3 INTRODUCTION This CLIENT HANDBOOK is provided to help clients understand the rules and regulations of the program and expectations for successful completion. Clients are expected to follow and comply with all rules and regulations. A copy of this is maintained at the Security Station and may be checked out for review at any time. If a client needs help understanding this, a staff member will provide assistance. Clients are responsible for checking written general orders, facility schedules and any other written materials posted or made available at the Security Station or throughout the Work Release Facility. Clients are responsible for their actions and will be held accountable. Failure to abide by the rules and regulations of the Work Release Program may result in transfer to the Weld County Jail to serve the remainder of their sentence(s). Protection of Client Rights: Staff will ensure a client s constitutional rights are afforded to them and that clients are treated firmly, fairly and consistently. These rights include: Freedom from discrimination based on race, religion, national origin, gender, gender orientation, disability, or political beliefs; Equal access to programs and work assignments (as applicable) and reasonable involvement in decisions on supervision status; Protection from personal abuse, corporal punishment, personal injury, disease, intentional damage of property, and harassment; and Freedom from reprisals or penalties for seeking administrative or judicial remedies. Clients who have disabilities will be given reasonable and necessary accommodations to assist them through the program. 3

4 SECTION 1: PLACEMENT AGREEMENT RULES Clients understand the and Placement Agreement will remain in effect until their final discharge from the Work Release Facility. All clients are required to read this, sign and follow their Placement Agreement. Failure to abide by the rules and regulations of the Work Release Program may result in disciplinary action and/or regression from the program. 1.1 Clients will abide by all Court orders and Probation terms and conditions (as applicable). 1.2 Clients will provide documentation of their identity and authorization to work in the United States. 1.3 Clients will abide by all municipal, state or federal laws. Clients issued a citation, summons or arrested by a law enforcement officer may be in violation of their placement and a conviction is not always necessary. Illegal activity may be reported to a court of law for further criminal proceedings. Clients will report any law enforcement contact to staff immediately. 1.4 Clients will be courteous and respectful in all interpersonal relationships and interactions; verbal or physical abuse will not be tolerated. 1.5 Clients will follow all reasonable instructions and directives given to them by Work Release personnel. 1.6 Clients will be honest and not misrepresent any information to any person and/or on any document. 1.7 Clients understand that intimate contact with other clients, visitors, or staff, with or without the other person s consent, is prohibited. 1.8 Clients will not possess or consume alcohol, Spice, marijuana or products containing THC. No controlled substance possession or use except for medication currently prescribed by a physician. Clients will turn in all prescribed medications to staff immediately and will consume, ingest or otherwise use as prescribed and in the direct, visual presence of staff. 1.9 Clients will participate in substance use monitoring and according to specified time frames, as directed by staff Clients will participate in electronic monitoring, as directed by staff, and perform equipmentoperating instructions as given and directed Clients will submit to a search of their person, property or vehicle (when said vehicle is on the grounds of the facility), upon the request of staff, with or without notice. Clients understand their personal property is subject to seizure if it violates any terms of the and/or Placement Agreement Clients will not possess or introduce contraband into or on the grounds of the Work Release Facility. 4

5 1.13 Clients will not possess or use any firearms, explosives, destructive devices, or any other article as a weapon or weapons Clients will actively participate in any program or service, as a condition of their sentence and placement Clients understand that they are required to sign in and sign out of the facility; clients will notify on-duty staff immediately before leaving and immediately when entering the facility Clients will be at their designated place of assignment (work, facility, or when on temporary leave from the facility) and will travel directly to and from their designated place of assignment by the approved method of travel, route and time. Clients will notify staff of any changes to their work schedule and must receive prior approval of such changes before signing out of the facility. Clients will make themselves available for periodic phone, direct or remote checks by staff of their whereabouts. Should clients encounter a situation, which prevents them from returning to the facility by their prescribed time, clients will immediately call the facility for instructions from staff. Should a client s work, school or approved attendance to an event in the community terminate ahead of schedule, the client will immediately and without delay, return directly to the facility Clients understand that failure to return to the facility as scheduled or not being at their designated place of assignment may place them on escape status, as defined by Colorado law Clients are responsible for their own medical and dental care, and will inform staff of any and all appointments Clients will seek, secure and/or maintain gainful employment or otherwise approved equivalent. All employment and educational programs shall require staff approval and meet at least basic requirements according to law. Clients will inform staff when quitting or changing a job or educational program Clients sentenced in Weld County agree to pay $15.00 per day for room and services. Out of County clients, agree to pay $27.00 per day. Clients will not cash their paycheck or other form of payment for approved employment, without the prior approval of staff. Clients will not possess any unauthorized funds; accept any financial aid, loans or gifts or enter into any contracts, agreements without staff approval Clients will keep themselves, their property, their sleeping quarters and assigned bedding materials and all common areas in and around the facility, clean and orderly. Clients will participate in daily cleaning assignments Clients will provide staff documentation of the following before considered and/or approved to operate and park a motor vehicle at the facility: (a) valid Colorado Driver s License; (b) valid vehicle insurance; (c) valid vehicle registration and (d) compliance with any driving restrictions. Clients will follow all requirements of the Work Release Parking Permit process and maintain requirements as current. 5

