6 Homeland Security and Public Safety Committee Saturday, February 20 1:15 p.m. 2:45 p.m. Salon II Joining Forces Before the Next Storm Governors across the country have led response and recovery efforts to a significant number of natural disasters over the last year, including wildfires in the West, major flooding in the Southeast and Midwest and significant winter storms in the Northeast. The preparation for, response to and recovery from these events has put enormous strain on resources and budgets at all levels of government. In the face of a potentially active 2016, states must look outside of government for opportunities to shorten response time, reduce cost and strengthen long-term resiliency. During the Homeland Security and Public Safety Committee session, governors will (i) receive an outlook for severe weather in 2016, and (ii) discuss opportunities to improve state-level coordination with non-governmental organizations and the private sector before, during and after disaster events. 10 Dr. Louis Uccellini Director National Weather Service Dr. Louis W. Uccellini is the National Oceanic and Atmospheric Administration s Assistant Administrator for Weather Services, and Director of the National Weather Service. In this role, he is responsible for the day-to-day civilian weather operations for the United States, its territories, adjacent waters and ocean areas. Prior to this position, he served as the Director of the National Centers for Environmental Prediction (NCEP) for 14 years. He was responsible for directing and planning the science, technology, and operations related to NCEP s nine centers: Central Operations, Environmental Modeling Center, Ocean Prediction Center, Hydrometeorological Prediction Center, Climate Prediction Center, all in Camp Springs, MD; the National Hurricane Center in Miami, FL; Storm Prediction Center in Norman, OK; Space Weather Prediction Center in Boulder, CO; and the Aviation Weather Center in Kansas City, MO. Dr. Uccellini was the Director of the National Weather Service s Office of Meteorology from 1994 to 1999, Chief of the National Weather Service s Meteorological Operations Division from 1989 to 1994 and section head for the Mesoscale Analysis and Modeling Section at the Goddard Space Flight Center s Laboratory for Atmospheres from 1978 to Dr. Uccellini has served on many national and international research and field experiment programs. He has received many awards in recognition of his research and operational achievements including the Maryland Academy of Sciences Distinguished Young Scientist Award (1981), the NASA Medal for Exceptional Scientific Achievement (1985), the AMS s prestigious Clarence Leroy Meisinger Award (1985), and the National Weather Association s Research Achievement Awards for Significant Contributions to Operational Meteorology (1996). He was elected as a Fellow to the AMS in 1987and served as Co-Chief Editor of Weather and Forecasting from In January 2012, Dr. Uccellini was elected the President of the AMS and served from 2012 to Dr. Uccellini received his Ph.D. (1977), Master (1972) and Bachelor of Science (1971) degrees in meteorology from the University of Wisconsin-Madison.

11 Gail McGovern President and CEO American Red Cross Gail J. McGovern joined the American Red Cross as president and CEO in 2008 and has taken a strong leadership role at the nation s leading emergency response and blood services organization. Under her direction, the Red Cross has become more effective in fulfilling its mission and is better prepared to face current and future challenges. Her transformational initiatives have led to improved financial stability and have expanded the reach of lifesaving Red Cross services. McGovern has initiated extensive modernization projects at the Red Cross. Among them are an overhaul of Red Cross IT systems and the growth of the organization s leadership in social media and mobile technologies including the introduction of a series of free apps that put lifesaving skills at people s fingertips during emergencies. During her tenure, McGovern has overseen the American Red Cross response to multiple high-profile disasters across the country and around the world, including the Haiti earthquake in 2010, the Japan earthquake and tsunami in 2011, Hurricane Sandy in 2012, as well as the multitude of tornadoes, hurricanes, floods, wildfires, home fires and other local disasters that affect our country each year. In March of 2011, she was appointed as one of 10 members on the President s Management Advisory Board and serves as the only nonprofit leader on this White House panel. Prior to joining the Red Cross, McGovern was a faculty member at the Harvard Business School and earlier had served as president of Fidelity Personal Investments, a unit of Fidelity Investments. She was also executive vice president at AT&T for the Consumer Markets Division, the company s largest business unit and was responsible for its $26 billion residential long-distance service. McGovern is currently a member of the board of trustees for Johns Hopkins Medicine. She also serves on the board of directors of DTE Energy, PayPal and The Weather Channel. She earned a Bachelor of Arts degree from Johns Hopkins University and an MBA from Columbia University and has since been recognized as alumna of the year from both universities.

