1 MEMORANDUM OF UNDERSTANDING This Memorandum of Understanding is entered into by and between the Florida Department of Management Services (FDMS), the Florida Department of Law Enforcement (FDLE), the Florida Division of Emergency Management (FDEM), and the Joint Task Force on State Agency Law Enforcement Communications (JTF) in furtherance of their respective duties under law for the purpose of management and administration of the Statewide Law Enforcement Radio System (SLERS). WHEREAS, pursuant to s , Florida Statutes (2011), FDMS is tasked with administration of the SLERS and bears the overall responsibility for the design, engineering, acquisition, and implementation of the system. FDMS is to consult and act in conjunction with FDLE and FDEM in implementing its powers and duties regarding the SLERS; and WHEREAS, also pursuant to s , Florida Statutes, the JTF is comprised of representatives of the various statewide law enforcement agencies and is created to advise FDMS of member-agency needs related to the planning, design and establishment of the SLERS; NOW THEREFORE, the parties agree as follows: As a duly authorized exercise of its powers and duties under s , Florida Statutes, and in consultation with and agreement by FDLE and FDEM as indicated by the signatures of those agency representatives below, revised Standard Operating Procedure 16 is established to govern the operational administration of the SLERS system and trust fund as between FDMS and the JTF. 4 2. 2. Per s (2)(c),709, F.S., the Joint Task ForceJTF shall elect a chair from among its members to serve a one-year term. A vacancy in the chair must be filled for the remainder of the unexpired term by an election of the JTF members Per s (2)(d),709, F.S., the JTF Board shall meet as necessary, but at least quarterly, at the call of the chair and at the time and place designated by him/her Per s (2)(b),709, F.S., any Board member may, upon notification to the chair prior to the beginning of any scheduled meeting, appoint an alternate to represent the member and vote on task force business in his or her absence. Membership and Terms: 1. The JTF Board establishes s or other work groups as necessary to meet the needs of the system and the JTF member agencies. The following committees are established: Standard Operating Procedures,; Technical, and Joint Dispatch Oversight Regional User s. Also, in accordance with SOP 1, a Security Manager and a Deputy Security ManagersManager are established. 2. Each JTF statutory agency is responsible for designating a representative to serve on each committee. OnlyEach JTF Statutory agenciesstatutory agency and the Office of Agricultural Law Enforcement of the Department of Agriculture will be allocated one no-proxy vote on each committee. and must have its member present to vote. An agency may have any reasonable number of representatives in attendance at meetings. The Security Manager or his/her representative, STODMS, and, as requested, the primary system 2. contractor will be assigned to each committee. 3. A Chair and Vice-Chair are elected annually by vote from nominations from the full committee. The terms shall be by calendar year. The Vice-Chair serves in the absence 3. of the Chair. 4. STODepartment of Management Services is the keeper of the committee representative roster as part of the master JTF mailing list. It is the agencies' obligation to keep STODMS notified of any committee representative changes. Agency representatives will be re-affirmed yearly. 5. Each Regional Communications Center will maintain a Regional User to resolve Joint Dispatch issues at the local level; Each SLERS Agency will appoint a member to the User at each Regional Communications Center. Each will elect a chair and vice-chair from the participating agencies. Regional User s will openly discuss issues and resolve them with the Regional Communications Center Commander. Issues not resolved by Regional User s will be referred to the FHP Deputy Director of Law Enforcement Support Services for resolution. Issues not resolved at that level may be directed to the JTF Board. Regional User members may continue to serve as reaffirmed by their agency. Each will elect a chair and vice-chair from the participating agencies. Regional User s will openly discuss issues and resolve them with the Regional Communications Center Commander. Issues not resolved by Regional User s will be referred to the FHP Deputy Director of Law Enforcement Support Services for resolution. 16 Meetings: 1. A voting quorum is attained when a simple majority of possible statutory agency representatives is present. One attendee must be the Chair or Vice-Chair. 2. The frequency of meetings is to be proposed by the Chair and passed by a vote. The recommended maximum interval between meetings is three months. 3. Meeting notifications are to be delivered via to the membership and publicly noticed in accordance with Chapter 286, F.S., The Government in the Sunshine Law. 4. meetings are considered working meetings. Discussion and work may occur at any meeting, however no decisions or recommendations will be passed to the JTF Board unless a vote is taken and the minutes reflect that a quorum was present. 5. The Chair is responsible for developing accurate, brief minutes and a list of attendees of each meeting. If possible, a copy is provided to all members for review prior to the next scheduled meeting. A copy of the minutes and attendees will be archived by the Chair and also provided to DMS. 6.