6 1.23 Clients will present all property to staff before entry into the facility. Clients will place their property in their assigned lockers and secure them with staff issued padlocks. Clients understand that they are responsible for the safety and security of their property. Exchange of personal property between clients is prohibited, unless approved by staff. Clients will not damage any property in or out of the facility. Clients will only use property or items throughout the facility as intended. If transfer to the jail terminates placement, clients will ensure their property is picked up within 30 days. If placed on escape, the client s property will be held for 30 days and only released upon the client s apprehension. Any property not picked-up within the designated time frame will be considered as abandoned and Work Release staff shall dispose and/or donate the client s property Clients will not act in such a manner, through individual or complicit behavior, to interfere or hinder with program operations that would jeopardize the safety and well-being of any persons associated with the program and/or to the Work Release Facility. Clients understand that violation of this Handbook and with the Placement Agreement may constitute a violation of their sentence and placement, and that they may be transferred to the Weld County Jail to serve the remainder of their sentence and/or for other proceedings. Clients hereby authorize Weld County personnel to exchange information with other agencies of the 19 th Judicial District (or judicial district where they were sentenced) that may have interest in or be associated with their sentence and placement. Clients hereby release Weld County, Weld County Justice Services, the Weld County Sheriff, its officials, employees and agents, from any and all liability, loss, damage, claim, demand or cause of action, whether the claim is based on negligence or otherwise, that may arise out of their sentence and placement under their Placement Agreement. 6

7 SECTION 2: HOUSING 2.1 Clients will be assigned to a bunk bed and specific housing area in the facility. Unless for documented medical, safety or supervision purposes, clients will not be assigned to a different living area. Male clients are not allowed in designated female living areas and female clients are not allowed in designated male living areas. 2.2 Daily inspections of client sleeping, restroom, and living areas will be conducted by staff to ensure that all are orderly and clean. Inspections will occur a minimum of once per shift (day and night). Both inspections must pass satisfactory expectations of staff in order for clients to obtain one (1) Earned Time release hour credit for that day. Results will be posted at the Security Station nightly after both inspections have been completed. 2.3 Clients must make their bunk beds daily and anytime when they are not sleeping in them. The mattress cover must be fitted onto the mattress. The blanket shall cover the entire mattress and tucked under both ends and both sides of the mattress to make a firm, flat surface. The extra blanket must be neatly rolled or folded and centered in the middle or at the end of the mattress. The pillow will be neatly centered at the head of the bed. Nothing else is allowed on the bed, under the bed or under the mattress pad. 2.4 Each morning, clients must clean around their bunk bed and living area. Except for shoes or slippers, nothing is to be kept on the floor, bed or side chair. Clothing must be neatly folded and organized in the client s assigned drawer or hallway locker. All personal property beyond the main security checkpoint must be contained in the client s assigned bunk drawer or hallway locker. Property that does not fit in these spaces must be disposed of, released to an approved person outside of the facility, or removed from the facility by the client upon their next sign out. Staff will confiscate any property not fitting into these spaces, or for purposes deemed as contraband. 2.5 Visitors are not allowed in the facility and clients are not allowed to have items brought to, or picked up from the facility without prior staff permission. There are no visitation times within the facility or premises. 2.6 Excessive loitering, or waiting in the lobby or front locker area is prohibited. 2.7 Puzzles, games and cards are authorized to be used by clients with staff approval. These items are allowed in the Day Rooms only. Gambling, and any items intended for gambling purposes, are prohibited in the facility. 2.8 Books, newspapers and magazines are authorized for use by clients with staff approval. (Current day newspapers and magazines less than two (2) months old are allowed in the Day Rooms only.) 2.9 Work Release and/or approved client property is to be used only for its intended purpose(s) All lights, doors, stairways, and hallways are to be kept clear of items and/or debris at all times. 7

