4 1. Introduction This Safeguarding Strategy outlines the strategic direction South Devon & Torbay Clinical Commissioning Group (SDTCCG) will work towards over the next three years. It builds on existing safeguarding arrangements for children, young people and adults, and strengthens the assurance and governance framework. This strategy relates to the statutory duties as laid out in the Accountability & Assurance Framework (2013) and Working Together to Safeguard Children (2013), to safeguard and promote the welfare of children and young people, and the particular duty to protect those adults who are less able to protect themselves from harm, neglect or abuse, as outlined in the new Care Act This strategy acknowledges the principles of multi-agency working explicit within the Children and Young People Plan, the Local Safeguarding Children Boards Business Plan and Safeguarding Adult Boards Business Plan. 2. Legislative Framework and Background Safeguarding arrangements across all agencies continue to be highlighted and criticised following tragic, high profile incidents and their subsequent enquires. In response the priority that has been given to safeguarding nationally has increased and inspection frameworks developed to enable arrangements to be monitored across all agencies working with children and adults. As the major commissioners of local health services, Clinical Commissioning Groups (CCGs) must assure themselves that the organisations from which they are commissioning have effective safeguarding arrangements in place. In order to gain this assurance, CCGs must work in partnership with health and other agencies to ensure that the most vulnerable children, young people and adults have the most appropriate services in place that can respond to their needs; ultimately preventing harm and improving outcomes. CCGs have a duty under Sections 10 and 11 of the Children Act 2004 to cooperate to improve well-being, and to ensure their functions are discharged having regard to the need to safeguard and promote the welfare of children. A child is defined under the Children Act 1989 as being under 18 years of age, therefore a child will hereafter encompass children and young people Child protection is part of safeguarding and promoting welfare. It refers to the activity that is undertaken to protect specific children who are suffering, or likely to suffer significant harm Safeguarding and promoting the welfare of children is defined as: Protecting children from maltreatment 4

5 Preventing impairment of children s health or development Ensuring that children grow up in circumstances consistent with the provision of safe and effective care; and Taking action to enable all children to have the best outcomes An adult is defined as a person who is over the age of 18 years. Adults at risk in need of safeguarding are those who have needs for care and support (whether or not the Local Authority is meeting those needs; and is experiencing, or at risk of abuse and neglect; and as a result of those care and support needs is unable to protect themselves from either the risk of or the experience of abuse or neglect. (Care Act 2014) CCGs have a duty under the Care Act 2014 Chapter 15 to cooperate generally in performing their functions related to care and support; and, supplementary to this, in specific individual cases, local authorities and their partners must cooperate in performing their respective functions relating to care and support. For the purpose of this document generic references to safeguarding relate to safeguarding children, young people, safeguarding adults and the Mental Capacity Act. This strategy does not in any way replace or negate related statutory guidance or policy referred to on page 2. This strategy takes account of the absolute necessity for effective engagement with partners involved in the design and delivery of service provision to children, young people, adults, families and communities. It acknowledges the significance of promoting and maintaining strong working arrangements with key stakeholders and with particular reference to the functioning of the CCG in collaboration with: Local children and adults as service-users and members of the community, Local healthcare service providers, Local partner agencies, Local and regional commissioning and governing bodies. Although the safeguarding frameworks for adults and children are managed separately, operationally they can often run concurrently, for example in Domestic Abuse concerns, the Multi-Agency Public Protection Arrangements (MAPPA) and the Multi-Agency Risk Assessment Conference (MARAC). Other national frameworks such as NHS England s Serious Incident Framework and the Child Death Overview Process may also be applicable. The lead agency for safeguarding children and adults is the local authority, whilst the National Probation Service leads on MAPPA, the Police lead on MARAC and the Community Safety Partnerships lead on Domestic Abuse and Domestic Homicide reviews. Health commissioners and providers are expected to contribute to all safeguarding processes and have lead persons identified to support MAPPA and MARAC and have policies in place to respond to Domestic Abuse. 5

