INTRODUCTIONS AND WELCOME - In Chairman Yoder s absence, Vice-Chairman Don Perdue requested everyone in the room to introduce him/herself. II STRATEGIC PLAN ACTION ITEMS a. Review of Plan-Discussion, Reports and Status - The TTF continues to address several training topics including the role of the TTF in Domestic Readiness Team/Weapons of Mass Destruction Public Information Officer Training specific to hazard materials incidents and the unique requirements of training for volunteer fire responders. In January 1993, the SERC established the Training Task Force (TTF) to address the requirements of the Hazardous Materials Transportation Act grant program. Since its inception the Task Force s responsibilities have been expanded to include the development of responder training guidelines, coordination with various responder groups to ensure that required hazardous materials training is available, establishment of a uniform classification system for hazardous materials incidents and examination of the need and feasibility of hazardous materials area response teams. Chief Perdue chaired the January 9, 2003 TTF during which the updated Guidelines for Hazardous Materials Training were presented. The guidelines are designed for use by both private and public sector responders and incorporate changes made to the National Fire Protection Agency Standards 471, 472, and 473. In an effort to consolidate terrorism and hazardous materials Awareness and Operations Level training, the guidelines were reviewed in comparison with the Terrorism/Weapons of Mass Destruction Competencies guide being developed by the Training Fire Chief Ernie Hiers, Chairman - Charles E. 2 Subcommittee to the Statewide Working Group (SWG). It is anticipated that the Guidelines can be adapted to include additional training as a component of the Awareness and Operations Level training requirements. The Training Subcommittee to the SWG met once during the quarter and several Local Emergency Planning Committees (LEPCs) have already recommended members to participate. Participation by the LEPCs on the Training Subcommittee will help ensure that the LEPCs are training topics including the roles of the TTF in Domestic Readiness Team/Weapons of Mass Destruction Public Information Officer Training specific to hazard materials incident and the unique requirements of training for volunteer fire responders. b. Open Discussion. The chair reported that basically, 80% of the strategic plan had been completed and it was now necessary to look at the new two years and what the TTF members felt would be necessary. SERC GUIDELINES FOR HAZARDOUS MATERIALS TRAINING CONTRACT a. Final approval for recommendations to SERC - Guidelines for Hazardous Materials Training, Florida Awareness and Operations Level Hazardous Materials Training Program. Funding to update the Public and Private Section Guidelines for Hazardous Materials Training has been provided and draft guidelines were reviewed during the quarter. The new guidelines reflect recent changes made to the National Fire Protection Agency recommendation and standards 471, 472 and 473, as well as consolidate the previously separate private and public sector guidelines. b. Distribution of final product - In January Lee Newsome distributed finished product which was applauded by TTF members who voted unanimously to accept and to present to SERC for approval. SERC delayed action pending final review/coordination by the entire first response community. Guidelines will be put on website and be available on CD. Additionally, each individual response discipline (fire, law enforcement, EMS, etc.) will have own separate CD to provide ease of access. Quarterly SERC Meetings Recap - April 3-4, 2003 p. 3

4 Still some members of first response community who are not fully on board with guidelines. TTF agreed to forward recommendation to SERC anyway to approve with a matrix coming later to show how training could be accomplished with guidelines. IV. MODEL STANDING OPERATING PROCEDURES (SOP) FOR RESPONSE TEAMS a. Clarification of goals/objectives. While only a small portion of TTF have reviewed, it was determined that all needed to receive basic copy of proposed SOP. This will be most difficult of tasks due to varied districts/departments involved, some standardization can be achieved. Wayne Yoder has forwarded the Palm Beach document, and the request to all teams to submit their SOPs for review to the State has been done and a crosswalk accomplished. There is a need to get moving on this item and things to determine: What are the performance expectations? There are many terminologies with different plans and products and this needs standardization. Also needed is standardization of activities. Training and reference documents should answer such questions as, how long does it take to set up a