12 Mark Cooper Senior Director, Global Emergency Management WalMart Stores, Inc. Mark Cooper serves as the senior director of Global Emergency Management for Walmart Stores, Inc. in Bentonville, Arkansas, which operates over 11,000 retail units under 71 banners in 27 countries and e- commerce websites in 10 countries. His departments are responsible for the company s security analytical services, business continuity efforts, preparedness (including public/private partnerships), emergency response and operations, and recovery. During his time with Walmart, the company has responded to numerous disasters including Hurricanes Ike, Isaac and Sandy. Previously, Cooper served on the cabinet of former Louisiana Governor Bobby Jindal as the executive director of the Governor's Office of Homeland Security and Emergency Preparedness (GOHSEP) and as the state's homeland security advisor. While executive director, GOHSEP continued to lead the State's recovery efforts for Hurricanes Katrina and Rita and responded to an unprecedented number of Federallydeclared disasters. These included Hurricanes Gustav and Ike in 2008, the British Petroleum (BP) Oil Spill in 2010 and historic flooding along the Mississippi River in Under Cooper's leadership, Louisiana established the state's first Urban Search and Rescue Team that was deployed to the 2011 Alabama Tornados, a successful public preparedness campaign "Get a Game Plan, and one of the largest radio interoperability programs in the Country. Partnering with academia and the private sector, Cooper also led the establishment of the nation's first, fully functional Business Emergency Operations Centers that was named a "best practice" by the U.S. Department of Homeland Security. As a major advocate for public/private partnerships in emergency management, he worked closely with Walmart Stores, Inc. and other private sector companies, which led to his current position. Prior to returning to his home State of Louisiana in 2008, Cooper spent almost 20 years with Los Angeles County government including deputy fire chief with the Los Angeles County Fire Department. During his time with the County, he responded to the 1992 Los Angeles Riots, 1993 Northridge Earthquake, numerous wildfires and was part of a team deployed during Hurricane Katrina to assist the City of New Orleans with continuity of government. Cooper holds both a Masters and Bachelors Degree from Louisiana State University. He serves as a member of the United Nations ARISE Public/Private Sector Executive Board, FEMA Administrator's National Advisory Council, U.S. Department of Homeland Security Resiliency Task Force, LSU Stephenson Disaster Management Institute Board of Directors and other boards and volunteer organizations.

13 Pascalis Papouras Chair, Maryland State Voluntary Organizations Active In Disaster Board Member, National Voluntary Organizations Active in Disaster Pascalis Papouras is Senior Policy Advisor & Government Relations at International Orthodox Christian Charities (IOCC). His current portfolio includes representing IOCC to Congress, the Presidential Administration, the international diplomatic community, policy institutes, the ecumenical and inter-faith community; and he advocates on behalf of IOCC s beneficiaries and programs. He currently serves on the Board of Directors of National Voluntary Organizations Active in Disaster (VOAD), a multi-lateral civil society alliance; and also serves as the Chairman of Maryland VOAD, a state-level alliance within the same movement. With over 16 years of experience in emergency response management, development and community mobilization, Pascalis has worked in the Middle East, Eurasia, East Africa and throughout the United States, where he developed an emergency response network of volunteers, thus building the capacity of civil society to engage in post-crisis assistance and recovery. He received his BA in History, Classics, and Ancient Greek from Miami University in Oxford, OH and his MA from The Ohio State University s Department of Greek and Latin, serving as a Graduate Teaching Assistant.