8 2.11 Shakedowns are searches for possible contraband. They are done as deemed necessary by staff, they may include but are not limited to living areas, bunk drawers, and lockers. Personal searches of clients may occur at any time deemed necessary and will be done by staff of the same gender. General non-contact personal searches may be performed upon any client and by any staff. If deemed necessary, strip searches may be conducted but only at the direction of the AP Director. Two (2) supervisory personnel of the same gender as the client shall conduct these Sitting is allowed only in chairs, couches or on bunk beds. Sitting on the floor, table tops, etc. is prohibited. Clients will keep their feet off walls and furniture, including tables Defacing or breaking facility property, internal or external, is prohibited Clients may not hang, affix, or display anything to the building structure or furniture to include any bunk bed frames, lockers, etc Clients will dispose of trash in proper containers. Littering, inside or outside of the facility, including cigarette butts is not allowed Day Room furniture must remain in the Day Room. Furniture in the Day Room must be neatly kept and properly positioned at all times. TV s shall remain off when clients are not present for viewing. Upstairs Day Rooms are not restricted by housing unit or POD Unless otherwise approved, clients must use the restroom they are assigned to clean. Clients are not authorized to use the staff or public restroom in the lobby unless otherwise directed by staff Clients are expected to maintain good personal hygiene and must shower at least four (4) times a week Clients are responsible to keep noise levels in the facility at a minimum. Clients are expected to keep speaking and television volume only loud enough to be heard. Unnecessary noise such as pounding on the walls, floors, ceilings, doors or windows is not allowed except as may be necessary to alert someone of a safety or security emergency. The sleeping areas are considered quiet zones, there is to be limited noise in these areas. Exceptions only include situations involving the safety and security of the clients and staff Silence will be maintained during facility lockdowns and in the sleeping areas at all times. Unscheduled lockdowns may occur at any time. When a lockdown is announced, clients must immediately go and sit quietly on their assigned bed and wait for further instructions. Clients are expected to stay on their assigned bunk during a lockdown except to use the restroom and as approved by staff There is one scheduled lights out in the facility nightly. Lights out in the sleeping areas is from 11:00 P.M. to 5:00 A.M. nightly. Clients are required to remain on their assigned bunk during this time except to use the restroom. 8

9 2.22 Clients scheduled to return from work after 10:00 P.M. are allowed to stay up two (2) hours later than their scheduled return time Clients scheduled to check out to work before 5:00 A.M. are allowed to be up one (1) hour before their scheduled checkout time In the event of an emergency (e.g. fire, tornado, severe weather, etc.), clients will remain quiet and await staff instructions based on the type of emergency. During any evacuation, clients are not to go to their locker, talk on cell phones or smoke cigarettes. When alarms sound, clients are to proceed to the nearest common exit. Secured exits should only be used in the case of imminent threat or danger as the door alarms will sound. Outdoor evacuations will proceed to the east side of the facility parking lot. Clients will be directed to the first floor for indoor evacuations. Staff may lockdown the facility or restrict client travel for other types of emergencies. 9

10 SECTION 3: CLOTHING, LINENS & LAUNDRY 3.1 Clients must wear a shirt, pants, and footwear at all times in the facility. Shirts must be buttoned, pulled over and/or zipped up and pants must be worn over the hips and waist. No clothing that exposes breast/chest areas, genitals or buttocks. By design, manner worn, or due to the absence of, allows the anatomical detail of the client s body parts or midriff to be clearly viewed (e.g. tank tops, etc.). No sheer, transparent, or excessively tight clothing. Dresses/skirts are acceptable, but must extend to at least 2-3 inches above the knee. No article of clothing shall display alcohol advertisements, drugs, gang affiliation, offensive language, or nudity of any sort. Clients are not to cover their head or face while in the facility; sunglasses, and hats are not allowed beyond the main security checkpoint. Wigs, hairpieces, religious veils are permitted with the prior review and permission of the AP Director or designee. Any article deemed unacceptable by staff will be confiscated and removed from the facility. 3.2 Pajamas are authorized and must be worn only in the sleeping areas and designated bathrooms. Clothing Allowed 3.3 Clients are expected to have only enough clothing, (everyday clothing and work clothing), to last seven (7) to ten (10) days. Clothing shall be brought in large collapsible bags; there is no storage space for suitcases. Clients are expected to bring with them their clothing at their initial intake and arrival at the Work Release Facility. All clothing brought into the facility will be run through the facility dryer on high heat. After initial intake, and upon the approval of the Shift Supervisor, additional storepurchased clothing will be allowed into the facility with the store tag intact and the purchase receipt present, this includes gently used clothing from second-hand stores. All clothing will be of good quality. Staff will inspect all clothing. 3.4 Approved clothing in the Housing Units includes the following: Shirts Pants Belt T-shirts Work clothing/uniforms One pair thermal underwear (top and bottom) One pair shoes One pair slippers Socks Pantyhose or nylons (female only) Pajama top Pajama bottom 10