DECON unit; etc. Standardization in dealing with hospitals also needed. Some hospitals expect very detailed coordination with HAZMAT teams, some require none. The SOP will not only be for the District Response Teams but for all HAZMAT teams as well. b. Establish timelines/process - TTF members requested to forward comments prior to July 03 meeting for next meeting s discussion. V. VOLUNTARY CERTIFICATION EXAM FOR HAZARDOUS MATERIALS FIRST RESPONDERS - Time did not permit discussion. Tabled until July 03 meeting. VI. AIR MONITORING EQUIPMENT TRAINING AND INFORMATION SHARING There is a great concern that there is not enough training being accomplished on the new equipment, and under what circumstances it is to be used. The consensus was that more training should be conducted. The Florida National Guard s Civilian Support Team (CST) will be doing training at Marco Island under a test program. The CST are IR specialists and Major Russ Spengler is developing a program which will offer the training on campus at Camp Blanding so the team will not have to travel extensively throughout the state. Travel IRs need to be shared around so that all can perform hands-on when training occurs. The 27 District Response Teams (DRT), for whom the equipment was purchased, will be trained. The discussion of information sharing arose and many believe that open discussion of which pieces of equipment have been purchased for whom with make and model numbers should not be put Quarterly SERC Meetings Recap - April 3-4, 2003 p. 4

5 out as public information. It is too easy for potential terrorists to access internet information and then determine a DRTs capabilities and then thwart them. VII. OTHER BUSINESS A big push was made to get the April TRANSCAER Workshop at Ocala filled. There have been some cancellations from first responders since the war with Iraq began. Bill Lofgren indicated that he was working with local Department of Health officials to see of the Health Resources Support Activities (HRSA) funds for training hospitals could be channeled through the LEPCs. CALL TO ORDER/WELCOME/INTRODUCTIONS - Chairman George Danz requested that everyone in the room introduce him/herself. After introductions, John Gibbons of District 9 indicated that he had previously suggested the reciting the Pledge of Allegiance before each meeting, which had been agreed, but which was not being done. This time the group moved and passed a resolution to recite the Pledge, which was then done. The Chair also indicated that at the SERC meetings, he felt his responsibility was to represent the interests of the Chairs and Staff group and asked DEM to always include on the Chairs and Staff meeting agendas for the future, as a last item, a recap of issues to be taken to the SERC from the group on the following day. II. TRAINING TASK FORCE UPDATE - Don Perdue provided a recap of the Training Task Force held earlier this date. He highlighted the TTF major concerns: a. Communications for the Emergency Medical Services - to continue as priority item. DCA and the TTF will find out who is currently working the issues and what equipment is involved with the problems associated, and what is working well. b. Doug Wolfe gave his report on the Florida Association of HAZMAT Responders c. Strategic Plan - moving toward completion of all items. d. Tracking of Trained Individuals - the FDLE is working this issue and the TTF does not want to duplicate their work. e. PIO - issue deferred until next meeting. f. SERC Guidelines - approved by the TTF and supported by Chairs and Staff for presentation to SERC for approval. g. SOPs - issue is being tabled until all feedback can be obtained. Model SOPs for HAZMAT Team Standardization - clarification of goals and objectives to be worked and model SOP to be reviewed h. Survey of Volunteer Fire Department needs for HAZMAT training - this issue will be taken off the back burner and given more priority. See Page 1 for full report on these items. 7 III. TIER II RECORDS RETENTION DEM reported that EPA indicated it was a state and local decision. Language actually states to retain until records obsolete or superceded. Basically, the word was to retain records at least until the new ones arrived, but most felt that a minimum of three years was necessary. Facilities, on the other hand, have a responsibility for retaining all records to beginning of EPCRA. IV. POLK COUNTY DECONTAMINATION TRAILER - Burt McKee McKee gave a PowerPoint presentation on the trailer, but spoke about decontamination more in general. There are many DECON considerations, to include basic health issues, hygiene, countermeasures, etc. Most facilities are now capable to handle both gross and technical decontamination. Time is of the essence. The first hour following an incident is critical. V.. DISTRICT REPORTS: (Items discussed