15 NGA Center for Best Practices Homeland Security and Public Safety Division Update on Select Activities for the Homeland Security and Public Safety Committee Winter 2016 The NGA Center for Best Practices Homeland Security and Public Safety (HSPS) Division provides governors and their staff with analysis and information about best practices, tailored technical assistance and insights into emerging policy trends across homeland security and public safety. The division covers policy areas such as cybersecurity, emergency preparedness, energy assurance, public health preparedness, sentencing and corrections reform, juvenile justice, prescription drug abuse, justice information sharing and public safety broadband communications. Support for State Efforts to Reduce Prescription Drug Abuse: Ongoing In collaboration with the NGA Center s Heath Division, the HSPS Division has assisted governorappointed teams from 13 states in developing comprehensive action plans for reducing prescription drug abuse. Colorado Governor John Hickenlooper and Alabama Governor Robert Bentley co-chaired the first Policy Academy on Reducing Prescription Drug Abuse, and Vermont Governor Peter Shumlin and Nevada Governor Brian Sandoval co-chaired the second. The NGA Center is currently exploring opportunities to continue supporting state efforts to reduce prescription drug abuse, address heroin use and treat opioid addiction. Resource Center for State Cybersecurity: Ongoing The NGA Resource Center for State Cybersecurity (Resource Center), co-chaired by Michigan Governor Rick Snyder and Virginia Governor Terry McAuliffe, provides governors with resources, tools and recommendations to help craft and implement effective state cybersecurity policies and practices. As follow up to the HSPS Division s National Summit on State Cybersecurity in March, the Resource Center is exploring opportunities to continue supporting state efforts to improve cybersecurity governance, posture and response capabilities. For cyber issues related to energy and other critical infrastructure, the division collaborates with the NGA Center s Environment, Energy and Transportation Division. Governors Homeland Security Advisors Council: Ongoing The HSPS Division continues to provide staff support and technical assistance to the Governors Homeland Security Advisors Council (GHSAC). The GHSAC serves as the collective voice of homeland security advisors from the 55 states, territories and the District of Columbia. The GHSAC meets twice a year to identify common challenges, share best practices and keep governors informed of homeland security policies affecting the states. The GHSAC convened their winter meeting from February 4-6 in Arlington, VA. The next meeting is planned for August in New York, NY. Governors Criminal Justice Policy Advisors Network: Ongoing The HSPS Division provides staff support and technical assistance to governors criminal justice policy advisors (CJPAs). At states request, HSPS Division staff will conduct research and prepare tailored memoranda, connect governors staff with their peers in other states and national experts and, to the extent resources are available, provide on-site assistance. The HSPS Division also holds monthly conference calls for governors offices on new and emerging issues in criminal justice and public safety.

16 The HSPS Division will hold its annual institute for CJPAs in Richmond, VA in fall The institute will explore critical state public safety challenges as well as the latest research and best practices in criminal justice policy. This year, directors of state administering agencies (SAAs) will also be invited to attend. The institute will provide an opportunity for governors CJPAs and SAAs to learn together and coordinate policy development and criminal justice planning. Enhancing State Public Health Preparedness: Ongoing The HSPS Division is working to assist governors in enhancing public health preparedness. Recently, the HSPS Division convened an experts roundtable with representatives from health, public health, homeland security and emergency management. The goal of the roundtable was to identify key challenges and recommend actions governors can take to improve their state s public health preparedness. The HSPS Division will capture those recommendations in an issue brief to be published in Energy Assurance and Resilience Projects: Ongoing In collaboration with the NGA Center s Environment, Energy and Transportation Division, the HSPS Division is supporting two related initiatives on energy assurance and resilience. The first, Preparing Governors for a Potential Prolonged and Widespread Outage of the Electric Power Grid, aims to assist governors in responding to a massive and prolonged power outage. The NGA Center recently hosted an experts roundtable with two goals: (1) to examine governors role in ensuring that their states are prepared to respond to and recover from such an event; and (2) to develop a framework for the NGA Center s ongoing technical assistance to states. Participants included national experts as well as state officials from Washington and Wisconsin. In the fall and winter of , the NGA Center will visit Washington and Wisconsin to discuss challenges, review current activities and identify ways to improve energy assurance plans. A forthcoming issue brief will highlight strategies and lessons learned from those two states. The second initiative aims to help governors improve energy assurance coordination among energy officials, homeland security advisors and emergency managers. Recently, the