6 SDTCCG is committed to collating comprehensive evidence to demonstrate effective working with partner agencies to improve outcomes for children and adults. This evidence will be used to support any audit work or inspections by the Care Quality Commission (CQC) or OFSTED. SDTCCG has a duty under Section 26 of the Counter-Terrorism and Security Act 2015 (the Act), to have due regard to the need to prevent people from being drawn into terrorism. The Prevent Duty: Guidance England and Wales guidance is issued under section 29 of the Act. The Act states that the authorities subject to the provisions must have regard to this guidance when carrying out the duty. 3. Our vision for safeguarding SDTCCG is committed to creating a commissioning environment where safeguarding is viewed as a positive process; maximising cross-agency working to continuously improve and promote positive outcomes. We will effectively safeguard children and adults against abuse, neglect, discrimination, embarrassment or poor treatment. We aim to create an environment where all people, including those in local authority care are enabled to achieve their potential, to be empowered, respected and lead confident and happy lives. We know we will have achieved our vision when: People who live and work in South Devon and Torbay know what signs and indicators of abuse and neglect to look for and who to contact for advice and support Local organisations work together, responding in a timely and effective way to concerns about abuse or neglect Staff share information at the right time, with the right person, enabling appropriate early action to be taken in order to safeguard children and adults at risk of, or suffering significant harm Children and adults have access to the support and services they need Children and adults have their voices heard within safeguarding procedures and services and we maximise their rights to choice and control, within the confines of their mental capacity and competence Children and adults are protected when necessary and have improved quality of life as a result 4. Our Aims SDTCCG s commitment to safeguarding children and adults is reflected in a strategic approach with overarching aims that serve to steer and inform on-going programmes of work and day-day Safeguarding business and as such enable SD&TCCG: To commission services that ensure all children and adults who are at risk of abuse or neglect are kept safe and free from harm To enable the Governing Body to fully apply its statutory responsibilities that came into effect 1 st April 2015 as a result of the statutory framework for 6

7 safeguarding adults outlined within the Care Act 2014 and associated Care and Support Guidance 2014 To discharge statutory functions To encourage, embed and maintain best safeguarding practice across South Devon and Torbay To adeptly steer and influence local healthcare service planning and delivery for the promotion of good health, positive life experience and minimisation of the likelihood of harm To ensure compliance with local and national policy and reporting procedures To develop and implement systems for quality monitoring and assurance that are robust, effective and auditable To raise awareness about safeguarding and embed it into practice, making it everyone s business To effectively contribute to multi-agency approaches such as the MAPPA and MARAC processes To facilitate the effective alignment of multiple reporting / investigative streams and processes, such as NHS England Serious Incident reporting framework 2015 and Child Death Overview Process to prevent confusion regarding the primary process and facilitating effective communication. To actively facilitate and support the application of learning across the health economy from the findings of enquiry, audit, inspection and review in order that safe practice and professional competency can be continuously enhanced. To ensure partnership working and continued contribution to the work of the LSCBs and LSABs 5. Leadership Following an unprecedented organisational change in the commissioning of healthcare, SDTCCG has continued to build upon the positive relationships with strategic partners, in order to safeguard children and adults. We consider effective leadership, a learning environment and empowered staff as cornerstones to a positive safeguarding culture, which underpins our own commissioning workforce, along with the way in which we commission other health services. SDTCCG has developed core values and principles which strengthen the functioning of the whole safeguarding team, and clear structures are now in place to underpin that function. The Director of Wellbeing & Families is the Executive Lead for Safeguarding, supported by a Designated Adult Safeguarding Manager (Nurse), a Designated Nurse for Safeguarding Children and a Designated Nurse for Looked After Children. Both Designated Nurses for Children work closely with the Designated Doctors, who are aligned with the CCGs through SLAs within their contracts. The Designated Professionals for children will: 7

