1 Do you need to file Form CIQ Conflict of Interest Questionnaire? Chapter 176 of the Texas Local Government Code requires a person who enters or seeks to enter into a contract with the City of Corpus Christi (Vendor) to file a Conflict of Interest Questionnaire (Form CIQ) if the vendor has certain business and/or family relationships with officers of the City of Corpus Christi or have given any gifts exceeding $100 in the aggregate to an officer or a family member of an officer. 2 Do I need to file Form CIQ? QUESTIONNAIRE 1. Are you entering into a contract with the City of Corpus Christi either for yourself or on behalf of someone else (Vendor)? Yes (Go to question #2) No (Go to question #1a) a. Are you seeking to enter into a contract with the City either for yourself or on behalf of someone else (Vendor)? Yes (#2) No (#8) 2. Are you an employee or agent of a state, political subdivision of a state, the federal government or a foreign government? No (#3) Yes (#2a) a. Are you acting on behalf of that governmental entity? No (#3) Yes (#8) 3. Are you employed by the City of Corpus Christi? No (#4) Yes [End - Barred per City Code of Ethics] 4. Do you have a family relationship with an Officer of the City of Corpus Christi? A family relationship means related to the 3 rd degree by blood (father/mother/daughter/son, brother/sister/grandmother/grandfather/grandson/granddaughter, aunt/uncle/niece/nephew/great grand-m/f/s/d) or 2 nd degree by marriage (spouse/stepson/stepdaughter/mother-in-law/father-in-law/son-in-law/daughter-in-law, grand-m/f/s/d-in-law/brother-in-law/sister-in-law). No (#5) Yes (File CIQ) 5. Do you have a business relationship with an Officer of the City of Corpus Christi that resulted in the Officer receiving $2500 in taxable income within the last 12 months? Taxable income does not include interest, dividends or capital gains generated from a bank account, investments or a loan. No (#6) Yes (File CIQ) 6. Do you have a business relationship with a family member of an Officer of the City of Corpus Christi that resulted in the Officer s family member receiving $2500 or more in taxable income within the last 12 months? A family member means related to the 1 st degree by blood (father/mother/daughter/son) or marriage (spouse/stepson/stepdaughter/mother-in-law/father-in-law/son-in-law/daughter-in-law). No (#7) Yes (File CIQ) 7. Have you given one or more gifts with a total value exceeding $ to an Officer or a family member of an Officer within the last 12 months? A gift is a benefit offered by a person and includes food, lodging, transportation and entertainment. The term does not include a benefit offered on account of kinship or a personal, professional or business relationship. No (#8) Yes (File CIQ) 8. The Vendor may not be required to file a CIQ at this time. The Vendor is required to file a CIQ not later than the 7 th business day after the date the Vendor becomes aware of an event that would require the CIQ to be filed. Failure to do so is a misdemeanor, and the City may declare the contract void. [End - CIQ May Not Be Required] 2