as an addendum to published HazMatters Report - A full copy of the current HazMatters Report may be obtained online at pp ) District 1: Training Subcommittee has now been divided into 2 groups - East and West. McDonald provided a CHER-Cap update which will also be given to the SERC. District 2: Hospital Decon continues in Tallahassee. Elisa Roper conducted a CAMEOfm course and the district participated in FDLE Regional Exercises on March 12 with Operation Dark Cloud. District 3: District continues to work closely with the Regional HAZMAT team. The 2 nd of 4 trailers made its 1 st HAZMAT response. Some difficulty in getting community colleges to provide credits for training from instructors other than those from Florida Fire College has been worked. District 4: May 20-21st will be two-day HAZMAT Conference to be conducted at the First Coast Technical Institute in St. Augustine. District 5: April 10 th conducted a 4-hour session on Digestive Pathology. Their Tabletop exercise for April has been cancelled. Rich Berquist of the Florida Fire College has retired and will be suitably recognized by the LEPC. District 6: Jennifer Hobbs discussed the terrible events surrounding the Columbia explosion as it affected the ground crew at the Cape. District 7: Much training being conducted. Burt McKee still involved in Operation Clean Sweep. He stated that after holding Cleansweep collection events that served 62 of Florida s 67 counties between December 2000 and May 2002, the program has been retooled to offer free pick-up and disposal of cancelled, suspended and unstable pesticides. There will no longer be collection events. The Department of Agriculture and Consumer Services, with the help of county agriculture agents, county solid waste personnel, product dealers and trade associations, is collecting names, addresses, Quarterly SERC Meetings Recap - April 3-4, 2003 p. 7

8 quantities and types from participants and will verify this information. When there is a sufficient quantity of product in a defined area, a contractor will be dispatched to each participant s farm or business facility to pick up the pesticides. A flyer provides details and instructions on how to sign up for this free pick-up service. Keith Myhre of the Department of Agriculture and Consumer Services or call him toll-free at to sign up. See the Cleansweep website at for details and a promotional flyer. Collections just started on April 1 st. More than 100 participants have signed up already, mostly in Orange, Hillsborough, Seminole, Polk and Miami-Dade Counties, but there are some in every part o the state. Pickups will continue until June 15 or until the program runs out of money. The free service may or may not be available next year depending on the Legislature s decision on the funding request, so it is important to notify potential participants. District 8: Staff accompanied DEM RMP Auditors Kunish and Malozzi in the audits of the City of Clearwater Advanced Pollution Facility and the Clorox Plant in Tampa; attended the Greater Tampa Bay Marine Advisory Council and was guest speaker at the International Shipbuilders meeting on March 21 st. Motiva/Shell is planning a large PREP Exercise at Port Tampa on June 10-12, 2003, but since this falls during the Governor s Hurricane Conference, it is unlikely that many first responders and Coast Guard personnel will be able to attend. Finally, the Chlorine Institute will hold its annual Chlorep Seminar at the Tampa Airport Hilton on November These meetings will provide everything all refresher necessary for people dealing with chlorine at all levels and workshops will provide breakout sessions for those dealing with all three types of repair kits and tanks as well as a workshop on sodium hypochlorite for those who have converted from chlorine. More information will be provided at the July meeting, but we urge you to have your utilities operators mark their calendars for this important conference. Finally, DOH has announced that some $17M may be made available this year through the Hospital HRSA grants for Awareness and Ops training to hospitals. This year, each year has submitted a training plan to DOH in Tallahassee for approval. In some cases, this plan stated only, Hire a consultant to teach the course. And, the money was approved and sent. This year, we are working with local DOH reps who are representing us in Tallahassee to request that all this money go through the LEPCs who can then schedule and provide training for all hospitals. It could be as much as $50 to $80 per DOH district. District 9: Held TRANSCAER Mini-workshop on January 29 th. A CAMEOfm workshop was also held and had good attendance. District 10: Lots of good training taking place. Had to cancel the joint exercise with the Regional Domestic Security Task Force. 