8 Provide leadership, support and clinical advice and expertise in matters relating to safeguarding and children in care; Advise how services should be commissioned to safeguard children; Assure the quality of safeguarding across commissioned services; Facilitate the implementation of legislation, audit and Review recommendations Work in partnership with all agencies and the Local Safeguarding Children Boards Lead innovation and change to improve safeguarding across the health economy The Designated Adult Safeguarding Manager (Nurse) will: Manage Safeguarding adult investigations of health commissioned service where the incident involves individual(s) with complex needs.; monitor the progress of cases to ensure that they are dealt with as quickly as possible, consistent with a thorough and fair process Maintain regular contact and effective working relationships with their counterparts in partner organisations. Report on the extent to which their own organisation prevents abuse and neglect taking place. Provide advice and guidance on safeguarding within their organisation, liaising with other agencies as necessary. Work with care and support providers and other service providers to ensure that referral of individual employees to the DBS and, or Regulatory Bodies (e.g. CQC, HCPC, GMC, NMC) are made promptly and appropriately and that any supporting evidence required is made available. Ensure that systems are in place within provider organisations to support employees and teams going through Safeguarding investigations. Ensure that appropriate recording systems are in place that provide clear audit trails about decision-making and recommendations in all processes relating to the management of adult safeguarding allegations; ensure the control of information in respect of individual cases is in accordance with accepted Data Protection and Confidentiality requirements. In addition, the CCG employs two GP Clinical Leads; one for Patient Safety and Quality/ Safeguarding Adults and one for Safeguarding Children. The CCG, supported by NHS England, have appointed a Safeguarding Nurse for Primary Care, who will sit within the Safeguarding Team and work closely with the Clinical Leads to provide safeguarding support to Primary Care Teams within our geographical footprint. This is a key step towards developing more effective working relationships with the Safeguarding Leads and their teams within our member practices, ensuring that they and their expertise is visible within all safeguarding processes. The development of a Directorate for Wellbeing and Family Services Commissioning, within which the Safeguarding Team will sit, further demonstrates the commitment to safeguarding and will only serve to strengthen the relationship with commissioning services. 8

9 An Accountability Framework has been developed and disseminated, and is available on the CCG website, to ensure all staff are aware of who to contact should they have concerns about any children or adults. 6. Principles for safeguarding children Working Together to Safeguard Children (2013) clearly sets out how organisations and individuals should work together to safeguard and promote the welfare of children in accordance with the Children Act (1989/2004). The principles for safeguarding children are linked with these Acts and those within the United Nations Convention on the Rights of the Child, which was ratified by the UK Government in 1991, and as such will guide the work of SDTCCG. Health professionals and organisations have a key role to play in safeguarding and promoting the welfare of children. The general principles that apply are: SDTCCG will ensure there is Board level focus on the needs of children and that safeguarding children is an integral part of their governance systems, aiming to ensure that all children who are at risk of, or who are suffering significant harm receive timely and appropriate preventative and therapeutic interventions. Those professionals working directly with children should ensure that safeguarding and promoting welfare forms an integral part of all stages of care they offer Those professionals who come into contact with children, parents and carers in the course of their work also need to be aware of their safeguarding responsibilities SDTCCG will ensure that all health professionals can recognise risk factors and contribute to reviews, enquiries and child protection plans, as well as planning support for children and providing on-going promotional and preventative support through proactive work 7. Principles for Safeguarding Adults The Care Act 2014 makes provision to reform the law relating to care and support for adults and the law relating to support for carers. It also makes provision about safeguarding adults from abuse or neglect, providing the first statutory framework for safeguarding adults in England. It is has replaced the majority of the previous multiple legal frameworks for social care, including:- Carers Legislation; the National Assistance Act 1948; Health Services and Public Health Act 1968; Chronically Sick and Disabled Person Act 1970; Disabled Persons Act 1986; NHS and Community Care Act 1990; No Secrets 2000; Health and Social Care Act 2001; and Section 254 and Schedule 20 of the NHS Act

