2 Request for Information - Questions and Answers /JSW Professional Engineering Services to Test, Adjust and Balance HVAC Systems /JSW Geotechnical and Construction Materials Testing Services Question 1: My office said that we are to submit Attachment C and D. I see that D needs to be filled out but C is just one paragraph on a page with no place for signature, except for a reference to signing this Agreement. Do we include it as it is? Answer 1: Attachment C - Rider 104: Policy on Utilization Historically Underutilized Businesses: It is imperative that you fill out page 9 and return it with your response. Failure to do so will result in automatic disqualification of your response. If you are awarded a contract, when you actually quote on a specific job, you will complete the subcontractor sections in the rest of the document. Attachment D Rider 105: Contractor s Affirmations & Warranties: there are three pages in this document. You need to answer the questions one pages 1 & 2, and complete the information on page 3. This does not have to be completed in your response, but will be completed during the contract negotiation phase. You may however, choose complete it and return it with your response. Question 2: If we submit as a prime, is it ok to submit as a sub on other teams? Is there a limit on number of teams a sub can join? Answer 2: They can bid as a prime or come in as a sub later. But that does not come into play at this stage due to the fact that we are only requiring the letter of HUB Commitment. Subs would not be identified at this point. Question 3: What will be the HUB goal for this contract once contract is awarded? Answer 3: The MD Anderson HUB Goal for all Professional Services is 38.4%. Question 4: Is a Joint Venture between a HUB certified Engineering firm and a Test and Balance firm allowable?

3 Answer 4: A true Joint Venture is fine, assuming that they are a properly formed business entity. We would contract with that entity. Some people use the term Joint Venture loosely when they really mean a sub-consultant relationship. Whether either of them is a HUB is not the issue, since HUB certification is not a selection criteria. Question 5: We just want to be clear that the submission requirements addressed in our submittal are those outlined in the Agreement for Materials Testing Services, Article 3.04, Sections a-j. Is this correct? Answer 5: The paragraph you mention in the DRAFT Agreement is not for evaluation purposes, but will be utilized once MD Anderson has an agreement with a company, and a specific piece of business is being quoted. We post the draft agreement at this time merely to give you a sense of what we will be asking the awarded company or companies to sign. In your response to the RFQ that is due on 3/26/12, you need to refer to the Request for Qualification document, Section 3, Requirements for Statement of Qualifications. Additionally, you will need to format your response according to Section 4 of the RFQ. Question 6: (Our) representative at the pre submittal meeting for the above referenced RFQ understood that a HUB plan did not need to be submitted at the time of the submittal and that only Page 8 needed to be submitted. I wanted to check the accuracy of what he heard at the meeting because it specifically states that a copy of the HUB plan must be delivered at the same time as the RFQ in a separate envelope. In the Page 8 letter it states that the HUB plan is attached to the letter. Answer 6: The Letter of HUB Commitment is all that is required. This letter can be found on page 9 of the Rider 104-B HUB Documents. Please place this letter on your company s letterhead and reference the appropriate RFP number. Be sure to follow the instructions for submission as specified in the RFP. Question 7: How do you suggest we fill out the letter on page 9 if we are not enclosing a HUB Subcontracting Plan with our submittal which the letter clearly states we are? Also we are not a HUB but are planning on subcontracting some of the services to HUB firms?

4 Answer 7: The Letter of HUB Commitment (page 9 of the Rider 104-B attachment) is the plan for this RFQ, and is the only information we are requiring. This letter is used for RFQ s or IDIQ contracts where the quantity is unknown. Once an award has been fully executed, we will at that time request a HUB Subcontracting Plan from the successful contractor. Please complete this letter and follow the directions as specified in the RFP for submission. Question 8: Letter 9 refers to self-performance does that imply that a HUB firm is performing the work and not subcontracting with other firms? Answer 8: Page 9 essentially states that you are acknowledging that once an award has been made, you will make a good faith effort to include HUB subcontractors. This letter is required from all interested contractors, whether they be HUB or Non-HUB. Question 9: Will an Addendum be posted stating that the following sections of the RFQ and Attachment C Rider 104-B: Policy on Utilization Historically Underutilized Businesses requesting a HUB Plan have been changed to just require the submission of page 9? Answer 9: The requirements have not been changed. Because this is an IDIQ contract, the Letter of HUB Commitment is all that is required. Again, page 9 of the Rider 104-B attachment is all that is required for this RFQ. Your bid will be rejected if you fail to provide this letter. Please follow the directions as specified in the RFP for submission. Question 10: In CRITERIA FOUR: TECHNICAL CAPABILITIES OF THE FIRM, Sections 3.4.1, 3.4.2, and CRITERIA FIVE: RESPONDENT S ABILITY TO IDENTIFIY AND RESOLVE PROBLEMS Section the RFO refers to providing information for three (3) projects listed in response to Criteria 3.4. This appears to be a typo. Shouldn t it refer to projects listed in response to Criteria 3.3? Answer 10: You are correct that it is a typo. The reference should be to paragraph 3.3.

5 Question 11: Can a HUB qualified firm submit both as a prime and a sub-consultant on a team? Answer 11: A HUB firm may submit as both a prime or be listed as a subcontractor to another prime. This information however is not required at this stage of the process.