11 Underwear Bras (female only) One chain or necklace with a religious medallion or icon no larger than 1.5 Wrist watch One ring Linens 3.5 Bedding: Standard bedding is provided to all clients by the program. Issued blankets and linens are to be laundered by client Facility Workers designated by staff and within the facility. These items shall be exchanged weekly on a one-for-one basis. Clients are not allowed to bring in their own bedding and there is no cost to clients for these laundry services. Extra bedding is only allowed and provided for medical reasons as documented by a physician and specifying additional bedding required. Items provided by the Work Release Program to clients shall include: One (1) mattress One (1) mattress cover Two (2) blankets One (1) pillow One (1) pillowcase 3.6 Towels: The program does not provide towels. Clients must use personal towels, not to exceed two (2) towels. Laundry 3.7 On-site coin-operated laundry facilities are provided and clients are expected to launder and wear clean clothing. All personal laundry must be done using the provided washers and dryers. 3.8 All laundry, including towels, wet or dry must be kept in the client s designated locker or bunk drawer. 3.9 Any laundry taken out of the facility will not be allowed back into the housing unit. 11

12 SECTION 4: PROPERTY ISSUED AND ALLOWED 4.1 Each client will be assigned one (1) hallway locker and one (1) bunk drawer in his or her designated housing area of the facility and one (1) locker in the front lobby locker room area. The front lobby locker room area is intended for coats, work shoes, and other items not allowed past the security checkpoint and into the housing areas of the facility. Clients must remove personal property any time it exceeds the space allowed for it. 4.2 Clients must keep their property locked and secured at all times using the issued three (3) combination padlocks for their lockers. Clients are not to use their own locks. DO NOT give your combinations to anyone for any reason. 4.3 There is no expectation of privacy in any locker, bunk drawer, container or any area of the facility. All areas are subject to unannounced search at any time, clients will keep themselves, and areas neat and orderly at all times. 4.4 Staff reserve the right to confiscate cell phones or scan usage activity based on suspicion of illegal and/or non-compliant behavior and with prior acknowledgment by the client. 4.5 Clients that are regressed from the program or arrested outside the facility must arrange to have their property picked up within 30 days. After 30 days, all remaining property will be inventoried by staff, donated to a local charity and/or destroyed. If a client escapes from the facility, the client s property shall be held for 30 days before being considered abandoned and will be donated to a local charity and/or destroyed. Escapee property shall only be released upon client apprehension within the 30-day property hold. 4.6 ALLOWABLE Items in the Housing Units past the Security Checkpoint Hygiene Items: One (1) container: Body Lotion One (1) shampoo container One (1) container: Hair Conditioner One (1) box of tampons and/or pads for feminine hygiene One (1) toothbrush One (1) tube of toothpaste One (1) toothbrush holder One (1) Chapstick One (1) disposable razor, and non-alcohol shave cream One (1) comb, pick or hairbrush One (1) deodorant (non-aerosol) One (1) bar of soap One (1) soap holder One (1) small container of mouthwash, alcohol free One (1) contact lens case with cleaning solution One (1) nail clippers One (1) tweezer 12

13 One (1) small box of Q-Tips Beauty Items: One (1) container: Hair Spray, non-aerosol, pump only One (1) set of sponge type hair rollers Up to five (5) Hair Barrettes or similar hair care devices One (1) Hair Dryer One (1) Curling Iron Cosmetics may only be brought into the housing unit at program entry. Thereafter, only sealed new make-up with a store receipt will be permitted into the housing unit. Makeup or containers with mirrors or glass are not permitted. Medical documentation may be required of the client before use. For example, an item for a sleep disorder or a breast pump for a new mother. 13

14 SECTION 5: CONTRABAND 5.1 PROHIBITED IN THE FACILITY: Contraband is anything that has not been provided or approved for entry into the Weld County Work Release Facility. Clients involved in any way attempting to introduce, the actual introduction of, or possession of contraband in the facility, will face disciplinary action and/or criminal charges. Contraband will be confiscated, documented, held as evidence or destroyed/discarded. Contraband items include, but are not limited to: Weapons of any type (including scissors, etching tools, martial arts weapons, or other sharp instruments) or simulated weapons. Illicit drugs Prescribed medications not checked in at the Security Station Alcohol beverages or products containing alcohol Any Cannabis products or Spice Any drug paraphernalia Any device or material used to manipulate a breath or urine sample result Counterfeit documents or identifications not belonging to the client Money that cannot be traced or verified Credit/Debit cards or other financial transaction documents not belonging to the client Tattoo devices (including giving or receiving) Any form of gambling materials Non prescribed inhalants Any pornographic materials Glass containers Hair or beard clippers or trimmers Microwavable Popcorn Nail Polish Hair Dye 5.2 PROHIBITED IN THE HOUSING UNIT: These items are allowed in the facility; however, they become contraband in the housing unit past the security checkpoint. These items must be stored in the client s assigned locker in the front lobby area. At the security checkpoint, all items going into the housing unit must be declared and available for staff inspection. The below list of items must be stored in the front lobby locker, also called contraband locker: Cell Phones, items or devices with screens, internet access, or computer attributes Personal video game devices, televisions, tablets, DVD/Blu Ray players, or computers Any item (hygiene or otherwise, but strictly not including for consumption in any way) that contains alcohol Lighters or matches Tobacco or simulated tobacco products Chewing Gum Perishable food or drink not otherwise provided in the facility vending machines Wall mountings, personal decorations or pictures in sleeping areas 14