NGA Center hosted a learning lab in Trenton, NJ to explore proven approaches for energy assurance coordination. The learning lab convened governor-appointed teams from six states (Hawaii, Maryland, Michigan, North Carolina, Oklahoma, and Rhode Island) to identify best practices in energy assurance planning and coordination, informed by New Jersey s experience with Superstorm Sandy and other events. State teams developed action plans to guide future efforts at improving coordination and collaboration. The NGA Center will produce an issue brief based on lessons learned from the learning lab. Learning Collaborative: Paroling Authorities as Key Partners in Achieving Governors Criminal Justice Policy Goals: July 2015 and November 2015 The NGA Center, in partnership with the National Parole Resource Center, is launching a learning collaborative to assist governors in developing coordinated strategies for strengthening parole policies and practices. To kick off this work, the HSPS Division will be hosting a webinar on July 30 to examine best practices in paroling and model state initiatives. In addition, the webinar will provide information about the learning collaborative for states interested in applying to participate. Statewide Recidivism Reduction Project: Ongoing The NGA Center, in partnership with the Council of State Governments, is developing resources and tools to help states develop and implement recidivism reduction plans that are goal-oriented, based in riskreduction science and promote data accountability for results. The project will work with states to measure and assess current recidivism efforts while also developing plans for reducing recidivism utilizing evidencebased practices. 17 NGA Federal Relations Update Homeland Security and Public Safety Committee Winter 2016 The following is a synopsis of current federal developments on issues under the Homeland Security and Public Safety (HSPS) Committee s jurisdiction as of February 3, 2016: National Guard In November, Congress passed the revised National Defense Authorization (NDAA) Conference Agreement for fiscal year (FY) 2016 after it cleared a budget deal to raise defense and non-defense discretionary caps for two years. The revised agreement maintains provisions in the original conference report that would allow the full reduction of Army National Guard (ARNG) personnel to 342,000 soldiers in FY 2016 and postpones the transfer of up to 48 AH-64 Apache helicopters from the ARNG to the active Army another three months until June 30, This preserves a 60-day congressional review of the National Commission on the Future of the Army s (Commission) report (released January 28), before any transfer of ARNG Apaches can proceed. The FY 2016 NDAA also included a provision that would authorize the conversion of certain state-managed National Guard military technician positions to federallymanaged Title 5 civilian employees. This month, the Department of Defense (DoD) is required to submit report to Congress on plans to implement the provision by January On January 28, the Commission released its final report to Congress following its year-long review of Army force structure requirements across the active and reserve components. During its meeting on February 19, the Council of Governors (Council) will hold a discussion with DoD and Army leadership on how the Commission s recommendations will be integrated into future budget proposals. NGA Action In August, Council and HSPS leadership sent a letter to the Commission responding to questions about governors priorities for Army restructuring and state-level military requirements. In September, Governors Terry Branstad (IA) and Mark Dayton (MN) testified before the Commission to express governors concerns with plans to reduce ARNG personnel and equipment. On January 7, the Council Co-chairs sent a letter to congressional Armed Services Committee leadership to express concerns over the military technician conversion requirement and to urge repeal the provision in the FY 2017 NDAA. On February 5, the Army Commission briefed governors and staff on the conclusions of their analysis and recommendations to Congress related to Army force structure. Cybersecurity Congressional efforts to pass comprehensive cybersecurity legislation intensified this year in response to several significant cybersecurity breaches to government and private sector entities. In advance of those efforts, HSPS and Council leadership sent a letter to Congress this summer promoting three key priorities for governors for federal legislation: improving threat sharing with states, strengthening the cyber capabilities of the National Guard, and maintaining states ability to enforce their data breach laws. Last fall, Congress passed legislation to enhance private-sector information sharing with the federal government, which included provisions to facilitate further information exchange with state and local authorities. Both

