT: Nicaragua goes to World Court J SSUE: The impact of Nicaraguan action of charging the US with intervention in internal affairs. and armed action (mlniqg ports). ~, BACKGROUND: '" On 9 April Nicaragua filed an application with the nternation~l Court of Justice to institute proceedings against the UnitEki States. Charges are: "The United States of America is usiqg military force against Nicaragua and intervening in Nicaragua'ls internal affairs in violation of Nicaragua's sovereignty, ; territorial integrity and political independence and of thie most fundamental and universally-accepted principles of inter~ national law". Further charges are also made of violations olf the UN Charter, OAS Charter and the Convention on Rights anj:! Duties of States. The US has notified the World Court that w~ will not accept their jurisdiction in Central America for two years in order to give the Contadora process a chance. 1 i OTiER FACTORS:.. - ApprOXimately 8 ships of foreign registry have hit and received minor damag from mines placed in the port area of Corinto. Some of the national registrie invol ved are the USSR, Panama, and Great Sri tain. - Great Britain has made an informal prote~~ to the US. The oil refinery i being forced to shut down for appro~imately 2 months for lack of crude; q9~to and coffee are reported to be piling up on piers awaiting shipment.. --There is of a downside DSCUSSON:.. _ This is the latest of several "diplomatic" initiatives by Nicaragua to focus: world opinion as well as US domestic opinion on alleged US action while diverting! attention from and attempting to lessen by comparison Nioaraguan and CUban support: for guerrillas in El Salvador. Work continues on their new and im- : proved airfields which could become operational in the near futurel and be capable of supporting high performance aircraft. Nicaragua could be planning to significantly step up support fo~ E Salvador guerrillas and/or introduction of guerrilla activity ~ in Honduras this fall. 9 3 CENTRAL AMERCA UPDATE (Cont'd) SUBJECT: (U) Aid to E1 Salvador SSUE:... Supplies for the conduct of military operations in El Salvador remain dangerously low. We no longer have any obligational authority remaining in the $44.5M in FY84 CRA. DSAA estimates that if we do not have appropriation by 13 Apr 84, we must seek. other authority to fund critical supply/training lines. i BACKGROUND: (0) The FY84 supplemental request for $178.8M remains before Congresis and we do not expect funding before July. A compromise on our emergency request for $92.75M of these supplemental funds has been voted in the Senate and approved at $61.75M. t~ now go to a House/Senate Conference Committee.. A'4y DSCUSSON:.., - We are rapidly approaching a point where we must provide additional funding for ' the ESAF or they will begin to run out of critical supplies (ammunition, bombs, rockets, etc.) - The training of additional battalions will suffer as there will be no funding to prepare trainers for replacement and for pre-deployment functions. f - An additiopal and sorely needed rotary wing aviatiqn training course will not be undertaken after the current group of 20 pilots graduates. " - These and other critical lines within our projected security assistance supplementa\ need to be funded by 13 April \ - Although,the Senate members of the House/Senate conference have been named, the House has no~ taken'any action to move the legislation or appoint conference committee members. - Secretary Shultz has called on the House leadership to request expedited action on the emergency supplemental. ' - There is increasing reluctance amongst House leadership (Speaker O'Neill, i Cong. Whitten) to go to conference citing too many unresolved issues. Congre~J5Pl8n: Jim Wright is expected to raise this issue again with the House leadership on' : 10 April; however, Congressional liaison is not optimistic that he will persuade Speaker O'Neill. DOD POSTON: 411ft We should continue to push for House and Senate action but it must came by Friday, 13 April. f authorization of funding supplemental funding is not available by this date, we must seriously consider authorization under section 21(d) AEeA.