10 Putting people first is critical to safeguarding and underpins the six safeguarding principles for achieving good outcomes: Principle 1: Empowerment Personalisation and the presumption of person led decisions and informed consent Principle 2: Prevention It is better to take action before harm occurs Principle 3: Proportionality Proportionate and least intrusive response appropriate to the risk presented Principle 4: Protection Support and representation for those in greatest need Principle 5: Partnerships Local solutions through services working with their local communities. Communities have a part to play in preventing, detecting and reporting abuse and neglect Principle 6: Accountability Accountability and transparency in delivering safeguarding 8. PREVENT Healthcare professionals will meet and treat people who may be vulnerable to being drawn into terrorism. Being drawn into terrorism includes not just violent extremism but also non-violent extremism, which can create an atmosphere conducive to terrorism and can popularise views which terrorists exploit. The key challenge for the healthcare sector is to ensure that, where there are signs that someone has been or is being drawn into terrorism, the healthcare worker is trained to recognise those signs correctly and is aware of and can locate available support, including the Channel programme where necessary. Preventing someone from being drawn into terrorism is substantially comparable to safeguarding in other areas, including child abuse or domestic violence. In fulfilling the duty, SDTCCG and healthcare providers must demonstrate effective action in the following areas. Partnership Risk Assessment Staff Training Monitoring and Enforcement SDTCCG will continue to work in partnership with Devon and Torbay local authorities and NHS England to achieve its duties as identified within the Guidance and Building Partnerships-Staying Safe, issued by the Department of Health and Social Services, which provides advice to healthcare organisations on their role in preventing radicalisation of vulnerable people as part of their safeguarding responsibilities 10

11 9. Priorities for Safeguarding Children The new Directorate of Wellbeing & Families will be responsible for providing the safeguarding children, young people and adult functions within the CCG, and for aligning those functions to the commissioning of care encompassing both physical and mental health. It is anticipated that SDTCCG will become a co-commissioner of Primary Care Services with NHS England in the near future. Co-commissioning responsibilities are expected to include responsibility for safeguarding within Primary Care. The newly developed role of the Primary Care Safeguarding Nurse (funded by NHS England) will be instrumental in assisting the CCG to undertake these responsibilities and to support the Independent Contractors to achieve compliance. The key priorities for the Safeguarding Children Team for are: To focus on achieving improvement in services for Looked After Children and Care Leavers To continue to be an active member of the Corporate Parenting Boards and contribute to workplans to achieve improved outcomes for Looked After Children and Care leavers To ensure that Looked After Children have their health needs fully assessed, that they have a health plan in place which is regularly reviewed and that they have access to a range of health services to meet their needs To work closely with the Safeguarding Adult professionals to ensure that the issues around Domestic Abuse (DA), PREVENT, Female Genital Mutilation (FGM) and Child Sexual Exploitation (CSE) remain high on the Safeguarding agenda To ensure that appropriate representation is made at all relevant DA, PREVENT, FGM and CSE Forums, thus informing the development of commissioning services for these priority issues To ensure there is senior management commitment to the safeguarding children agenda, providing a clear line of accountability within the organisation which supports the completion of the work plan over the next three years To develop and embed the CCG Training Strategy which will ensure all members of the CCG will be trained to the appropriate level of safeguarding appropriate to their role, as set out in the Intercollegiate Document To ensure that all staff across the health economy are work in close collaboration with multi-agency partners, sharing information in a timely way allowing real time risk assessments to enhance decision making To ensure that CCG staff are trained and competent to be alert to potential indicators of abuse and neglect in children, and know how to act upon their concerns 11