18 chambers of Congress continue to consider several bills which create a national data breach standard and preempt related state laws. Several of the bills have been approved through committee and may receive floor consideration before this summer. In December, the National Guard Bureau announced the placement of 13 new cyber units across the Army and Air National Guards, which expands coverage across 18 additional states with growth of over 800 cyber-trained professionals. The HSPS Committee continues to work in partnership with the Council of Governors and NGA s Resource Center for State Cybersecurity on activities which promote the state role in cybersecurity and support governors priorities in this issue area. NGA Action In October, the Council s federal and state participants convened a staff working session to discuss next steps for developing departmental policies that will support states with cybersecurity response, including a Department of Homeland Security (DHS) policy to facilitate information sharing with state officials on imminent threats to critical infrastructure, and interim DoD guidance for state use of federal cyber resources by the National Guard. In November, NGA moderated a panel discussion for congressional staff to examine the role of states for improving the nation s cybersecurity posture and opportunities to improve state-federal coordination. State participants included a state CIO, an HSA and the National Guard. Throughout the fall, NGA provided input on several federal legislative and appropriations proposals that will improve DHS engagement with state government on cybersecurity matters. Veterans Affairs Last year, NGA worked with the Department of Veterans Affairs (VA) to facilitate state compliance with Section 702 of the Veterans Choice, Accountability and Transparency Act (Choice Act), which requires public post-secondary educational institutions to provide in-state tuition rates for out-of-state veterans and their dependents. As a result, all states and territories were in compliance with the law as of December 31. Last fall, the NGA Center for Best Practices completed a two-year demonstration project for the Department of Labor to explore best practices for state licensing and credentialing of military service members and veterans. The accompanying report and cost analysis was published in October. NGA Action In September, NGA testified before the House Veterans Affairs Subcommittee on Economic Opportunity to highlight key findings from the Center s demonstration project and convey additional opportunities to improve state-federal information exchange. In October, NGA briefed congressional staff on the conclusions of the Center report and discussed next steps for federal legislative and policy solutions that could aid in the issuance of state licenses for related civilian and military occupations. In January, the HSPS and Health and Human Services Committee held a joint briefing on VA efforts to address opioid and other prescription drug abuse among the veterans population. Refugee Resettlement Following the Paris terrorist attacks in November, the Administration responded to public calls for information about the federal process for admitting refugees from conflict zones such as Iraq and Syria to the U.S. Several governors raised concerns with current processes for sharing information with states on refugee placement, such as their number, location and nationality. In late November, White House Chief of Staff Denis McDonough sent a letter to NGA leadership with proposed changes to the way the federal government communicates with states about the placement of refugees. The Council of Governors also discussed the DHS vetting process for refugees during a conference call with Homeland Security Secretary Jeh Johnson and other federal officials in December. 2

19 NGA Action Since November, NGA and the Council of Governors have hosted several calls to update governors and state officials on the federal refugee resettlement process and discuss improvements to federal information sharing with states. In December, NGA worked with the White House to facilitate a process to provide monthly updates to states on refugees through a State Department-hosted website. NGA hosted calls with state refugee coordinators to develop recommendations for improving information sharing and comparing state data systems. FirstNet: Nationwide Public Safety Broadband Network In October, the First Responder Network Authority (FirstNet) sent a letter to governors summarizing two key legal interpretations related to a governor s opt-in versus opt-out decision and the retention of revenues from the sale of broadband spectrum. In January, FirstNet issued its final Request for Proposals (RFP) ahead of selecting its vendor partner(s) by the end of FirstNet is currently scheduled to deliver state plans to each governor by the second quarter of FirstNet has committed to providing advance review of state plans ahead of their official submission to the states which requires governors to respond on their opt-in decision within a 90-day review period. NGA Action In November, NGA hosted FirstNet officials to brief governors offices and relevant state officials on the current timeline for FirstNet deliverables such as the RFP and scheduled state consultations. Governors Public Service Secretaries and Homeland Security Advisors are receiving regular updates on FirstNet activities. Chiefs of Staff will be briefed at this year s Winter Meeting. REAL ID In October, DHS updated the REAL ID compliance status of all states and provided qualifying states with extensions to come into full compliance with the law. In January, Secretary of Homeland Security Jeh Johnson announced the final phase of REAL ID enforcement by the Transportation Security Administration at all U.S. airports. Beginning in January 2018, passengers with a state driver s license not compliant with the REAL ID Act will need to show an alternative form of identification for domestic air travel. Beginning in October 2020, every air traveler will need a REAL ID compliant license or another acceptable form of identification for domestic air travel.