16 SECTION 6: FOOD SERVICES 6.1 Clients are responsible to provide for their own meals while residing at the Work Release Facility. 6.2 Individually packaged, non-perishable food items may be brought in and stored in the client s assigned front lobby locker. Examples of these would be cup-a-soup, breakfast bars, etc. No large portion items, only single serving size portions. Daily rations of these items are allowed in the client s assigned locker beyond the main security checkpoint. Before entry into the facility, staff must first visually inspect ALL items. All food packaging must be intact, to include any liquid items, no opened containers or packages are allowed past the security checkpoint. Any food that states refrigerate after opening may not be brought in (e.g. Velveeta cheese). No food items are allowed past the security checkpoint past 6:00 P.M., unless checking in for the first time after 6:00 P.M. and clients are only to access their lobby locker once daily. 6.3 Food, including vending machine snacks and soft drinks, are allowed only in the Day Room areas and at the tables provided. Perishable food from the vending machines must be consumed immediately after purchase and may not be stored. Food is not allowed in any other areas under any circumstances. (Food and drink vending machines are not owned or operated by Weld County; staff has no direct control over these machines.) 6.4 Clients eligible for temporary leave from the facility are allowed to eat meals outside of the facility and as approved by the amount of time earned, and according to normal sign-out protocols. 6.5 Clients may purchase meals from the Work Release program. Cost for all three (3) daily meals is $5.00 and will be charged to the client s account balance. These meals consist of one (1) breakfast, one (1) lunch and one (1) dinner. Clients who wish to purchase a meal must sign up for all three (delivered) meals. No substitutions are allowed. Clients who do not pick up their meals will face disciplinary action. Signup sheets are posted in the Security Station the evening before meal delivery and clients can sign up by, but no later than 8:00 A.M. the day meals are provided. Special diets may be prepared or allowed for documented medical reasons. Clients must declare and provide medical documentation of their special dietary needs during their first day on intake. These requests will be considered and for consultation with Weld County s food services provider. Clients who do not report their special dietary requirements at their intake will not be honored at a later date, unless otherwise approved by the AP Director or designee. 6.6 Unless issued by staff through the Meal Sign Up process, perishable food is allowed on a limited basis in the facility. Additional refrigerated storage for meals is available for clients providing appropriate medical documentation (must be specific). These meals are to be stored in the designated refrigerator and given to clients as scheduled. Otherwise, all non-perishable food must be consumed in the Day Room areas only. 6.7 Clients are responsible for immediately cleaning up after themselves including the proper disposal of trash and containers. 6.8 Water is allowed in the sleeping units in a spill proof container (water bottle). 16

17 SECTION 7: TELEPHONES 7.1 Clients are not allowed to use any office (county) telephones to make calls, unless specifically approved by staff (i.e. legal, or medical). 7.2 Staff will not accept incoming telephone calls and/or messages for clients except for clear supervision reasons or in the case of a verifiable emergency. If the client s attorney calls, clients will be given a message to call their attorney. 7.3 Cell phones are not authorized past the main security checkpoint and must be stored in the client s assigned locker in the front lobby. Clients are not authorized to use their cell phones anywhere in the facility beyond the main security checkpoint. Clients must be off their cell phones before entering the facility, and while in the facility, their cell phone is to be turned completely off at all times unless directed otherwise or first given permission by staff. 7.4 Clients may use coin-operated pay phones located throughout the facility, as needed. Clients may not use these phones if past lights out or as otherwise defined if the client works a swing or overnight shift as defined in the Housing section. Clients may not use the coin-operated pay phones during announced or sanctioned lockdown times. 17

18 SECTION 8: MAIL 8.1 Clients have access to the U.S. Postal Service and may send their own outgoing mail during their Business or Earned Time temporary leave from the facility and according to their approved sign out destinations. Clients are responsible to provide their own letter writing, postage and sending materials. 8.2 To receive incoming mail, mail should be addressed as follows: CLIENT NAME Weld County Work Release Facility 1390 N 17 th Ave. Greeley, CO Mail received for clients from a County Jail or other penal institution or is deemed threatening, contains criminal plans, acts of violence, gang activity or pornography shall be reported to law enforcement as applicable or returned to the sender. All mail is subject to general inspection by staff unless considered privileged or legal mail. Privileged or legal mail may consist of mail sent to or received by any Federal branch of government, state government, a Judge or Court official, Attorney, Legal Aid service, Public Official acting in their official capacity, unless their records meet Colorado Open Records Act criteria, a law enforcement agency or medical information from a recognized physician or institution. 18