9 VI. OTHER BUSINESS - a. Bill Lofgren reported that Larry Gispert, DEM representative to Region IV s Regional Domestic Security Task Force, made a presentation to the Tampa Bay Regional Planning Council regarding the need to plan and budget for replacements for the federally funded equipment and PPE gear being given to cities and counties. There is no pipeline, in that the federal grants are a onetime only appropriation and must be replaced by local funds. Now is the time for communities to begin the process of budgeting for replacements as equipment ages or is used. b. Chairman Danz attended the State Working Group quarterly meeting. c. Denise Imbler reported that the continuing grants for the HMEP program are in the cycle for renewal. Anyone desiring to propose a new planning project need to contact Denise with a Scope of Work before June. d. John Gibbons requested to know if the CAMEO workgroup would be reconstituted. There was considerable discussion about CAMEOfm and how EPA had neglected the needs of Florida when designing the program and this Florida s user fields were not active. This discrepancy is being corrected so that Florida s hazards analysis compilation process will have the appropriate user defined fields. This will be an agenda item for next meeting. e. The Transportation Security Agency (TSA) of the US Department of Transportation has proposed that placards be removed from railcars in the interest of security. Parent DOT as well as Florida DOT opposes the move. In a vote of consensus, the Staff and Chairs group voted to forward to the SERC the groups belief that placards should remain on the cards. VII.. Audit/Inspection Work Plan for the Risk Management Planning (RMP) Program for Fiscal Year (FY) (SERC Memo #09-03) The RMP Program s annual Audit/Inspection Work Plan prioritizes and identifies the facilities recommended for audits and inspections based on the audit selection criteria found in the Florida Accidental Release and Risk Management Planning (ARP/RMP) Act of 1998, Chapter 252, Part IV, Florida Statutes (F.S.). Accompanying this memorandum is the list (Table I) of facilities that are recommended for audits and inspections for FY Each year the Department of Community Affairs is required to develop an annual work plan for the SERC s review and consideration which identifies facilities for audits and/or inspections. The determination of these facilities is based on the following audit selection criteria identified in the florida ARP/RMP Act: stationary source (facility) location and proximity to population centers; chemical characteristics and inventories; stationary source accident history; process accident history; compliance or inspection by allied agency programs and the results of stationary sources self audits. Ammonia, chlorine, and sulfuric acid continue to be the three Extremely Hazardous Substances in Florida for which accidental releases are most frequently reported to the State Warning Point. Both ammonia dn chlorine are RMP-regulated chemicals. 12 ammonia and chlorine (such as cold storage/refrigeration facilities and water/wastewater treatment facilities) during FY Staff continues to monitor and compare data to prioritize facilities in need of technical assistance, compliance assistance, audits and/or inspections. This Audit/Inspection Work Plan identifies a total of 34 facilities that have been prioritized for audits based on program resources available and the criteria identified in the Florida ARP/RMP Act. The list (Table I) includes facilities with large quantities of regulated chemicals adjacent to population concentrations; facilities representative of chemicals in processes with relatively high accidental release histories (such as cold storage/refrigeration facilities; water and wastewater treatment plants; frozen fruit, juice and vegetable processing plants, fertilizer manufacturers; and chemical and allied products wholesalers and/or manufacturers); facilities subject to recent compliance efforts; and/or facilities with significant accidental chemical releases. Presentation of the Comprehensive HAZMAT Emergency Response Capabilities Assessment Program (CHER-CAP) Exercise. Presentation was made by Larry McDonald, LEPC Staff for District 1 LEPC. The Coast Guard was involved so this was a PREP drill as well with a marine related HAZMAT scenario. A very large exercise, this exercise required numerous meeting and eventually involved a number of large subcommittees. The total cost as shared by a number of organizations, to include CITGO Petroleum as the responsible party, ran close to $1.2 million which meant for every dollar of FEMA money received, there was $148 spent from auxiliary sources. A number of lessons leaned included 1) good communications; 2) local handling of the incident went well; 3) cooperation with federal, state and local agencies