12 To ensure that organisations commissioned by the CCG can demonstrate that their staff are trained and competent to be alert to potential indicators of abuse and neglect in children, and know how to act upon their concerns To develop monitoring systems for safeguarding training and development to all Providers of NHS funded care To strengthen the working relationship and leadership with our children s Social Care partners, and ensure equity of expertise across South Devon and Torbay To continue to be full and active members of the LSCBs, contribute to the work plan and ensure the Board meet its statutory responsibility To ensure that lessons learnt from Serious Case Reviews and Child Death Overview processes are shared appropriately and embedded in practice To ensure that children and families are actively involved in decisions about service development in order to safeguard and promote the welfare of children To ensure that progress against Action Plans from Section 11, CQC Reviews, Serious Case Reviews are monitored for Provider services and the CCG To influence and support systems and practice that enables General Practice and other Independent Contractors to be more effectively engaged in Safeguarding Children practice 10. Priorities for Safeguarding Adults To continue to be full and active members of the LSABs. To implement the Care Act 2014 and associated Care and Support Guidance 2014 within the CCG, ensuring compliance on all areas including self-neglect and domestic violence and abuse To implement the recommendations following the House of Lords Select Committee review of the MCA and the Supreme Court Judgement regarding Cheshire West ensuring compliance To continue to contribute to the programme of work associated with the existing DSAB and TSAB Business Plans and its priorities, ensuring that evidence is available which informs on activity and outcome. To ensure that healthcare services engage appropriately in the multi-agency work programmes, including multi-agency audits and that activity and outcomes from such are understood. To ensure that lessons learnt from Safeguarding Adult Reviews (replaces serious case reviews) and Domestic Homicide Reviews are considered and timely applied in accordance with need and that information is available which evidences overall impact on system and practices. To continue to support the provider organisations to engage and contribute to multi-agency arrangements with regard to safeguarding alerts and to understand the impact and outcomes from such activities. To continue to support providers with the application of Deprivation of Liberty Safeguards and associated case law. To attend to findings arising from internal audit of SDTCCG Safeguarding arrangements, ensuring that learning is duly applied. 12

13 To ensure that the Action Plans formulated by provider organisations from the findings of multi-agency audits are monitored and acted upon To progress the work associated with the PREVENT agenda, ensuring alignment in contracts for provider services and associated work programmes as a result of such. To ensure that healthcare services are effectively engaged in the local multiagency domestic abuse agenda and that activity and outcomes of such are understood. To work closely with the Safeguarding Children professionals to ensure that the issues around Domestic Abuse (DA), PREVENT, Female Genital Mutilation (FGM), Child Sexual Exploitation (CSE) and slef-neglect remain high on the Safeguarding agenda To ensure that healthcare service needs of adults in care homes, with particular reference to Nursing Homes, are met by partner agencies. To influence and support system and practice that enables General Practitioners and other independent contractors to be more effectively engaged in safeguarding adult processes. To ensure that appropriate representation is made at all relevant DA, PREVENT, FGM, CSE and self-neglect Forums, thus informing the development of commissioning services for these priority issues. To ensure that all staff across the health economy are work in close collaboration with multi-agency partners, sharing information in a timely way allowing real time risk assessments to enhance decision making 11. Achieving our Aims To demonstrate the success of the vision and strategic aims, SDTCCG will: Support the Safeguarding team to be visible, proactive and available to all staff within the organisation as required, and ensuring they provide regular reports into the SDTCCG Quality Committee and Governing Body on progress, challenges, risks and successes Maintain a proactive membership of both Torbay and Devon Safeguarding Children and Adult Boards and their sub groups as required, providing support and challenge when appropriate Ensure a robust monitoring of safeguarding assurance frameworks in health providers is in place, with a system for escalating shortfalls Maintain a robust accountability and governance structures across the organisation that are explicitly understood by local healthcare and partner agency organisations and that are well utilised Commission and monitor healthcare services that must demonstrate appropriate safeguarding arrangements are in place by which to serve children and adults across their organisations 13

