9 Planning and Zoning Commission Minutes, September 5, 2017 Agenda Item 2 MINUTES A regular called meeting of the City of Decatur Planning and Zoning Commission was held at 6:30 p.m., Tuesday, September 5, 2017, in City Hall Chambers with the following in attendance: MEMBERS PRESENT: Curtis Creswell Terry Berube Eddie Allen John Lanier MEMBERS ABSENT: William D. Edwards, Chairman Cecil LeMond, Vice-Chairman Eileen Standridge OTHERS PRESENT: Planning and Development Director Dedra Ragland and Development Review Coordinator Shanna Smith, representing the staff, Mark Morris, representing the applicant and Will Klose Decatur citizen. In the absence of Chairman Edwards and Vice-Chairman LeMond, Commissioner Allen made a motion for Commissioner Creswell to serve as acting Chairman. Commissioner Berube seconded the motion. The motion passed 3-0, Chairman Edwards, Vice-Chairman LeMond and Commissioner Standridge absent. Commissioner Creswell called the meeting to order at 6:31 p.m. ITEM 1: Public Hearing Items: ITEM 2: Consider and take appropriate action regarding approval of the Planning and Zoning Commission Meeting Minutes on: a. August 1, 2017 Commissioner Allen made a motion to approve the Meeting Minutes for August 1, Commissioner Lanier seconded the motion. The motion passed 4-0, Chairman Edwards, Vice-Chairman LeMond and Commissioner Standridge absent. b. August 1, 2017 Main Street Program Workshop Commissioner Lanier made a motion to approve the Meeting Minutes for August 1, 2017 Main Street Program Workshop. Commissioner Berube seconded the motion. The motion passed 4-0, Chairman Edwards, Vice-Chairman LeMond and Commissioner Standridge absent. c. August 15, 2017 Commissioner Berube made a motion to approve the Meeting Minutes for August 15, Commissioner Allen seconded the motion. The motion passed 4-0, Chairman Edwards, Vice- Chairman LeMond and Commissioner Standridge absent. SUP Commission to hear and consider and take action to make a recommendation to City Council regarding Specific Use Permit Application Mr. Stephen Lindsey s request, on behalf of Rooster s Roadhouse, for a Specific Use Permit to allow for the sale of alcoholic beverages, including mixed drinks, on approximately acres of land being legally described as North Part of Lot 2, Block 5, Original Decatur Addition or more commonly referred to as 106 N. 10 Planning and Zoning Commission Minutes, September 5, 2017 Planning Director Ragland presented the staff report and reminded the Commission that a Specific Use Permit for the sale of alcoholic beverages is required for properties located in the C-1A Zoning District. Twenty-three (23) property owners were notified with fourteen (14) responses received in favor of the request. The property meets the 300 buffer for churches, schools, and hospitals and staff recommends approval. Commissioner Allen asked if the business was moving from the private club status. Planning Director Ragland answered yes. ITEM 3: Commissioner Berube made a motion to recommend approval of Specific Use Permit Commissioner Lanier seconded the motion. The motion passed 4-0, Chairman Edwards, Vice-Chairman LeMond and Commissioner Standridge absent. SUP Commission to hear and consider and take action to make a recommendation to City Council regarding Specific Use Permit Application Mr. Kirk Dinkins request, on behalf of Fuzzy s Taco Shop, for a Specific Use Permit to allow for the sale of alcoholic beverages, including mixed drinks, on approximately acres of land being legally described as Lot 3, Block 12, Original Town of Decatur Addition or more commonly referred to as 109 N. State Street, Decatur, Texas. A complete legal description of the property can be obtained from the Planning and Development Services Department. Planning Director Ragland presented the staff report and reminded the Commission that a Specific Use Permit for the sale of alcoholic beverages is required for properties located in the C-1A Zoning District. Twenty-eight (28) property owners were notified with thirteen (13) responses received in favor of the request. The property meets the 300 buffer for churches, schools, and hospitals and staff recommends approval. Commissioner Lanier asked if a Specific Use Permit requires an annual renewal. Planning Director Ragland explained the Specific Use Permit stays with building as long as the use stays the same. Commissioner Creswell asked what the timeline is for a Specific Use Permit. Development Coordinator Smith gave the Commissiners the date the application was submitted and Planning Director Ragland stated it is approximately a two month process. Non Public Hearing Items ITEM 4: Commissioner Berube made a motion to recommend approval of Specific Use Permit Commissioner Lanier seconded the motion. The motion passed 4-0, Chairman Edwards, Vice-Chairman LeMond and Commissioner Standridge absent. New and/or future business items. a. October meeting currently has ten (10) applications. Planning Director Ragland told the Commission the October meeting currently has ten (10) applications. Four (4) of the applications were originally planned for September but the applicant postponed until October.