19 SECTION 9: FEES AND MONEY MANAGEMENT 9.1 Clients are required to pay a daily fee for placement at the Work Release Facility. Fees are set by Weld County Code and accrue daily beginning on the second through the last day of sentence. The current fee amount is $15.00 per day for Weld County sentences and $27.00 per day for sentences ordered outside of Weld County. 9.2 Fees must be paid for the current week each Thursday by 4:00 P.M., in the form of a money order. Fees paid after 4:00 P.M. will be credited to the next week. The Work Release week starts Friday at 12:01 A.M. and ends Thursday at 11:59 P.M. 9.3 Clients will receive a receipt for any payment made. Non-payment or late payment may constitute a rule violation. Clients are responsible for any outstanding balance. 9.4 Clients must pay their food fees for any meals purchased. Weekly meal balances are posted and may be combined in one (1) money order with the weekly fee for placement. Clients will not receive Earned Time release into the community until meal fees are paid in full. 9.5 Clients may be charged additional fees for services, such as $5.00 for DNA collection or $15.00 for urine sample confirmation, per substance. 9.6 If a client is regressed to the Weld County Jail or escapes from the program, unpaid fees shall be debited from their account to the date of regression or escape. All fees are to be paid by specified due dates. 9.7 Clients will not cash their paycheck or other form of payment for approved employment, without the prior approval of staff. Clients will not possess any unauthorized funds; accept any financial aid, loans or gifts or enter into any contracts, agreements without staff approval. 9.8 The daily fee rate for clients sentenced to the program outside of Weld County is $ These clients must pay in advance one (1) month of rent/subsistence of $ on the client s first day of placement (non-refundable) or term of sentence is expected to be less than 30 days, full payment of the entire placement and if applicable, then a daily placement rate of $27.00 ($ per week). 9.9 Program Fees Day entered Work Release Day released from Work Release Friday = $ Friday = $ Saturday = $ Saturday = $ Sunday = $ Sunday = $ Monday = $ Monday = $ Tuesday = $ Tuesday = $ Wednesday = $ Wednesday = $ Thursday = $ Thursday = $

20 SECTION 10: HEALTH SERVICES 10.1 Clients are responsible for their own medical and dental expenses while at the Work Release Facility. This includes expenses resulting from any injury incurred while working at an outside site or within the facility Sign out of the facility for medical releases shall be approved only for enough time to seek treatment and return to the facility. Upon returning to the facility, clients must provide documentation that they were treated or seen at a medical or dental office or facility If a client has a clear medical emergency or upon the client s request, staff will call Clients requesting immediate medical assistance must have identified transportation. In a medical emergency, clients are not permitted to walk to an emergency room Clients who have been to the hospital, temporarily or admitted will be placed on a Welfare Check status for a minimum of 24 hours upon their return. These checks may necessitate the client s movement to a different POD assignment, as needed Immediately upon return and check in at the Security Station, clients must announce all prescription medications; this includes medications given by medical personnel or prescriptions filled. Staff may then allow the client to place these items in a secured medical locker in the Security Station. Clients will check-in at the Security Station for self-administration of prescribed medications within the direct, visual presence of staff and according to prescription instructions. It is the responsibility of clients to follow their prescription. It shall not be staff s responsibility to remind clients to take their medications. All prescribed medications must be stored in its original secured prescription bottle or blister pack. Inhalers may be kept on the client s person and with staff permission. Prescribed ointments or creams may be permitted in the housing area with staff permission only. Home Therapy equipment, which may include plug-in heating pads, are not allowed Over-the-counter medications, non-prescription, may be stored in the client s assigned front lobby locker. All medications must be kept in their original container (no loose pills), and are not allowed past the main security checkpoint. Non-prescription medications shall not contain alcohol. Vitamins and supplements shall also be stored in the client s assigned locker in the front lobby area in their original containers only. Over-the-counter medications and supplements must be taken as directed Clients exhibiting mental distress through statements or actions shall be referred to North Range Behavioral Health s Crisis Services or other viable mental health provider. 20

