1 LEGISLATIVE REPORT SUBJECT: Civil service exempt positions REFERENCE: House Concurrent Resolution No. 270, H.D. 1 ACTION REQUESTED: Report on civil service exempt positions in the Department of Education. DOE REPORT: This report covers Support Services Personnel positions exempted under 76-16(b)(11)(B) and other positions exempted from civil service per 76-16(b)(3), 76-16(b)(6), 76-16(b)(9), 76-16(b)(12), 76-16(b)(17), 76-16(b)(23), and 76-16(b)(24). FINDINGS: Positions exempted under 76-16(b)(6), 76-16(b)(9), 76-16(b)(11)(B), 76-16(b)(12), 76-16(b)(17), 76-16(b)(23), and 76-16(b)(24) are listed on Attachment A. The list includes, among other data, the dates that the positions were established and the purpose of the positions. Approximately 3,200 of these positions were exempted from civil service under 76-16(b)(11)(B) and placed in the Support Services Personnel system on July 1, 2003 per Act 253, SLH The purpose of the positions are to provide student support services. Positions exempted from civil service per 76-16(b)(3) are listed on Attachment B. RECOMMENDATIONS: All positions that were exempted under 76-16(b)(11)(B), 76-16(b)(6), 76-16(b)(9), 76-16(b)(12), 76-16(b)(17), 76-16(b)(23), and 76-16(b)(24) will remain exempt from the civil service system. Positions exempted under 76-16(b)(3) will be placed into existing civil service classes, have new classes of work developed or will be abolished. Due to the current transition of the civil service system from DHRD to the DOE, the timeline for the above-mentioned actions have yet to be confirmed.
2 REPORT TO THE HAWAII STATE LEGISLATURE HCR 270 HD 1 CIVIL SERVICE EXEMPT POSITIONS IN THE DEPARTMENT OF EDUCATION The House Concurrent Resolution 270, H.D. 1, requested from the Department of Education (DOE), a report on civil service exempt positions. The report must include the following information on the positions: When the position was established; The purpose of the position; The reason for the exemption from civil service; Findings and recommendations on whether the position should remain exempt or be converted to a civil service position; and The timetable by which the specified exempt positions will convert to civil service positions. The DOE has approximately 3,200 positions which are exempted from civil service. The majority of these positions are the Support Services Personnel which transferred to the DOE on July 1, Other positions were created to comply with the mandate of the Felix Consent Decree and to provide additional services to special needs students (complete list Attachment A). Recommendations: Positions exempted under 76-16(3) (Attachment B) be placed into the existing civil service classes, have new classes of work developed, or be abolished. Due to the implementation of Act 51, the transfer of functions from the Department of Human Resources Development to the DOE, the timeline for the recommendation is not confirmed. Positions in Attachment A remain exempt from the civil service system. This recommendation is based on the shortage of personnel to fill vacant positions, the uniqueness of the positions, and the specialized training required to fill the positions.