was good. An after-action report will be published in 60 days. 4. Update on the Emergency Planning and community Right-to-Know Act (EPCRA) and Risk Management Planning (RMP) Program Outreach and Compliance efforts (SERC Memo #10-03) The Florida Hazardous Materials Planning and Prevention Program has recently renewed its outreach efforts and enforcement actions for both the EPCRA and RMP programs. EPCRA outreach efforts include program education and technical assistance for the marina industry and additional incentives for first time filers. EPCRA staff met with personnel from the Florida Department of Environmental Protection (DEP) and the marina industry to develop a pamphlet in association with The Clean Boating Partnership Program. This pamphlet provides basic EPCRA information necessary for those marinas storing or using chemicals (mainly diesel fuel) subject to the reporting requirements of EPCRA. This outreach effort took place at the request of DEP and the marina industry after the U.S. Environmental Protection Agency (EPA) levied enforcement penalties on marinas in South Carolina. Several EPCRA How-to-comply Seminars have been conducted in association with this effort. Other coordinated efforts with the DEP include the development of procedures for DEP storage tank inspectors to disseminate EPCRA information to their facilities. A simplified version of the EPCRA Industry Brochure is being developed for this purpose. As an incentive to encourage first time Section 311/312 filers, program staff, working in conjunction with the Office of General Counsel, has drafter an agreement for facilities which, though subject to EPCRA for several years, have not come into compliance. This option is only available to those facilities that have never been notified by the SERC of their potential EPCRA reporting Quarterly SERC Meetings Recap - April 3-4, 2003 p. 14

15 obligations and that were not discovered through an investigation of a chemical release or incident. This agreement allows a facility, which has never reported previously, to come into compliance with EPCRA requirements by submitting Tier II Chemical Inventory Reports for all subject years and annual registration fees for the three most current subject years. This is similar to the self-disclosure initiative begun by the USEPA which allows first time filing facilities to self-disclose without penalty. Other outreach efforts also continue on an ongoing basis. Over 450 facilities have been identified as potentially subject to the new Section 313 Toxic Release Inventory (TRI) reporting requirements for reduced lead thresholds. Outreach materials to contact and assist in determining these facilities compliance requirements are now being developed. In addition, the Local Emergency Planning Committees (LEPCs) have requested that the Hazardous Materials Citizen s Guide be translated and printed in Spanish and that a LEPC membership brochure be developed. In addition to outreach, the program continues to maintain an active EPCRA compliance component. During the past six months 13 Final Orders were processed and mailed, eight facility compliance issues were resolved immediately prior to processing a final Order, one final Order was successfully adjudicated and four partial responses were received from other facilities. These efforts are notable in that a Final Order determination often represents six months or more of continual compliance review, verification and followup. As reported to the SERC in October, 2002, compliance efforts for the RMP program began with the investigation of 162 facilities potentially subject to RMP requirements based on maximum chemical inventory levels reported on the facilities 2001 Tier II Chemical Inventory Report. Staff determined that 43 of the 162 facilities investigated reported RMP chemicals at or in excess of the RMP Threshold Quantity (TQ). Notices of Violation (NOV) were mailed to these facilities establishing a deadline for filing a RMP. From this original effort, seven RMPs have been filed, 11 facilities reduced inventory below TQ and 11 facilities continue to be under investigation. The remaining facilities contacted either: had multiple processes in which a single process did not exceed the RMP TQ (6 facilities); used the RMP chemical as a fuel (1 facility); submitted incorrect Tier II Chemical Inventory Reports (3 facilities); concentration of the chemical did not trigger RMP reporting requirements (2 facilities); RMP chemical is a byproduct of the process and never exceeds TQ (2 facilities). Continuing investigations revealed an additional three facilities believed to be subject for which NOVs have been mailed. Representatives from facilities whose compliance status remains unclear will be invited to attend show-cause meetings to discuss their RMP compliance. This method of discussing chemical inventories, locations and applications with the facilities has proven to be very successful in accident investigations and should prove equally as useful in RMP compliance determinations. Pre-audit compliance assistance efforts are also continuing. Two on-site technical assistance visits were conducted during the quarter, both to municipalities subject to RMP requirements. These targeted compliance education and outreach programs, along with ongoing technical assistance activities, aid in making the Florida Hazardous Materials Planning and Prevention Program one of the most successful in the county. 