21 SECTION 11: SUBSTANCE USE MONITORING 11.1 Possession or consumption of alcohol and marijuana in any form, or controlled substances without a current prescription is a cause for possible disciplinary action and/or criminal prosecution Substance use testing, breath or urine, can be directed at any time by Work Release personnel, testing is at no cost to the client, unless the client challenges the result of the test and requests further confirmation by the testing laboratory Upon every return to the facility, every client shall submit to a passive breath test via the wallmounted device. Any positive test shall be verified using a hand held device for a measured Blood Alcohol Content (BAC). Clients are responsible for all products used or consumed that may contain alcohol Clients are required to submit to random urinalyses (UA) testing. When notified by staff, clients will have up to two (2) hours to provide an acceptable urine sample in proper amount and concentration for valid testing. Clients who fail to submit an acceptable sample may face disciplinary action to include regression from the program When notified, clients must provide a urine or breath sample BEFORE being authorized for release from the facility Any attempt to alter, tamper, or refuse a urine or breath sample is a major violation. Clients shall not submit diluted urine samples. Multiple diluted urine samples may constitute disciplinary action to include regression from the program Clients with a current Protection Order that prohibits the use of illicit drugs and/or alcohol will be subject to prosecution and/or disciplinary action, if submitting a breath or urine sample that proves positive. Additionally, for clients on Probation that office will be notified of any positive breath or urine test results when Work Release is a condition of the sentence to Probation Clients on random testing for another supervising agency may be expected to call into an automated system (i.e. Sentry) using a county phone in the presence of staff using speaker mode prior to 12:00 P.M. if completing as a court ordered activity. Staff must verify all substance use testing prior to the client s departure from the facility and any verification occurring after 12:00 P.M. must be on Earned or Business time. Clients who fail to call will be subject to disciplinary action if no Earned or Business time is available In-house AA / NA meetings or similar support meetings are offered on a weekly basis and attendance is encouraged. 21

22 SECTION 12: RELIGIOUS ACTIVITIES 12.1 The Weld County Work Release program does not discriminate against recognized religious beliefs or practices. Clients eligible for Earned Time leave from the facility will be granted leave to attend church or religious services in Weld County. Business Time may be used if no Earned Time is accrued and the client is not currently serving a disciplinary sanction. When using Business Time, proof of attendance is required and clients may not attend church services at an individual s home. Any circumstances that may jeopardize the client s personal safety or to the community, may necessitate not allowing the client to attend a religious activity outside of the facility. Work Release personnel will make reasonable efforts to accommodate the client s request to meet their religious needs Clients may display on their person one (1) religious medallion or icon, no larger than 1.5, to be worn on a single chain or necklace. 22

23 SECTION 13: TRANSPORTATION, PARKING AND BICYCLES 13.1 Clients are responsible for arranging transportation to and from the facility and to approved destinations Some jobs may not be approved for clients who are unable to secure reasonable and/or reliable transportation Clients are responsible for providing reliable transportation to their destinations; detours and unauthorized locations are prohibited Destinations more than 60 miles away from the facility or travel exceeding an hour and half (1.5) will not be authorized If a client is approved to operate a motor vehicle, the client must park said vehicle in designated areas of the parking lot at the Work Release Facility and as only approved by the Parking Permit process. Clients must park their vehicles in the Work Release parking lot and not at any adjacent lots in the Weld County Government campus, unless otherwise approved. To be considered for a Parking Permit, clients must provide a copy of their valid driver s license, as well as both a valid vehicle registration and proof of insurance for approval to operate a motor vehicle. The same paperwork must also be provided if a separate party owns the vehicle Client parking is for approved passenger vehicles only. Trailers, boats, recreational vehicles or unregistered vehicles are not allowed. Vehicles must be parked in an orderly fashion. No vehicle maintenance may be performed on the premises unless approved by the AP Director or designee. Disabled vehicles must be immediately reported to staff, and unless the AP Director or designee approves, the vehicle must be removed by the end of the next business day or it may be towed at the operator s expense Clients who are regressed to the Weld County Jail will have seven (7) business days to have their vehicle picked up. The person(s) who picks up the vehicle MUST report to the Security Station first before retrieving the vehicle. Vehicles not picked up will be towed at the operator s expense. Vehicles of clients who escape from the program will also be towed at the operator s expense and at the determination of the AP Director or designee Clients may use a bicycle while at the facility. All bicycles must be registered with staff (i.e. Bike Permit) and locked on the front or side bike racks. Bicycles without a Bike Permit will be removed or abandoned (30 days) will be donated to a local charity. Motorized scooters are not allowed. 23

