Van Nuys Area Vice talked to the consultant for the property, and both parties agreed to modify condition No. three (3). All the requested conditions remain as requested, except for condition No. three (3). Please modify condition three (3) to the following: 3. The exterior windows and glass doors on the southwest comer of the store shall be maintained substantially free of signs and other materials from the ground to at least six (6) feet in height above the ground so as to permit surveillance into the location by Police and private security. The entire west facing window shall be so maintained. The south facing window, within ten (10) feet of the front door shall be so maintained. Van Nuys Area Vice has reviewed the applicant s request along with their criminal history and there is not anything that would prevent them from obtaining approval. Van Nuys Area Vice Unit is not opposed to the Master Land Use Permit Application. However, Van Nuys Area Vice, is requesting that the following conditions be attached to the permit: 1. Within six (6) months of the effective date of this determination, all personnel acting in the capacity of a manager of the premise shall attend Standardized Training for Alcohol Retailers (STAR) session sponsored by the Los Angeles Police Department. Training shall be repeated on an annual basis. 2. No dance floor or dancing shall be permitted at the location. 3. The exterior windows and glass doors of the store shall be maintained substantially free of signs and other materials from the ground to at least six (6) feet in height above the ground so as to permit surveillance into the location by Police and private security. 4. No live music or performers shall be permitted at the location which would require the use of a permanent or temporary stage or require amplified audio equipment such as speakers, amplifiers or any live band audio in order to perform. 6. No Loitering and No Public Drinking of Alcoholic Beverages signs shall be posted at the front, side and rear of the site. These signs shall be in English and Spanish. 7. Signs shall be posted in Spanish and English that California State Law prohibits the sale of alcoholic beverages to persons who are under 21 years of age. 9. Consumption of alcoholic beverages shall be permitted only from 9:00 a.m. to 9:00 p.m. every day. 10. No happy hour type of reduced price for alcoholic beverages shall be allowed. 11. Electronic age verification device(s) which can be used to determine the age of any individual attempting to purchase alcoholic beverages shall be installed on the premise at each point-of-sale location. The device(s) shall be maintained in an operational condition and all employees shall be instructed in their use prior to the sale of any alcoholic beverage. 12. Consumption of alcoholic beverages shall be permitted only inside the building and not in the parking lot, sidewalk area, or any exterior patio or tent area. 13. No open bottles of alcohol shall be sold or allowed to be removed from the building by any customers. 14. Distilled spirits over 80 proof can be sold for off-site consumption, but shall not be consumed on the premise at any time. 15. Wine over 16 percent alcohol content, or beer over 10 percent alcohol content, can be sold for off-site consumption, but shall not be consumed on premise at any time. 16. The property owner shall keep the property, including the sidewalk adjacent thereto, free of debris and litter. 17. The business operator shall install video surveillance cameras and monitors inside the premises and cameras outside which show the sidewalk area, to the satisfaction of the Los Angeles Police Department. Evidence of compliance shall be submitted by the business operator to the zoning administrator. The business operator shall maintain the tapes for at least two (2) weeks and make them available to the Police Department upon request.

All other doors shall be equipped on the inside with automatic locking device and shall be kept closed at all times other than to permit temporary access for delivery of supplies and trash removal. 19. The business shall not allow any Smoking inside the location, on any patio area, or within ten (10) feet of any entrance into the business. No smoking signs shall be posted inside the business and inside any patio area. Per Los Angeles Municipal Code section , Smoking shall mean, engaging in an act that generates smoke, such as possessing a lighted pipe, a lighted hookah pipe, a lighted cigar, a lighted cigarette, or an operating electronic smoking device.