14 Work closely with healthcare provider organisations to influence, support and monitor their ability to most effectively safeguard children and adults from harm, abuse and neglect and by taking action when concerns regarding an ability to do so arise Embed strong Working Together arrangements with partner agencies in order that children and adults can be most ably supported with their safeguarding needs Engage with other commissioning sites at local, regional and national levels to support the Safeguarding agenda relating to children and adults as afforded to the commissioning bodies Liaise and network with neighbouring healthcare organisations in order to gauge local progress and to encourage innovation in practice Embrace external and internal review of healthcare service provision for assurance of safe system and practice and to influence positive outcomes in response to any local findings for improvement and development 12. Training CCGs are statutorily responsible for ensuring that the organisations from which they commission services provide a safe system that safeguards children and adults at risk of abuse or neglect, and staff need to be competent as to a level as identified within the Training Needs Analysis to ensure that safeguarding underpins all commissioning and assurance processes. The Training Needs Analysis is based on the core competencies detailed within the Intercollegiate document Safeguarding children and young people: Roles and competencies for healthcare staff" March 2014, which states "All non-clinical and clinical staff who have any contact with children, young people and/or parents/carers should be level 2 trained and the National Competence Framework for Safeguarding Adults (Bournemouth 2010), analysis of SDT CCG roles have identified that all staff should be trained to a minimum of level 2 for both safeguarding adults and safeguarding children. The analysis recognises the contact that all levels of SDT CCG staff potentially have with members of the public in the course of their work, either on an individual basis or during public consultations. Training all staff to level 2 competence will enable SDT CCG to fulfil its statutory accountabilities and responsibilities in relation to its functions as a commissioning organisation, by ensuring staff are suitably equipped to provide advice to those who disclose allegations of abuse during the course of their work, or enable challenge to providers from a predetermined knowledge base. SDT CCG recognises the requirement for GP members to undertake Level 3 training for their clinical roles, and do not expect additional training for these members unless they sit on the Governing Body and require level 6. 14

15 The analysis also recognises that some staff will need training to Level 3 or above, dependent upon their role and potential for being engaged with safeguarding adult processes. Face to face training is the preferred method for safeguarding training, however we acknowledge that this may not be possible for all members of staff. In this situation ESR Level 2 is available with the CCG slides to provide local details. Levels 1 and 2 will be provided in-house. The remaining levels will be accessible through the Safeguarding Boards training programmes. The intercollegiate guidance, Safeguarding Children and Young people: roles and competences for health care staff includes Prevent information and identifies competencies for all healthcare staff against six levels Measuring our Success Safeguarding Standards are embedded within Provider Contracts, a robust reporting system is in place that enables the Quality Lead for the contract to highlight any positive trends or escalate risks to the Designated Nurses/Manager for Safeguarding Children/Adults All providers commissioned by SDTCCG report against Safeguarding Children Standards through the Safeguarding Dashboard, which is reviewed monthly by the Safeguarding Children Team. All providers commissioned by SDTCCG report against the Safeguarding Adults Operating Principle and against standards agreed by Torbay and Devon Safeguarding Adults Boards The Designated professionals lead workstreams associated with external inspection and scrutiny of Safeguarding arrangements, including the Section 11 declaration (Children Act 2004) and ADASS Safeguarding Adults selfassessment tool ensuring that any identified areas for improvement and development receive due attention The Designated professionals, on behalf of SDTCCG, participate in Serious Case Reviews, Safeguarding Adult Reviews, and Domestic Homicide Reviews as appropriate, and ensure that relevant actions from findings and recommendations are reflected in the Safeguarding Action Plans The Designated professionals ensure that progress against Actions Plans is monitored through monthly team meetings, with regular updates to the Quality Committee, highlighting achievements and risks as appropriate SDTCCG co-ordinates a system of reporting and governance when serious incidents relating to local Safeguarding concerns arise 15