24 SECTION 14: LEAVE AWAY FROM THE FACILITY 14.1 Clients are allowed approved temporary leave from the facility for no more than fourteen (14) hours daily and must remain in the facility for a minimum of eight (8) consecutive hours daily All clients must personally report to the Security Station to inform staff of their intended sign out destination(s), to include contact phone numbers, addresses and method of transportation before leaving the facility. Clients must travel directly to and from approved destinations. If staff are unable to contact a client by phone, in person or through a reliable third party while away from the facility, the client will be considered out of place of assignment, which may include Escape status Clients are required to stay within the facility/building perimeter and must have staff permission to go through any perimeter door Loitering by clients or persons associated with clients, outside of the facility or in the parking lot is prohibited for any reason Conducting personal business, visits to a family or friend s residence etc. while out of the facility is prohibited without specific and prior authorization from staff. All schedule changes, such as for working overtime, dental or medical appointments, must be approved by staff in advance Clients whereabouts must be known at all times, in certain circumstances and situations, clients may be directed to call on-duty staff or the Location Change Line at (970) to report their status. The location change line is not to be utilized to change locations during Earned Time sign out into the community Clients are allowed thirty (30) minutes for a lunch break when working or work seeking. When working, clients must state their lunch destination when signing out and must call into the Location Change Line when actually going to lunch, and again when returning to work. Work Seek clients must list their lunch destination on their Work Seek Plan form and provide a receipt upon their return. Clients working through temporary employment agencies must call the Location Change Line indicating their lunch location and at the start and end of their lunch. Clients may forego the lunch break for a convenience store stop prior to work lasting no longer than fifteen (15) minutes and with the prior approval from staff at the time of their sign out To verify clients whereabouts in the community, staff will complete periodic checks to ensure compliance. Staff will also make frequent contacts with employers via telephone or , or in person. If deemed necessary, at staff discretion, clients will be fitted with a GPS tracking device to enhance the accountability of their whereabouts. This may also be done for disciplinary action as needed. Unless intentionally damaged or lost by the client, there is no cost to clients for having an electronic monitoring device placed on them (Work Release Program only). Clients will acknowledge and sign appropriate paperwork outlining proper use of such devices and comply with operating instructions. 24

25 14.9 Overnight furloughs are not allowed, unless approval is first granted by the AP Director or designee and for verifiable emergency or legal purposes only. Clients may petition the Court for a furlough, with notice given to Work Release staff of such petition. Employment Release All employment/employers must first be authorized and verified by designated staff prior to a client being authorized to attend employment Clients are authorized to leave the Work Release Facility only during the hours approved by staff. When released, clients must travel directly to and from their approved destination. If released from their approved destination early, given the day off, fired, or otherwise a legitimate disruption of their check out, clients must immediately return to the Work Release Facility. Over the phone work schedule changes are not accepted, unless otherwise approved and accepted by staff. All schedule changes need to be completed by either faxing or ing designated staff from the place of employment and are only accepted after staff has approved those changes Each Sunday, clients are given a print out of their approved work schedule for the week including travel time. This work schedule must be presented to on-duty staff at the Security Station when signing out for work. Any changes to the Client Work Schedule must be ed (WRS@co.weld.co.us) or faxed by the client s employer with at least a day s notice for processing by designated Work Release staff Unless granted the approval of the AP Director or their designee, the following Employment Release situations are not authorized for clients: a. When the employer pays by a non-payroll check or cash only and without an IRS 1099 verified work history. b. When the job requires the client to move frequently from place to place, door to door or job site that does not have an established schedule; c. When work hours vary widely from day to day or within the same day. For example, split shifts; d. Self-employment whereas the client has no established place of business, office or base of operations other than his/her residence. Clients will not be approved for self-employment release without providing two (2) years of tax returns and/or verification of the employment; e. When a relative directly supervises the client; in these circumstances, consideration will only be made after reliable, unbiased, supervision of the client is assured; f. Jobs requiring the client to leave the State of Colorado; g. Jobs that involve frequent association with co-defendants, former crime partners or other crime prone persons, and/or working for or with fellow Work Release clients; 25

26 h. Jobs or work industry that places clients in potentially harmful and/or liable situation(s). When employment is contrary to the client s current charges or courts orders. Examples include, but are not limited to serving/selling alcohol, hands-on security, guns/ammunition, adult entertainment or marijuana related (drug paraphernalia); and i. On-Call jobs. Work Seek Release Work Seek Release is intended to give clients the opportunity to find gainful employment Excluding holidays recognized by Weld County Government, Work Seek Release is authorized Monday through Friday, 8:00 A.M. to 2:00 P.M. for males, and 9:00 A.M. to 3:00 P.M. for females. Work Seeking is a program requirement for unemployed clients unless otherwise approved by staff Clients going on Work Seek Release must complete a Work Seek Plan form. Forms must be submitted to on-duty staff at the Security Station the day before their intended Work Seek Release check out day. The Work Seek Plan form must: a. Be legible, to include the client s printed first and last name; b. Denote the date, the potential employer s name, address, telephone number, and type of business; c. Up to six (6) contacts or locations (on-duty staff may reduce this amount as deemed necessary); Clients must attend a Work Seek Release Orientation session (in the morning) before being authorized to leave from the facility. Orientation is held at 7:45 A.M. for males and 8:45 A.M. for females. At the Work Seek Release Orientation, clients will be given their approved Work Seek Plan form completed the day prior for that day s job search Job interviews must also be arranged within these same scheduled work seek times When ready for check out, clients must furnish their Work Seek Plan form to Work Release orientation staff. Upon return to the facility, clients must return this form to on-duty staff at the Security Station. They may also be asked to provide additional physical proof of their whereabouts in the community while on Work Seek Release. The day s completed Work Seek Plan form must: a. Include any missing information highlighted from the initial plan; 26