16 5. Report of the Training Task Force (SERC Memo #11-03) Vice-Chair Don Purdue of the TTF provided a recap of the Training Task Force held earlier this date. For the SERC, he reduced the most important action items to three: a. SERC Training Guidelines - there was unanimous vote for adoption of the guidelines within both the TTF and later the Staff and Chairs, with a caveat that a booklet also be published on how the guidelines could best be used. b. The TTF will do a survey on hospital communication capabilities, what is and is not working well with the rest of the first response community. c. The TTF will contact the 44 th Combat Support Team of the Florida National Guard to increase training of first responders on the new air-monitoring equipment. A motion was made and the SERC approved by voice vote the recommendations presented by Mr. Purdue from the Training Task Force. See Page 1 for full report. 7. Financial Status Report (SERC Memo #12-03) Information was presented on the financial status of the Hazardous Materials Planning Program and the Risk Management Planning (RMP) Program for the first eight months of the Fiscal Year (FY), July 1, June 30, Table I provides a breakdown of revenues received through February 28, 2003 compared with receipts realized during FY Table II includes information regarding Hazards Materials Program s expenditures incurred by category for the first eight months of the FY through February 28, The Department has executed contracts with the Regional Planning Councils for LEPC s support and has offered counties contracts for hazardous analysis updates. Data on Table II reflect the total encumbered amounts for these contractual services. Changes transferred to the Office of the Secretary for legal support also represent the total allocation for the fiscal year. Other expense categories are consistent with projected expenditures for a five month period. Table III presents the budget allocations and expenditures to date for the RMP program. 19 7. Hazardous Materials Incidents Report (SERC Memo #13-03) The attached tables provide information on all hazardous materials incident reports received by the State Warning Point (SWP). The incident reports are reviewed by the Hazardous Materials Planning staff on a daily basis for compliance verification purposes. The information is not only useful in identifying Section 304 violators, it is also used to identify facilities which may have an obligation to report under other sections of EPCRA and the RMP programs. The following tables provide information on all District VIII hazardous materials incident reports received by the State Warning Point (SWP). The figures in Table 1, labeled Potential Section 304 Incidents, separate each incident by district for the period of March 1, 2002 through February 28, For the purposes of this summary, "Potential Section 304 Incidents" are incidents involving the release of an Extremely Hazardous Substance (EHS) or Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) chemical that are investigated by staff. In order for an incident to be covered under Section 304, the EHS or CERCLA must meet or exceed its designated Reportable Quantity (RQ) and must have potential for offsite exposure. Those facilities found to not be in compliance with all Section 304 reporting requirements will be referred to the Department of Community Affairs legal section for possible enforcement action. Increases in the number of incidents reported is a result of improved educational outreach for both the RMP and EPCRA programs. Table 2 provides a breakdown of all hazardous materials incidents for which evacuations, injuries and deaths were reported. Number of persons evacuated is provided for those incidents when this information is available. Table 3 breaks down the total number of hazardous materials incidents (Section 304 included) reported to the SWP and compares the number of petroleum-related incidents to non-petroleum incidents. Table 4 compares incidents occurring at fixed facilities to transportation related incidents Hazardous materials releases that occurred from leaking, abandoned drums or unidentified sources are accounted for under the heading of "Other."
